A. CALL TO ORDER—The meeting was called to order at 3:31 p.m.

B. REQUEST FOR CONTINUANCES
ITEM NO. 5 Annual Review of Development Agreement for North Newport Center
(PA2009-023)
Site Location: Sub-areas of Fashion Island; Block 100, Block 400, Block 500,
Block 600, and Block 800 of Newport Center Drive; and San Joaquin Plaza
Council District 5
The Zoning Administrator noted a request for continuance from the applicant regarding this item. No one from
the public wished to comment on the matter.
The Zoning Administrator continued the item to the regular scheduled hearing on June 16, 2016.
Action: Continued to June 16, 2016

D. PUBLIC HEARING ITEMS
ITEM NO. 1 15 Hermitage Lane Lot Line Adjustment No. LA2015-007 (PA2015-222)
Site Location: 15 Hermitage Lane and 1 Big Canyon Drive Council District 5
Jason Van Patten, Assistant Planner, provided a brief project description stating that the request was a lot
line adjustment that would shift the lot line shared between parcels 1.51 feet to the north. He noted that
approximately 181 square feet of land would be reallocated from 1 Big Canyon Drive to 15 Hermitage
Lane. He added that there would be no change in density or intensity at either parcel, and that access
would remain unchanged. He indicated that an existing wood deck crossing the property line would need
to be removed prior to recordation of the lot line adjustment.
Applicant Tom Decker, on behalf of the property owner, and Stephen Batcheller, property owner, both stated
that they had reviewed the draft resolution and agree with all of the required conditions.
The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment
the public hearing was closed.
The Zoning Administrator asked whether the wood deck was the only improvement crossing the property line.

Mr. Van Patten indicated that it was the only improvement crossing the property line.
The Zoning Administrator then moved to approve the request.

ITEM NO.2 1930 Port Ramsgate Place Modification Permit No. MD2016-006 (PA2016-052)
Site Location: 1930 Port Ramsgate Place Council District 5
Melinda Whelan, Assistant Planner, provided a brief project description stating that the request is for a
modification permit for a 10 percent encroachment into the required front yard setback in conjunction with an
addition to a single-story residence within the Harbor View Hills Planned Community (PC-3). Ms. Whelan
explained that there are land-based physical hardships as the property is at the end of a cul-de-sac, with an
unusual shape, and also has the largest front setback requirement on Port Ramsgate Place. The
encroachment is only for the corners of the garage addition and a post for an entry which are minor in nature
while allowing the structure to be squared-off to a regular shape. The minor encroachment does not block
sunlight or air on adjacent properties nor will it block protected views. Ms. Whelan concluded that based on
these facts she was able to make all of the required findings and recommends approval to the Zoning
Administrator.
The Zoning Administrator asked for clarification on the required 5-foot side setback which Ms. Whelan
clarified that the 5 feet is the requirement of PC-3 and the addition would not encroach into the side setback.
The applicant/property owner, Jenny Campbell, stated that she had reviewed the draft resolution and agrees
with all of the required conditions.
The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment
the public hearing was closed.

ITEM NO. 3 712 Heliotrope Avenue Tentative Parcel Map No. NP2016-008 (PA2016-054)
Site Location: 712 Heliotrope Avenue Council District 6
Melinda Whelan, Assistant Planner, provided a brief project description stating that the request is for a
tentative parcel map for two-unit condominium purposes. A single-family dwelling will be demolished and a
new duplex is currently in the building permit process. No waivers of Title 19 are requested and the duplex
will meet all Code requirements. Ms. Whelan concluded that she was able to provide facts in support of all
the required findings of Title 19 and recommends approval to the Zoning Administrator.
Applicant Paul Craft, representing the owner, stated that he had reviewed the draft resolution and agrees with
all of the required conditions.
The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment
the public hearing was closed.

ITEM NO.4 302 Marguerite Avenue Tentative Parcel Map No. NP2016-007 (PA2016-055)

Melinda Whelan, Assistant Planner, provided a brief project description stating that the request is for a
tentative parcel map for two-unit condominium purposes. A triplex has been demolished and a new duplex is
currently under construction. Since the existing units exceeded two within the Coastal Zone, compliance with
Section 20.34 of the Zoning Code and the Mello Act was required prior to demolition of the units. No waivers
of Title 19 are requested and the duplex will meet all Code requirements. Ms. Whelan concluded that she
was able to provide facts in support of all of the required findings of Title 19 and recommends approval to the
Zoning Administrator.
The Zoning Administrator asked for clarification on the determination of compliance with the Mello Act prior to
demolition of the existing triplex. Ms.Whelan explained that a Staff Approval application was submitted which
included income verification and official documents from the tenants and the owner of the property. Staff was
able to confirm the documents, that none of the units were affordable housing units, and approved the Staff
Approval finding compliance with the Mello Act.
Applicant Paul Craft, on behalf of the Owner, stated that he had reviewed the draft resolution and agrees with
all of the required conditions.
The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment
the public hearing was closed.
Action: Approved

F. ADJOURNMENT
The hearing was adjourned at 3:44 p.m.
