HomeMy WebLinkAbout2017-54 - Amending the Adopted Capital Improvement Program Budget for Fiscal Year 2017-18 to Include Road Maintenance and Rehabilitation Account (RMRA) Funding under the Road Repair and Accountability Act of 2017 – Local Streets and Roads Program and ApprRESOLUTION NO. 2017-54 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, AMENDING THE ADOPTED CAPITAL IMPROVEMENT PROGRAM BUDGET FOR FISCAL YEAR 2017-18 TO INCLUDE ROAD MAINTENANCE AND REHABILITATION ACCOUNT (RMRA) FUNDING UNDER THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 — LOCAL STREETS AND ROADS PROGRAM AND APPROVING BUDGET AMENDMENT NO. 18BA-002 WHEREAS, on April 28, 2017, the Governor signed Senate Bill 1 (Beall, Chapter 5, Statutes of 2017) ("SB 1 "), known as the Road Repair and Accountability Act of 2017, to address basic road maintenance, rehabilitation, and critical safety needs on State highway and local street road systems; WHEREAS, pursuant to SB 1, beginning November 1, 2017, the State Controller will deposit portions of new funding from increases to certain fuel excise and sales taxes and vehicle registration fees into the Road Maintenance and Rehabilitation Account ("RMRA") of which a percentage will be apportioned by formula to eligible cities and counties for basic road maintenance, rehabilitation, and critical safety projects on local streets and roads systems; WHEREAS, the City of Newport Beach ("City") uses local, county, state, federal, and grant funding to maintain and improve the streets within its jurisdiction; WHEREAS, the City Council does not support SB 1 or any future increase in fuel excise and sales taxes or vehicle registration fees that may arise from its adoption; WHEREAS, City taxpayers contributed to funding RMRA, and the City is eligible for an apportionment of RMRA funding; WHEREAS, the City Council is willing to accept its apportionment of RMRA funding to recover the intended benefit of taxes paid by City taxpayers and to continue to maintain and improve City streets; WHEREAS, the City Council's acceptance of RMRA funding is not intended to be an endorsement of SB 1 or any future increase in fuel excise and sales taxes or vehicle registration fees; WHEREAS, SB 1 emphasizes the importance of accountability and transparency in the delivery of California's transportation programs and requires cities and counties to provide to the California Transportation Commission ("CTC") annually a list of projects to be funded with RMRA funding; WHEREAS, a city or county receiving an apportionment of RMRA funds is required to sustain a maintenance of effort ("MOE") from the city's or county's general fund to ensure new revenues are used to supplement and not supplant revenues used for transportation purposes; Resolution No. 2017-54 Page 2 of 4 WHEREAS, all projects proposed to receive RMRA funding must be included in a city or county budget that is adopted by the applicable city council or county board of supervisors at a regular public meeting; WHEREAS, the City Council of the City of Newport Beach ("City Council") adopted the Capital Improvement Program Budget for Fiscal Year 2017-18 at its June 13, 2017 meeting, before guidelines were issued by the CTC; and WHEREAS, the City Council is required to adopt a resolution to document the approval of the City's amended operating or capital improvement budget at a regular public meeting to include the list of projects relevant to receiving RMRA funding. By this resolution, the City Council intends to amend the adopted Capital Improvement Program Budget for Fiscal Year 2017-18 and approve a budget amendment to increase revenue estimates and appropriate such revenue to supplement the MacArthur Boulevard / University Drive Pavement Rehabilitation Project, which is proposed to receive RMRA funding. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby amend the adopted Capital Improvement Program Budget for Fiscal Year 2017-18 to include RMRA funding for basic road maintenance, rehabilitation and safety projects on the local streets and roads system. Said RMRA funds for Fiscal Year 2017-18 shall be appropriated to supplement the following project: MacArthur Boulevard from Ford Road -Bonita Canyon Drive to city limits / University Drive from Jamboree Road to SR 73 Pavement Rehabilitation (Project 18R23). Section 2: The particulars of the project are as follows: a. Anticipated Funding Sources: Measure M Fair Share ($1,300,000), and 2017-2018 RMRA funds ($481,309). b. Project Description: This project grinds and overlays sections of MacArthur Boulevard and University Drive with rubberized asphalt concrete and reconstructs deteriorated concrete improvements. C. Project Location: MacArthur Boulevard from Ford Road / Bonita Canyon Drive north to city limits at State Route 73; and University Drive from Jamboree Road to State Route 73 within the city limits of Newport Beach, California. d. Schedule: Award construction contract spring 2018, complete construction by fall 2018. e. Estimated Useful Life: City's Pavement Management Plan calculates a new useful life of 15 years minimum for this repaired roadway. Resolution No. 2017-54 Page 3 of 4 Section 3: The City Council hereby approves Budget Amendment No. 18BA-002 to increase revenue estimates by Four Hundred Eighty One Thousand Three Hundred and Nine Dollars and 00/100 ($481,309.00) (12101-431127) and appropriate such Four Hundred Eighty One Thousand Three Hundred and Nine Dollars and 00/100 ($481,309.00) to Account No. 12101110-980000-181323 for the MacArthur Boulevard from Ford Road -Bonita Canyon Drive to city limits / University Drive from Jamboree Road to SR 73 Pavement Rehabilitation (Project 18R23). Section 4: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 5: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 6: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 7: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution. In addition, these projects are sometimes coordinated with other improvement projects such as water and wastewater pipeline projects that tend to have significant impacts on the pavement. The streets will be overlayed with Asphalt Rubber Hot Mix (ARHM) which contains recycled tires. Recycling tires is beneficial as it diverts material away from the landfill. ARHM is also a superior material compared to conventional asphalt concrete (no recycled tires). It rides quieter and retains its dark color longer. There are existing bike lanes and sidewalks on both sides of MacArthur Boulevard and University Drive that will be preserved as complete streets elements. The benefit of rehabilitated pavement is a smoother, quieter and safer ride. It also enhances the overall aesthetics of the street. Proposed Project A MacArthur Boulevard / University Drive Pavement Rehabilitation (Project 18R23) Description: As part of the Pavement Rehabilitation Program - Overlay, this project grinds and overlays sections of MacArthur Boulevard and University Drive with rubberized asphalt concrete. The estimated quantity of Asphalt Rubber Hot Mix (ARHM) is 8,000 tons. Reconstruction of deteriorated concrete improvements is also included.
