Alford, Zoning Administrator The Zoning Administrator meeting is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires that the Zoning Administrator agenda be posted at least seventy-two (72) hours in advance of each regular meeting and that the public be allowed to comment on agenda items before the Zoning Administrator and items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Chair may limit public comments to a reasonable amount of time, generally three(3)minutes per person. The City of Newport Beach's goal is to comply with the Americans with Disabilities Act (ADA) in all respects. If, as an attendee or a participant at this meeting, you will need special assistance beyond what is normally provided, we will attempt to accommodate you in every reasonable manner. NOTICE REGARDING PRESENTATIONS REQUIRING USE OF CITY EQUIPMENT Any presentation requiring the use of the City of Newport Beach's equipment must be submitted to the Community Development Department 24 hours prior to the scheduled meeting. If in the future, you wish to challenge in court any of the matters on this agenda for which a public hearing is to be conducted, you may be limited to raising only those issues which you (or someone else) raised orally at the public hearing or in written correspondence received by the City at or before the hearing. TLT Food Minor Use Permit Amendment (PA2016-032) Site Location: 1332 Bison Avenue Project Summary An Amendment to Minor Use Permit No. UP2014-047 to change the Alcoholic Beverage License at an existing eating and drinking establishment from a Type 47 (On-Sale General - Eating Place) to a Type 41 (On Sale Beer and Wine - Eating Place). Additionally, the request is to amend the opening hour from 10:00 a.m. to 8:00 a.m. No other changes are proposed including the closing hour which will remain at 11:00 p.m. The eating and drinking establishment will be located in a tenant space previously occupied by Mozambique Peri Peri. If approved this MUP would supersede Minor Use Permit No. UP2014-047. Island Cinemas Minor Use Permit Amendment (PA2016-001) Site Location: 999 Newport Center Drive Project Summary Amendment No. 2 to modify Minor Use Permit No. UP2011-029 and change an existing Type 41 (Beer and Wine) Alcoholic Beverage Control License to a Type 47 (On Sale General) Alcoholic Beverage Control License within an existing movie theater. The movie theater currently operates from 11:00 a.m. through 1:00 a.m., daily, and is limited to 680 seats. Pursuant to NBMC 5.25, the operation as described requires the owner/operator to modify Operator License No. OL2013-001 because the proposed amendment includes a change in the alcohol license type for the establishment. CEQA Compliance The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). Recommended Action 1. Conduct a public hearing; and 2. Adopt Draft Zoning Administrator Resolution No. _approving Minor Use Permit Amendment No. UP2016-001 and Operator License No. 01-2016-001. Item No. 2 Staff Report 3. Crocker's The Well Dressed Frank (PA2016-025) Site Location: 211 Marine Avenue, Suite B Project Summary Minor Use Permit request to amend Use Permit No. UP2010-016 to allow an existing eating and drinking establishment with beer and wine sales (Type 41 alcohol license) to expand into an adjacent tenant space. The expanded restaurant would be 1,004 square feet with a net public area of 200 square feet. Proposed hours of operation are 7:00 a.m. to 10:00 p.m. daily. If approved this use permit would supersede Minor Use Permit No. UP2010-016. CEQA Compliance The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). Item No. 3 Staff Report 4. Green Element 365 Juice Bar (PA2016-040) Site Location: 609 East Balboa Boulevard Project Summary A minor use permit to allow a juice bar (Take-Out Service, Limited Eating and Drinking Establishment) to operate in an existing, 920-square-foot vacant ground floor commercial tenant space of a two-story mixed-use development. The project includes tenant improvements to create a preparation area, front counter and retail area. The proposed hours of operation are from 6:00 a.m. to 6:00 p.m., daily, with potential adjustments due to seasonal changes. CEQA Compliance The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). Recommended Action 1. Conduct a public hearing; and 2. Adopt Draft Zoning Administrator Resolution No. _ approving Minor Use Permit No. UP2016-010. Item No. 4 Staff Report 5. Villas Fashion Island Tentative Parcel Map (PA2015-220) Site Location: 1101 San Joaquin Hills Road Project Summary A tentative parcel map to subdivide one existing 18.29-acre parcel into two numbered parcels and two lettered parcels in conjunction with the Villas Fashion Island project (formerly the San Joaquin Plaza Apartments). CEQA Compliance The project is categorically exempt under Section 15315, of the State CEQA (California Environmental Quality Act) Guidelines - Class 15 (Minor Land Divisions). Recommended Action 1. Conduct a public hearing; and 2. Adopt Draft Zoning Administrator Resolution No. _approving Tentative Parcel Map No. NP2016-003. Item No. 5 Staff Report Item No. 5a Additional Materials Received - Mosher (PA2015-220) 6. Villas Fashion Island Signage (PA2016-030) Site Location: 1101 San Joaquin Hills Road Zoning Administrator Meeting April 14, 2016 Page 4 Project Summary A modification permit to allow two project identification monument signs and two leasing directional signs along San Joaquin Hills Road where the North Newport Center Planned Community regulations allow one of each. Also included is a request to increase the sizes for both sign types above what is allowed. CEQA Compliance The project is categorically exempt under Section 15311, of the State CEQA (California Environmental Quality Act) Guidelines - Class 11 (Accessory Structures). Recommended Action 1. Conduct a public hearing; and 2. Adopt Draft Zoning Administrator Resolution No. _approving Modification Permit No. MD2016-004. Item No. 6 Staff Report IV. PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on agenda and non-agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers' time limit on agenda or non-agenda items, provided the time limit adjustment is applied equally to all speakers.
