To Whom it may concern. Start off and say that I hope you are all truly safe and healthy. As a native of Orange County and now a local resident of Newport Beach, I started a small business from scratch with 1 employee and grown it to numerous trucks and equipment and employ 19 men that all have families to provide for. I am a little frustrated by the actions of this removal. I have been on the franchise hauling list for quite some time now and have paid for the extra coverage of insurance and always reported my fees. My insurance broker said he has only seen this type of excessive coverage in railroad contracts, large government contracts at military bases or on large skyscraper jobs. NEVER for a small hauling company doing residential jobs. The cost per truckload in other cities is approx. $700. In Newport with this extra coverage is will be around $1500. Very hard to explain this to the residents and contractors who always want the best price and will go to a company that is cheaper, and not on this list.. It is basically screwing over your own residents. It is going to cost me approx. an extra $2,500 per month for this insurance. Not to mention all the collision avoidance systems I need to install. As a small business owner during these uncertain times it is causing great strain, sleepless nights trying to survive and pray that the economy can handle what is going on. I have had jobs cancel due to stock market reasons, kids at home and not wanting a house under construction, owners not wanting random workers in there homes, and all very understandable reasons. Furthermoreā€ž why is this just for trash hauling trucks? Why not cement trucks, landscape trucks, roofing trucks and all the other trades? Does not make sense. I would hope during a time of Federal, State and local emergencies that the city would have more important issues to discuss at there meetings. Morally and ethically I hope that you reconsider the removal of my company at this time or consider delaying it. At least let my try to survive through these uncertain times to help me provide for my family and employess the best I can. To not be able to work in Newport Beach will put me out of business as we do a fair amount of work here, but not enough to constitute paying for all this extra insurance. Good Afternoon, Regrettably, I was confused about the time of the City Council Meeting today. I believed the meeting started at 4PM. I just spoke with Mike from the City Managers IT office outside the Council Chamber. Mike informed me that with the special meeting being held today (I assume it's Covid related given the media outside) the schedule got scrambled. The agendas moved back. Mike informed me that the regular Council Meeting will start at 713M. I cannot stay to attend as I have two toddlers at home. Mike and Avery offered to call me when my opportunity to speak is called. I may, or may not, be able to answer depending on conditions with the two children. I will try to be available. In the absence of my appearance via phone, I respectfully request the Council suspend the termination action against CWS pending the City's verification of compliance with the collision avoidance requirement. All CWS waste collection vehicles are fully compliant with the exact specifications of the collision avoidance equipment requirement. CWS has met the increased insurance requirement, thus the risk exposure to the City is protected. Thank you for your consideration and have an enjoyable evening. Avery is aware I will need the WebEx portal provided outside the Council Chamber. CWS is fully compliant with the Non -Exclusive Franchise Agreement collision avoidance system requirement. The entire CWS fleet of waste collection vehicles is fully compliant. However, the proof of compliance has not yet been confirmed by the City. This can be accomplished by a visual inspection of any, or all, vehicles - or a declaration of compliance by the service provider - Zenduit. I will work in good faith with Keith and his team to complete this last verification step. I sincerely apologize to all City staff involved in this matter. To manage this piece of the Franchise Agreement non-compliance is not an efficient use of resources. CWS has been a licensed hauler and a CalRecycle Certified Construction and Demolition waste material recycler for the City of Newport Beach for over 20 years. During the two decades of partnership, CWS has timely paid all fees while never failing an audit. I have copied Giovanni Lopez, the CWS Compliance Manager, on this thread.
