AMENDED AND RESTATED
MEMORANDUM OF LEASE
THIS AMENDED AND RESTATED MEMORANDUM OF LEASE ("Memorandum") is
entered into Ma -t c tn ZS` , 2002, between County of Orange ("COUNTY") and
Ted Christensen and Eve Christensen, Husband and Wife as community property ("TENANT")
I the purpose of recordation in order to give constructive notice of the existence of
A.) That certain undated, unrecorded Lease ("Lease") between the County of Orange and
William F. Power and Marlene Power, husband and wife, as (original) Tenant, and the
County of Orange; and
B.) Memorandum of Lease dated September 2, 1992, and recorded October 2, 1992, as
Document 92-667069 in Official Records of Orange County, California, wherein said
Lease was erroneously referenced as being dated September 2, 1992; and
C.) Assignment of Lease dated March 13, 1998, and recorded on May 15, 1998, as
Document 19980301690, in the County of Orange, California, whereby the Tenant
interest of William F. Power and Marlene Power, under said Lease, was assigned to
Ted Christensen and Eve Christensen, husband and wife as Community Property.
COUNTY AND TENANT NOW HEREBY AGREE to the following:
1. LEASE. On or about September 2, 1992, the County of Orange, as County, and
William F. Power and Marlene Power, husband and wife, as Tenant, entered into an undated and
unrecorded Lease ("Lease"), a Memorandum of Lease of which was recorded October 2, 1992,
26 as Document 92-667068 in Official Records of Orange County, California;

1 11 2. TENANT. The interest of William F. Power and Marlene Power, under said Lease,
2 was assigned to Ted Christensen and Eve Christensen, husband and wife as Community
3 Properly by that certain Assignment of Lease dated March 13, 1998, and recorded on May 15,
4 1998, as Document 19980301690, in the County of Orange, California; and
5 3. PREMISES. Pursuant to the terms of said Lease, COUNTY has leased to TENANT
6 that certain property referred to as "Premises," shown on "Exhibit A," attached hereto and by
7 reference made a part hereof, and described as those filled tidelands lying between the extension
8 of the sidelines of Lot 15 of Tract 802 from the adjudicated mean high tide line to the United
9 States bulkhead line, excepting therefrom those lands lying below the existing mean high tide
10 line. Use of the submerged "water covered" tidelands areas are not provided for therein.
11 4. USE. As more particularly defined in said Lease, TENANT has exclusive, private
12 enjoyment of the Premises for residential yard, landscaping and non -permanent recreational
13 purposes as an adjunct to the residence of that single family residence(s) that adjoins the
14 Premises, and can exclude public access during the term of the Lease, consistent with Chapter
15 11715, of the Statutes of 1984, State of California.
16 5. TERM. The term of said Lease commenced March 22, 1988, and shall continue
17 1 thereafter for a period of forty-nine (49) years.
18 6. RENT. Said Lease provides for payment of annual rent.
