Alford, Zoning Administrator The Zoning Administrator meeting is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires that the Zoning Administrator agenda be posted at least seventy-two (72) hours in advance of each regular meeting and that the public be allowed to comment on agenda items before the Zoning Administrator and items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Chair may limit public comments to a reasonable amount of time, generally three(3)minutes per person. The City of Newport Beach's goal is to comply with the Americans with Disabilities Act (ADA) in all respects. If, as an attendee or a participant at this meeting, you will need special assistance beyond what is normally provided, we will attempt to accommodate you in every reasonable manner. NOTICE REGARDING PRESENTATIONS REQUIRING USE OF CITY EQUIPMENT Any presentation requiring the use of the City of Newport Beach's equipment must be submitted to the Community Development Department 24 hours prior to the scheduled meeting. If in the future, you wish to challenge in court any of the matters on this agenda for which a public hearing is to be conducted, you may be limited to raising only those issues which you (or someone else) raised orally at the public hearing or in written correspondence received by the City at or before the hearing. PUBLIC HEARING(S) 1. 2312 Laurel Place Modification Permit No. MD2016-008 (PA2016-086) Site Location: 2312 Laurel Place Project Summary A modification permit to allow a 111-percent addition to an existing nonconforming single family residence where the Zoning Code limits additions to 10 percent of the existing gross floor area when the required parking dimensions are not met. The nonconforming garage provides dimensions 19 feet 6 inches wide by 19 feet 5 inches deep. The Zoning Code requires 20 feet for both Zoning Administrator Meeting August 11, 2016 Page 2 dimensions. CEQA Compliance The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). Recommended Action 1. Conduct a public hearing; and 2. Adopt Draft Zoning Administrator Resolution No. _approving Modification Permit No. MD2016-008. 2. Cypress Lot Merger No. LM2016-003 (PA2016-079) Site Location: 20101 Cypress Street and 20111 Birch Street Project Summary A lot merger application and request to waive the parcel map requirement for two contiguous properties under common ownership. The merger would combine two legal lots into a single parcel. CEQA Compliance The project is categorically exempt under Section 15315, of the State CEQA (California Environmental Quality Act) Guidelines - Class 15 (Minor Land Divisions). Recommended Action 1. Conduct a public hearing; and 2. Adopt Draft Zoning Administrator Resolution No. _approving Lot Merger No. LM2016-003. 3. CHALK of Newport Beach Minor Use Permit No. UP2016-017 (PA2016-072) Site Location: 2500 West Coast Highway Project Summary A minor use permit to allow a day care center/preschool with a capacity of 72 students and 10 staff members. Proposed hours of operation are 7:30 a.m. to 5:30 p.m., Monday through Friday. The gross floor area of the existing building is 5,035 square feet with 14 proposed parking spaces and an approximately 6,600 square-foot outdoor playground. Vehicular access to the property, including drop-off and pick-up of children, will be from the alley at the rear of the property. CEQA Compliance The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). V. PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on agenda and non-agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers' time limit on agenda or non-agenda items, provided the time limit adjustment is applied equally to all speakers. As a courtesy, please turn cell phones off or set them in the silent mode. VI. ADJOURNMENT
