HomeMy WebLinkAbout11 - Authorization to Issue Obligations by the California Municipal Finance Authority to Benefit Harbor Day School Project - Public HearingPUBLIC NOTICE CITY OF NEWPORT BEACH NOTICE OF PUBLIC HEARING PURSUANT TO SECTION 147(f) OF THE INTERNAL REVENUE CODE OF 1986, AS AMENDED, FOR THE FINANCING OF CERTAIN IMPROVEMENTS TO FACILITIES FROM THE ISSUANCE OF TAX-EXEMPT OBLIGATIONS NOTICE IS HEREBY GIVEN that at its regular meeting to be held on Tuesday, April 28, 2020, at 7:00 p.m., a public hearing will be conducted in the City Council Chambers of the City of Newport Beach (the "City") located at 100 Civic Center Drive, Newport Beach, California 92660, the City Council of the City of Newport Beach will conduct a public hearing as required by Section 147(f) of the Internal Revenue Code of 1986, as amended (the "Public Hearing") at which the City will hear and consider information concerning the proposed tax-exempt loans (the "Loans") by Farmers & Merchants Bank or such other to be determined lender (the "Lender") to the California Municipal Finance Authority or such other to be determined financing agency (the "Authority"), in a principal amount not to exceed Fifty Five Million Dollars ($55,000,000.00) pursuant to a loan agreement (the "Loan Agreement") among the Lender, the Authority and Harbor Day School (the "School"), a California nonprofit public benefit corporation and an organization described in Section 501(c)(3) of the Internal Revenue Code of 1986, as amended. The Authority will lend the proceeds of the Loans to the School to finance the costs of the demolition of the School's existing facilities and the construction of a new, approximately 100,000 square foot campus, which will include several buildings, and all associated design, engineering and planning costs related thereto, of a school commonly known as Harbor Day School, located at 3443 Pacific View Drive, Corona del Mar, California and related capital project costs (the "Facilities") and paying related expenses incurred with respect to the Loans (collectively, the "Project"). The owner and operator of the Facilities will be the School. The Loans will be paid entirely from repayments made by the School under the Loan Agreement. Neither the full faith and credit nor the taxing power, if any, of the City, the Authority, the State of California (the "State") or any other political corporation, subdivision or agency of the State is pledged to the payment of the principal of, premium, if any, or interest with respect to the Loans, nor shall the City, the Authority, the State, or any other political corporation, subdivision or agency of the State be liable or obligated to pay the principal of, premium, if any, or interest with respect to the Loans. The Project is categorically exempt from environmental review under the California Environmental Quality Act ("CEQA") pursuant to Section 15302 of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential to have a significant effect on the environment. The Project includes the demolition and reconstruction of an existing private school facility where the new structures will be located on the same site as the structures replaced and will have substantially the same purpose and capacity as the structures replaced. All interested parties may appear and present testimony in regard to this Project. If you challenge this Project in court, you may be limited to raising only those issues you raised at the public hearing or in written correspondence delivered to the City, at, or prior to, the public hearing. Administrative procedures for appeals are provided in the Newport Beach Municipal Code Chapter 20.64. The hearing may be continued to a specific future meeting date, and if such an action occurs additional public notice of the continuance will not be provided. Prior to the public hearing the agenda, staff report, and documents may be reviewed at the City Clerk's Office, 100 Civic Center Drive, Newport Beach, California, 92660 or at the City of Newport Beach website at www.newportbeachca.gov. All interested parties may participate in the hearing by calling the toll free telephone number (833) 920-1316 at 7:00 p.m. through and until the conclusion of the hearing. Individuals not able to attend or call in to the meeting during the meeting may contact the City Clerk or access the City's website after the meeting to review the action on this hearing.
