Leung, City Manager - 949-644-3001, gleung@newportbeachca.gov PREPARED BY: Tara Finnigan, Deputy City Manager, tfinnigan@newportbeachca.gov PHONE: 949-644-3035 TITLE: Professional Services Agreement with Carpi & Clay, Inc. for Federal Advocacy Services ABSTRACT: Staff recommends the City of Newport Beach enter into a professional services agreement with Carpi & Clay, Inc. for federal advocacy services. The firm was selected after a detailed Request for Proposals process. The recommended agreement is for an initial two-year term, with two optional one-year extensions, for a total not -to -exceed cost of $458,400, if the initial term and both extensions are exercised. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Approve the Professional Services Agreement with Carpi & Clay, Inc. of Washington, D.C., for federal advocacy services for an initial, approximately two-year term, ending December 31, 2022, with two optional one-year extensions and a total not to exceed amount of $458,400, and authorize the Mayor and City Clerk to execute the agreement. FUNDING REQUIREMENTS: The current adopted budget includes sufficient funding for this purchase. For Fiscal Year 2020-21, it will be expensed to the Aviation Issues account in the City Manager's Office budget, 01020001-811008 and to the Public Works Department budget, 010800005- 811008. 7-1 Professional Services Agreement with Carpi & Clay, Inc. for Federal Advocacy Services January 12, 2021 Page 2 DISCUSSION: Background The City of Newport Beach has retained federal advocacy consultants to help promote its legislative policy interests and elicit actions at the federal level on matters beneficial to the community. In recent years, the City has retained lobbyists to help advance its ocean and harbor dredging programs and projects, and to help secure funding via the Army Corps of Engineers to construct the federal dredging project in Newport Harbor. Lobbyists have also helped the City with its efforts to mitigate the aircraft noise and air quality impacts John Wayne Airport's operations have on a large section of the community. The City's agreements with its lobbying firms were set to expire at the end of 2020. The City Manager suggested the City Manager's Office and Public Works Department work together on a Request for Proposal process to determine if one firm could represent the City moving forward and, ideally, the City could realize some cost savings. Request for Proposals and Evaluation Staff developed a Request for Proposals (RFP) solicitation containing requirements and a scope of services detailing federal advocacy services with an emphasis on federal dredging programs within Newport Harbor and on aviation and airport matters. The RFP was published on September 22, 2020 when it was posted on the City's electronic public procurement platform, PlanetBids, and distributed directly to known consultants providing these services. The RFP submission deadline was October 20, 2020 and the process yielded eight (8) proposals. This RFP was evaluated in two phases. Phase 1, the Technical Evaluation, involved an evaluation panel consisting of staff from the City's Public Works Department and City Manager's Office reviewing each proposal and rating them on the following technical factors: • Qualifications and relative experience of the proposer, related to federal advocacy services; • Demonstrated understanding of the City's current dredging project; • Demonstrated understanding of the current community issues related to John Wayne Airport; and • Subject matter expertise and ability to perform the requested services. The RFP instructed proposers that only those proposals earning a minimum of 70% of the available points from Phase 1 would be eligible to advance to Phase 2, the Cost Evaluation, in which the City's Purchasing staff would compare and calculate the costs from each proposal. Of the total proposals received by the City, three (3) qualified to advance to the Cost Evaluation phase. Virtual interviews were also conducted with the finalists to augment the evaluation panel's findings. The results of the panel scoring can be found under the Technical Review section in the table below: 7-2 Professional Services Agreement with Carpi & Clay, Inc. for Federal Advocacy Services January 12, 2021 Page 3 Proposer Alcalde & Fay Carpi & Clay Clark Hill Phase 1: Technical Review -Proposal Review 55.92 64.35 61.40 Maximum 70.00 Phase 2: Cost Review 30.00 28.71 30.00 Maximum 30.00 ($10,000 Retainer) ($10,450 Retainer) ($10,000 Retainer) Total Score 85.92 93.06 91.40 Maximum 100.00 Overall Rank 3 1 2 The RFP asked proposers to provide an all-inclusive, fixed -fee monthly retainer for services rendered. In Phase 2 (the Cost Evaluation) of the RFP evaluation, Purchasing staff compared the proposed monthly retainers from each of the finalists and assigned points to each proposer wherein the proposal with the lowest retainer cost would receive the maximum of 30 points and each subsequent proposal would receive a number of points proportional to the difference in retainer cost. The results of the Cost Evaluation can be found in the Cost Review section in the table above. Despite proposing a slightly higher retainer than the other finalists, Carpi & Clay was ranked by the evaluation panel as the top-rated proposer for federal advocacy services based on the content of its proposal, which outlined the depth and breadth of its lobbyists' experience and contacts, and the interview staff conducted with the firm's lead consultants. During the interview, the consultants demonstrated not only their understanding of the City's projects and programs, but importantly, they discussed recommended next steps for securing federal funding for the dredging of Lower Newport Harbor and how the City could work with Congress in its new session on incentivizing airlines to invest in quieter, more environmentally friendly aircraft. Carpi & Clay has provided federal advocacy services to the City's Public Works Department and currently represents several cities on a variety of federal legislative and regulatory issues. The firm has developed relationships with Members of the California Congressional delegation, Members of Congress, Congressional Committees and staff within federal agencies, including the Department of Transportation (DOT), the Federal Aviation Administration (FAA), the Army Corps of Engineers (Corps) and the Environmental Protection Agency. The firm's lead lobbyists for the City's projects would be Julie Minerva and Channon Hanna. Ms. Minerva has helped her clients secure nearly a billion dollars for infrastructure projects, such as levees, dams, navigation channels and environmental restoration projects. She has extensive contacts throughout the Corps, from the Office of the Assistant Secretary of the Army for Civil Works to the Corps district level. 7-3 Professional Services Agreement with Carpi & Clay, Inc. for Federal Advocacy Services January 12, 2021 Page 4 Ms. Hanna has an extensive background in airports and aviation matters, including having worked on the Senate Aviation Subcommittee. She has a wide range of contacts in DOT, FAA, and the Office of Management and Budget. Ms. Hanna has also assisted the City with its aviation -related federal advocacy through her prior work with another firm. The technical ranking of Carpi & Clay reflects the firm's well-rounded expertise on the City's areas of federal advocacy need. Conclusion Staff entered into negotiations with Carpi & Clay that generated cost savings in the form of a revised monthly retainer of $9,550, which is reflected in the final agreement (Attach ment). This represents a savings of $450 per month when compared to the collective costs for the current consultant engagements for advocacy efforts for dredging and airport and aviation matters. Staff believes Carpi & Clay has the expertise and experience to best guide the City's federal advocacy efforts and therefore recommends approval of the professional services agreement. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
