CALL TO ORDER—The meeting was called to order at 3:30 p.m. Staff Present: Patrick J.Alford,Zoning Administrator David Lee, Planning Technician Melinda Whelan,Assistant Planner B. MINUTES of February 25, 2016 Action: Approved C. PUBLIC HEARING ITEMS ITEM NO. 1 Ferrari Comprehensive Sign Program No. CS2015-014 and Modification No. MD2016-001 (PA2015-211) Site Location: 900-950 West Coast Highway Council District 3 David Lee, Planning Technician, provided a brief project description stating that the applicant requested a Comprehensive Sign Program and a Modification Permit. The deviations requested through the Comprehensive Sign Program are the following: • The installation of three wall signs on the primary frontage, where the Zoning Code allows one wall sign; • The installation of two wall signs on the secondary frontage, where the Zoning Code allows one wall sign; • The installation of wall signs outside the middle fifty(50)percent of tenant frontages; • The signs located on adjacent walls will not be separated by a minimum of thirty (30) feet measured along the building exterior; and • The sign area of 89 square feet for the Ferrari channel letter sign located on the primary frontage, where the Zoning Code allows 75 square feet. Mr. Lee then discussed the following requests through the modification permit: • The proposed area of 89 square feet for the Ferrari channel letter sign, located on the secondary frontage,where the Zoning Code allows 44.5 square feet; • The proposed letter height of 4 feet on the Ferrari channel letter signs, where the Zoning Code allows 3 feet; • The proposed logo height of 5 feet, located on both the primary and secondary frontages, where the Zoning Code allows 3 feet. Mr. Lee explained that all of these requests were necessary to improve visibility for signage for the dealership due to the busy nature of West Coast Highway. He also discussed how the proposed larger signs are in scale Page 1 of 3 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 03/10/2016 with the large fascia of the primary and secondary frontage. The Zoning Administrator asked Mr. Lee if the existing freestanding sign could be modified by the property owner. Mr. Lee responded that the copy and pictorial content may be changed, but any further alterations would require another public hearing in the future. Applicant Armen Kazanchyan, on behalf of the owner, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved ITEM NO. 2 Newport Center Drive Tentative Parcel Map No. NP2015-021 (PA2015-213) Site Location: 500, 520 & 550 Newport Center Drive and 545 & 555 San Nicolas Drive Council District 5 Melinda Whelan, Assistant Planner, provided a brief project description stating that the request was for a tentative parcel map to create four parcels for refinancing purposes within the Block 500 of the North Newport Center Planned Community. She explained that three of the four parcels would each consist of an existing office building and the fourth parcel is the shared parking facilities and access to these buildings. Ms.Whelan addressed the parking and access by explaining that there is an existing Declaration of Covenants, Conditions, Restrictions and Easements (CC&Rs) that dedicates parking and access to the subject office buildings as well as four other parcels in Block 500 and that this CC&R would remain intact to provide the allocations to those four other parcels. An additional CC&R is required and will be recorded simultaneously with the parcel map to provide the parking and access for the new Parcels 1, 2, and 3 from the new Parcel 4. Ms. Whelan added that all of the existing office buildings meet all of the Zoning Code and Building Code requirements and the proposed tentative parcel map would not change this and that conditions are in place to require an additional pedestrian easement along Newport Center Drive as well as public improvements required by the Public Works Department. Ms. Whelan concluded that staff was able to make all of the required findings per Title 19 and recommends approval to the Zoning Administrator. Applicant Shawna Schaffner of CAA Planning, on behalf of Irvine Company, stated that she had reviewed the draft resolution and agrees with all of the required conditions. She answered a question from the Zoning Administrator confirming that the CC&Rs were all private agreements that the City was not a party to and that there are not any parking agreements with the City regarding the subject properties. The Zoning Administrator opened the public hearing. Mike Hewitt, representing 567 San Nicolas, explained that he would like to review final CC&Rs, but has no objection to the tentative parcel map application. Jim Mosher, a member of the public, commented on the name and entity of the Irvine Company. Shawn Monterastelli, legal counsel for Irvine Company, explained the name and different entities of Irvine Company. Mr. Mosher added that he is concerned that the parking would be a separate parcel that would be developed for a different use in the future taking away the parking for the office buildings. Ms. Whelan explained that there are existing development limits that would preclude them from developing on Parcel 4 and a new application would have to be submitted and would have to comply if Irvine Company wished to redevelop on the property in the future. PUBLIC COMMENTS ON NON-AGENDA ITEMS None. E. ADJOURNMENT The hearing was adjourned at 3:43 p.m. The agenda for the Zoning Administrator Hearing was posted on March 3, 2016, at 11:55 a.m. in the Chambers binder and on the digital display board located inside the vestibule of the Council Chambers at 100 Civic Center Drive and on the City's website on March 3, 2016, at 11:45 a.m. Patrick J.
