Alford, Zoning Administrator The Zoning Administrator meeting is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires that the Zoning Administrator agenda be posted at least seventy-two (72) hours in advance of each regular meeting and that the public be allowed to comment on agenda items before the Zoning Administrator and items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Chair may limit public comments to a reasonable amount of time, generally three(3)minutes per person. The City of Newport Beach's goal is to comply with the Americans with Disabilities Act (ADA) in all respects. If, as an attendee or a participant at this meeting, you will need special assistance beyond what is normally provided, we will attempt to accommodate you in every reasonable manner. NOTICE REGARDING PRESENTATIONS REQUIRING USE OF CITY EQUIPMENT Any presentation requiring the use of the City of Newport Beach's equipment must be submitted to the Community Development Department 24 hours prior to the scheduled meeting. If in the future, you wish to challenge in court any of the matters on this agenda for which a public hearing is to be conducted, you may be limited to raising only those issues which you (or someone else) raised orally at the public hearing or in written correspondence received by the City at or before the hearing. Nekter Juice Bar Minor Use Permit No. UP2017-012 (PA2017-089) Site Location: 1620 San Miguel Drive Project Summary A minor use permit to allow a take-out service, limited, juice bar, within an existing 1,080-gross-square-foot retail tenant space with 422 square feet of net public area and a maximum of 6 seats. The proposed hours of operation are from 7:00 a.m. to 7:00 p.m. No late hours (after 11:00 p.m.) or alcohol service are proposed as part of this application. In order to allow for future flexibility, a condition of approval is included allowing hours of operation between 7 a.m. and 9 p.m., daily. Zoning Administrator Meeting May 25, 2017 Page 2 CEQA Compliance The project is categorically exempt under Section 15303, of the State CEQA (California Environmental Quality Act) Guidelines - Class 3 (New Construction or Conversion of Small Structures). Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of Small Structures) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _approving Minor Use Permit No. UP2017-012. 2. 226 Orange Street Coastal Development Permit No. CD2017-026 (PA2017-060) Site Location: 226 Orange Street Project Summary A Coastal Development Permit (CDP) to allow a 476 square foot addition divided between the first and second floors of an existing single-family residence. The project also includes the addition of a second story deck. The height of the overall residence would not increase and the project complies with all applicable development standards including height, setback, and floor area limits. CEQA Compliance The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 under Class 1 (Existing Facilities) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _approving Coastal Development Permit No. CD2017-026. 3. Newport Beach Wellness Massage Services Minor Use Permit No. UP2017-002 (PA2017-008) Site Location: 1501 Westcliff Drive Project Summary A minor use permit to allow massage services (accessory massage) in an existing 1,276 square foot chiropractic office. The chiropractic office is permitted by right. The massage service is provided by a maximum of two massage technicians within rooms of the existing chiropractic office on an as needed basis as a part of Zoning Administrator Meeting May 25, 2017 Page 3 the overall chiropractic treatment of patients. CEQA Compliance The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines. Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 under Class 1 (Existing Facilities) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _approving Minor Use Permit No. UP2017-002. 4. 1706 East Ocean Front Coastal Development Permit No. CD2017-013 (PA2017-030) Site Location: 1706 E. Ocean Front Project Summary A request for a Coastal Development Permit to allow the demolition of an existing single-family dwelling and attached garage and the construction of a new 4,048 square foot single-family dwelling with an attached garage. The development also includes hardscape, drainage, and landscaping. The development will meet all applicable development standards including height, setbacks, and floor area limitations. CEQA Compliance The project is categorically exempt under Section 15303, of the State CEQA (California Environmental Quality Act) Guidelines - Class 3 (New Construction or Conversion of Small Structures). Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of Small Structures) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _approving Coastal Development Permit No. CD2017-013. V. PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on agenda and non-agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers' time limit on agenda or non-agenda items, provided the time limit adjustment is applied equally to all speakers.
