Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Tom Sandefur, Assistant City Engineer tsandefur@newportbeachca.gov PHONE: 949-644-3321 TITLE: 2019-2020 Tidegate Improvement Project — Notice of Completion for Contract No. 7464-1 (19F03) ABSTRACT: On March 10, 2020, the City Council awarded Contract No. 7464 for the 2019-2020 Tidegate Improvement Project to T.E. Roberts, Inc. of Anaheim, California. The total contract award was $197,601.00 plus a $19,399.00 allowance for contingencies. The required work is now complete and staff requests the City Council accept the completed work and close out of the contract. RECOMMENDATION: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project; b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice of Completion has been recorded in accordance with applicable portions of Civil Code; and c) Release Faithful Performance Bond one year after acceptance by the City Council. A summary of the contract construction costs are as follows: Original bid amount: $197,601.00 Actual Cost of Bid Items Constructed: $197,601.00 Total Change Orders: $ 6,087.39 Final contract cost: $203,688.39 There was one change order totaling $6,087.39. This amounted to 3.1 percent of the original contract amount and was within the contingency allowance. The change order included the installation of an electric panel and control box at the 19t" Street and Balboa Boulevard location. A summary of the project schedule milestones is as follows: Project Awarded for Construction March 10, 2020 Notice to Proceed May 27, 2020 Estimated Completion Date per Baseline Schedule October 6, 2020 Contract Completion Date with Approved Extensions December 15, 2020 Actual Substantial Construction Completion Date December 7, 2020 The completion of construction was delayed by 40 days due to delivery issues with tidegate stems. In addition, unfavorable weather and tides caused unsafe conditions for the tidegate installations. ENVIRONMENTAL REVIEW: On March 10, 2020, the City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) , of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. 6-2 2019-2020 Tidegate Improvement Project — Notice of Completion of Contract No. 7464-1 (191`03) February 9, 2021 Page 3 NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
