The Parks, Beaches and Recreation Commission is subject to the Ralph M. Brown Act. Among other things, the Brown Act
requires that the Parks, Beaches and Recreation Commission agenda be posted at least seventy-two (72) hours in advance of each
regular meeting and that the public be allowed to comment on agenda items before the Commission and items not on the agenda
but are within the subject matter jurisdiction of the Parks, Beaches and Recreation Commission. The Chair may limit public
comments to a reasonable amount of time, generally three (3) minutes per person.

Motion by Vice Chair Marston, second by Commissioner Cole, to accept Consent
Calendar Items No. 5A, 5B and 5C. Motion carries unanimously.
D. Tree Donation - Castaways Park
Recommendation: Approve tree donation by Linda Beimfohr at Castaways Park
for Alan T. Beimfohr.
Staff provided details of the staff report.
Commissioner Anderson reported talking with the Beimfohr family and they had
asked if it was a possibility to revise the plaque to read “In Loving Memory of…”
rather than “In Memory of…”. He then asked staff for clarification of Council Policy
B-17.
Discussion ensued regarding the possibility of amending Council Policy B-17 in the
future but approving the requested wording at this time.
Directors Detweiler and Pisani recommended that the Commission approve the
requested change and that staff will forward the amended policy language to the City
Council for their review and approval during the scheduled review of all Council
Policies. They noted that should the City Council deny the amendment, then staff
would change the plaque back to read “In Memory of…”
Chair Howald opened the public comments.
Jim Mosher expressed concerns with the requested action by the Commission as it
was not in compliance with Council Policy B-17.
Chair Howald closed public comments.
In response to questions from the Commissioners, Director Pisani clarified that item
IV-F includes only a request for approval of the standard bench dedication plaque
specified in Council Policy B-17, and not the one shown in the staff report.
Motion by Commissioner Anderson, second by Vice Chair Marston, to approve
the tree donation by Linda Beimfohr at Castaways Park with a plaque indicating “In
loving memory of Alan T. Beimfohr”, with the caveat that should Council deny the
amendment, then the plaque would be redone to read “In memory of Alan T.
Beimfohr.” Motion carried unanimously.
E. Bench Donation - Mariners Park
Recommendation: Approve bench donation by Lizzy McNeill at Mariners Park for
Allister McNeill.
F. Bench Donation - Mariners Park
Recommendation: Approve bench donation by Newport Harbor Baseball
Association at Mariners Park for Zach Cornwell.

Commissioner Englebrecht indicated he has misread the title of the aforementioned
bench donations and did not have anything to discuss further.
Chair Howald opened the public comments. Seeing none the public
comments were closed.
Motion by Commissioner Englebrecht, second by Vice Chair Marston, to
approve Items IV-E and IV-F. Motion carried unanimously.
V. CURRENT BUSINESS
A. Drought Update - PowerPoint Presentation
For Information only.
Manager Sereno introduced Landscape Supervisor Kevin Pekar to the Commission,
commented on his background and job history and deferred to him for a
presentation.
Supervisor Pekar provided details of a PowerPoint presentation to the Commission
with an update regarding the current drought and the conservation efforts being
taken by the City.
Chair Howald opened the public comments.
Jim Mosher indicated it would be interesting to know about the City’s water usage
and commented on the information included in the City’s website. He alleged that
the City may be disappointed with the performance of residents relative to water
conservation.
Chair Howald closed the public comments.
Supervisor Pekar addressed the City’s water use and opportunities for water
conservation.
B. Follow-Up to Denial of Tree Removal Request - 901 Chestnut Place
Consider staff's recommendation to deny request of Dan & Katherine Heinfeld to
remove one City Eucalyptus tree at 901 Chestnut Place.
Manager Sereno provided details of the staff report addressing background, the
Commission’s previous consideration of the matter, and qualifications of the
Arborist/Consultant, Walter Warriner.
Arborist/Consultant Walter Warriner provided a brief summary of his report
addressing the risk assessment process including the likelihood of failure, impacts,
root conditions and trunk defects. He addressed categorizations, and findings and
conclusions with respect to the subject tree. He presented recommendations
including that the tree be structurally pruned to remove defective limbs, but not be

pruned for at least three years, and that the tree be inspected annually, to determine
if there is any change in its structure.
In response to Commissioner Englebrecht’s question, Manager Sereno reported that
the City paid for the assessment of this tree and addressed the cost.
Discussion followed regarding clarification of the recommendations, structure
pruning to remove defective limbs and the extent of pruning to be done in three
years.
Chair Howald opened the public comments.
Jim Mosher spoke in support of staff recommendations to keep the tree and
commented on the risk assessment, the tree affecting the sewer system and costs
associated to the Arborist travelling from Hawaii.
Consultant Warriner noted that he works in both Hawaii and California. He
explained why he does not feel that the subject tree will fall and addressed the
direction that the tree would fall, if it were to fail. He explained that roots are not
predatory and explained how they could affect the sewer system.
Dan Heinfeld commented on the increased likelihood of failure and listed concerns
relative to the subject tree. He addressed the beetle infestation, the fall zone of the
tree, the occupancy rate of his yard and the risk rating of the tree. Mr. Heinfeld
stated that he fails to understand why the City would subject him and his neighbors
to this kind of a risk.
Robert Montgomery commented that this tree does have some issues; but it is a
beautiful tree and should not be cut down, and that the tree was there before the
homeowner moved in and should remain.
Consultant Warriner addressed the difference between low- and moderate-risk. He
noted that there is always some level of risk for any street tree and addressed the
importance of considering the likelihood of failure (imminent or probable).
Chair Howald closed the public comments.
Discussion followed regarding the City’s liability in terms of now having a written
report that categorizes the level of risk as low and moderate and the potential for
limb failure.
Discussion continued regarding the report, conclusions and recommendations.
Motion by Commissioner Cole, second by Commissioner Anderson, to support
the staff's recommendation and the Arborist/Consultant to deny the request of Dan
& Katherine Heinfeld to remove one City Eucalyptus tree at 901 Chestnut Place.

C. Request by the Newport Harbor Baseball Association (NHBA) to Install
One Bullpen at Mariners Park on Baseball Field #1.
That the PB&R Commission consider staff’s recommendation to approve the
request by Newport Harbor Baseball Association (NHBA) to install one (1) bullpen
at Mariners Park on baseball field #1, a dedicatory plaque donated by NHBA
consistent with Council Policy B-17, and waive the 10% maintenance fee for the
bullpen area. Installation would be contingent upon NHBA obtaining all necessary
City of Newport Beach Community Development Department permits prior to
construction.
Manager Justin Schmillen provided details of the staff report. He addressed the
NHBA, details of their proposal and the proposed plaque. .
Jim Stowell commented on the NHBA’s experience in the City and their proposed
investment. He provided suggested language for a memorial plaque.
Commission Members commented on the contributions of the Cornwell Family to
the Newport Beach community.
Discussion followed regarding location of the plaque.
Chair Howald opened the public comments.
Jim Mosher commented on the proposed project and Council’s policy relative to
donations, use of the facility by other organizations and construction approval and
compliance with the City’s Building Code.
Jim Stowell stated the fencing of the proposed project would extend only 50 feet
from the existing backstop and would give room for through traffic and other park
activities. He also stated that the organization is currently using temporary fencing,
but it is not safe or stable.

Motion by Commissioner Anderson, second by Commissioner Hayes, to
approve the request by Newport Harbor Baseball Association (NHBA) to install one
(1) bullpen at Mariners Park on baseball field #1, a dedicatory plaque donated by

Director Detweiler announced the recent Grand Opening of Marina Park as well as
upcoming events. Additionally, she commented on a new home improvement
program for seniors (SHARP), and an upcoming speed-dating event for seniors.
Director Pisani provided an update on Poppy Avenue trees and addressed the review
schedule for the project.
Manager Sereno provided a brief update of City trees recently affected by strong
winds and staff cleanup efforts.
VII. PUBLIC COMMENTS ON NON-AGENDA ITEMS
Jim Mosher commented on Eucalyptus trees still standing along the bike trail, the
blackball issue and the Harbor Commission’s establishment of goals and objectives.

PARKS MAINTENANCE:
Bayside Drive Park Planting
Landscape Division staff recently coordinated the enhancement of the landscaping at
Bayside Drive Park at the corner of Bayside Drive and Carnation Avenue utilizing the
City’s landscape contractors. The planting replaced the dated and water-thirsty
groundcover. It consisted of drought-tolerant and a colorful mix of succulents,
ornamental grasses, and shrubs. Moreover, plant materials were selected with
consideration to the heavy shade that this planter receives due its northern exposure,
as well as being under the canopy of existing trees. Both residents and visitors traveling
in Corona del Mar are certain to take notice of this newly brightened corner!

As part of the City’s overall grid and annual trimming schedule, in January, the City’s
tree service contractor pruned trees within the Corona del Mar, and Newport Coast
areas. Additionally, pruning has occurred at various Palm tree locations.

BEACH MAINTENANCE:
Clean Up After the Storm
The recent storm brought rain and strong winds up to 40 mph to Newport Beach. Field
Maintenance crews cleaned up windblown sand on the streets, sidewalks, and parking
lots. Crews will continue the clean-up efforts with heavy equipment and manual labor for
over two weeks until the sand was returned to the beach.

Welcome Cody to the City
Recreation & Senior Services is happy to introduce our new Sports
Coordinator, Cody Huson.
Cody is a graduate from Cal State Fullerton with a BA in Public
Administration. He has worked for the City of Orange and City of Irvine,
doing everything from a Teens-4-Team summer camp, special events, field
reservations, Adult Soccer, contract classes and has even taught recreation
classes. Some of his hobbies include traveling, boating on the lake, watching
sports, and refereeing soccer.
Cody Huson Fun fact: He has refereed soccer for 10 years and has been
awarded the opportunity to travel all over the country to referee soccer
games at both the youth and collegiate levels!
We are excited to bring his passion for recreation to our team and are
looking forward to using his soccer expertise to help continually refine the
adult and youth sport offerings. Cody can be located at the Civic Center Bay
E, so stop by and help welcome him to the City.
Godzilla at the
Ramsar
Convention?!
The Natural Resources
Management (NRM)
division was pleased to partner with the Newport Bay Conservancy (NBC)
for the 45th Anniversary of the Ramsar Convention. This year’s overarching
symposium topic was climate change, the Godzilla El Niño, and their
impacts on oceans and estuaries.
The Ramsar Convention is an international treaty for the conservation and
sustainable utilization of wetlands. The various speakers at this event
recognized the fundamental ecological functions of wetlands and their
economic, cultural, scientific, and recreational value.
About 133 people took part of this year’s event. The guest list included
individuals from the National Oceanic and Atmospheric Administration,
University of California Irvine, California Department Fish and Wildlife,
Orange County Parks, Orange County Coast Keeper, Segerstrom High
School and more! This event, highlighted the importance of wetlands, and
supports the NRM division’s efforts to protect our estuaries and beaches in
Newport Beach. For more information about our local estuaries and the

OASIS Hosts UCI Lecture
On February 9, Dr. Michael Leon from UCI Medical Center presented
Improving your Brain with Environmental Enrichment. He noted that
studies have found that human neurological problems can be treated
using enhanced sensory stimulation (music, artwork and
fragrances). Dr. Leon discussed a new study that will be used to
determine whether cognitive abilities in older adults can be enhanced
by environmental enrichment.

Mark your calendars, Sunday, March 20 at the Newport-Mesa Spirit
Run the Department will be having its Annual Camp Newport Expo!
As Gidgets and Groms surf through over 25 booths with some of our
most popular instructors; they will catch a glimpse of the endless fun
in store for them for this 2016 Summer Camp season. This family

event includes giveaways, a mechanical surfboard simulator, rock
climb wall, the marine life ISOpod, a photo booth, and will be
featuring a skateboard demo by Adam Cohen’s Skatedogs. This fun
event takes place at Fashion Island starting at 6:30 a.m. and will wrap
up around 11:30 a.m.
Start planning for the coming sunny days and perfect waves. Summer
camp registration opens March 5, 2016 at campnewport.com. Register
by May 9 to receive the early bird special discount.
Eastbluff Backstop On Its Way
The Eastbluff backstop project is well underway with footings
and poles being installed. The project is on schedule and will be
complete in time for the spring baseball season. Special thanks to the
Public Works Department for partnering with us on this
project!
Senior Center “Speed Dating” Event
The Speed Dating event at the OASIS on February 18 was a huge success.
The night began with a short wine and cheese social period. Then all the
participants were escorted into the room where 15 card tables were set up.
Fifteen men and 15 women were given five minutes with each other before
moving on to the next participant. After each encounter, they either marked
a “yes” or “no” next to the person’s name. After the event, staff tallied the
results and if a couple both marked a “yes” next to each other’s names, they
are a match. Each person will receive a letter with the name and phone
number they matched to. From there, it is up to them.
The event was given high praise from everyone involved. They truly enjoyed
the experience

ABSTRACT:
The mouth of the Santa Ana River abuts to the City of Newport Beach and is under the
jurisdiction of the County of Orange. The Newport Beach Police Department Animal
Control receives calls for service due to dog related issues both on the County’s beach
property and the adjacent Newport Beach, beach property. Due to the location’s
distance from other County areas creating a lack of enforcement, this MOU (Attachment
A) would allow the City’s Police Department (NBPD) to enforce Orange County Codified
Ordinances as it relates to dogs within the County’s subject area.
RECOMMENDATION:
Recommend to the City Council the adoption of a Memorandum of Understanding
(MOU) between the County of Orange, the Orange County Sheriff-Coroner and the City
of Newport Beach for Sharing Responsibilities along the Santa Ana River to enforce dog
regulations at the mouth of the river.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item. Any enforcement activities can be
accommodated within the Police Department’s existing budget.
DISCUSSION:
The Newport Beach Police Department Animal Control receives calls for service due to
dog related issues both on the County’s beach property and the adjacent Newport
Beach property at the mouth of the Santa Ana River.
The City of Newport Beach Municipal Code Section 7.04.030 “Animals Prohibited on
Public Beaches” states:
A. No person having the care, custody, charge or control of any animal
shall permit or allow that animal to be on any ocean front beach or

B. No person having the care, custody, charge or control of any animal
shall permit or allow that animal to be on any harbor/bay front beach
between the hours 9:00 a.m. to 5:00 p.m. year-round.
C. No person having the care, custody, charge or control of any animal
shall permit or allow that animal to be on any ocean front beach,
ocean front sidewalk, harbor/bay front beach or harbor/bay front
sidewalk unless that person has, in his or her possession, an
implement or device capable of removing any feces deposited by the
animal.
In addition, the City of Newport Beach Municipal Code Section 7.04.020 Leash
Required states:
No person having the care, charge or control of any dog shall cause or
allow, either willfully or through failure to exercise due care or control,
such dog to be present upon any beach, street, alley, or public place, or
upon any private property or premises other than his or her own without
written consent of the owner or lessee of such land unless such dog is
securely restrained by a substantial leash or chain not exceeding six feet
in length and controlled by a person competent to restrain such dog. This
section shall not be construed as allowing dogs on leashes in the areas
from which dogs are prohibited as designated by Sections 7.04.025,
7.04.030, and 7.04.050.
Two jurisdictions (Newport Beach and the County of Orange) are responsible for
enforcement of laws and ordinances in this area. Over the years, this area has become
an unofficial dog park where the public runs their dogs off leash, do not pick up after
their dogs and do not follow the posted signs. Currently dogs are not allowed to run off
leash on City property, nor are they allowed on County beaches. Residents in the area
call the Newport Beach Police Department when a problem arises and the NBPD
Animal Control responds.
The public understands where the City of Newport Beach and the County of Orange
boundaries lie and if they see an Animal Control Officer, they often times move to the
County’s jurisdiction where the City currently does not have enforcement authority.
The County of Orange, Code of Ordinances related to dogs on beaches states:
Sec. 4-1-46. - Public school property; county parks, public beaches and
county buildings. No person having the charge of any dog, except a blind,
deaf or disabled person with his or her guide dog, signal dog or service
dog, or a person training a guide, signal or service dog, shall permit said
dog to be under any circumstances within public school property, the
county park known as Upper Newport Bay, any public beach, or any
building owned or occupied by the County, including any space in
buildings partially occupied by the County.

Exceptions. The provisions of this section are not applicable to dogs that
are in direct supervision of County personnel or in areas designated by the
Board of Supervisors as allowing dogs. In the event the Board of
Supervisors, by resolution, authorizes dogs to be upon any public beach,
the provisions of this section shall not be applicable thereto.
The terms "guide dog," "service dog," and "signal dog," in this section shall
be given the same meaning as set forth in Penal Code Section 365.5.

The draft MOU would allow the NBPD and Animal Control to respond to complaints
effectively and efficiently when called. This area is separated from other Sheriff Patrol
and County Animal Control unincorporated areas and makes enforcement difficult. The
City’s Animal Control Division has data regarding calls in the area as identified below.

In order to get community input on this issue, the City posted the following question on
Facebook and mySidewalk sites, “We want to hear from you. Do you think the Newport
Beach Police Department should respond on leash law and dog waste violations at the
mouth of the Santa Ana River, which is the County of Orange’s jurisdiction?” The survey
opened on December 8, 2015 and closed January 7, 2016. The full list of responses
and comments are shown in Attachment B. The Facebook and mySidewalk survey
comments cannot be identified as residents or non-residents. There were 24 (twenty-
four) individuals who posted on both Facebook and mySidewalk and the duplicate
“votes’ have been removed from the total count and duplicated are highlighted in blue.

The final count was Yes (27), No (226) and Unclear or Does Not Matter (13). The City
also received one letter from a resident in Huntington Beach supporting a leash free
beach.
The Parks, Beaches and Recreation Commission is being asked to consider this issue
as the off leash activity on County property often times extends onto the adjacent City
beach and results in calls for service from the Police Department. The ability to step
onto County property to avoid citations makes it very difficult for staff to remedy the
issue and ongoing complaints received.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

BEACH FOR SHARING LAW ENFORCEMENT
RESPONSIBILITIES ALONG THE SANTA ANA RIVER
This Memorandum of Understanding ("MOU") is entered into this day of
, 2015, which date is enumerated for purposes of reference only, by and
among the County of Orange ("County"), the Orange County Sheriff-Coroner
("Sheriff'), and the City of Newport Beach ("City").
RECITALS
WHEREAS, the Sheriff is responsible for general law enforcement within the
County, including areas along the Santa Ana River, specifically, the west bank of the
Santa Ana River where it adjoins the eastern boundary of the City of Huntington Beach
from Adams Avenue south to the Pacific Ocean, including the area identified on the
map attached hereto as Exhibit "A" and incorporated herein by reference (hereinafter
referred to as "the Subject Area"); and
WHEREAS, the Subject Area is within the County's jurisdiction; however, it is
separated from other, regular areas of Sheriffs patrol, making it more difficult for
Sheriffs personnel to frequently patrol the Subject Area; and
WHEREAS, the City is regularly called by its residents when a problem arises in
the Subject Area. The Newport Beach Police Department responds to these calls, and
is willing to enforce the Orange County Codified Ordinances in the Subject Areas; and
WHEREAS, the Sheriff has the exclusive authority under Penal Code section
830.1, subdivision (a)(2) to give her consent to any City police officer to exercise the
authority of peace officers in any place within the County.
THEREFORE, pursuant to the authority set forth in California Government Code
sections 54981 and 55632, and the Sheriffs authority under California Penal Code
section 830.1 (a)(2), the parties agree as follows:
1. The Sheriff consents to allow all police officers employed by the City to
exercise the authority of peace officers in the Subject Area.
2. The Police Department of the City may enforce the general laws of the
State of California and the Orange County Codified Ordinances, as currently exist or
may be amended or adopted, in the Subject Area;
3. Any prosecutions of violations cited by the City's Police Department in
the Subject Area will be by the Orange County District Attorney's Office.
4. The City agrees that it will not receive and will not seek compensation
from the County or the Sheriff for the enforcement of the general laws of the State of
California and the Orange County Codified Ordinances in the Subject Area.
5. The City agrees to release, defend with counsel approved by the County
and hold harmless the County and the Sheriff for any and all liability, claims, or causes
of action, including but not limited to those for property damage or personal injury,
arising from, or related to, law enforcement by the City Police Department in the
Subject Area.
6. This MOU may be terminated at any time by any party upon written
notice to all other parties.
Nothing in this MOU is to be construed as conflicting with existing laws and prescribed
responsibilities applicable to the respective parties hereto.

keep a county beach to themselves. I live next to both the jetty and the fire

The city of Newport Beach has seriously underestimated the dog support from
this city and it's proven on this thread. It really looks like the city needs to
make more accommodations to allow dog owners to run and socialize their
dogs public land. San Fran has many parks and beaches where dogs are
allowed off-leash and the designated and promote areas for dogs to exercise.
In Newport Beach they basically cut off every little hope for residents to do so
besides a tiny little dog park, which isn't ideal. Even take a look at our
neighboring cities Laguna Beach and Huntington beach... Laguna has a 10 acre
dog park with natural grass and Huntington has a couple of miles of beach
designated for pups to play.

on and off leash and never seen a problem like you see sometimes in
Huntington most people are responsible dog owners Maybe put up a few signs

home owner in lido sands community not far from dog beach. i have been
going their with both of my dogs for the past 20 years. this is a perfect place to
have your dog off leash. it's got jetties on both sides and sits in a river mouth.
the dog owners are great and i have NEVER seen a poop on that beach ever!
Regulating this area makes NO sense at all!!! I will fight this unnecessary
proposal. who is Diane dixon? has she even been there before? who could
possibly be for this measure? its Ridiculous in nature. the dogs & owners dont

me to have to drive all the way to Goldenwest St. just to take my dog for a
romp in the sand. The river jetties is a sanctuary for our whole family and

It's a designated area for dogs to have fun in the sand and now she wants to
take it away! There are not many places that you can take your dog off leash.
The beach is a fun and great place to play for a dog or a human! I own a dog
and know how excited that they get to go play with other dogs, run around

Absolutely not! As it is there are very few places to take your dog. People with
aggressive dogs need to patrol themselves and leash their dogs and if they do
not then they should receive fines or punishment when needs be. This beach is

My house has been broken into. Separately, checks were stolen. We knew
who did it and provided evidence that would have been an easy conviction.
$80K of fraud. The evidence was not examined ever. Lastly, my Porsche Turbo

owners are good about picking up after the dogs.
