Re: 1011 Kings Road, D'Eliscu Residence Variance No. VA2015-004 (PA2015-205)
Several emails were exchanged on March 16, 2016 regarding a pending application to construct a new
home at the above address. The property owner requests a variance to construct a new home that
exceeds the 24-foot height limit for flat roof structures by 7 feet 7 inches. The Planning Commission was
scheduled to consider the application at its March 17, 2016 meeting. At the request of the applicant, the
Planning Commission continued consideration of the item to April 7, 2016.
Unfortunately, one of the emails dated March 16, 2016, between staff and a neighboring resident,
included incorrect information regarding the dimensions of the existing deck line at 1011 Kings Road.
The email incorrectly stated that the edge of the existing deck, located at the rear of the existing home,
extends 71 feet from the front property line. When, as shown in the attached site plan, the existing rear
deck extends 77 feet, 1% inches from the property line.
There was also a misunderstanding related to realigning the sewer line/easement, which City Council
approved on March 8, 2016. It shall be noted, that the sewer line/easement realignment did not result in
the redesign, modification, or expansion of the footprint for the new home from its original design. It was
determined by the City's Public Works Department that realigning the easement would best
accommodate future maintenance and reconstruction. The long term goal of the City is to relocate the
mid-slope sewer line that bisects properties along the south side of Kings Road to the southerly property
lines.
