CALL TO ORDER – The meeting was called to order at 3:30 p.m. Staff Present: Patrick J. Alford, Zoning Administrator Gregg Ramirez, Senior Planner Liane Schuller, Contract Planner Melinda Whelan, Assistant Planner David Lee, Planning Technician B. REQUEST FOR CONTINUANCES Gregg Ramirez, Senior Planner, requested that this item be continued to October 12, 2017 Zoning Administrator hearing. He noted the applicant was not present, but concurred with the request. The Zoning Administrator asked if anyone present wanted to speak on this item. There was none. The Zoning Administrator granted staff’s request and continued the public hearing until October 12, 2017. He noted that since this item was continued to a date certain, no additional public notice was required. C. MINUTES of September 14, 2017 The Zoning Administrator said that the City received an email from Mr. James Mosher pointing out a misspelled word and approved the minutes with the correction. Action: Approved D. PUBLIC HEARING ITEMS ITEM NO. 1 Bengston Residence Coastal Development Permit No. CD2017-024 (PA2017-058) Site Location: 111 8th Street Council District 1 Continued to October 12, 2017. ITEM NO. 2 620 and 620 ½ Poinsettia Tentative Parcel Map No. NP2017-018 (PA2017-157) Site Location: 620 and 620 ½ Poinsettia Avenue Council District 6 Liane Schuller, Contract Planner, provided a brief project description stating that the applicant is requesting approval of a Tentative Parcel Map for condominium purposes. The applicant has obtained approval to demolish an existing duplex and to construct a new duplex that complies with all current development standards. Approval of the parcel map would allow each unit to be sold individually as condominiums. Applicant James Person, on behalf of the Reklaw, LLC, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 09/28/2017 Page 2 of 4 ITEM NO. 3 552 Seaward Lot Merger No. LM2017-004 (PA2017-100) Site Location: 552 Seaward Road Council District 6 David Lee, Planning Technician, provided a brief project description stating that a request has been made to combine two parcels, under common ownership, into a single parcel. The applicant is proposing to make an addition across the existing interior property line. Mr. Lee stated that the legal description of the lot at 552 Seaward Road is Lot 178 of Tract 1273, and the lot to the east of 552 Seaward Road is Lot 4 of Tract 14795. Mr. Lee explained that the proposed lot area is 11,588 square feet and the proposed lot width is 72 feet, each of which are not excessive compared to lots in the surrounding area. Staff recommended approval of the project and stated that a resolution was provided with the required findings. In response to a question from the Zoning Administrator, Mr. Lee acknowledged that the City has approved other lot mergers with similar lot configurations in this area. Applicant Holly Rose, on behalf of the owner, stated that she had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved ITEM NO. 4 DeMore Residence Coastal Development Permit No. CD2017-058 (PA2017-136) Site Location: 1033 West Balboa Boulevard Council District 1 David Lee, Planning Technician, provided a brief project description stating that a request has been made to allow the construction of a new 3,600-square-foot single-family residence with an attached 750-square-foot garage on a lot with no existing residence. Mr. Lee stated that the lot was zoned for two-unit residential, and that the proposed development is consistent with the standards in the Zoning Code. Mr. Lee also stated that since the development is approximately 460 feet away from the mean high water line, a W ater Quality Management Plan and Construction Pollution Prevention Plan were not required. A drainage system will be installed to ensure that the project will not impact water quality. Mr. Lee explained that the project is not located between the nearest public road and the sea, and will not affect public recreation, access, or views. Staff recommended approval of the project and stated that a resolution was provided with the required findings. Applicant Rod Jeheber, on behalf of the owner, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved ITEM NO. 5 427 Marigold Tentative Parcel Map No. NP2017-012 (PA2017-111) Site Location: 427 Marigold Avenue Council District 6 Melinda Whelan, Assistant Planner, provided a brief project description stating that the request is for a tentative parcel map for condominium purposes. An existing single-family dwelling has been demolished and a new duplex is under construction. No waivers of Title 19 are proposed. The Tentative Parcel map would allow each unit to be sold individually. Mrs. Whelan concluded that staff was able to find facts in support of all the required findings of Title 19. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Mr. Person added for the record that he requested that the staff forego the presentations for Agenda Items 6, 7, and 8 as they were all his projects, there was no one present from the public, and they were similar requests. The Zoning Administrator agreed to his request. Action: Approved ITEM NO. 6 619 and 619 ½ Marguerite Tentative Parcel Map No. NP2017-011 (PA2017-110) Site Location: 619 and 619 ½ Marguerite Avenue Council District 6 Mr. Person acknowledged that he reviewed and agreed to the conditions of approval. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. ITEM NO. 7 418 and 418 ½ Fernleaf Tentative Parcel Map No. NP2017-013 and Coastal Development Permit No. CD2017-053 (PA2017-112) Site Location: 418 and 418 ½ Fernleaf Avenue Council District 6 Mr. Person acknowledged that he reviewed and agreed to the conditions of approval. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. ITEM NO. 8 435 Fernleaf Tentative Parcel Map No. NP2017-014 and Coastal Development Permit No. CD2017-052 (PA2017-113) Site Location: 435 Fernleaf Avenue Council District 6 Mr. Person acknowledged that he reviewed and agreed to the conditions of approval. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved E. PUBLIC COMMENTS ON NON-AGENDA ITEMS Mr. Person said that the agendas placed out for the public were for the September 14, 2017 meeting. Assistant Planner Whelan replied that the correct agenda was available. The Zoning Administrator noted that the Mr. Person might have mistaken the September 14, 2017 draft meeting minutes for the agenda. F. So I don't expect to be able to attend, but I do have these comments: Item III.1. Minutes of September 28, 2017: page 1, Item B: the first sentence says "Gregg Ramirez, Senior Planner, requested that this item be continued ..." without identifying what item. Shouldn't it say "Gregg Ramirez, Senior Planner, requested that Item 1 be continued ..."? I would also note that this request was likely accompanied by a written memo. However, none of the materials related to the presentation of this Item 1 from September 28, including the continuation notice, if any, have, at present, been preserved in the City's archive of the Zoning Administrator hearings that day: http://ecms.newportbeachca.gov/Web/0/fol/1231481/Row1.aspx I would suggest all the materials presented at the September 28 hearing be posted there, so both the City and the public have a complete and accurate record of what transpired. Item IV.1. Bengston Residence Coastal Development Permit No. CD2017-024: The latest request for continuance/tabling of this item says "The project is being re-designed to ensure the proposed home complies with applicable development standards." The fact that there may be doubt about the project's compliance is in curious juxtaposition to the "Project Summary" in the main staff report, which assures the Zoning Administrator and public that (as already designed) "The project complies with all applicable development standards." This vacillation, especially without any explanation of what, specifically, the compliance doubt is about, raises serious questions about the credibility of such assertions in future staff reports and Zoning Administrator resolutions. Item IV.3. Rooney Residence Coastal Development Permit No. CD2017-012: I think there is a Coastal Act issue, unaddressed here, related to the depletion of the already limited single family coastal housing stock created by the merging of the few coastal lots on which such housing is
