Planning Commissioners are citizens of Newport Beach who volunteer to serve on the Planning
Commission. They were appointed by the City Council by majority vote for 4-year terms. At the table in
front are City staff members who are here to advise the Commission during the meeting. They are:

NOTICE TO THE PUBLIC
Regular meetings of the Planning Commission are held on the Thursdays preceding second and fourth Tuesdays of
each month at 6:30 p.m. The agendas, minutes, and staff reports are available on the City's web site at:
http:/fwww.newl)ortbeachca.gov and for public inspection in the Community Development Department, Planning
Division located at 100 Civic Center Drive, during normal business hours. If you have any questions or require copies
of any of the staff reports or other documentation, please contact the Community Development Department, Planning
Division staff at(949) 644-3200.
This Commission is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires that the
Commission's agenda be posted at least 72 hours in advance of each meeting and that the public be allowed to
comment on agenda items before the Commission and items not on the agenda but are within the subject matter
jurisdiction of the Commission. The Commission may limit public comments to a reasonable amount of time,
generally three (3) minutes per person. All testimony given before the Planning Commission is recorded.
It is the intention of the City of Newport Beach to comply with the Americans with Disabilities Act (ADA) in all
respects. If, as an attendee or a participant of this meeting, you will need special assistance beyond what is normally
provided, the City of Newport Beach will attempt to accommodate you in every reasonable manner. Please contact
Leilani Brown, City Clerk, at least 72 hours prior to the meeting to inform us of your particular needs and to determine
if accommodation is feasible (949-644-3005 or Ibrown@newportbeachca.gov).
APPEAL PERIOD: Use Permit, Variance, Site Plan Review, and Modification Permit applications do not become
effective until 14 days following the date of approval, during which time an appeal may be filed with the City Clerk in
accordance with the provisions of the Newport Beach Municipal Code. Tentative Tract Map, Tentative Parcel Map,
Lot Merger, and Lot Line Adjustment applications do not become effective until 10 days following the date of
approval, during which time an appeal may be filed with the City Clerk in accordance with the provisions of the
Newport Beach Municipal Code. General Plan and Zoning Amendments are automatically forwarded to the City
Council for final action.

ITEM NO.2 MILLER RESIDENCE GRADE ESTABLISHMENT APPEAL(PA2015-120)
Site Location: 1608 West Ocean Front
Summary:
An appeal of the Community Development Director's establishment of grade for purposes of determining
height in accordance with Section 20.30.050 (Grade Establishment) of the Zoning Code for the
construction of a new single-family residence. The applicant desires to use a higher average grade than
the grade elevations determined by the Community Development Director.
CEQA Compliance:
Pursuant to Section 15270 of the California Environmental Quality Act (CEQA) Guidelines, projects
which a public agency rejects or disapproves are not subject to CEQA review. If the applicant's request
is approved, the project is categorically exempt under Section 15303, of the State CEQA (California
Environmental Quality Act) Guidelines - Class 3 (New Construction or Conversion of Small
Structures).
Recommended Action:
1. Conduct a de novo public hearing, and
2. Adopt Resolution No. denying the appellant's Appeal to Planning Commission and
upholding the Community Development Director's establishment of grade.
ITEM NO. 3 TROESH RESIDENCE (PA2015-122)
Site Location: 336 Catalina Drive and 333 La Jolla Drive

Summary:
In conjunction with the addition of a 4,451-square-foot detached dwelling, the applicant requests the
following:
Modification Permit - to allow a property that is nonconforming to add more than 10 percent of the
existing floor area developed on site. A separate detached dwelling unit exists on the northerly half of
the property and is considered nonconforming due to the size of the parking spaces.
Variance - to allow a retaining wall and guardrail to exceed 42 inches in height within the 5-foot front
setback adjacent to La Jolla Drive due to the topography of the property.
CEQA Compliance:
The project is categorically exempt under Section 15303, of the State CEQA (California
Environmental Quality Act) Guidelines - Class 3.
Recommended Action:
1. Conduct a public hearing; and
2. Adopt Resolution No. approving Modification No. MD2015-008 and Variance No.
VA2015-003.
ITEM NO. 4 VERIZON MONOEUCALYPTUS TREE (PA2015-128)
Site Location: 23 Corporate Plaza
Summary:
A conditional use permit for Verizon Wireless to install 12 panel antennas and two ray caps on a new
32-foot high telecommunications monopole designed to resemble a eucalyptus tree. The associated
equipment is proposed to be located within an existing 20-foot 8-inch by 16-foot trash area, which will be
fully screened with a 5-foot 10-inch block wall with 2-foot 6-inch mesh steel panels above.
CEQA Compliance:
The project is categorically exempt under Section 15303, of the State CEQA (California
Environmental Quality Act) Guidelines - Class 3 (New Construction or Conversion of Small
Structures).
Recommended Action:
1. Conduct public hearing; and
2. Adopt Resolution No._approving Conditional Use Permit No. UP2015-033.
ITEM NO. 5 LOCAL COASTAL PROGRAM IMPLEMENTATION PLAN (PA2013-001)
Site Location: Coastal Zone
Summary:
The Planning Commission will consider recommending to the City Council of the City of Newport Beach
the adoption of the Local Coastal Program (LCP) Implementation Plan. The LCP Implementation Plan
consists of the zoning regulations, maps, and other legal instruments needed to implement the California
Coastal Act and the City's certified Coastal Land Use Plan.
CEQA Compliance:
Notice is hereby further given that pursuant to the authority and criteria contained in the California
Environmental Quality Act (CEQA), the proposal is statutorily exempt from CEQA pursuant to
Section 15265(a) (1) of the California Code of Regulations, Title 14, and Chapter 3 of the Coastal
Act.

Recommended Action:
1. Conduct public hearing, and
2. Adopt Resolution No. recommending City Council approval of Local Coastal Program
Implementation Plan.
VIII. NEW BUSINESS
ITEM NO. 6 NEWPORT CENTER VILLAS STUDY SESSION (PA2014-213)
Site Location: 150 Newport Center Drive
Summary:
A study session to allow staff and the applicant, Newport Anacapa Associates, LLC, to present
information regarding the proposed Newport Center Villas residential development project. Newport
Center Villas is an approximate 1.3 acre site in Newport Center bounded to the north by Newport Center
Drive and to the east by Anacapa Drive. The proposed project consists of the demolition of an existing
2,085-square-foot car-wash and gas station to accommodate the development of 49 condominium
dwelling units. The project requires the following discretionary approvals to be reviewed by the Planning
Commission: a General Plan Amendment, Zoning Code Amendment, Planned Community
Development Plan, Site Development Review, Tentative Tract Map, and certification of a Mitigated
Negative Declaration.
CEQA Compliance:
A Mitigated Negative Declaration (MND) has been prepared for the project in accordance with the
California Environmental Quality Act (CEQA). The document was released for a 20-day public
comment period from September 11, 2015, through October, 1, 2015. As a courtesy to the public, the
public review period was extended to October 7, 2015.
Recommended Action:
1. No formal action will be taken. Review and discuss the proposed project.
