Alford, Zoning Administrator The Zoning Administrator meeting is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires that the Zoning Administrator agenda be posted at least seventy-two (72) hours in advance of each regular meeting and that the public be allowed to comment on agenda items before the Zoning Administrator and items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Chair may limit public comments to a reasonable amount of time, generally three(3)minutes per person. The City of Newport Beach's goal is to comply with the Americans with Disabilities Act (ADA) in all respects. Newport Harbor Yacht Club Limited Term Permit No. XP2016-006 (PA2016-135) Site Location: 720 West Bay Avenue between 7th and 8th Street on the Balboa Peninsula Project Summary Limited Term Permit for the installation of temporary land and water facilities to provide yacht club services during the demolition and construction of the Newport Harbor Yacht Club approved in Planned Development Permit No. PL2012-002. The temporary facilities will consist of three elements: (1) on the east boatyard Zoning Administrator Meeting September 15, 2016 Page 2 deck, kitchen and office facilities will be placed in portable (modular) structures; (2) at the east dock, three slip fingers will be modified to allow the mooring of a vessel of approximately 80 feet in length for use as a temporary clubhouse; (3) in the main boatyard, two trailers on wheels will provide offices for sailboat coaching functions and restrooms. The temporary facilities would be in place throughout the construction anticipated to be 17 months. CEQA Compliance The project is categorically exempt under Section 15303 , of the State CEQA (California Environmental Quality Act) Guidelines - Class 3 (New Construction or Conversion of Small Structures). Recommended Action 1. Conduct a public hearing; and 2. Adopt Draft Zoning Administrator Resolution No. _approving Limited Term Permit No. XP2016-006. 2. 217 Marguerite Avenue Condominiums Tentative Parcel Map No. NP2016-009 (PA2016-103) Site Location: 217 Marguerite Avenue Project Summary Request for a tentative parcel map for condominium purposes. No waivers of Title 19 (Subdivisions) design standards are requested. An existing two-unit duplex was demolished and will be replaced with a new two-unit duplex. The Tentative Parcel Map would allow each unit to be sold individually as condominiums. CEQA Compliance The project is categorically exempt under Section 15315, of the State CEQA (California Environmental Quality Act) Guidelines - Class 15 (Minor Land Divisions). Recommended Action 1. Conduct a public hearing; and 2. Adopt Draft Zoning Administrator Resolution No. _approving Tentative Parcel Map No. NP2016-009. 3. 129 34th Street Condominiums Tentative Parcel Map No. NP2016-011 (PA2016-104) Site Location: 129 34th Street Project Summary Request for a tentative parcel map for condominium purposes. Adopt Draft Zoning Administrator Resolution No. _approving Tentative Parcel Map No. NP2016-011. 4. 429 Snug Harbor Modification Permit No. MD2016-011 (PA2016-132) Site Location: 429 Snug Harbor Road Project Summary A modification permit to allow an approximate 21-percent addition to an existing non-conforming single-story, single-family residence where the Zoning Code limits additions to 10 percent of the existing gross floor area when the required parking dimensions are not provided. The non-conforming garage is currently 17-feet, 6-inches wide by 20 feet deep, where a minimum 20-foot by 20-foot dimension is required. The project proposes an approximately 400-square-foot master bedroom addition. CEQA Compliance The project is categorically exempt under Section 15301 , of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). Recommended Action 1. Conduct a public hearing; and 2. Adopt Draft Zoning Administrator Resolution No. _approving Modification Permit No. MD2016-011. 5. Vacancy Coffee Bar Minor Use Permit No. UP2016-034 (PA2016-136) Site Location: 6480 West Coast Highway Project Summary A minor use permit to allow the operation of a take-out service limited, eating and drinking establishment in an existing office/ retail building. The proposed tenant space would include approximately 500-square-feet and 6 seats for patrons. No late hours (after 11:00 p.m.) or alcohol service are proposed as part of this application. CEQA Compliance The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). Adopt Draft Zoning Administrator Resolution No. _approving Minor Use Permit No. UP2016-034. 6. Vibe Organic Kitchen &Juice Minor Use Permit No. UP2016-036 (PA2016-140) Site Location: 1000 Bristol Street, Suite 28 Project Summary To allow the operation of a new food service eating and drinking establishment within an existing 1,300-square-foot commercial space that was previously used as a physical therapy/fitness facility. The proposed net public area includes 560-square-feet with 20 seats for patrons. No late hours (after 11:00 p.m.) or alcohol service is proposed. CEQA Compliance The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). Recommended Action 1. Conduct a public hearing; and 2. Adopt Draft Zoning Administrator Resolution No. _approving Minor Use Permit No. UP2016-036. V. PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on agenda and non-agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers' time limit on agenda or non-agenda items, provided the time limit adjustment is applied equally to all speakers.
