NEWPORT BEACH HEARING OFFICER MINUTES

REGULAR HEARING
10:00 a.m.
I. CALL TO ORDER—The meeting was called to order at 10:00 a.m.
Present: William Conners, Municipal Law Consultant, Hearing Officer

II. PUBLIC HEARING ITEMS
ITEM NO. 1 806 Harbor Island Drive Reasonable Accommodation No. RA2015-002 (PA2015-202)
Site Location: 806 Harbor Island Drive Council District 5
Hearing Officer Conners opened the public hearing and provided an overview of his procedures and
expectations for the hearing.
Makana Nova, Associate Planner, provided a brief PowerPoint presentation. She provided an overview of the
applicant's request to construct an elevator within an existing 2-car garage. Ms. Nova explained the layout of
the residence, the required findings, and the requested deviations from the Zoning Code development
standards.
Hearing Officer Conners inquired about draft Condition No. 8 requiring the improvements to be removed
should the disabled person no longer occupy the home unless the Community Development Director
determines otherwise. Ms. Nova indicated the condition reflects the standard in the Zoning Code and
explained the Hearing Officer has the authority to modify the condition if it is appropriate.
Applicant, Eric Papa, on behalf of property owner Vincent McGuinness, stated that he had reviewed the draft
resolution and the required conditions. Mr. and Mrs. McGuiness stated that the family had purchased a
vehicle (BMWX3) that would continue to fit within the garage depth after the elevator had been installed.
Thus, the driveway would not need to be utilized for required parking. Mr. McGuinness indicated his desire to
keep the elevator improvement within the garage after the property is sold.
Hearing Officer Conners noted that the Zoning Code requires that a parking area remain useable although a
vehicle is not specifically required to be parking in the space. After some research into vehicle depth, he
found that the deviation from the required depth per the Zoning Code was appropriate and that several
vehicle types could be parked within the proposed depth.
Ms. Nova noted the parking dimensions required by the Zoning Code. She stated that many homes in this
neighborhood only provide a two-car garage and are legally nonconforming because they were constructed
prior to 2010 when the current Zoning Code requirements became effective.
Seeing that no one from the public wished to comment, the public hearing was closed. The Hearing Officer
indicated he would deliberate on the information received in this public hearing and render a decision within
ten (10)days.
On February 25, 2016, Hearing Officer Conners approved Reasonable Accommodation No. RA2015-002,
modifying Condition No. 8 and allowing the elevator to remain should the requesting individual no longer
occupy the residence or convey the property.

The hearing was adjourned at 10:18 a.m.

Chambers binder and on the digital display board located inside the vestibule of the Council
