Subject: Gastlin v. City of Newport Beach, E1 Monte Judicial
District, Municipal Court case No. G11505
The above action was filed in the Municipal Court of the E1
Monte Judicial District by Frank E. Gastlin against the City
of Newport Beach, Mr. Gastlin does business under the firm
name of Royal Pipeline Construction Company and had a contract
with Newport Beach for water main construction. A claim was
filed by Royal Pipeline in April, 1964. A memorandum directed
:. the City Council from the City Attorney was recently written
recommending that the claim be denied. This action is based
upcm that same claim.
It is recommended that the action, be referred to the City At-
torney and that he be authorized and directed to take such
action as may be necessary to defend the City.

Comes now the plaintiff and for cause of action alleges:
I
Plaintiff, at all times mentioned herein, was, and now is,
a contractor licensed by the State of California to perform all of
the work undertaken by him as hereinafter set forth; plaintiff has
conducted his business operations under the firm name of Royal Pipe-
line Construction Co., and he has filed the certificate and publish
the notice required by Civil Code ; 12466 and 2468.
II
City of Newport Beach at all.times herein mentioned has be
and now is, a municipal corporation.
III
On May 29, 1963, plaintiff and defendant executed a con-
tract in writing whereby plaintiff, as contractor, agreed to coast
certain public .improvements as more fully described therein.

formed by him under the said contract under the supervision and in-
spection of representatives of the defendant; all of the said work
was - completed by plaintiff and was accepted in the field by defen-
dant's representatives on October 15, 1963.

Defendant refused to accept the work or pay plaintiff the
balance of the funds earned by plaintiff under the said contract un-
less certain trench patching was repaired by plaintiff; the refusal
of defendant to accept the work and to pay plaintiff for the work
performed unless additional work by way of trench patching was per-
formed by plaintiff constituted a breach of defendant's obligation
under the said contract.

Plaintiff, to obtain release of the sum of $99463.82 being
withheld by defendant, notified defendant that the trench patching
work would be performed under protest and that he would look to de-
fendant for payment for the said work performed under protest; plai
tiff thereafter performed the said trench patching work demanded by
defendant; that the cost of performing the said work is the sum of
$3, 249.77; that the trench patching work was completed on January 9,
1964; plaintiff is entitled to interest at the rate of 7% per annum
upon the said sum of $3.249.77 from January 9, 1964, until the said
sum is paid.
VII
Prior to the commencement of this action, namely on April
239 1964, within the time permitted by law, and in accordance with
all requirements therefor, plaintiff gave notice to defendant of its
claim pursuant to the provisions of Government Code ; §900- 935.6.
VIII
Defendant failed to act upon the claim of plaintiff within
35 days after the same was presented, and is deemed to have been
denied by defendant pursuant to the provisions of Government Code \

Subject-. Report recommending denial of claim for damages of
the Royal Pipeline Construction Company
On May 13, 1963, the City Council awarded a contract for water main
construction in Balboa Boulevard, Lafayette Avenue, and West Coast
Highway to Frank Ea Gastlin, doing business as the Royal Pipeline
Construction Company,
From an examination of the file and discussion with Public Works
personnel, the facts appear to be-. The work called for in the
contract was completed on October 9, 1963. On November 11, 1963,
prior to acceptance of the work by the City Council, the Public
Works Department became aware of excessive cracking of concrete
trench patches in Balboa Boulevard and in Lafayette Avenue. During
the ensuing weeks the cracking appeared to worsen and on December
12, 1963, a letter was sent by the Public Works Department to the
contractor advising him that the trench patches would have to be
repaired at the contractor's expense before the work would be ac-
cepted by the City. The contractor was also advised that the
City would retain the final 10% completion payment for the work
until the trench patches were repaired; After further discussion
between representatives of the contractor and the Public Works
Department, the contractor agreed to make the necessary repairs
under protest while reserving his right to assert a claim against
the City for the costs of such repairs, The repair work consisted
of removal of the defective paving from the areas where subsidence
had occurred, adding additional backfill material, compacting the
backfill material, and repaving said areas, The completed proj-
ect, including the repairs, was subsequently accepted by the City
Council and a notice of completion filed,
The contractor has filed a claim for damages against the City in
the amount of $3,249077 which includes the cost of the trench
repair work plus 15% for overhead and profit. In addition, the
contractor is claiming 7% interest on the above amount commencing
on January 9, 1964, the date on which the trench repair work was
completed,

The contractor disclaims responsibility for the trench repair work
on the grounds that the original work fully complied with the
plans and specifications for the project and that he had not under-
taken to guarantee that the work would be satisfactory. The con-
tractor also contends that the original work was approved by the
City °s inspector, thus relieving the contractor of responsibility.
From a review of the Standard Specifications, the opposite conclu-
sion appears justified.
to Section 16 -07 of the Standard Specifications concerning trench
backfill requires that all backfilling be done in such a manner as
to a0insure work against subsequent settlement ". It is also re-
quired that ponding and jetting methods of compaction shall be
supplemented by the use of vibratory or other compaction equipment
when necessary to obtain the required compaction. The amount of
trench settlement which occurred indicates that these requirements
were not complied with.
20 As stated in Section 5 -08 of the Standard Specifications, the
presence or absence of the City inspector at the job site does not
relieve the contractor of his obligation to fulfill the terms of
the contract, It is not City policy to maintain continual inspec-
tion at all job sites as this is not an economical use of manpower.
In addition, since an end result was specified in the contract, the
City inspector did not comment on the adequacy of particular com-
paction methods used.
It is recommended that the claim be denied,

Gentlemen:

Pursuant to the requirements of § 5900 -935.6 of the
Government Code, this letter is submitted as a claim on
behalf of Frank E. Gastlin doing business as Royal Pipeline
Construction Co. This claim amends and corrects the claim
dated February 24, 1964 previously filed with your office
on February 25, 1964. The following information is fur-
nished pursuant to the requirements of §910 of the Govern-
ment Code:
(a) Name and post office address of claimant: Frank
E. Gastlin doing business as Royal Pipeline Construction Co.
11335 Thienes Avenue, E1 Monte, California.
(b) Post office address to which notices are to be
sent: Royal Pipeline Construction Co., c/o Grant & Popovich,
8654 Wilshire Boulevard, Beverly Hills, California.
(c) Date, place and other circumstances of the
occurrence or transaction which give rise to this claim are
as follows:
Frank E. Gastlin doing business as Royal Pipeline
Construction Co., hereinafter referred to as "Royal ",
submitted the low competitive bid for the work in-
volved under a contract with the City of Newport Beach,
hereinafter referred to as "City ", identified as follows:
Water Main Construction in Balboa Boulevard, Coast
Highway and Layfayette Avenue (C -838). The City of
Newport Beach on May 29, 1963, awarded a contract to

Royal for the performance of the work. The work
was performed by Royal in accordance with all con-
tract requirements. The work was completed on
October 15, 1963, and was accepted in the field by
the representatives of the City charged with this
responsibility. The City was then and there obligated
to accept the work and pay Royal the full contract
price. Despite the obligation of the City to accept
and pay for the work performed by Royal, the repre-
sentatives of the City charged with the responsibility
of requesting formal acceptance of the work failed
to do so. Royal did not know of the failure of the
representatives of the City to request formal accept-
ance of the work until Royal called the said represen-
tatives after expiration of the 45 day period provided
by the agreement between the parties for final payment
to the contractor. At that time Royal was advised
for the first time that the City had failed to give
formal acceptance of the work. Royal was further
advised that the City would refuse to accept the work
and would further refuse to release to Royal the sum
of $9,463.82 representing the retention withheld by
the City until certain trench patching would be re-
paired. Royal disclaimed any responsibility for the
trench patching on the ground that it had complied
with all contract requirements, and the performance
of the work demanded by the City as a condition of re-
leasing funds earned by the contractor was a breach
of the agreement under which the work was done. On
December 12, 1963, the City advised Royal by letter
that the City Council of the City of Newport Beach
would not accept the work performed by Royal unless
the trench patching work would be performed. Royal,
after conferences with representatives of the City
during which Royal attempted to have the work accepted
by the City in accordance with its contract obligation,
notified the City by a letter dated January 3,.1964,
sent by counsel for Royal,Grant & Popovich, that the
trench patching work would be performed under protest
and that Royal would look to the City for all damage
sustained by reason of the wrongful refusal of the
City to accept and pay for the work performed by
Royal under the contract.
(d) General description of the damage or loss incurred:
Royal removed the paving installed by it in
those areas which had been designated by the repre-
sentatives of the City as requiring repair as a con-
dition of accepting the work as a whole, brought in

additional backfill material, compacted the backfill
material, and re -paved the areas. All of this work
was performed under protest as indicated in the
letter from Royal to the City dated January 3, 1964,
and in accordance with verbal protests which had pre-
viously been made by Royal.
(e) Amount claimed and basis of computation:
The cost of performing the trench repair work,
together with an amount equal to 15% for overhead and
profit as permitted by the contract documents in the
case of extra and force account work, is the sum of
$3,249.77.
In addition to the damage described hereinabove, Royal
is further entitled to interest at the rate of 7% per annum
upon the cost of performing the repair work, namely $3,249.77
from the date that the trench repair work was completed on
January 9, 1964, until the said amount is paid.

I. SCOPE OF WORK
THE WORK CONSISTS OF FURNISHING ALL LABOR, MATERIAL, EQUIPMENT AND TRANSPOR-
TATION NECESSARY TO CONSTRUCT THE WATER MAINS AND APPURTENANCES AS SHOWN ON THE
CITY OF NEWPORT BEACH DRAWING NO. W- 5OO$ -S AND TO COMPLETE ALL NECESSARY IN-
CIDENTAL WORK AS SHOWN ON THE PLANS AND IN ACCORDANCE WITH THE STANDARD DRAW -
INGS, STANDARD SPECIFICATIONS, AND THESE SPECIAL PROVISIONS OF THE CITY OF
NEWPORT BEACH.
2. TIME Of COMPLETION
THE CONTRACTOR SHALL DiL;GCNTLY PROSECUTE THE WORK TO COMPLETION WITHIN
120 CALENDAR. DAYS.AFTER DATE OF EXECUTION OF THE CONTRACT BY THE CITY.
3. WORK SCHEDULE
THE ENGINEER RESERVES THE RIGHT TO DETERMINE THE ORDER IN WHICH THE VARIOUS
LINES SHALL BE SCHEDULED FOR CONSTRUCTION.
4. PIPING MATERGALS
ALL WATER MAINS SHALL BE ASBESTOS CEMENT WATER PIPE CONFORMING TO THE RE-
QUIREMENTS OF SECTION 19 -02 (1) OF THE STANDARD SPECIFICATIONS. SECTION 7 -06,
DOMESTIC MATERIALS, OF THE STANDARD SPECIFICATIONS SHALL NOT APPLY TO ASBESTOS
CEMENT PIPE WHICH MAY BE OF FOREIGN MANUFACTURE.
PRIOR TO DELIVERY OF ANY ASBESTOS CEMENT PIPE TO THE JOB, THE CONTRACTOR
SHALL SUPPLY THE ENGINEER WITH A CERTIFICATE THAT THE PIPE COMPLIES WITH THE
SPECIFICATIONS. THE METHOD OF IDENTIFICATION AND OF DELIVERY OF THE PIPE SHALL
BE SUCH THAT IT CAN BE READILY ASCERTAINED THAT THE SAME PIPE WHICH HAS BEEN
CERTIFIED IS THAT WHICH IS DELIVERED TO THE JOB SITE.
CERTIFICATION OF THE PIPE IS TO BE DONE BY A RECOGNIZEDy REPUTABLE, IN-
DEPENDENT TESTING LABORATORY APPROVED BY THE ENGINEER. THIS LABORATORY MUST BE
BASED IN THE UNITED STATES EVEN THOUGH THE TESTING OPERATION MAY.BE CONDUCTED
BY AN OVERSEAS BRANCH OR SUBSIDIARY. IT IS NOT NECESSARY THAT THE PIPE BE
TESTED IN THE UNITED STATES EXCEPT FOR THE PRESSURE TEST AFTER INSTALLATION
DESCRIBED IN SECTION 19 -08 OF THE STANDARD SPECIFICATIONS. SEE SECTION 6, PIPE
JOINTS, OF THESE SPECIAL PROVISIONS FOR ADDITIONAL REQUIREMENTS FOR PIPE.
5. VALVES AND FITTINGS
ALL VALVES AND FITTINGS SHALL CONFORM TO THE REQUIREMENTS OF THE STANDARD
SPECIFICATIONS EXCEPT THAT NO CAULKED JOINTS WILL BE PERMITTED WITH ASBESTOS
CEMENT PIPE. VALVE AND FITTING ENDS SHALL BE OF THE RUBBER RING TYPE EXCEPT AS
OTHERWISE SPECIFIED OR SHOWN ON THE PLANS. ALL DEAD -END FLANGED OUTLETS SHALL
BE EQUIPPED WITH A BLIND FLANGE.

6. PIPE JOINTS
THE PIPE USED MUST BE SUCH THAT IT IS POSSIBLE TO CONNECT TO THE STANDARD
VALVE AND FITTING ENDS WITH A STANDARD RING -TITE RUBBER RING GASKET. NO SPECIAL
ADAPTORS WILL BE ALLOWED. DRAWINGS SHOWING DETAILS, DIMENSIONS, AND CLEARANCES OF
ANY TYPE JOINT OTHER THAN RING -TITE OR FLUID -TITE SHALL BE SUBMITTED TO THE
ENGINEER FOR APPROVAL. THESE DRAWINGS SHALL COVER BOTH THE PIPE COUPLINGS AND THE
CONNECTIONS TO VALVES AND FITTINGS. SEE SECTION 9 OF THESE SPECIAL PROVISIONS FOR
EXCEPTIONS REGARDING CONNECTION TO EXISTING MAIN.
7. FIRE HYDRANTS
FIRE HYDRANT INSTALLATIONS SHALL CONFORM TO THE REQUIREMENTS OF THE STAND -
ARD SPECIFICATIONS AND OF STANDARD DRAWING STD -501 -L EXCEPT AS INDICATED BELOW.
IN ORDER TO FACILITATE TESTING AS CONSTRUCTION PROCEEDS, IT WILL BE PERMIS-
SIBLE, AT THE CONTRACTORS OPTION, TO USE A TEE IN THE MAIN WITH THE SIDE OUTLET
FLANGED, A FLANGED CAST IRON SPOOL, AND A FLANGED GATE VALVE FOR THE FIRE HYDRANT
CONNECTION IN LIEU OF THE DETAIL SHOWN ON THE STANDARD DRAWING-
THE PRICE PAID PER FIRE HYDRANT INSTALLED SHALL INCLUDE STAND PIPE, PIPE
CONNECTOR, AND ANCHOR BLOCK., ALL IN ACCORDANCE WITH STD - 501 -L. SEPARATE,PAYMENT
WILL BE MADE FOR THE PIPE AND THE VALVE LEADING FROM MAIN TO FIRE HYDRANT.
8. SALVAGE OF EXISTING FACILITIES
THE EXISTING VALVES AND FIRE HYDRANTS SHALL BE CAREFULLY REMOVED OR REPLACED
AS SHOWN ON THE PLANS AND'SHALL BE DELIVERED TO THE CITY CORPgRATION YARD AT
592.SUPFRIOR AVENUE, NEWPORT BEACH, CALIFORNIA. -
9. CONNECTIONS TO EXISTING MAINS
UNLESS OTHERWISE fNDICATED ON THE PLANS, CONNECTIONS TO EXISTING MAINS SHALL
BE MADE BY MEANS OF A SMITH -BLAIR CAST COUPI.ING. CONNECTIONS BETWEEN NEW MAINS
AND EXISTING LATERAL MAINS SHALL HAVE ALL FLANGED JOINTS BETWEEN THE NEW MAIN_
AND THE VALVE WHEN A NEW VALVE IS CALLED FOR ON THE PLANS.
THE CONTRACTOR SHALL INFORM THE ENGINEER TWO-DAYS IN ADVANCE WHERE IT WILL
BE NECESSARY TO SHUT DOWN ANY PORTION OF THE EXISTING SYSTEM IN ORDER TO CON-
NECT THE NEW MAIN-
10. CASED CROSSING
THE CASED CROSSINGS SHALL BE CONSTRUCTED BY A JACKING OR BORING METHOD IN
ACCORDANCE WITH SECTION 16 -13 OF THE STANDARD SPECIFICATIONS.
11. EXISTING UTILITIES
THE LOCATION OF'EXISTING UTILITIES AS SHOWN ON THE PLANS IS APPROXIMATE ONLY
AND IS INDICATED SOLELY FOR THE CONTRACTORS INFORMATION. THE CITY DOES NOT
GUARANTEE THE PRESENCE OR ABSENCE OF UTILITIES IN ANY LOCATION. IT WILL BE THE
CONTRACTOR'S RESPONSIBILITY TO LOCATE AND UNCOVER THE EXISTING UTILITY LINES
SUFFICIENTLY IN ADVANCE-OF THE WORK TO DETERMINE THEIR EXACT LOCATIONS AND TO
WORK AROUND THE UTILITIES AT HIS OWN EXPENSE-

12. SERVICES
THE CONTRACTOR SHALL NOT RE- INSTALL SERVICES UNTIL THEE MAIN PIPE HAS SUCCESS-
FULLY PASSED THE LEAKAGE TEST AS SPECIFIED IN SECTION 19 —OS OF THE STANDARD
SPECIFICATIONS.
THE CONTRACTOR SHALL RECONNECT ALL EXISTING WATER SERVICES TO THE NEW MAIN.
THE PRICE PAID PER WATER SERVICE RECONNECTION SHALL INCLUDE FULL COMPENSATION
FOR DISCONNECTING SERVICE FROM OLD MAIN AND INSTALLING NEW PIPE TO NEW MAIN
COMPLETE IN PLACE. THE CITY WILL PROVIDE AND INSTALL NEW METERS AS REQUIRED.
13o MEASUREMENT AND PAYMENT
THE PIPE LENGTHS SHALL BE MEASURED AS FOLLOWS:
1. CENTERLINE OF COUPLING TO CENTERLINE COUPLING AND/OR VALVE
2. CENTERLINE OF VALVE TO CENTERLINE OF VALVE)
3. CENTERLINE OF VALVE TO CENTERLINE OF FIRE HYDRANT.
THE PRICE PAID PER LINEAL FOOT OF WATER MAIN SHALL INCLUDE FULL COMPENSA-
TION FOR WATER MAIN IN PLACE INCLUDING EXCAVATION, _INSTALLATION OF PIPE AND
FITTINGS, BACKFILL, AND THE RESTORATION OF EXISTING SURFACE IMPROVEMENTS IN
ACCORDANCE WITH THE REQUIREMENTS OF THE STANDARD SPECIFICATIONS, AND THE CON-
NECTION OF ALL EXISTING MAINS TO THE NEW MAIN.
14. SEWER CROSSINGS
WHERE THE WATER MAIN TRENCH CROSSES EXISTING SEWERS, THE CONTRACTOR WILL
PROVIDE FOR THE CONTINUOUS FLOW OF SEWAGE IN BOTH MAIN SEWERS AND 'HOUSE SEWERS.
SEWAGE WILL NOT BE PERMITTED TO ENTER THE WATER MAIN TRENC1I.AT ANY TIME.
THE CONTRACTOR SHALL REPLACE ALL SEWERS DAMAGED DURING CONSTRUCTION. NO
SEPARATE PAYMENT SHALL BE MADE, AND THE COST FOR ALL WORK NECESSARY IN PRO-
TECTING, MOVING, OR REPLACING THE SEWERS SHALL BE INCLUDED IN THE UNIT PRICE
BID FOR THE WATER MAIN PIPE IN PLACE.
15. TEMPORARY PAVEMENT REPLACEMENT
THE CONTRACTOR SHALL INSTALL TEMPORARY PAVEMENT IN THE TRENCH AT STREET
INTERSECTIONS, AND AS DIRECTED BY THE ENGINEER. THE TEMPORARY PAVEMENT SHALL
CONSIST OF BITUMINOUS SURFACING, 1 INCH THICK MINIMUM.
THE PRICE PAID PER LINEAL FOOT OF TEMPORARY PAVEMENT IN TRENCH SHALL IN-
CLUDE FULL COMPENSATION FOR THE BITUMINOUS SURFACING IN PLACE.
16. GUARANTEE
THE CONTRACTOR SHALL GUARANTEE FOR A PERIOD OF ONE YEAR AFTER ACCEPTANCE OF
THE CONTRACT ALL MATERIALS AND WORKMANSHIP AGAINST ANY DEFECTS WHATSOEVER.
ANY SUCH DEFECTS SHALL BE IMMEDIATELY REPAIRED AT THE CONTRACTORS EXPENSE.
17. MAINTAINING TRAFFIC
ONE LANE OF TRAFFIC IN EACH DIRECTION SHALL BE MAINTAINED AT ALL TIMES
IN BALBOA BOULEVARD. THE WORK IN LAFAYETTE AVENUE SHALL BE SO CONDUCTED THAT
ONE LANE OF TRAFFIC CAN BE MAINTAINED ALONG THE LINE OF THE WORK.

18. LAFAYETTE AVENUE CONSTRUCTION pp
THE CONTRACTOR SHALL CONNECT THE.NEW 12" MAIN AT 28TH STREET AND LAFAYETTE
AVENUE TO THE EXISTING 16" MAIN WITH A TAPPING SLEEVE AND VALVE. THE VALVE IS
TO BE INSTALLED IN THE HORIZONTAL POSITION. THE VALVE SHALL BE EQUIPPED WITH
BEVEL GEARING, VERTICALLY RISING STEM) STANDARD BOX, AND COVER TO ENABLE
OPENING AND CLOSING OF VALVE FROM THE STREET LEVEL.
THE CONTRACTOR SHALL CONNECT THE EXISTING 8° C. 1. MAIN IN LIDO PARK
DRIVE TO THE NEW MAIN BETWEEN THE HOURS Of 12:.00 A.M. TO 4:00 A.M., INCLU-

19. WEST COAST HIGHWAY CONSTRUCTION
THE CONTRACTOR SHALL COMPLY WITH ALL REQUIREMENTS OF THE STATE ENCROACH-
MENT PERMIT AND'THE STATE INSPECTOR.

VICE BY SEPTEMBER 3, 1963. THE WORK APPEARED TO BE COMPLETE ON OCTOBER % 1963; HOWEVER,

Subject- Report recommending denial of claim for damages of
the Royal Pipeline Construction Company
On May 13, 1963, the City Council awarded a contract for water main
construction in Balboa Boulevard, Lafayette Avenue, and West Coast
Highway to Frank E. Gastlin, doing business as the Royal Pipeline
Construction Company,
From an examination of the file and discussion with Public Works
personnel, the facts appear to be- The work called for in the
contract was completed on October 9, 1963. On November 11, 1963,
prior to acceptance of the work by the City Council, the Public
Works Department became aware of excessive cracking of concrete
trench patches in Balboa Boulevard and in Lafayette Avenue, During
the ensuing weeks the cracking appeared to worsen and on December
12, 1963, a letter was sent by the Public Works Department to the
contractor advising him that the trench patches would have to be
repaired at the contractor's expense before the work would be ac-
cepted by the City. The contractor was also advised that the
City would retain the final 10% completion payment for the work
until the trench patches were repaired. After further discussion
between representatives of the contractor and the Public Works
Department, the contractor agreed to make the necessary repairs
under protest while reserving his right to assert a claim against
the City for the costs of such repairs. The repair work consisted
of removal of the defective paving from the areas where subsidence
had occurred, adding additional backfill material, compacting the
backfill material, and repaving said areas, The completed proj-
ect, including the repairs, was subsequently accepted by the City
Council and a notice of completion filed.
The contractor has filed a claim for damages against the City in
the amount of $3,249.77 which includes the cost of the trench
repair work plus 15% for overhead and profit. In addition, the
contractor is claiming 7% interest on the above amount commencing
on January 9, 1964, the date on which the trench repair work was
completed.

The contractor disclaims responsibility for the trench repair work
on the grounds that the original work fully complied with the
plans and specifications for the project and that he had not under-
taken to guarantee that the work would be satisfactory. The con-
tractor also contends that the original work was approved by the
City's inspector ,,, thus relieving the contractor of responsibility,
From a review of the Standard Specifications, the opposite conclu-
sion appears justified.
1. Section 16 -07 of the Standard Specifications concerning trench
backfill requires that all backfilling be done in such a manner as
to tl0insure work against subsequent settlement ". It is also re-
quired that ponding and jetting methods of compaction shall be
supplemented by the use of vibratory or other compaction equipment
when necessary to obtain the required compaction, The amount of
trench settlement which occurred indicates that these requirements
were not complied with,
20 As stated in Section 5 -08 of the Standard Specifications, the
presence or absence of the City inspector at the job site does not
relieve the contractor of his obligation to fulfill the terms of
the contract, It is not City policy to maintain continual inspec-
tion at all job sites as this is not an economical use of manpower,
In addition, since an end result was specified in the contract, the
City inspector did not comment on the adequacy of particular com-
paction methods used,

Gentlemen:
Pursuant to the requirements of 5§900 -935.6 of the
Government Code, this letter is submitted as a claim on
behalf of Frank E. Gastlin doing business as Royal Pipeline
Construction Co. This claim amends and corrects the claim
dated February 24, 1964 previously filed with your office
on February 25, 1964. The following information is fur-
nished pursuant to the requirements of §910 of the Govern-
ment Code:
(a) Name and post office address of claimant: Frank
E. Gastlin doing business as Royal Pipeline Construction Co.,
11335 Thienes Avenue, E1 Monte, California.
(b) Post office address to which notices are to be
sent: Royal Pipeline Construction Co., c/o Grant & Popovich,

submitted the low competitive bid for the work in-
volved under a contract with the City of Newport Beach,
hereinafter referred to as "City ", identified as follows:

Newport Beach on May 29, 1963, awarded a contract to

Royal for the performance of the work. The work
was performed by Royal in accordance with all con-
tract requirements. The work was completed on
October 15, 1963, and was accepted in the field by
the representatives of the City charged with this
responsibility. The City was then and there obligated
to accept the work and pay Royal the full contract
price. Despite the obligation of the City to accept
and pay for the work performed by Royal, the repre-
sentatives of the City charged with the responsibility
of requesting formal acceptance of the work failed
to do so. Royal did not know of the failure of the
representatives of the City to request formal accept-
ance of the work until Royal called the said represen-
tatives after expiration of the 45 day period provided
by the agreement between the parties for final payment
to the contractor. At that time Royal was advised
for the first time that the City had failed to give
formal acceptance of the work. Royal was further
advised that the City would refuse to accept the work
and would further refuse to release to Royal the sum
of $9,463.82 representing the retention withheld by
the City until certain trench patching would be re-
paired. Royal disclaimed any responsibility for the
trench patching on the ground that it had complied
with all contract requirements, and the performance
of the work demanded by the City as a condition of re-
leasing funds earned by the contractor was a breach
of the agreement under which the work was done. on
December 12, 1963, the City advised Royal by letter
that the City Council of the City of Newport Beach
would not accept the work performed by Royal unless
the trench patching work would be performed. Royal,
after conferences with representatives of the City
during which Royal attempted to have the work accepted
by the City in accordance with its contract obligation,
notified the City by a letter dated January 3, 1964,
sent by counsel for Royal,Grant & Popovich, that the
trench patching work would be performed under protest
and that Royal would look to the City for all damage
sustained by reason of the wrongful refusal of the
City to accept and pay for the work performed by
Royal under the contract.
(d) General description of the damage or loss incurred:
Royal removed the paving installed by it in
those areas which had been designated by the repre-
sentatives of the City as requiring repair as a con-
dition of accepting the work as a whole, brought in

material, and re -paved the areas. All of this work
was performed under protest as indicated in the
letter from Royal to the City dated January 3, 1964,

together with an amount equal to 15% for overhead and
profit as permitted by the contract documents in the
case of extra and force account work, is the sum of
$3,249.77.
In addition to the damage described hereinabove, Royal
is further entitled to interest at the rate of 7% per annum
upon the cost of performing the repair work, namely $3,249.77,
from the date that the trench repair work was completed on
January 9, 1964, until the said amount is paid.

The above action was filed in the Municipal Court of the E1
Monte Judicial District by Frank E. Gastlin against the City
of Newport Beach. Mr. Gastlin does business under the firm
name of Royal Pipeline Construction Company and had a contract
with Newport Beach for water main construction. A claim was
filed by Royal Pipeline in April, 1964. A memorandum directed
to the City Council from the City Attorney was recently written
recommending that the claim be denied. This action is based
upon that same claim.
It is recommended that the action be referred to the City At-
torney and that he be authorized and directed to take such
action as may be necessary to defend the City.

Defendant.
Comes now the plaintiff and for cause of action alleges;

Plaintiff, at all times mentioned herein, was, and now is,
a contractor licensed by the State of California to perform all of
the work undertaken by him as hereinafter set forth; plaintiff has
conducted his business operations under the firm name of Royal Pipe-
line Construction Co., and he has filed the certificate and publishe
the notice required by Civil Code 1§2466 and 2468.

City of Newport Beach at all times herein mentioned has be
and now is, a municipal corporation.

On May 29, 1%3, plaintiff and defendant executed a con-
tract in writing whereby plaintiff, as contractor, agreed to constru
certain public improvements as more fully described therein.

Plaintiff performed all of the work required to be per-

2 spection -of representatives ef.the defendant; all of the said work

6 Defendant refused to accept the work or pay plaintiff the
7 balance of the funds earned by plaintiff under the said contract un-
8 less certain trench patching was repaired by plaintiff; the refusal
9 of defendant to accept the work and to pay plaintiff for the work
10 performed unless additional work by way of trench patching was per -
11 formed by plaintiff constituted a breach of defendant's obligation
12 under the said contract.

14 Plaintiff, to obtain release of the sum of $9,463.82 being
15 withheld by defendant, notified defendant that the trench patching
16 work would be performed under protest and that he would look to de-
17 fendant for payment for the said work performed under protest; plain
18 tiff thereafter performed the said trench patching work demanded by
19 defendant; that the cost of performing the said work is the sum of
20 $3, 249.77; that the trench patching work was completed on January 9,
21 1 %4; plaintiff is entitled to interest at the rate of 7% per annum
22 upon the said sum of $3,249.77 from January 9, 1 964, until the said
23 sum is paid.

25 Prior to the commencement of this action, namely on April
26 23, 1964, within the time permitted by law, and in accordance with
27 all requirements therefor, plaintiff gave notice to defendant of its
28 claim pursuant to the provisions of Government Code 51900- 935.6.

301 Defendant failed to act upon the claim of plaintiff within
31135 days after the same was presented, and is deemed to have been
32 denied by defendant pursuant to the provisions of Government Code

COAST HIGHWAY (CITY OF NEWPORT BEACH DRAWING No. W- 5004 -S).
THIS WATER MAIN CONSTRUCTION IN THE PACIFIC COAST HIGHWAY 15 A SOLUTION
TO THE PROBLEM OF NUMEROUS FAILURES OF THE BADLY DETERIORATED EXISTING
WATER MAIN. IT 18 IMPERATIVE THAT THESE EXISTING HAIRS BE REPLACED IN
ORDER TO PROVIDE CONTINUOUS WATER SERVICE TO A MAJOR PORTION OF WEST
NEWPORT BEACH AND TO MINIMIZE DISRUPTIONS TO TRAFFIC ON COAST HIGHWAY
INCLUDED IN THIS PROJECT ARE PROVISIONS FOR CONNECTING THE NEW PIPE TO

A - Inspection Requirements
1 - It is imperative that the Permittee notify the following State Inspector
at least 48 hours prior to starting any work under this permit. State
Inspector MR. D. L. MUM= Dhone S42.47,V4 between

B - Specifications
Unless otherwise detailed and authorized

Standard Specifications dated January, 1960,

direction. In ad on, m nimum clearances of two feet adjacent to any
surface obstruction and a five -foot clearance between the excavation
and the traveled way, shall be maintained.
Provision shall be made for barricades, lights, and flagmen to
adequately protect the traveling public during construction operations.
When necessary for public safety,, flagmen shall be on duty 24 (twenty -
four) hours a day.
When the permit authorizes installation by the open -cut method, not
more than one lane of the highway pavement shall be opened at any one time.
After the pipe is placed in the open section, the trench is to be back -
filled, in accordance with Specifications, permanent repairs made to the
surfacing and that portion opened to traffic b4fore the pavement is out
for the next section.
2 - CONSTRUCTION REQUI .S:
Unless otherwise authorized pipes and conduits shall be installed in a
manner to provide at least a minimum clearanoe.of 42 inches between the
top of pipe and surface of existing or future pavement.
Except in cases where the perimeter of pavement removal w it be less
than 30 feet, P.C.C. pavement shall be scored to a depth of 1+# inches by
means of a concrete saw to provide a neat and straight pavement break
along both sides of trench also, provide an unfraetured pavement joint
and rigid bonding of pavement replacement patch.
A.C. pavement shall be-scored as per P.C.C. pavement except where in
the opinion of the State Inspector the pavement has been out neat and
straight along both sides of trench to provide an unfractured and level
pavement joint for bonding existing pavement and replacement patch.
Form VII -SS -Rev. 8 - 4/2/63 (Over)
Repairs to P.C.C.Oavement shall be made of Portland Cement concrete
containing a minimum of 7 sacks of cement per cubic yard. ?eplacem. -nt
of P.C.C. pavement shall equal existing pavement thickness. The concrete
shall be satisfactorily cured and protected from disturbance for not
less than 48 hours.
Repairs to A.C. pavements shall be made with asphaltic concrete
meeting State specifications, with every effort made to match the
existing pavement as to color and surface texture. Replacements of
A.C. pavement shall equal existing pavement thickness but not less
than 3" or more than 6 ". Rock base will be required if so indicated
on the face of the permit or shown on the plans.
Structure backfill within the roadbed area shall be compacted in
horizontal layers not exceeding 8 inches in thickness, using approved
hand, pneumatic or mechanical type tampers, to obtain a "relative
compaction" of 95 percent. Structure backfill outside of slope lines
and not beneath any roadbed shall be compacted to a relative compaction
of 90 percent. Backfill. material shall have a "Sand Equivalent" value
of not less than 30 if the excavation falls within the roadbed. In such
areas consolidation by ponding and jetting will be permitted when, as
determined by the engineer, the backfill material is of such character
that it will be self draining when compacted and that foundation materials
will not soften or be otherwise damaged by the applied water and no
damage from hydrostatic pressure will result. Pon ding and jetting of the
upper 4 feet below finished grad is not ermitt�Mien ponding and
jetting is permi a materia for use as structure backfill shall be
placed and compacted in layers not exceeding 4 feet in thickness.
Ponding and jetting methods shall be supplemented by the use of vibratory
or other compaction equipment when necessary to obtain the required
compaction.
Repairs to asphalt shoulders shall be made with SC -800 Asphalt
Plant Mix Surfacing equal in thickness to that removed but not less than
3 inches in compacted depth.
Concrete sidewalks or curbs shall be cut to the nearest score marks
and replaced equal in dimensions to that removed with score marks
matching existing scorer..
When installation is to be made by boring or jacking under the
traveled way, excavations on either side of the road shall be
sufficiently distant from the edge of pavement to insure pavement
stability and minimum obstruction to traffic as determined by the
Division of Highways' representative.
If considered necessary by the Division of Highways' Representative,
the Permittee shall, at his expense, pressure grout from within the
casing and /or from the top of pavement, the area between the pavement
and.the casing, in order to fill any voids caused by the work as covered
under this permit.
Service connections must be installed at an angle of 90 degrees
from the centerline of the State Highway which the main line traverses.

All boring operations shall be made without the use of
water or air excepting that a minimum amount of water supplied
from a container mounted on operator's equipment may be used
for bit lubrication only, if approved by and used in the
presence of a Division of Highways representative.
If considered necessary by the Division of Highways'
Representative, the Permittee shall, at his expense, pressure
grout from within the casing and /or from the top of pavement,
the area between the pavement and the casing, in order to fill
any voids caused by the work as covered under this permit.

A - Inspection Requirements
1 - It is imperative that the Permittee notify the following State inspector
at least 48 hours prior to starting any work under this permit. State
2 - All inspection costa incurred incidental to this work shall be borne by
the Permittee, except in cases labeled, "For Record Purposes Only ", on the
face of the permit.
B - Specifications
Unless otherwise detailed and authorized on the face of this permit
all work shall be done in accordance with the Division of Highways'
Standard Specifications dated January, 1960, and the following special
provisions:
1 - SAFETY AND TRAFFIC COMOL:
A minimum of all existingLanes shall be provided for traffic in each
direction. In ad on, m nimum clearances of two feet adjacent to any
surface obstruction and a five -foot clearance between the excavation
and the traveled way, shall be maintained.
Provision shall be made for barricades, lights, and flagmen to
adequately protect the traveling public during construction operations.
When necessary for public safety, flagmen shall be on duty 24 (twenty -
four) hours a day.
When the permit authorizes installation by the open -cut method, not
more than one lane of the highway pavement shall be opened at any one time.
After the pipe is placed in the open section, the trench is to be back -
filled, in accordance with Specifications, permanent repairs made to the
surfacing and that portion opened to traffic b.6fore the pavement is out
for the next section.
2 - CONSTRUCTION MUI S:
Unless otherwise authorized pipes and conduits shall be installed in a
manner to provide at least a minimum clearance.of 42 inches between the
top of pipe and surface of existing or future pavement.
Except in cases where the perimeter of pavement removal w ll be less
than 30 feet, P.C.C. pavement shall be scored to a depth of 1f inches by
means of a concrete saw to provide a neat and straight pavement break
along both sides of trench also, provide an unfraetured pavement Joint
and rigid bonding of pavement replacement patch.
A.C. pavement shall be scored as per P.C.C. pavement except where in
the opinion of the State Inspector the pavement has been out neat and
straight along both sides of trench to provide an unfractured and level
pavement Joint for bonding existing pavement and replacement patch.
Form VII -SS -Rev. 8 - 4/2/63 (Over)
Repairs to P.C.0 pavement shall be made of frtland Cement concrete
containing a minimum of 7 sacks of cement per cubic yard. Replacement ;
of P.C.C. pavement shall equal existing pavement thickness. The concrete
shall -be satisfactorily cured and protected from disturbance for not
less than 48 hours.
Repairs to A.C. pavements shall be made with asphaltic concrete
meeting State specifications, with every effort made to match the
existing pavement as to color and surface texture. Replacements of
A.C, pavement shall equal existing pavement thickness but not less
than 3" or more than 6 ". Rock base will be required if so indicated
on the -face of the permit or shown on the plans.
Structure backfill within the roadbed area shall be compacted in
horizontal layers not exceeding 8 inches in thickness, using approved
hand, pneumatic or mechanical type tampers, to obtain a "relative
compaction" of 95 percent, Structure backfill outside of slope lines
and not beneath any roadbed shall be compacted to a relative compaction
of 90 percent. Backfill.material shall have a "Sand Equivalent" value
of not less than 30 if the excavation falls within the roadbed. In such
areas consolidation by ponding and jetting will be permitted when, as
determined by the engineer, the backfill material is of such character
that it will be self draining when compacted and that foundation materials
will not soften or be otherwise damaged by the applied water and no
damage from hydrostatic pressure will result. Ponding and jetting of the
upper 4 feet below finished grade is not permitted en pond ng an
jetting is perms e3, material for use as s ructure backfill shall be
placed and compacted in layers not exceeding 4 feet in thickness.
Ponding and jetting methods shall be supplemented by the use of vibratory
or other compaction equipment when necessary to obtain the required
compaction,
Repairs to asphalt shoulders shall be made with SC -800 Asphalt
Plant Mix Surfacing equal in thickness to that removed but not less than
3 inches in compacted depth.
Concrete sidewalks or curbs shall be cut to the nearest score marks
and replaced equal in dimensions to that removed with score marks
matching existing score r.:ar'k =..
When installation is to be made by boring or jacking under the
traveled way, excavations on either side of the road shall be
sufficiently distant from the edge of pavement to insure pavement
stability and minimum obstruction to traffic as determined by the
Division of Highways' representative.
If considered necessary by the Division of Highways' Representative,
the Permittee shall, at his expense, pressure grout from within the
casing and /or from the top of pavement, the area between the pavement
and the casing, in order to fill any voids caused by the work as covered
under this permit.
Service connections must be installed at an angle of 90 degrees
from the centerline of the State Highway which the main line traverses.

No bid will be received un-
less it is made on a proposal ;
form as bound in the specifica-
tions. Each bid must be accom-
panied bycash, certified check
or bidder's bond made payable -
to the City of Newport Beach,
for an amount equal to at least
10 percent of the amount bid,
such guaranty to be forfeited
should the bidder to whom the
contract is awarded fail to en-
ter into the contract.
In accordance with the provi-
sions ofSection 1770 of the La-
bor Code, the City Council of
the City of Newport Beach has
ascertained the generalprevail-
ing rate of per diem wages in
the locality in which the work
is robe performed for each craft
or type of workman or mechan-
ic needed to execute the con-
tract and is set forth in Resolu-
tion No. 5729. A copy of said
Resolution is available in the
office of the City Clerk in the
City of Newport Beach.
All bids are to be compared
on the basis of the Architect's
estimates of the quantities of
work to be done.
No bid will be accepted from
a Contractor who is not licensed
in accordance with the.provi-
sions of Chapter 9, Division III
of Business and Professions
Code.
Plans and Specifications, forms
of proposals, bonds, and con-
tract may be obtained at the
Public Works Department, City
Hall, Newport Beach, Califor-
nia.
A non-refundable charge of
$2. 00 will be required for each
set of standard specifications.
A refundable deposit of $5.00
will be required for each set of
plans, special provisions, and
