This AGREEMENT FOR DONATION OF SURPLUS PROPERTY ("Agreement") is made
Phis_J� day of 2018 ("Date ,of Donation") by .and between the CITY OF
NEWPORT BEACH forma municipal corporation and charter city ('City"), and the
CENTRAL BELL COUNTY FIRE/RESCUE DEPARTMENT, a 501(c)(.3) organization ("Donee").
It is agreed between the parties that:
1. City agrees to donate, and Donee agrees to accept the following described controlled surplus
property ("Property") valued at approximately $0. This Property is described in further detail
on the related Donation Authorization Form:
• 7 sets of Turnout Boots;
• 9 sets of Turnout Coats -,,and
a 11 sets of Turnout Pants.
Said Property is donated in "as is" condition and the City disclaims any warranty of
merchantability or worming order or condition -of the Property except that they shall be donated
in their present ,condition, City has not made any representations or warranties, implied or
express, :relating to the .condition of the Property.
3. The parties agree that the C4 will 'be released of all liability resulting from the use.
maintenance, storage or possession of the !Property effective upon the Date of Donation.
4. The City agrees to transfer the Property to the address of the Donee located at:
Central Bell County Fire & Rescue
100 North Main Street
Nolanv:ille, Texas 76559
5, This Agreement shall be binding and inure to the benefit of the parties. their successors,
assigns .and personal representatives.
IN WITNESS WHEREOF, the parties have caused this Agreement to be executed on the
dates written below.
