Minutes of the February 4, 2014, Meeting Note: In five places the draft minutes say “Motion carried by acclamation.” The Commission should be aware that a new Brown Act requirement (California Government Code Subsection 54953(c)(2)), effective January 1, 2014, requires reporting the detailed vote on each action, identifying each decision maker’s position: yes, no or abstained. “Acclamation” seems the opposite of this, since it most commonly means a decision was made with near universal support, but with no clear vote. To comply with the new Brown Act requirement, the minutes should probably be amended to report the actual vote (in this case, saying something like “Motion carried by the following vote: Yes - Anderson, Cole, Englebrecht, Howald, Marston; No - none; Absent - Hamilton, Hayes”). The following additional corrections are suggested: 1. Page 1, Item 4, paragraph 1: “He acknowledged Board Member Rae Cohen, the listed accomplishments made throughout the years and invited ...” 2. Page 2, Item 6.A., paragraph 2: “… as it is also something that makes the City of Newport Beach, unique.” [delete extraneous comma] 3. Page 3, paragraph 4: “He added that when the area around The Wedge is blackballed, there are body boarders that go to the area known as cylinders Cylinders.” 4. Page 3, paragraph 6: “… Deputy Chief McGill reported that there are a certain finite number of finite parking spots in the City and that will not change.” 5. Page 4, line 2: “… the changes would eliminate the inclusion of body surfers of surfing waves at the best hours and at the best surfing conditions.” 6. Page 5, paragraph 3 from end, last sentence: “She commented on the area at Balboa Pier for skin skim boarders ....” 7. Page 6, line 3: “… consistent with the Coastal Act and the Newport Beach Coastal Land-use Land Use Plan.” 8. Page 6, paragraph 3 from end, sentence 2: “Additionally, he stated that the ordinance resolution looks like the Newport Beach Municipal Code …” 9. Page 6, paragraph 3 from end, sentence 3 from end: “He commented on the area around the Balboa Pier being reserved exclusive exclusively for skim boards …” 10. Page 7, paragraph 3: “Mike Icki stated that the Blackball increase increases controversies …” 11. Page 8, paragraph 2 from end, last line: “He thanked Vice Chair Cole and the Working Group for their efforts.” 13. Page 9, paragraph 5 from end, last line: “… Assistant Chief Williams stated that it could be within the next month of or longer, depending on the direction given tonight.” 14. Page 10, paragraph 2: “… it is important to veto the recommendations of the Working Group and directing direct staff to return next month with a timeline.” 15. Page 10, Item B (paragraph in italics): “Consider request of MOD Staff to remove one (1) City Special Blue Gum – Landmark Tree and replaced replace with a Coast Live Oak Tree.” 16. Page 10, paragraph 4 from end: “Jim Mosher stated that only one tree fell in a strong wind storm, and it was not one identified as having the fungus.” 17. Page 11, line 2: “… remove one (1) City Special Blue Gum – Landmark Tree and replaced replace with a Coast Live Oak Tree.” 18. Page 12, paragraph 4 from end: “Superintendent Levin reported that two adult sports groups have recently started …” [or leagues?] 19. Page 12, paragraph 3 from end: “He requested that the meeting matter be agendized and that staff advise him and Commissioner Englebrecht regarding that meeting time and date.” 20. Page 12, last paragraph: “Jim Mosher complemented complimented the Commission for its consideration of the Blackball issue. … Additionally, he referenced an upcoming groundbreaking at Marina Park and a City Charter provision designating a permanent area in the park for public use and the possibility of the Girl Scout facility intruding into that location.”
