CALL TO ORDER—The meeting was called to order at 3:30 p.m. Staff Present: Patrick J.Alford, Zoning Administrator Jason Van Patten, Assistant Planner B. MINUTES of January 28, 2016 Action: Approved C. PUBLIC HEARING ITEMS ITEM NO. 1 Family Meal Market Minor Use Permit No. UP2015-046 (PA2015-209) Site Location: 417 30th Street Council District 1 Jason Van Patten, Assistant Planner, provided a brief project description stating that the request was for a take-out service limited eating and drinking establishment. He provided an overview of the operation stating there would be 208 square feet of interior net public area, no alcohol service, and no late hours. He noted that while no seating was proposed, the Zoning Code allows up to six seats. Mr. Van Patten then discussed parking, proposed tenant improvements, and conditions of approval related to the number of employees allowed on site at one time as well as the location of employee parking. The Zoning Administrator indicated that he was concerned that the public notice referenced no seating, but that a project condition allowed up to six seats. He inquired whether Mr. Van Patten had received any public correspondence regarding this specific issue. Mr.Van Patten stated he received no correspondence regarding public seating. The Zoning Administrator then inquired whether staff would like to comment on the letters received regarding parking, odor, and delivery activity concerns. Mr. Van Patten indicated that the applicant will provide a new covered trash enclosure on private property, dedicated areas within the building for washout that will drain directly into the sewer system, and referenced conditions of approval that restrict delivery hours and employee parking. The Zoning Administrator asked staff whether the findings would still apply should the applicant decide to later add up to six seats inside the building. Mr.Van Patten confirmed that all of the findings would still apply. Applicant, Noah Von Blom of Family Meal Market, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. One member of the public, George Leeper, stated that he was the next-door neighbor and had some objections. He asked whether limits on seating included tables, and for clarification on maximum seats. He further inquired when the staff report was available to the public and noted that the staff report did not recognize residential uses in the area. He had concerns about the proximity of his patio to the back entrance, deliveries, trash, and access through the alley. Page 1 of 2 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 02/11/2016 Mr. Leeper then proposed extending the wall separating his property from the subject property further towards the alley. The Zoning Administrator clarified that if approved, there may be up to six seats with corresponding tables. He indicated that the applicant could provide less. The Zoning Administrator noted that Mr. Leeper appeared to be aware that he was in a mixed-use district, to which Mr. Leeper confirmed he was aware. A second member of the public, Jim Mosher, had two comments. He stated that based on the aerial photo in the staff report, there seemed to be adequate parking for a restaurant use. However, he had concerns that half of the parking was at the rear of the property and that the front had limited parking for patrons. He asked for clarification regarding the public correspondence received. The Zoning Administrator indicated that his earlier reference was to the correspondence attached to the staff report and that staff had received no other public correspondence. Mr. Von Blom stated that the intent was to have no seating. He stated they take great pride in being part of the community and their intent is to enhance, not detract,from it. There were no other public comments. The Zoning Administrator stated that he felt staff addressed all potential issues and approved Minor Use Permit No. UP2015-046. Action: Approved D. PUBLIC COMMENTS ON NON-AGENDA ITEMS None E.
