The Parks, Beaches and Recreation Commission is subject to the Ralph M. Brown Act. Among other things, the Brown Act
requires that the Parks, Beaches and Recreation Commission agenda be posted at least seventy-two (72) hours in advance of each
regular meeting and that the public be allowed to comment on agenda items before the Commission and items not on the agenda
but are within the subject matter jurisdiction of the Parks, Beaches and Recreation Commission. The Chair may limit public
comments to a reasonable amount of time, generally three (3) minutes per person.

Request by the Newport Harbor Baseball Association (NHBA) to Install One
Bullpen at Mariners Park on Baseball Field #1.

That the PB&R Commission consider staff’s recommendation to approve the request by Newport
Harbor Baseball Association (NHBA) to install one (1) bullpen at Mariners Park on baseball field
#1, a dedicatory plaque donated by NHBA consistent with Council Policy B-17, and waive the 10%
maintenance fee for the bullpen area. Installation would be contingent upon NHBA obtaining all
necessary City of Newport Beach Community Development Department permits prior to
construction.

3) COMMUNITY SERVICE AWARD - DARREN BRILHART
Recreation Supervisor Matt Dingwall spoke regarding Darren Brilhart's work and
efforts in putting together a major, yearly surfing event for the City for the past 27
years.
Chair Howald presented Darren Brilhart with the Community Service Award in
acknowledgement and appreciation of his efforts.
Mr. Brilhart provided information regarding the history of the surf contest including
the addition of a pro element to same, and thanked the City for the honor.

Chair Howald opened the public comments; seeing none, the public

Motion by Commissioner Englebrecht, second by Vice Chair Marston, to accept
Consent Calendar Items No. 5A, 5C and 5D. Motion carries unanimously, with
Commissioner Hamilton, absent.
B. Parks & Operations Division Activity Report.
Recommendation: Receive/file Activity Report.
Chair Howald referenced the removal of 42 City trees, 33 of which were on Poppy
Avenue. Staff affirmed Chair Howald's statement noting that within the course of the
year, the City plans to plant 500 trees.
Discussion followed regarding special circumstances relative to the removal of trees
on Poppy.
Director Pisani provided an update on the Poppy Avenue tree removal project,
including an upcoming community meeting and the inclusion of a reforestation plan
and removal of sidewalks to allow for wider parkways. Examples of potential
replacement trees will be provided and the community will have the opportunity to
comment on same. An update will be provided to the PB&R Commission at a future
meeting, after the plan is better-defined. The original trees on Poppy Avenue have
been removed and addressed the next steps.
E. Tree Donation - Grant Howald Park
Recommendation: Approve tree donation in memory of Geri Mooney by Gael
Mooney at Grant Howald Park.
Chair Howald asked regarding staff to provide a brief history of the person for which
a tree is dedicated. Staff stated that it will be provided, going forward.
Chair Howald opened the public comments.
Jim Mosher commented on the donor's request to plant two specific species of trees.
He reported that the Commission is being asked to approve a different species and
questioned the rationale.

Manager Sereno explained that Park Supervisor Paul Ramirez is in charge of the
donation program and reported that the species that were requested did not fit in
well with the location. He added that the African Tulip tree was suggested and
accepted by the donor and will fit in better with the location. The matter was
discussed with the donor, who accepted the suggestion.
Chair Howald closed the public comments.
Motion by Commissioner Cole, second by Commissioner Hayes, to approve
Consent Calendar Items No. 5B and 5E. Motion carries unanimously, with
Commissioner Hamilton, absent.
6) CURRENT / NEW BUSINESS – Staff Report
A. Tree Removal Denial - 901 Chestnut Place
Recommendation: Consider staff's recommendation to deny request of Dan &
Katherine Heinfeld to remove one City Eucalyptus tree at 901 Chestnut Place.
Director Pisani provided details of the staff report addressing location, value and age
of the existing tree, a prior claim for damages caused by the tree by the applicants,
subsequent actions by City staff, the City's G-1 policy, and conditions under which
trees may be removed. He commented on City actions to mitigate damage from the
specific tree, an arborist report submitted by the applicant, staff findings and
recommendations.
Discussion followed regarding additional stress placed on trees by excess trimming,
conflicting claims between the applicant's arborist and staff, the possibility of getting
an independent arborist to evaluate the tree, expiration of the applicant's original
claim, the need to comply with the G-1 policy, the City's liability in terms of trees
causing damages to private property and the need for additional information
regarding the specific tree.
Chair Howald requested a report from staff, at a future meeting, regarding the City's
claim process.
Chair Howald opened the public comments.
Dan Heinfeld, applicant, provided a brief PowerPoint presentation addressing his
prior claim for damages and trimming of the tree. He referenced his application for
removal of the tree, actions related to his original claim before expiration of the
claim, trimming and pruning, and listed his expectations regarding the tree.
Additionally, he addressed the damage caused by the tree including heavy debris
drop and concerns about the health of the tree. He referenced letters from neighbors
in support of his request.
Alexandra Montgomery spoke in opposition to removing the tree.

Jim Mosher agreed that the Commission should weigh in on retaining a healthy tree
rather than removing it. He commented on noticing problems including notification
of the HOA and on the City's liability when a City tree causes private property
damage. Additionally, he suggested that the City provide comments from the Risk
Manager relative to the City's liability.
Chair Howald closed the public comments.
Discussion followed regarding a prior action relative to a fatal accident on Irvine
Boulevard, the removal of other City trees and the latest pruning of the tree.
Mr. Heinfield stated that in 2011, other trees in the area were trimmed but the
subject tree was not.
Ensuing discussion pertained to dealing with structural damage versus the tree being
a nuisance, and having the City arborist evaluate the tree.
Discussion followed regarding the process for obtaining an independent arborist, the
tree valuation process and no requirement for noticing homeowner associations on
removal of standard trees.
Motion by Commissioner Marston, second by Commissioner Cole, to continue
item to allow for the evaluation of the subject tree by an independent arborist. Motion
carries by the following roll call vote:

B. Special Tree Removal - 431 Santa Ana Avenue
Recommendation: Consider staff's recommendation to remove one Special City
Eucalyptus - Neighborhood tree from Joseph Smith at 431 Santa Ana Avenue; if
approved tree will not be replaced at this location, instead a 36" box tree will be
planted elsewhere in the community.
Manager Sereno provided details of the staff report addressing location, existing
conditions, tree maintenance, damage of the trees by Southern California Edison
over the years and staff findings. He corrected the staff report noting that staff is
recommending a tree replacement, but not at the subject site.
Discussion followed regarding Southern California Edison pruning of specific trees.
Chair Howald opened the public comments; Seeing none, the public
comments were closed.

Landscape Manager Sereno presented details of the staff report addressing location,
details of the request, existing conditions, sidewalk damage, challenges to making
the necessary improvements without removing the tree, findings and
recommendations. He added that staff recommends replacement with the same
species and involvement of the appropriate property owner.
Chair Howald opened the public comments.
Jim Mosher expressed confusion regarding whether a replacement tree will be
planted at the same location or a different one. He then asked whether a new,
smaller tree will be planted in the same place after improvements are made.
Manager Sereno explained that the tree to be removed will be replaced with another
tree at the same location and another tree will be planted at 1700 Starlight Circle, of
the same variety.
Chair Howald closed the public comments.
Motion by Commissioner Englebrecht, second by Commissioner Marston, to
remove one Special City Eucalyptus Tree - Neighborhood tree located at 1700 Starlight
Circle; tree will be replaced with same species type and at same location. Motion carries
by the following vote:

Commissioner Howald, Commissioner Marston

D. Relocation Bench Donation - Buena Vista Blvd & West Edgewater Avenue
Recommendation: Consider request of Paul McDonough to relocate an existing
bench from the corner of Lindo Avenue at West Edgewater Blvd. to the end of
Buena Vista Blvd at West Edgewater Avenue; if approved Paul McDonough will
incur the costs of relocating bench and plaque.
Director Pisani presented details of the staff report. He addressed the request,
relocation of an existing bench, willingness of the applicant to fund the relocation of
the bench and notification of adjacent residents and original donor of the bench.

Discussion followed regarding staff recommendations, why the original location was
chosen, related policies, accessibility issues with the new location and the potential
of roots of the nearby tree damaging it or the bench.
Chair Howald opened the public comments.
Lisa Scorziell referenced a handout that she submitted for distribution and spoke in
opposition to relocating the bench. She reported that Mr. McDonough is not the real
party of interest nor the actual homeowner and lacks standing for this request. She
stated she is the homeowner adjacent to the proposed relocation site and expressed
concerns with reduced privacy. In terms of Mr. McDonough's claim that relocating
the bench will provide for a better view, she noted that this claim is subjective and
his opinion. Additionally, she stated that the original donor and others feel that the
current location is best. Currently there is a view of the park and the water and the
movement of the bench would provide only a view of the water. She reported that the
bench was there when the applicant moved to the property and that relocating it
would reduce her privacy. She reported that the functionality of the bench would be
lessened with its removal and addressed public access and additional public benches
in the area. She urged the Commission to deny the public bench relocation request
and submitted two signed letters from nearby property owners in opposition to the
proposed project.
Mr. Scorziell addressed the locations of other benches on Edgewater. He added that
roots from the nearby tree will affect access to the bench and reduce accessibility to
the nearby park.
Paul McDonough thanked the Commission and staff and deferred to the property
owner of the home.
Carolyn Stockton, property owner at 350 Buena Vista, reported that when she moved
in that there was no bench at that location. When the case was originally heard, there
was no noticing done nor impact studies. She referenced to Council Policy G-5 which
was in effect at the time and reported that noticing was never done. She expressed
concerns with impacts to her privacy.
Mr. McDonough addressed lack of privacy, after-hour violations, and alcohol
consumption and noted that the area is not supervised. He added that if staff's
recommended relocation is not satisfactory, there are alternative locations, on the
peninsula, for the bench.
Ms. Stockton opined that the view is better from the proposed location and asked
that the Commission approve the request.
Tom Kupfrian stated that his wife's family donated the bench, referenced a letter
submitted by her and asked that the Commission maintain the bench where it is
currently located. He added that it had been a special place for his wife’s sister, Cora,
and commented on the loss of view of the park if the bench is relocated.

In response to Chair Howald's inquiry, Mrs. Kupfrian reported that the bench was
donated in 2002 and noted that neighbors had been in attendance when the matter
was originally heard, and reported there were no objections at that time.
Mary Fletcher reported that moving the bench will add a burden to the homeowner
near the new location. She spoke in opposition to relocating the bench.
Jim Mosher addressed the current and proposed locations and commented on the
original subdivision of the area. He reported that the map presented by staff is out of
date, addressed the public area and commented on Council's actions regarding same
without involving the PB&R Commission.

Discussion followed regarding the park and current view, loss of park view with the
relocation of the bench, whether it is a City park, maintenance and the length of time
the bench has been in its present location.
Motion by Commissioner Englebrecht, second by Commissioner Cole, to deny the
request of Paul McDonough to relocate the existing bench from the corner of Lindo
Avenue at West Edgewater Boulevard to the end of Buena Vista Boulevard at West
Edgewater Avenue. Motion carries by the following vote:
Ayes: Commissioner Anderson, Commissioner Cole, Commissioner Englebrecht,
Commissioner Hayes, Commissioner Howald, Commissioner Marston

Director Detweiler provided a summary of promotions, and lateral transfers to the
Recreation Department in relation to the opening of Marina Park. She addressed the
Movies-in-the-Park events, and reminded the Commission of the Marina Park Grand
Opening on December 5, 2015, at 10 a.m.
Chair Howald commented on the Coral tree at Ensign and Director Pisani reported
that a replacement tree was planted yesterday as the original replacement tree was
damaged upon delivery. There were no additional costs, and he noted that the City
appreciates the community for donating it.
Discussion ensued regarding the City not meeting its water conservation goals and
the Commissioner questioned staff about the grass in front of City Hall and parks.

Director Pisani reported that the grass in front of the Civic Center was damaged
during an event and will be reseeded later in the year. He addressed cuts in irrigation
in specific areas of the City.
Discussion followed regarding City parks that use reclaimed water.
Chair Howald requested an update on the City's water-conservation efforts, on a
future agenda.
Commissioner Hayes commended the City for the landscaping work on Dover Drive.

Monthly Activities Report

OASIS Annual Holiday Luncheon
Over 190 seniors celebrated the holiday season at our annual
Holiday Luncheon held Friday, December 18th. A caroling group
sang traditional Christmas carols followed by local band Dallas &
Doll, who performed a variety of holiday hits. Lunch was provided
by Age Well Services and served by 18 volunteers, including our
own City Manager and Councilmember Tony Petros. The holiday
luncheon is a popular event at OASIS providing an opportunity for
our seniors and staff to celebrate the holidays with thanks.
Marina Park Grand Opening
The City celebrated the Grand Opening of the new Marina Park Community Center on December 5, 2015.
Over 2,000 people attended and received their first glimpse of the new site with all of its amenities. The
event allowed the public to meet the community center’s instructors and to learn more about programs
and classes. The community explored the facility and utilize the great new park and nautical themed
playground. The event was a huge success.
The following week was the true initiation of the building as numerous people came in to try free sample
classes. This was followed by the community having the opportunity to enjoy the new “Window to the
Bay” during the Boat Parade with over 1500 people coming to the facility.
OASIS Health Brain Lecture
On January 27, OASIS hosted Dr. Tonia Vojtkofsky from Cognitive Care Solutions. She presented Maintaining
Brain Health as We Age. There are several modifiable risks that are related to brain health and Dr. Vojtkofsky
discussed various strategies to keep the brain stronger longer.

OASIS Wine and Cheese Social
OASIS hosted the Wine and Cheese Social on January 20. Guests sipped on a variety of lovely wines and
treated their pallets to bites of delicious cheeses and desserts. Those attending enjoyed the
entertainment provided by the talented Da Capo Players.
Newport Coast Facility Maintenance
Over the holiday break the Newport Coast Community Center received fresh interior paint, new pickleball
lines, and a resurfacing of the gym floor. This time of year is generally used for maintenance and allows staff to
do significant work with zero impact to users of the facility.
Community Days Are So

public, Community Day is a
great interactive way for the
Natural Resource Team to
teach about protecting our
environment, explain
interesting facts about local
wildlife, and enlightening
the community about the
work the City of Newport
Beach and other agencies aredoing to preserve our environment. Visitors take part in various activities
such as catching plankton from the dock, using binoculars to get a glimpse of local birds, and touching
marine animals includingsea anemones, sea cucumbers, and sharks!
There are activities and learning opportunities for all ages. Come out to the Back Bay Science Center on
Sundays and touch a leopard shark, explore plankton under a microscope, and watch an octopus change
colors in front of your eyes!
Community Day is held every Sunday at the Back Bay Science Center located at 600 Shellmaker Road
from 10a.m. - 2p.m. For more information, please email marineeducation@newportbeachca.gov.
OASIS Speed Dating
OASIS is hosting its first ever Speed Dating Event on Wednesday, February 17 from 5:30-8p.m. Speed
dating is a fun, and lively way to meet like-minded singles one-on-one without commitment. Staff is
drawing upon the experience of other Senior Centers around the country that have done this event. If you
know a gentleman who would enjoy this social event please send him our way! The 15 spots for women
are full but men are still needed. Participants must be 65 years of age or older. We are thrilled to share
this experience with our seniors and anticipate a very exciting night.

Marina Park Classes Are Up and Running!
The first classes at Marina Park kicked off the week of January
11 with 164 people signed up! The facility has been busy with
lots of happy visitors and participants. Some of our more
popular classes incude gymnastics, Playball, Jedi Hip Hop, How
to Work Your Iphone, sailing and fitness! Look for the spring
Navigator in your mailbox the last week of February with
registration opening on March 3rd for all classes!
Stay Fit With Lap Swimming
2015 was a year dedicated to health and wellness at the Marian Bergeson Aquatic Center (MBAC). Lap
swim attendance saw an increase of nearly 20% compared to 2014. Eight participants showed their
dedication to staying physically fit and reached the goal of attending at least 100 lap swim sessions
throughout the year. Year 2016 can be your year to incorporate this fun and healthy trend! Lap Swim is
offered at the MBAC at Corona del Mar High School and runs Monday-Friday from 6-8p.m. and
Saturday/Sundays from 7:30-11:30a.m.
ACE Registration Now Open
Registration opened January 18th for the winter session of the After Class Enrichment Program (ACE) and
numbers are strong right out of the gate. Classes began to fill just three days after registration opened
online and numbers continue to rise across all the different school sites which include Harbor View
Elementary, Mariners Elementary, Newport Coast Elementary, and Newport Elementary. ACE classes
allow students to sign up for a variety of recreational activities held on campus right after school
dismissal. Winter classes begin February 1st.
2nd Annual Mayor’s Egg Roll
The Recreation & Senior Services (RSS) Department is gearing up
for the 2nd Annual Mayor’s Egg Roll. This event was held for the first
time last spring and brought joy to many families as hundreds of
people gathered to enjoy the fun activities.
This year’s Mayor’s Egg Roll will be held on Saturday, March 19 on
the Civic Center Green & Community Room. From 10a.m. to noon,
children will enjoy sack races, a bounce house, games, face
painting, train rides, and most importantly, the egg races across
the lawn. RSS staff will be handing out popcorn, cotton candy, and
goodie bags. Spring pictures with the civic center bunny will be
provided as well! This is a fun and free family event, so mark your
calendars and come out to enjoy the fun!

Senior Housing Assistance Repair Program (SHARP)
The Newport Beach SHARP Program aims to help low income seniors in need of critical home repair or
modifications due to accessibility needs, safety concerns, health and wellbeing, or citation received by
Code Enforcement. This program is co-sponsored with Habitat for Humanity of Orange County and
funded through the City of Newport Beach affordable housing fund. For more information, please contact

Eligibility Requirements:
Newport Beach homeowner currently living in the home that is in need of repair
Age 60 and older
At or below the 50th percentile of the median income of Orange County with net assets not to
exceed gross household income for 18 months
Home repair is of critical nature
Applicant must currently live in housing that is unsafe or otherwise in poor condition
Applicant must be unable to perform the repairs themselves
Applicant must be unable to afford to pay a market rate contractor to complete the repairs
Applicant must be willing to work with Habitat for Humanity of Orange County and City staff
Applicant must be willing to provide a nominal financial contribution to the project
Project approval is at the discretion of program staff

RECOMMENDATION:
That the PB&R Commission consider staff’s recommendation to approve the request by
Newport Harbor Baseball Association (NHBA) to install one (1) bullpen at Mariners Park on
baseball field #1, a dedicatory plaque donated by NHBA consistent with Council Policy B-
17, and waive the 10% maintenance fee for the bullpen area. Installation would be
contingent upon NHBA obtaining all necessary City of Newport Beach Community
Development Department permits prior to construction.
FUNDING REQUIREMENTS:
Project is to be fully funded by NHBA, including but not limited to installation, materials and
subsequent damages from the project. No fiscal impact to the General Fund. NHBA will be
responsible for the maintenance of the bullpen area and therefore waiver of the 10%
maintenance fee is recommended.
DISCUSSION:
The NHBA is a 100% volunteer youth serving organization that serves the west side of
Newport Beach and the east side of Costa Mesa. The league is comprised of over 400
Newport Beach resident participants.
The NHBA has requested to install a bullpen area with two warm up mounds along the
first base side of baseball field #1 at Mariners Park (Attachment A). The proposed
bullpen would be a 50’ x 6’ area consisting of brick dust, two mounds with pitching
rubbers, two home plates and fencing on three sides. The entire project will be funded
by NHBA with estimated costs at $10,000.
The bullpen construction will extend 6-foot high fencing from the first base side dugout
fencing for the entire length of the bullpen area (approximately 50 feet). Fencing

(approximately 6 feet long) would extend off of the 50 foot section behind the pitcher’s
mounds and plates. The fourth side of the bullpen area would remain open for
accessibility. All fencing will match the existing backstop fencing. No permanent
structures will exist within this footprint. Only the existing sod in the area would be
removed and replaced by brick dust.
During games, pitchers and catchers currently warm up in the proposed bullpen area but
require an additional “spotter” to protect them from foul balls and overthrows. The addition
of the bullpen would not only provide a safer area for pitchers warming up, but also for
coaches and spectators to view games when the bullpen is not in use. The addition of the
bullpen would also allow:
More players to practice pitching off a mound at one time
Minimize damage and maintenance costs to the game day mound
Reduce wear on turf from warming up in unspecified pitching areas
This configuration would not impede on the current passive use of the park or other
recreational activities. This includes any conflict with the existing soccer field layout as
confirmed by AYSO Region 97, who uses Mariners Park as one of their home fields. Use
of the bullpen will be open to the public and limited daylight hours, as Mariners Park does
not have athletic field lights.
Recreation & Senior Services and Municipal Operations staff met on site to discuss the
preliminary layout and concept with the NHBA in October of 2015. If approved,
construction would begin the first week of February and completed by March 1, 2016. The
NHBA’s Opening Day program at Mariners Park and first games are scheduled to start
the first weekend in March.
ACKNOWLEDGEMENT:
In acknowledgement of the project, NHBA is requesting a dedicatory plaque in the name
of the Cornwell Family to honor the life of their son Zach and the many years of dedicated
service of the Cornwell Family to the community. Fred Cornwell served on the NHBA
board for over a decade and was key in working with the City to create many
improvements in both the fields and the field allocation system as a whole for all sports
leagues. Fred was a vital participant in the design of the Sunset Ridge Park baseball field
and in working with the City to gain Coastal Commission approval of the park. Fred
continued to volunteer his time years after his sons were no longer participating in the
league to see the project through completion.
The dedicatory plaque, which will be provided by NHBA, will be consistent with Council
Policy B-17.

Dear Mr. Schmillen,
Newport Harbor Baseball Association (NHBA) would like to install a bullpen area with two warm up
pitching mounds at Mariners Park Field #1 on the first base side. Currently there is no formal area for
pitchers to warm up.
We have over 400 Newport Beach baseball players/managers/coaches/residents in our program. Our
goal is to provide a safe environment and to enhance the baseball experience for our players and
spectators. We feel the addition of the bullpen will support our goal. The current situation does not
provide a safe environment for the players to practice or warm prior to and during games.
Currently pitchers are warmed up in the grassy areas on both the first base and third base sides of the
field. There is no protection for players or spectators behind the pitcher or catcher. On the third base side
spectators and other park visitors are exposed as they walk the path to access the restroom. On the first
base side, it is common for spectators to sit and observe the game in lawn chairs along the right filed line.
The bullpen area would remedy this situation. We are suggesting the dual bullpen area on the first base
side of the field due to space availability, managing the cost and minimizing the impact to the overall use
of the park. Additionally the bullpen area will minimize the use and damage to the fields game mound and
reduce our maintenance costs.
Enclosed with this letter are overhead photos with approximate dimensions detailing the location of the
bullpens. Official plans for the bullpens are currently in development with a licensed architect.
We expect construction to start first week of February and be complete by March 1, 2015. Our Opening
Day program is scheduled for the first weekend in March at Mariners Park with an official opening day
game on the Mariners #1 field.
