RECOMMENDATION: 1. Provide input to staff on the terms of the RFP which is scheduled to be released in mid- July. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The purpose of the Mooring Management Services contract is to establish and define the responsibilities of the City and a mooring management provider in conjunction with the mooring of vessels over City Tidelands. Currently, the City permits approximately 1,229 public moorings (consisting of 439 onshore moorings and 790 offshore moorings) with the County permitting approximately 25 offshore moorings over County Tidelands. Since 1989, the City and the County have entered into, and subsequently amended, a Joint Powers Agreement for mooring management services by the Sheriff's Department Harbor Patrol. This agreement expired, and in 2010, a five-year cooperative agreement was executed between the City and the County (Harbor Patrol) with five-year renewal increments for up to twenty years. The current five-year agreement expired on June 30, 2015 ramping up to $290,000 for the final year. The County had proposed an additional five-year extension to this agreement which would have ramped up to $404,622 at the fifth year. Due to the significant increase in cost, the City Council entered into a six month amendment with the County for mooring management services beginning July 1, 2015. The City Council also directed staff to solicit proposals from both private and public entities for the same services via an RFP, and also requested the Harbor Commission's input on the mooring services scope of services prior to releasing the RFP. Harbor Commission Review and Input on the Request for Proposal for Mooring Management Services in Newport Harbor July 08, 2015 Page 2 As part of a streamlining effort, staff is also soliciting responses for marina management services at the future Marina Park facility within this same RFP. Proposers may respond to either the mooring management or the Marina Park components, or both if they desire. (Staff has omitted the Marina Park scope of services from the attached RFP because it is still under internal review, and is a separate, non-related component to the mooring management scope.) ENVIRONMENTAL REVIEW: Staff recommends the Harbor Commission find this action is not subject to the California Environmental Quality Act ("CEQK) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the Harbor Commission considers the item). Proposers are welcome to bid on one or both items. The City reserves the right to award the services to either one or separate vendors. A. The City of Newport Beach ("City") invites all qualified parties to submit proposals to manage approximately 1,200 public moorings (consisting of 400 onshore moorings and 800 offshore moorings) ("Project") in Newport Harbor, California, through a Mooring Management Agreement. Most of these moorings are the responsibility of the City, but the County of Orange ("County") controls a small amount of offshore moorings. This RFP does not include service for County moorings. The selected proposer's primary responsibilities shall include providing sufficient staff to ensure that the requirements of the City's rules and regulations regarding moorings and Newport Beach Municipal Code Chapter 17 (all attached hereto as Attachments F through Q are properly administered, enforced and implemented. In addition, there are established rules and procedures that must be properly implemented to„provide effective and efficient management of the mooring areas. B. The City of Newport Beach is seeking proposals from qualified proposers interested in providing the City with management of marina and related shore side facilities at Marina Park. Marina Park is a City-owned, 23-slip short term, visitor serving marina property located at 1600 West Balboa Blvd, Newport Beach, CA 92663, (Marina Park Vicinity Map-Attachment B). Marina Park is currently under construction with the anticipated grand opening in December 2015. Contractor will provide management services for the marina: transient, short term slips rentals (up to 30 days), vessel pumpouts, dinghy racks, general marina management; and upland facilities such as visitor restrooms and shower facilities, laundry, and general upkeep of marina areas. This proposal does not include janitorial or security services. I. PROJECT INFORMATION A. Mooring Management Services. The purpose of the Mooring Management Services Agreement is to establish and define the responsibilities of City and a mooring management services provider in conjunction with the mooring of vessels over City owned and controlled tidelands. County and City have previously entered into Joint Powers Agreements, dated February 21, 1989 and lune 29, 2010, as amended by various amendments, to provide this service. County and City have now mutually 2 DRAFT SL 7-2-95 agreed to terminate this Joint Powers Agreement. City has determined that it is now appropriate to accept proposals from private mooring management services providers and government entities for mooring management in the most cost-effective and efficient methods available based on an evaluation of submitted proposals. Current mooring regulations including rents, fees, and transfer processes are under review by City Council. Proposers should be aware that the Newport Beach Municipal Code ("NBMC") sections regarding moorings are subject to change in the coming weeks. B. Marina Management at Marina Park. The Marina Park project encompasses a 10.5-acre site and involves new construction of a public park; a 24,000-square-foot community and sailing center building; a 23-slip visitor serving marina; a reconstructed 19th Street restroom building; a freestanding playground lighthouse feature; themed playground; outdoor fitness circuit; parking lots; and frontage street improvements. The scope of services are limited to the marina management, associated shore side facilities, and slip rentals. Proposals for marina slip rental and billing software were due on July 10, 2015. City plans to have software decision completed in August. Expected installation at the city- owned Balboa Yacht Basin will occur in the early fall(not part of Marina Park management scope) Software installation at Marina Park will occur later in the fall as the City takes over the building from the contractor. The Marina Management vendor will be included in software training prior to the opening of the marina to the public. The purchase and maintenance cost the marina software will be the City's responsibility. The Marina Management at Marina Park Scope of Services is attached as Attachment E. II. RFP TERMS AND CONDITIONS A. This RFP does not commit the City (or County) to award a contract or bind the City (or County) to any action or to any party. No other party, including any proposer, is intended to be granted any rights hereunder. This RFP and the process it describes are proprietary to the City and are for the sole and exclusive benefit of the City. B. It shall be the proposer's responsibility to review and verify the completeness of its proposal. Proposals which do not meet the minimum proposal submission requirements, may, at the sole discretion of City, be immediately rejected and may not be reviewed. C. No proposer may submit more than one proposal pursuant to this RFP. Entities that are legally related to each other or to a common entity may not submit separate proposals. Any proposal may be rejected because it, at City's sole discretion, violates these conditions or the spirit of these conditions. D. Submissions do not create or assume any relationship, agency or obligation by City, its officers or employees. 3 DRAFT SL 7-2-95 E. Any response will become the property of City and, if required by law, may be subject to public disclosure by City or any authorized agent of City. Proposers must identify all copyrighted material, trade secrets or other proprietary information that the proposers claim are exempt from the California Public Records Act. In the event a proposer claims such an exemption, the proposer is required to state in the proposal the following: "The proposer will indemnify the City and its officers, employees and agents and hold them harmless from any claim or liability and defend any action brought against them for their refusal to disclose copyrighted material, trade secrets or other proprietary information to any person making a request thereof." Failure to include such a statement shall constitute a waiver of a proposer'sright to exemption from this disclosure. F. City employees and officials are prohibited from responding to this RFP or being a party, direct or indirect, to any contract resulting from the RFP, and no proposal shall be accepted from, or contract awarded to, any City employee or official who submits a proposal or solicits any contract in which he or she may have any direct or indirect interest. G. The City is not liable for any costs associated with the development, preparation, transmittal or presentation of any proposal or material(s) submitted in response to this RFP. Any such costs shall be the sole responsibility of the proposer. H. Verbal communications made by any City employee or agent of the City with respect to this RFP are not binding and shall not in any way be considered as a commitment by the City. Only written responses to questions submitted in writing to the City or written addenda to this RFP issued by the;City may be relied upon. I. The City reserves the following rights and options which it may exercise, at its sole discretion, with respect to the evaluation and selection of proposals for negotiation: 1. Accept, reject, or negotiate modifications to any and all proposals; 2. Reject any proposal if such proposal is incomplete, non-responsive to the RFP, not in conformity with applicable law, conditioned in any way, deviates from the requirements of this RFP, or contains erasures, ambiguities, alterations, or items of work not called for by this RFP; 3. Award the contract in whole, or in part; 4. Ask specific companies to respond to this RFP or issue additional solicitations for proposals; 5. Waive any informality, defect, non-responsiveness, irregularities and/or deviation from this RFP; 6. Select any proposal as the basis for negotiations with any of the proposers, or select any proposal as the basis for an agreement; 7. Make corrections or amendments due to errors identified in proposal by the City or the proposer; 4 DRAFT SL 7-2-95 8. Permit or reject, at City's sole discretion, amendments (including information inadvertently omitted), modifications, alterations and/or corrections of proposals by some or all of the respondents following proposal submission; 9. Request that some or all of the proposers modify proposals based upon the evaluation of the City; 10. Supplement, amend, substitute or otherwise modify this RFP at any time; 11. Cancel this RFP with or without issuing another RFP at any time; and 12. Reject the proposal of a proposer who, in City's sole judgment, has been delinquent or unfaithful in the performance of any contract with the City or other government entity; is financially or technically incapable of fulfilling the requirements of the agreement; or is otherwise not a responsible proposer. J. The City may enter into negotiations on terms and conditions satisfactory to the City with one or more selected proposers. However, the City reserves the right to terminate any negotiations at any time or conduct simultaneous, competitive negotiations with multiple proposers. The City also reserves the right to negotiate acceptable terms in an otherwise unacceptable proposal. Such terms may include but shall not be limited to contract requirements, compensation, service level agreements, detailed:scope of work specifications, ordering, invoicing,. delivery, receiving and payment procedures, etc., in order to insure successful administration of the contract. Such negotiations may result in changes in terms material to this RFP. In such an event, the City shall not be obligated to inform other proposers of the changes, or permit them to revise their proposals accordingly, unless the City, in its sole discretion, determines that doing so is in the City's best interest. Should negotiations not prove satisfactory with the selected proposer(s), the City reserves the right to discontinue negotiations. K. The City may enter into agreement with one party for both Mooring Management and Marina Management at Marina Park, or enter separate agreements with two parties for Mooring Management and Marina Management at Marina Park respectively. L. The City may contact the proposer's references, call the proposer for clarification, conduct investigations with respect to the proposer's qualifications, and obtain any additional information deemed necessary to evaluate the proposer's experience and financial capability, and to determine the ability of the proposer to carry out its obligations under the proposed agreement. M. All proposals shall become the property of the City of Newport Beach. III. PROPOSED AGREEMENT Applicants shall review the proposed agreement attached hereto as Attachment "D" and: 1. Agree, in writing, to the agreement as-is; OR 2. Provide, in writing, counter-proposals to any provision in the proposed agreement at the time the proposer submits a response to this RFP. 5 DRAFT SL 7-2-95 Insurance The selected proposer must meet all the insurance requirements required by the agreement. All proposers are encouraged to contact their insurance carriers during the review of qualifications stage to ensure that the insurance requirements can be met if the proposer is selected for negotiation of a contract. Prior Approvals Any necessary approvals, permits and licenses required by City, State and Federal agencies (including, but not limited to, a City business license) must be secured prior to the execution of the agreement. IV. PROPOSAL A. Moorings The proposer shall include within its proposal: 1. The location of proposed localoffice facility—the proposer may identify a site, such as facilities Harbor Patrol Headquarters, the office facilities to be vacated by Harbor Resources staff at the City-owned Balboa Yacht Basin which may be available for rent at a market rate, or other space that is not leased by the proposer at the time of proposal; 2. The proposed operating schedule of office and field personnel; 3. Identification of a;suitable vessel for inspections, vessel relocation, vessel assistance and other mooring-related duties; 4. A detailed description of the approach and methodology the proposer shall take to achieve client satisfaction and to fulfill the terms and conditions of the work described in this RFP; 5. Demonstrated knowledge of local harbor facilities and issues; 6. Estimated monthly expenditures for personnel, administration costs and incidental expenses; 7. A detailed description of specific tasks the proposer may require from City staff, and what respective roles City staff and proposer's staff shall have to complete the scope of work described in this RFP and in the proposal; and 8. Proposer's detailed fee structure for its scope of services. B. Marina Management at Marina Park 1. Intentionally left blank. Will be completed for RFP issuance. 6 DRAFT SL 7-2-95 V. QUALIFICATIONS Proposers must provide information regarding its qualifications and knowledge of mooring management. Each proposal must include: 1. The background, experience and qualifications of the proposer, including a list of previous work that is similar to the work described in this proposal and the length of time the proposer has been providing similar services; 2. At least five (5) references that received services from proposer's company with the following information: company or municipality name, contact person, title, and telephone number; 3. A demonstrated ability to finance ongoing operations. Evidence shall include submission of the most recent two (2) years of audited financial statements and/or such relevant information; 4. A brief description of all key personnel for the mooring management office and field duties, and; 5. A completed Contractor Application Form (Exhibit "B"). In addition, the proposer may include information in forms such as video, photographs, etc., to demonstrate its existing operations at other cities or localities. Proposers must not be currently indebted to the federal government, State of California, or the City of Newport Beach for non-payment of taxes, fines,judgments, liens, or fees. VI. Submission Date and Requirements One original and five unbound copies of completed proposals must be submitted to: Anthony Nguyen Finance/Purchasing 100 Civic Center Drive Newport Beach, CA 92660 The following conditions apply to this submission: • Proposals must be submitted by 12:00 noon, on Friday, August 14, 2015. Late proposals shall not be accepted. • Proposals must be 1 1/2 spaced (or double-spaced) and in a font size of 12 or larger. Proposals typed single-spaced or in a font size smaller than 12 will not be accepted. • Proposals must conform to the RFP instructions, respond to the RFP requirements, and provide a complete and clear description of the offer. 7 DRAFT SL 7-2-95 • The address given in the proposal response must be an address to which certified mail can be delivered, and shall be considered the legal address of the proposer. In addition, the proposer must provide the address and telephone number of its office located nearest to Newport Beach, and, if not the same, the address and telephone number of its office from which the project will be managed. • Please do not bind your proposals using binders, laminates, press-bindings, spiral binding, etc. Proposals should be simply stapled or clipped together to avoid excess packaging. • Proposals or proposal components will not be accepted via facsimile (fax) transmission or e-mail. • Proposals shall remain effective for one hundred eighty (180) days from the date of proposal submission. • The City reserves the right, at its sole discretion, to reject and return, without evaluation, any proposal received after the proposal submission time and date, whether it is delivered by mail or otherwise. • Proposals must be signed, in ink, by an individual duly authorized to bind the proposer and must be sealed and labeled on the cover with the RFP title and proposer's name. • No questions other than written will be accepted, and no response other than written will be binding upon the City. All prospective proposers are encouraged to attend a pre-proposal conference at 2:00 pm on Thursday, July 30, 2015 in the Crystal Cove Room Bay 2D at Newport Beach Civic Center, Newport Beach, CA 92660. VII. REVIEW OF PROPOSAL RESPONSES All proposals received by the deadline will be evaluated by a committee ("Review Committee") established by the City Manager or his designated representative. Upon review of the proposals, the City may contact proposers for clarification on any point in the proposal, or to schedule an interview. If an interview is scheduled, then the person who shall be directly responsible for carrying out the terms of the agreement, if awarded, should be present at the interview. Negotiations shall be confidential and not subject to disclosure to competing proposers until an agreement is reached. 8 DRAFT SL 7-2-95 Upon the review and discussion of the quality and responsiveness of the proposals received, the Review Committee will make recommendations to the Newport Beach City Council. The City discourages any proposer's advocacy before Members of the City Council until such time as the Review Committee has brought forth its recommendation to the City Council. VIII. ATTACHMENTS A. Provider shall: A. Facilities and Equipment 1. Establish a near waterfront office within Newport Harbor that is easily accessible by water and/or land to the boating public interested in the many aspects of mooring management listed below. 2. Provide at least one vessel for mooring administration duties. City is not responsible for securing or paying for vessels, registration, or other related costs. 3. Maintain an impound area for abandoned, found, and/or impounded vessels including but not limited to availablemoorings, slips, and other facilities. 4. Provider is responsible for equipping the mooring office, vessel(s), and other similar facilities or equipment. 5. Provider is responsible for maintaining telephone, fax, and email communication according to the services needed and desired by mooring permittees. B. Staffing 1. Provide sufficient qualified and trained office staff to provide administration and guest mooring check-in. Required services will vary seasonally and specific scheduling defined in post-proposal review negotiations. 2. Staff should be available during daylight hours and additional hours based on demand, services, holiday, inclement weather, weekends and/or other times as warranted. 24-hour service is not required but is an option for the service provider. 3. Provide sufficient qualified field staff for water-side services such as mooring and vessel inspections, administration, vessel relocation, etc. Services may vary seasonally and with inclement weather. 24-hour service is not required but may be an option for the service provider depending on demand, inspections, etc. C. Administration 1. Document current mooring location and coordinate with City staff to record locations. Maintain and update visual mooring field map. 2. Maintain mooring permittee information in a City-provided management database to maximize access to moorings available for transient guest rental, mailings, inspections, and auctions. All information must be made available to the City electronically. City may request provider to furnish data that is in a format usable by the City. 3. Process mooring transfers, overhaul notices and documentation, and update billing information. 4. Provide City with updated billing information. 14 DRAFT SL 7-2-95 5. Maximize transient rental revenue and use by providing public access to available vacant moorings for guest use according to the NBMC. Assist transient renters with safe vessel mooring as needed. 6. Assist City in the location of current owners of abandoned or found vessels on moorings over City Tidelands. 7. Process lien sales. 8. Assist in auctions in coordination with Orange County Sheriff's Harbor Patrol and the City of Newport Beach. 9. Coordination with contractors and City to dispose of vessels. City is responsible for disposal costs. 10. Develop, update, and or maintain records, files, and forms as necessary. Examples include mooring transfers, letters of permission,and lien notices. 11. Provider is responsible for costs of mailings, postage, etc. D. Enforcement of Codes, Rules and Procedures 1. Enforce applicable provisions of the NBMC Title 17 as it pertains to moorings over City Tidelands. Provisions may be amended and it is provider's responsibility to stay up to date on policies and regulations. 2. Conduct investigation of code violations and recommend mooring permit revocation to the Harbor Resources Manger when code compliance cannot be achieved. 3. Assist City in processing of permit revocations by assisting in lien sales, participating in appeal hearings, and vessel impounds as necessary. 4. Implement mooring transfers per NBMC. 5. Manage the mooring permits issued to the yacht clubs per the requirements of the NBMC. 6. Assist in identifying live-aboard violations including illegal live-aboards and nuisance conditions. Coordinate with City to permit legitimate live-aboards. 7. Report water quality violations to the City and/or appropriate agency. E. Inspections 1. Perform dye-tablet testing and holding tank inspections to ensure that vessel holding tanks are secure and y-valves are closed. Dye-tests may be performed on vessels permitted on moorings and rentals. 2. Establish routine, inspections to monitor mooring equipment, mooring availability and mooring conditions. Proposer shall submit a sample inspection schedule with no fewer than 3 inspections per week. 3. Conduct inspections of vessels assigned to moorings for seaworthiness, operability, nuisance requirements, and compliance with other NBMC mooring regulations. 4. Provide inspections of shore moorings throughout Newport Harbor. Identify grounded, nuisance, and derelict vessels. 5. Maintain the mailing list and schedule for mooring inspection and overhauls. Overhauls are required every two years. Ensure inspections and overhauls are completed and recorded accordingly. Provide written notification to permittee for compliance according to the NBMC. 15 DRAFT SL 7-2-95 6. Spot check/field verify mooring contractors' records for mooring maintenance records, assigned mooring weights, etc. 7. Contact mooring permittees to prevent and react to sea lions on or near vessels in accordance with the NBMC. 8. Review, evaluate and possibly approve permittee requests for adjustments to mooring sizes. F. Services to Mooring Permittees 1. Provide vessel towing or relocation services associated with storage, nuisance mitigation, etc. 2. Provide information related to safe and proper mooring position to the local mooring service contractors. II. City shall: A. Prepare necessary billing and bill each mooring permit holder an annual mooring fee for moorings located over City tidelands. B. Allow the Provider to rent any vacant moorings over City tidelands. Provider shall submit to City all rents collected. C. Conduct twice annual, or as necessary, auctions of abandoned vessels and coordinate proper notification and form processing with California Department of Motor Vehicles with the County and Provider. D. Approve/disapprove plans and specifications of proposed non-standard moorings or buoys. E. Revoke mooring permits per the Municipal Code requirements related to unpaid fees. F. Approve/disapprove the transfer of a mooring permit per Municipal Code requirements. G. Revoke a mooring permit per Municipal Code requirements. 16 DRAFT SL 7-2-95 ATTACHMENT E SCOPE OF SERVICES MARINA MANAGEMENT AT MARINA PARK 17 DRAFT SL 7-2-95 ATTACHMENT F Schedule of Billing Rates and Personnel (To be supplied by Provider) is DRAFT SL 7-2-95 ATTACHMENT G MOORING REGULATIONS JULY 2015 Provided to Mooring Permittee at time of Transfer and on Annual Permit Mooring Permittee responsibilities include but may not be limited to: 1. Maintaining up to date records with the Mooring Manager's Office. Telephone numbers, mailing address, and email address must be up-to-date. 2. It is illegal to rent a mooring to anyone. If said mooring is unoccupied, it may be temporarily assigned by the Mooring Manager,as a mooring for guest vessels. 3. A mooring permittee may not loan a mooring to anyone without a letter of permission, submitted prior to the vessel going on the mooring, and approved by the Mooring Manager. Note: A mooring may only be loaned out for 30 days out of a 90-day period. 4. Vessels on moorings must be registered to the permit holder and assigned to the mooring permit through the Mooring Manager. 5. Only one boat is allowed on a mooring at any one time with the exception of a tender as described in Title 17. 6. Spreader lines must be adequately marked and buoyed at all times. 7. Living aboard a vessel on a mooring, without a City Live Aboard Permit, is a violation of the Newport Beach Municipal Code. 8. All offshore mooring' buoys and onshore mooring; posts'' must be painted white with the mooring number painted in black, 3" block letters, clearly visible. 9. Mooring pendants must be kept in good condition at all times. 10. Boats over 18' in overall length are not allowed on onshore moorings. 11. Vessels must be seaworthy,;operable, and y-valves must be closed and locked at all times. Newport Harbor is a NO DISCHARGE harbor. Vessel pumpout stations are located throughout the harbor. 13. Mooring rules are subject to change according to the Newport Beach Municipal Code. 19 DRAFT SL 7-2-95 Attachment H Newport Harbor Guest Mooring Regulations, July 2015 Regulations for Guest Mooring Rentals include but may not be limited to: A. Visiting Vessels: • Mooring rentals may be allowed along with proof of liability insurance. • Checkout time is 12:00 noon. Renters in violation of the checkout time are subject to vessel impound. Extension requests must be made in person prior to 12:00 noon. • All vessels must register regardless of the length of stay. All vessels must currently registered or documented, seaworthy, operable and free of nuisance. • Vessels shall be boarded to insure y-value closure. Dye tablets will be used to test for leaks of the vessel's sanitary system. B. Guests of a mooring permittee: A mooring permittee may allow a guest to use his/her mooring with written permission and submission of the written permission to the Mooring,Manager for approval. Guest's proof of liability is required accompanied with the letter of permission. The guest's vessel may stay on the mooring in 30 day increments ,up to 90 days maximum per calendar year. The mooring permittee cannot charge his/her guest a fee for the use of the mooring. 20 DRAFT SL 7-2-95 Attachment I Procedures for Mooring Transfers, July 2015 Whenever a person wishes to cancel his/her mooring permit and have it issued to another person, it is permissible to do so under the following conditions: 1. The mooring permit can only be put in one (1) person's name. 2. The seller must provide the buyer with two neatly written or typed letters. The first letter is for cancellation of his/her mooring permit and issuance to the new permittee. The second letter is a bill of sale. Below are samples of the two letters which must be notarized. 3. New permittee is responsible for any fees due including but not limited to overhauls and annual mooring permit rent. 4. As applicable the transfer fee is due and payable at the time of transfer. No exceptions. S. Anyone wishing to transfer a mooring must make an appointment with the Mooring Manager. All mooring buoys shall be of such type as approved by the City's Harbor Resources Manager, painted in compliance with State regulations, with numbers assigned by the Mooring Manager and painted per the requirements described in the Municipal Code. 3. All vessels must be moored fore and aft except in exposed areas designated as single point areas. 4. All mooring locations must be allocated by ;the Harbor Resources Manager and all moorings must be inspected before installation. 5. Top and bottom chain must be shackled together to farm one continuous length. Material other than chain may be used only upon approval of the Harbor Resources Manager. 6. The length of chain is to be determined by the Harbor Resources Manager or his designee and is governed by the depth of water in various mooring areas. 7. All mooring weights shall be metal. 2. Posts are not allowed for shore moorings unless there is not a wall for securing the mooring. 3. On-shore moorings should connect directly to the seawall with an eyebolt. 4. Buoy and post/eyebolt shall have a pulley attached with a line of not less than 3/8 inch diameter at all times. Vessel is to be moored securely thereto, bow and stern and must not be left on the beach. 5.
