CALL TO ORDER—The meeting was called to order at 3:30 p.m. Staff Present: Patrick J.Alford,Zoning Administrator Rosalinh Ung,Associate Planner Ben Zdeba,Associate Planner David Lee, Planning Technician B. MINUTES of April 28, 2016 A member of the public, Mr. Jim Mosher, requested that typo be corrected on Item 7, paragraph 2. Zoning Administrator Alford thanked Mr. Mosher for his diligence. Action: Approved as amended C. PUBLIC HEARING ITEMS At this juncture of the meeting, the Zoning Administrator informed the public that a request for a continuance was received for Item No. 5,the annual review of the Development Agreement for North Newport Center, and asked if anyone from the public wished to comment. Jim Mosher commented that the May 26`h Zoning Administrator hearing could conflict with the Finance Committee meeting. Seeing as no one else wished to comment on this item,Zoning Administrator Alford continued it to the Zoning Administrator meeting of May 26, 2016. He further noted that as this is continued to a date certain, there will be no further public noticing required. ITEM NO. 1 Huntress Modification Permit No. MD2016-005 (PA2016-047) Site Location: 1738 Skylark Lane Council District 3 David Lee, Planning Technician, provided a brief project description stating that the project is a modification permit to allow a 27 percent addition to an existing single-family residence with nonconforming parking, while the Zoning Code limits additions to 10 percent of the existing floor area when the required parking dimensions are not met. Mr. Lee noted the current nonconforming dimensions of the garage, and that the garage was legal, nonconforming. The interior clearance of the garage was compliant with the Zoning Code during the time of construction in 1960. Mr. Lee further explained that the applicant is proposing a two-story 831-square-foot addition in the rear of the structure, away from the garage, and that the addition will comply with all development standards. The addition will not intensify the nonconforming parking. The existing garage can fit two cars which fulfills the intent of the code to provide adequate parking for a single-family residence. The Zoning Administrator asked if the zoning (R-1-6000) had lot coverage requirements, not maximum square footage. Mr. Lee confirmed that the lot only has lot coverage requirements. Applicant Jarrett Huntress stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Page 1 of 3 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 05/12/2016 Action: Approved ITEM NO.2 Dexter Tentative Parcel Map No. NP2016-006 (PA2016-051) Site Location: 514 and 514 Y: Fernleaf Avenue Council District 5 David Lee, Planning Technician, provided a brief project description stating that the project is a tentative parcel map at 514 and 514 %: Fernleaf Avenue. The lot is zoned as a two-unit residential property.An existing single-family residence was demolished and will be replaced by a new two-unit duplex. Mr. Lee stated that the new duplex will provide the code required two-car parking per unit. The tentative parcel map would allow for each unit to be sold separately as condominiums. Mr. Lee explained that as a condition of approval, a park fee shall be assessed for one additional dwelling unit. There are no waivers of the subdivision development standards. The applicant, nor any representative for the applicant, was present for the hearing. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved ITEM NO. 3 Annual Review of Development Agreement for Pacific View Memorial Park (PA2009-024) Site Location: 3500 Pacific View Drive Council District 7 Rosalinh Ung,Associate Planner, reported that the Development Agreement was originally approved in 1995 and amended in 2007 with the term extended to 2025 or 2032, if development is completed early. She provided an update on construction activities between April 2015 and March 2016. Ms. Ung reported that staff has not received any complaints this year and believes the applicant has acted in good faith with regard to the terms of the Development Agreement. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Zoning Administrator Alford found that the annual review is exempt from CEQA and determined Pacific View Memorial Park is in good faith compliance with the terms of the Development Agreement. Action: Approved ITEM NO. 4 Annual Review of Development Agreement for Uptown Newport (PA2014-039) Site Location: 4311-4321 Jamboree Road Council District 3 Rosalinh Ung, Associate Planner, provided a brief description on the Development Agreement for the development of a 25-acre mixed-use project, including the type of development and term of the Development Agreement. She reported that the project is in the first phase of development. A site development review application was approved by the Community Development Director in January 2016, for the construction of 455 residential apartment units, 10,700 square feet of retail use and a 50-foot wide paseo. Building permits for this construction phase are currently under review and will be ready for issuance in the coming months. No public benefit fees are due at this time since building permits for new residential development have not been issued. The Zoning Administrator opened the public hearing. Mr. Jim Mosher commented on the status and location of the Uptown Hotel development application. Ms. Ung confirmed that the proposed hotel development was located within Phase 1 of the project and further noted that the application has been withdrawn by the applicant. Zoning Administrator Alford found that the annual review is exempt from CEQA and determined Uptown Newport is in good faith compliance with the terms of the Development Agreement. Action: Approved ITEM NO. 5 Annual Review of Development Agreement for North Newport Center (PA2009-023) Site Location: Sub-areas of Fashion Island; Block 100, Block 400, Block 500, Block 600, and Block 800 of Newport Center Drive; and San Joaquin Plaza Council District 5 Action: Continued to the May 26, 2016 D. PUBLIC COMMENTS ON NON-AGENDA ITEMS Mr. Jim Mosher stated that not all of the Development Agreements are provided on the City website. He further noted that it is City Council who reviews the Development Agreements, not the Zoning Administrator. Associate Planner Ung noted that the City Council granted authority to the Zoning Administrator to review all Development Agreements. Mr. Mosher responded that the language in the Development Agreement explicitly states they are to be reviewed by City Council. Ms. Ung informed Mr. Mosher that staff can look into this further. E.
