An unreasonable hardship exists where the cost of providing an accessible entrance, path of travel, sanitary
facilities, public phones, drinking fountains, etc. exceeds 20% of the cost of project without these features.
The actual work of the project must comply with current code and an additional amount equal to at least 20%
of the cost of the project must be spent to improve required accessibility features that are not in compliance
with current code.
In choosing which accessible elements to provide, priority should be given to those elements that will provide
the greatest access, in the following order: 1) An accessible primary entrance; 2) An accessible route to the
altered area; 3) At least one accessible restroom for each sex; 4) Accessible public telephones (when
provided); 5) Accessible drinking fountains (when provided); 6) When possible, additional accessible
elements such as additional parking, storage and alarms.
To request an unreasonable hardship, complete the attached worksheet, and prepare a site and floor
plan of the existing and proposed accessibility improvements. This information must be submitted to
the Building Division in duplicate, prior to processing a permit application. One copy of the approval or denial
will be returned to the applicant.
For projects exceeding the valuation threshold of $170,466, a hardship approval can only be obtained
through a ratification application and hardship application.
The $170,466 is based on $50,000 in 1981 dollars as of January 1, 2020.

Due to the additional Plan Check corrections regarding the automatic door operator and increased costs,
my client has elected to try to relocate the existing door so that it is flush with the outside of the adjacent
brick piers. That will bring the front door into compliance in terms of strike side clearances on both sides
of the door.
In addition, we will remove the existing iron bars and install an ADA compliant door pull, ADA decal to
indicate accessibility and a sign above the door to indicate the door should remain unlocked during
business hours.
As a result, we have attached revised drawings and a revised Unreasonable Hardship form detailing this
request.

Per our phone conversation. The plan you sent to me included specification for the door head hardware but not for the button itself. Please provide
specifications and detail information on the plans to show complete compliance with 11B-404.2.9, exception, including:
a. Powered doors shall comply with Builders Hardware Manufacturers' Association (BHMA) A156.10 or low energy operated doors complying with
BHMA A156.19.
b. Powered doors shall be controlled on both the interior and exterior sides of the doors with two push plates or a vertical actuation bar. For push
plates the centerline of one push plate shall be 7 -inches minimum and 8 -inches maximum above the floor or ground surface and the centerline
of the second push plate shall be 30 -inches minimum and 44 -inches maximum above the floor or ground surface. For vertical actuation bars
the operable portion shall be located so the bottom is 5 -inches maximum above the floor or ground surface and the top is 35 -inches minimum
above the floor or ground surface and be a minimum of 2 -inches wide.
c. Each push plate shall be a minimum of 4 -inches diameter or a minimum of 4 -inches by 4 -inches and shall display the International Symbol of
Accessibility.
Additionally both the door and the controls must meet the maneuvering clearance requirements of the code. Show all clear spaces on the floor plan.
Maneuvering clearances at power -assisted doors and gates shall comply with Section 11 B-404.2.4. Clearances at automatic doors and gates without
standby power and serving an accessible means of egress shall comply with Section 11 B-404.2.4 or shall remain open in the power off position [11 B-
404.3.21. Manually operated controls shall comply with Section 11 B-309. The clear floor space adjacent to the control shall be located beyond the arc
