Dear Mr. Nolan:
As you will recall, we are attorneys for Rockwin Prestressed Concrete
Corporation with regard to the Jamboree Road Bridge contract. We are
in possession of copies of Assistant City Engineer Perry's letter of
December 23, 1966, to Consulting Engineer William F. Lever and the
State Division of Highway's letter to you of December 19, 1966, both
relating approval of Mr. Lever's plans and specifications for the reme-
dial work on Jamboree Road Bridge. The minor proposed changes to
the plans contained therein are acceptable and will be incorporated into
the plans.
With respect to the procedural accomplishment of the modifications, and
in accordance with our previous telephone discussion with Mr. Seymour,
we request that a Change Order be issued which will serve as authoriza-
tion to Rockwin to proceed with the remedial work in accordance with the
approved calculations, plans and specifications of the Consulting Engineer.
The foregoing is to be done with the understanding that the cost of the
remedial work is to be assumed by the contractor and that upon determina-
tion of the monetary quantities by which the contract price is to be reduced,
a supplemental change order specifying these amounts will be issued.
As indicated by the analysis of the State Division of Highway's Engineering
Department, we believe that the proposed corrective measures and plans
demonstrate a conscientious and effective remedial engineering effort by
Rockwin. We have advised our client to proceed forthwith to accomplish
the same upon approval by the procedural method specified herein or some
similar method. This will permit the bridge engineering and remedial
construction work to be completed with the cost thereof being borne by
Rockwin. However, all monetary adjustments, such as for elimination of
asphaltic concrete wearing surfaces, credit to the City for the cost to be
incurred by equivalent construction allowance for future bridge widening,

etc., will occur by supplemental change order. If you have any question
concerning this matter, please call so that we can determine what further
action is necessary to resolve this question.

Dear Sir:
Plans and specifications for the remedial work on Jamboree
Road Bridge in Newport Beach are approved. The plans show that a
conscientiously detailed effort has been made to correct the prob-
lem of the floating sonovoids.
Considering the various factors involved, this general type of
corrective work may be the only acceptable procedure. While it is
a matter of individual judgment as to whether an equivalent struc-
ture will be provided, we feel that this remedial work should not
be considered as being a guarantee against the City having to do
some future work on the structure.
We have not had experience with remedial work of this type and
are thus unable to say whether or not a potential would exist for
cracks or small spalls to form in the concrete deck slab. Only the
passage of time will tell.
The enclosed plans show two comments in red pencil for the
City's consideration, We suggest that some type of reinforcing
steel arrangement be used at the upper corners of the transverse
expansion joints. Also, in order to help hold the transverse
expansion joint filler in proper position, the City may choose to
insert it between the existing prestressed units.
We understand the cost of this remedial work is to be borne by
the contractor and not financed with gas tax funds.

We are legal counsel for Rockwin Prestressed Concrete Corporation
with respect to its rights and obligations arising out of the above construction
project and the contractual agreements related thereto. From our telephone
convers&tions with your office we are aware that the dispute between the
various parties involved in this construction project has not formally been
referred to your office. However, in the hope and belief that it will be ben -
eficial to all of the various parties, and in conformity with the best interests
of the public to resolve this dispute without litigation or further delay, we
are writing to set forth the position of Rockwin in this matter and to seek the
assistance of your office in attempting to satisfactorily resolve the disagreement.
Inquiry into the facts surrounding this matter will reveal that Rockwin,

$10.000.00 or $12, 000. 00, the total cost of the bridge being approximately
the sum of $225. 000.00.
With regard to how this matter should be resolved. we respect-
fully invite your attention to the provisions of Paragraph 3 of the Con-
tractual Agreement between the City of Newport Beach and the County of
Orange, represented by the Flood Control District. Under the requirements

and submitted to the Public Works Director of the City of Newport Beach for
resolution. In effect, the dispute herein has in fact been referred to the
Public Works Director of the City of Newport Beach and has in fact been
resolved by way of approving the calculations, plans and specifications of
the Consulting Engineer. Nevertheless. the County Road Department
appears to be adamant in its refusal to concur with the acceptance by all
of the other public agencies involved. We respectfully submit that a fair
and reasonable analysis of this entire matter impels the conclusion that
the lack of concurrence by the Orange County Road Department is contrary
to the spirit and intent of the contractual agreement for the construction,
and that in the public interest the refusal of the Road Department should be
re- evaluated and rescinded at this time.
It is requested that you review this matter and consult with the
representatives of the County's Road Department to the end that the dispute
may be resolved in accordance with the determination of the Public Works
Director of the City of Newport Beach. and the representatives of the other
participating agencies. By copies of thie letter to all of the interested parties,
we wish to assure each of them of the sincere desire and intention of Rockwin
to have this entire matter satisfactorily resolved and to reaffirm its willing -
noes and readiness to forthwith proceed in full compliance with the proposal
and recommendations of the Consulting Engineer.

SPECIFICATIONS FOR REMEDIAL WORK,
SAN DIEGO CREEK BRIDGE.
1. Standard Specifications.
Except as modified herein, all work shall conform to Standard
Specifications dated July 1964 of the State of California
Department of Public Works, Division of Highways, hereinafter
referred to as State Standard Specifications.
In the event of any conflict between these Specifications for
Remedial Work and the specifications issued as part of the
contract documents for Jamboree Road Realignment, these
Specifications for Remedial Work shall govern.
2. Payment.
Portions of the State Standard Specifications regarding payment
do not apply to these Specifications for Remedial Work. All
remedial work including additional earthwork shall be performed
by the Contractor at no cost to the City of Newport Beach.
3. Sandblasting.
The rough top surface of the precast prestressed concrete deck
units shall be sandblasted to provide a positive key between
the units and the new concrete slab which is to be poured over
them.
Sandblasting shall be of sufficient severity to clean and expose
the coarse aggregate over the entire area of the tops of the units,
by the removal of all cement matrix and laitance.
Undercutting, loosening, abrasion and removal of the coarse
aggregate shall be avoided, All coarse aggregate shall remain
firmly embedded after sandblasting.
Sandblasting shall be dry process, using silica -type sand.
Sand shall be used once only and shall be blown clear of the
surface after exposure of the coarse aggregate. At least 300
cubic feet per minute of air at 100 pounds per square inch
pressure shall be used for each nozzle.

4. Drilling.

Holes for dowels shall be drilled at the locations shown on the
drawings unless interference with reinforcing steel occurs. In
such case the drill shall be withdrawn as soon as the reinforcing
is encountered, and a new hole shall be started adjacent so as
to clear the obstruction.
All holes shall be vertical and of diameter and depth as shown
on the drawings. All chips and dust shall be removed from the
holes on completion, and holes shall be washed out with water
and .shall be re- cleaned with compressed air immediately before
placing dowels and grout.
5. Reinforcement.
Materials and workmanship shall conform to State Standard Spec-
ifications, Section 52. Dowels shall be reinforcing bars and
shall be embedded in drilled holes and in keyways to the depth
shown on the drawings. Projection of dowels shall be the correct
length to permit them to act as chairs for the support of the slab
reinforcing mat.
6. Grout.
Materials and workmanship shall conform to State Standard Spec-
ifications, Section 51. Grout for keyways and dowel holes shall
contain a non - shrink additive. Non - shrink additive shall be
Embeco,.;manufactured by Master Builders, Inc. , and used in
accordance with manufacturer's instructions.
Grout shall be proportioned by weight and shall consist of one
part of Embeco non - shrink additive to two parts of non- air - entrain-
ing portland cement, to three parts of moist concrete sand. Water
content shall be the minimum required for workability, a higher
content being permissable for embedment of dowels in drilled holes
than for continuous keyways between units. All grout shall be
mixed at site, and for at least two minutes in a mechanically -
operated mixer. Keyways shall be free of grease or bond release
agents and shall be saturated with water so as to be moist prior
to placement of the grout.

7. Concrete Deck.
The deck shall be a reinforced portland cement concrete slab
with a finished surface forming continuous smooth curves and
tangents as indicated on the profile drawing. Finish of deck
shall conform to State Standard Specifications, Section 40.
Minimum thickness of the deck slab shall be four inches, vary-
ing to a maximum thickness in excess of seven inches, as
required to conform to the profile and to compensate for irreg-
ularities in elevations of prestressed concrete units.
Materials and workmanship shall conform to State Standard Spec-
ifications, Sections 51 and 90, modified as follows :
Portland Cement Concrete shall be Class A, with the mix proport-
ioned to contain 6.0 sacks of cement per cubic yard, a maximum
proportion of 44% by weight of fine aggregate, and a minimum pro-
portion of 45% by weight of #3 aggregate (1" maximum). Admixture
shall be 3LA Pozzolith at a quantity of 0.2 pounds per sack of
cement.
The sandblasted surface of existing concrete shall be thoroughly
washed down and shall be damp but not wet immediately before
the new concrete slab is poured.
Transverse joints shall be formed of premolded expansion joint
filler and shall be located over each pier and abutment at the
ends of existing prestressed units. All joints shall be sealed
with Rubber Calk 3105 or Presstite No. 55 sealant, applied hot.
B. Barrier Railing, Guard Rail and Handrail.
Barrier Railing, Guard Rail and Handrail shall be installed at
uniform heights above the finished deck slab, conforming to
corresponding continuous smooth curves and tangents as indic-
ated on the profile drawing.
Dowels for the barrier railing shall be spliced as shown on the
drawing. Guard rail posts shall be raised three or six inches as
required, using splice plates in the latter case. Four high - tensile
bolts conforming to ASTM A 325 shall be used in each embedded
plate or splice, in lieu of six unfinished bolts.

Adjustment of guard rail to required profile shall be obtained
by use of slotted holes in flanges of posts. Height of handrails
shall be adjusted by the use of coupling nuts and extension studs.
9. Pile Cap Dowels.
The number of holes to be drilled in pile caps and abutments,
and the number of dowels to be placed in said drilled holes to
secure prestressed units shall be reduced to one at each end
of each unit.

In response to your letter of August 31, 1966, please
be advised that we have reviewed the pleadings in this
matter and at the present time would suggest the following-
information be obtained.
We should find out who owns the land on whilab the
salt works is operated, this is probably the Irvine._COSr
pany, and from the owner of the land we should obtaft,L_a
copy of the lease between the owner and the salt comy in
order to ascertain whether or not the damages claimed %xe
entirely the property of the salt company or whether some
of this money would properly go to the owner of the land.
An attempt should be made to locate scale maps of the
area showing both the right of way and the salt works, maps
should show the area both before and after any changes were
made and pursuant to the roadworks was done.
we should obtain plans of the work done and ascestain
who designed the new roadway, what contracts were let for
the work and who had the supervision of the work and whether
or not in the design of the entire project the drainage was
considered and engineered and if so who was responsible for
this engineering.
We should obtain all copies of contracts on this work,
both the prime contract and copies of the sub - contracts,
and ascertain whether or not there are any hold harmless
agreements which might run to_ the q benefit of your insurbd:

sin the original cclmpiiint there is a ditch that
supposedly was filled 0- with dirt and it should be as-
certained the exact location of this ditch to determine
whether or not it was on the right of way or whether or
not it was on property controlled by the plaintiff.
It should be ascertained Aether or not the roadbed
was actually elevated above the dike mentioned in the com-
plaint.
Complete photographs of the area should be located
showing the area both before and after the roadwork was
done. These photographs should include both aerial and
ground photographs, if at all possible.
we should obtain rainfall reports, particularly for
November 23, 1965, however, these reports should be com-
prehensive enough to include not only that general period,
but the rainfall for several years prior to this particu-
lar incident.
A check should be made to see what notice the salt \ \\\l)
works had of the changes that were being made in the road - ✓
way and whether or not they were ever consulted on any
possible damage to the salt works.
A check should be made to see whether or not other
heavy rains have damaged the salt production and an effort
made to determine whether or not prior to the changes they
were subject to some flooding.
It is possible that after the above has been obtained
and reviewed that it might be advisable to consult an en-
gineer regarding the natural drainage and the changes in the
drainage and some consideration might be given to consulting
that man who maintains an office in Garden Grove and who
is quite familiar with drainage problems in the Orange County
area.
The co- defendants should also be contacted and any
items of investigation conducted by them reviewed in the.
hopes of avoiding duplication of work.
Please advise whether you wish us to arrange to have
Mr. Meader conduct this investigation or whether you d'sire
to have it done by men in your office.

DEAR MW. KOCH:
IT IS REOUCSTED THAT THE COUNTY RECONSIDER THE DECISION INDICATED IN
YOUR LETTER OF AUGUST 23, 1966, NOT TO APPROVE THE PROPOSED REMEDIAL
MODIFICATION TO THE JAMBOREE ROAD BRIDGE DECK. THIS REQUEST IS MADE
FOR THE FOLLOWING REASONS:
1. IT IS FELT THAT THE MODIFICATION WOULD RESULT IN A BRIDGE
OVA QUALITY AT LEAST EQUIVALENT TO THE ORIGINAL DESIGN,
THUS FULFILLING THE INTENTION OF THE PLANS AND SPECIFICATIONS..
2. THE PROPOSED MODIFICATION HAS BEEN APPROVED BY THE DIVISION
OF HIGHWAYS, THE ORANGE COUNTY FLOOD CONTROL DISTRICT_, AND
THE DESIGNERS, KEN O'BRIEN AND ASSOCIATES. COPIES OF THE
LETTERS OF APPROVAL FROM THESE AGENCIES ARE ENCLOSED FOR
REFERRNCE.
3. THE REMEDIAL MODIFICATION WOULD ENABLE THE NEW ROADWAY TO RE-
OPENED TO THE PUBLIC SEVERAL MONTHS SOONER THAN IF THE DECK,
WERE TO BE REMOVED AND REPLACED. IN ADDITION TO THE GREATER
CONVENIENCE TO THE PUBLIC, EARLIER OPENING OF THE ROADWAY
WOULD BE VERY DESIRABLE FROM A SAFETY POINT OF VIEW BECAUSE
OF THE POOR ACCIDENT HISTORY ON THE PRESENT ALIGNMEMT.
4. THE BRIDGE WILL BE MAINTAINED BY THE CITY, THUS THERE WOULD SE
NO ADDITIONAL COSTS TO THE COUNTY IF ANY UNUSUAL MAINTENANCE
EXPENSES WERE TO OCCUR.
5. THE CITY'S 18 -INCH WATER LINE IN JAMBOREE ROAD COULD BE COM-
PLETED SEVERAL MONTHS EARLIER. THE ENTIRE EASTBLUFF AREA IS
PRESENTLY SERVED WATER FROM A DEAD END LINE; ANY OUTAGE WOULD
HAVE VERY SERIOUS CONSEQUENCES. COMPLETION OF THE 18 -INCH
LOOP WILL PROVIDE ANOTHER SOURCE OF WATER FOR THE AREA.

THAT THE FOUR LANE PORTION OF THE SUBJECT PROJECT BE COMPLETED
FROM PALISADES ROAD TO APPROXIMATELY STA 97 + CO. IT IS PLANNED
TO USE THE CROSS -OVER FOR SOUTHBOUND TRAFFIC UNTIL THE BRIDGE IS
COMPLETED.
AS YOU WILL REMEMBERS THIS WAS DISCUSSED LAST SPRINGS BUT WAS
DROPPED WHEN IT WAS THOUGHT THAT THE ENTIRE CONTRACT WOULD BE
COMPLETED BY THE LATTER PART OF JULY (SEE LTR. DATED APRIL 28A
1966). AS IT APPEARS, THAT COMPLETION OF THE BRIDGE WILL BE DELAYED

Jamboree Road Bridge.

proposed modification of the design of the bridge decks.
After the defective beams were discovered, we concurred with the
City's notifying the contractor that this portion of the work was rejected.
At that time we were convinced that the City's action was the correct
approach considering the contractural arrangements and obligations of
the contractor. The situation seems to remain unchanged except for the
intent of the City.now to accept a substitute for the earlier rejected beams.
We have concluded that the County's position should remain as
stated in our letter of August 23, 1966. We will not approve the proposed
modification and will withdraw participation in the cost of the structure
if a substitute for the defective beams is made. )

1. A statement by agency's inspecting engineer verifying:
a. That he witnessed major portions of construction
work on the critical structural items.
b. That requirements of the contract plans and specifications
were substantially met.
2. Material Records
a. For concrete, a list showing:
R 1 The names of the cement and aggregate suppliers.
2 Test results of aggregate samples.
3 For transit mix concrete, copies of the delivery
tickets showing the amount of cement in the mix.
(4) All concrete samples taken and their compressive
strengths.
b. For reinforcing and structural steel, a list showing:
• 1 The names of the supplier and fabricator.
�2; Any shop inspection given and /or a certificate
of compliance by the steel company.

Reference is made to your letter of August 16, 1966 concerning a proposal
by the contractor's engineer to modify the Jamboree Road bridge deck units.
We have considered the proposal and the overall effect it has on the structure.
Regardless of the intended structural adequacy of the modification, the finished
bridge will not meet the requirements of the design, plans and specifications.
The addition of a four inch slab topping, even if it could be bonded securely or
keyed to the questionable beams, is still a proposed substitution for defective
workmanship. We believe the contractor is obligated under contractural
arrangements to build a structure which,is in accordance with the design,
plans and specifications.
On similar'situations which have occurred on County contract projects,
the defective workmanship was rejected and replaced by the contractor. In
this case, we believe the contractor has failed in the performance of his
contract unless he replaces the defective beams in lieu of substituting a
modification of the design. The County therefore does not approve the pro-
posed modification and will withdraw participation in the cost of the structure
if it is modified. The City, at its discretion, may continue with the construction
of the bridge as proposed, with the City and County participating in the balance
of the project.

It certainly was a pleasure to visit with you after so many
years when we were associated on the work in French Morocco in
1951 -53. That assignment was very interesting, I believe, to all of
us; but as usual, it was not without may troublesome periods.
I haven't heard about the activities of George Hall for many
years. I occasionally hear from and about Frank Basil, who is in
business for himself in Greece and was doing work in the Far East.
The Western Salt Company summons and complaint is being
handled by Austin C. Smith, Jr. of the law firm of Kirtland & Packard,
639 South Spring Street, Los Angeles, California - Telephone 624 -0935,
for the Continental National American Group, with whom we have a
million dollar professional liability insurance with a $15,000 deductible,
and where we pay the maximum of $5, 000 for legal and court costs.
Attached is a copy of my letter to Mr. Merritt Lane, Jr. of
July 20, and his letter of July 25 to Mr. Austin C. Smith, Jr. I am
also enclosing my letter of even date to Kenneth H. O'Brien, who has
also been served with the summons and complaint. I hope I didn't make
any error in the information you gave to me on July 5.
I shall, indeed, be grateful to you if you can confer with Mr.
Smith at a later date and again in our defense on the complaint of

I have just returned to the office this morning after having
considerable difficulty in obtaining pinne reservations from San
Francisco.
While in Los Angeles, I conferred with Mr. Austin Smith, Jr. ,
of Kirtland &Packard re ardina the Western Salt Company's clnim,
after first having a meeting with the officials of the City of Newport
Beach. The court allowed the service on Ken O'Brien to stand for the
claim against Porter, O'Brien & Armstronc -O: J. Porter & Co. It
appears however, that a good defense can be presented with the com-
bined efforts of the Department of Public Works of Newport' Beach and
Ken O'Brien. Welch, Cummings & White of the Stotler Towers, Los
Angeles, are the attorneys representing Ken O'Brien. Their name was
given to Mr. Smith so that he could coordinate with them in preparing =
the defense in conjunction with testimony which I believe the Engineers
of the Department of Public Works in New port Beach wiM be willing to
prepare. The officials of Newport Bench are as follows:
1) Joseph Devlin, Director of the Department of Public Works.
2) Benjamin Nolan, City Engineer.
3) Pat Dunigan, Inspector on the project.
I hired Joseph Devlin as a young engineer in 1951, and he
worked for us for over two years in French Morocco. Ile indicated that
the flooding, which is the basis of Western Salt Company's claim, was the
fault of the Contractor, as he did not maintain the ditch to carry away the
1 storm water as provided in the Contract. Apparently this deficiency had
been called to the Contractor's attention by the Inspector before the

flooding which occurred on November 23, 1965. After this, the
Contractor took care of the storm water with a ditch and other
facilities; as called for in the Contract, and then no further flooding
into Western Salt Company's property occurred.
Engineers, Devlin and Nolan stated that part of the water
and silt which flowed into Vat "It" came from the Western Salt Company's
own property. Mr. Devlin indicated that they would do what they could to
prevent us from being damnred by the claim. Fe indicated that the
Contract required the Contractor to hold the City of Newport Beach
"Harmless ". They also have not accepted the pre - stress deck panels
on the bridge and they are holding the Contractor responsible to
construct the bridge to meet all the Contract requirements.
I talked on the telephone with Ken O'Brien and he stated that
while they were not engaged to supervise construction, he could prepare
affidavits with members of his staff who have first -hand knowledge of
the cause of the flooding.
I verbally requested Mr. Austin Smith to confer with Ken
O'Brien'!s attorneys in obtaining an affidavit from Ken O'Brien and his
staff. 1 also told him that I thought we should enter a cross - complaint
against the Contractors to counteract his cross - .complaint against us.
If you concur, I believe that this letter, or a revised copy of
it, should be sent to Mr. Smith of Kirtland & Packard in Los Angeles,
California.

Gentlemen:
Rockwin proposed a method to correct for the displacement of
the voids in the bridge deck slabs. This was presented by
Coxco's letter June 7, 1966, to the City of Newport Beach.
To this date we have not received a response to this proposal;
however, you have indicated their verbal response was negative
and they are preparing a letter.
We would like to suggest submitting a second proposal to the
City to engage a mutually acceptable Structural Engineer, at
Rockwin expense, to review the present situation and prepare
a topping design to correct the condition. Cost for furnishing
and installing proposed topping would be borne by Rockwin.
In the event the asphalt or other material presently proposed
for the topping is deemed unnecessary, Rockwin would expect
monetary assistance from the City of Newport Beach or Coxco to
the value of that phase of the work.
We trust you will find this a satisfactory approach and present
this offer to the City.

MENT OF THE STATE DIVISION OF HIGHWAYS THE REMEDIAL MEASURES
SUGGESTED BY YOUR SUBCONTRACTOR, ROCKWIN PRESTRESSED CONCRETE
CORPORATION. IT IS OUR OPINION THAT THE PROPOSED REMEDIAL MEASURES
ARE NOT SATISFACTORY.
BECAUSE OF THE FACT THAT THE DECK UNITS DO NOT COMPLY WITH THE RE-
QUIREMENTS OF THE PLANS AND SPECIFICATIONS, YOU ARE HEREBY NOTI-
FIED THAT THE BRIDGE DECK IS REJECTED AND MUST BE REPLACED WITH
A DECK WHICH MEETS THE CONTRACT REQUIREMENTS. THE FOLLOWING
DISCREPANCIES HAVE BEEN OBSERVED:
.1. ALL OF THE DECK UNITS HAVE VOIDS WHICH HAVE FLOATED BY '
AMOUNTS VARYING FROM 3/4 INCH TO 3 -1 /4 INCHES. .
2. HONEYCOMBED CONCRETE, EXCESSIVE SURFACE CRACKING, AND
POORLY FINISHED CONCRETE ARE EVIDENT IN MANY UNITS.
3. THE DIMENSIONAL TOLERANCES ARE EXCESSIVE, RESULTING IN
SIDES AND ENDS OF THE UNITS NOT BEING PARALLEL OR OF
PROPER ALIGNMENT.
4. MANY CURB DOWELS ARE NOT PROPERLY EMBEDDED.
5• THE INSERTS FOR THE FUTURE 8 -INCH WATER LINE BRACKETS
ARE NOT PROPERLY PLACED.

As requested by your letter of June 9, 1966, we have reviewed the proposed
alterations to the subject bridge. The following are our comments:
1. The submitted computation assumes that the additional 2 -inch cap will act
as a unit with the existing deck. In order to assure that this will happen, a
positive means of shear connection between the deck and the 2 -inch cap must
be made to prevent separation when the structure deflects due to live load.
2. The additional load due to the 2 -inch slab will be less than 5 percent of
the design loads for the piles and pile caps; consequently, while additional
loading is undesireable, the additional loading would not materially effect the
piles and pile caps.

some errors. However, our calculations shoe
are adequate for a 1z0 offset of the voids,

epoxyed to the slabs is an alternate solution but it is not
as desirable as the rejection of the slabs. The epoxy
will not guarantee that the topping will be free from
future maintenance problems due to poor workmanship,
deflections, shrinkage or other factors but4 if placed
correctly, it may give satisfactory results.
Should you decide to allow the contractor to
place the topping we would still approve the project for
matching funds if all work is completed satisfactorily.
We recommend you obtain an experienced inspector to insure
the topping is placed correctly.

Gentlemen:
In reference to the latest position of the City of Newport
Beach, that of proving the location of every void within
plus or minus 314" as the basis for accepting the bridge, we
are proposing the following alternate.
We have prepared calculations assuming that the voids are
vertically displaced by lk" upwards. We would add 2" of
concrete topping reinforced with 6 gage at 6" centers mesh.
Our calculations indicate that all stresses are acceptable
and that an asphalt wearing surface could still be placed
over the topping. The extra costs for the topping would be
paid for by Rockwin.
We are postponing any testing program until we are advised
on this proposal, as we believe it to be a more practical
solution.

confronted with unresolved problems in connection with the pre-
stressed concrete bridge members. It is our opinion that per-
haps some or all of these problems might be solved at a personal
meeting between City's representatives, our supplier and sub-
contractor, and us.
We therefore suggest that you schedule such a
meeting at your earliest convenience to be held at your offices.
We further suggest that fully authorized representatives from each
interested party be present in order to agree to final settlement
of each question that may arise.

Gentlemen:
Although we have in one instance a floated void we believe
that the voids in general are satisfactory. However, to dispel
the doubts expressed by the City of Newport Beach in their
letter of April 19, 1966, we offer the following testing.
We propose to simulate the design loading (H -20 or 32,000 lbs.
per axle) by driving a vehicle lengthwise over the voids. This
vehicle will have a single rear axle with two wheels and will
be loaded in such a manner as to give an axle reaction of 16,000 #.
This is to be considered equal, in the void area, to 32,000 lbs.

We have reviewed the proposed revised doweling plan submitted
by Rockwin Engineers and after carefully considering all
alternatives we feel that there would be less damage to the
structure by placing the dowels in the locations required by the
plans and cutting the reinforcing as required. It is, therefore,
recommended that this plan be disapproved.
The plan for the repair of the damaged void is acceptable and is
recommended for approval.

Gentlemen:
Upon receipt of your letter of March 17, 1966, we made a survey
of the above referenced bridge. Aside from the items already
documented and approved by you, two additional problems exist.
The first of these pertains to dowels in the pile cap. When
drilling for these dowels, excessive rebar has been encountered
in the pile cap. Upon reviewing the drawings this rebar must
be the main longitudinal reinforcement and in some cases the
pile dowels into the pile cap. Standard practice for bridges
of this design have one dowel at each end of the girder at
centerline. We believe it would be better practice to accept
this criteria rather than cut this steel. For those girders
having both dowels over rebar we propose to move off of this
rebar and drill a hole at the center of the girder. This would
involve drilling thru the girder as well as into the pile cap.
The second problem pertains to a floated void. This void by
itself is easy to remedy as it is under the poured -in -place curb.
We propose that the void area be formed and the curb be poured
per plan. However, this void being out of position has created
some doubts as to the location of other items. We remind you
that this job was under full time inspection while being fabri-
cated. While errors have been discovered this should not be
construed that we should not have some confidence in the
inspection. It is suggested that we accept the problems that
are known and mutually solve them by proceeding with the job.
We will appreciate your earliest consideration of these matters.

Subject: Claimant, Western Salt Co. vs City of Newport Beach
This company received through the mails, a copy of the claim
of Western Salt Co, against the City of Newport Beach, dated March 24,
1966. It was forwarded by mail to Porter, O'Brien & Armstrong, 510
31st Street, Newport Beach, California, the Contractors, Coxco, Inc. ,
and Cox Brothers Construction Co. , 7002 Katella Road, Stanton, California.
The claim covers alleged damages to Western Salt Co. Is Vat H
in the City of Newport Beach, County of Orange, State of California.
The alleged damages, according to the claim, occurred on or
before November 23, 1965. Attached hereto is a copy of Ken O'Brien's
letter of March 31, 1965 to Roger S. Wooley Law Office for Western Salt
Company, Security First National Bank Building, Rancho Santa Fe, Cali-
fornia, which states that a review of the engineering design prepared for the
City of Newport Beach indicated that such design did not contribute to .
circumstances related to the claim.
The design which our firm prepared for the City of Newport
Beach was accepted by the City of Newport Beach in the Fall of 1964.
Referring to Paragraph 8 of the claim, it is my understanding
that 10 to 12 inches of rainfall occurred in early November 1965 in this area.
This amount of rainfall within the enclosed Vat H would certainly have pre-
vented the Western Salt Company from harvesting any salt in Vat H until
after many months of dry weather. Their claim for this loss is in the amount
of $8, 600.00. Certainly this loss, and the alleged loss of production in Vat H
for 1966, was due to natural forces of extremely heavy and unprecedented rains
in Southern California last Fall, and could not have been caused at all by the
design of Jamboree Road. If any damage occurred to the levees around Vat H

during this flood, it is our contention that it could not have been caused by
the design which we prepared for you of Jamboree Road.
As you are aware, the City of Newport Beach had the responsi-
bility of supervising the construction work carried out by Coxco, Inc. and

Dear Sir:
We refer to your letter of March 15, 1966 and the
construction requirements for the bridge hand8guard railing .
We submit in answer a copy of letter dated March 23,
1966 from our subcontractor, Alhambra Foundry Co. , Ltd., in
which they suggest the use of grout pads as a means of elevation
adjustment, providing that sufficient projection has been allowed
in the setting of the anchor bolts.
It is anticipated that the manner in which guard rail
is fabricated with slotted bolt holes that there will be sufficient
adjustment allowed to accommodate the desired result.
If other and more expensive methods are required to
accomplish the results set forth in your letter, then we must pro-
pose a change order to the contract be executed to allow reimburse-
ment to us for the added costs.

Accordingly, the rail was fabricated to Standard State
Highway specifications as referred to in the Special Prov-
isions.
The rail is all fabricated and at the galvanizers. We are
scheduled for the installation of this rail either during
the week of March 28, or April 4, 1966.
It is not practical economically and from the stand point of
shop practice to tailor make each individual panel of rail
to conform to any deviations in the deck unit. It has been
a standard practice even when mounted on a poured in place
sidewalk or curb that sufficient projection be allowed when
setting the anchor bolts to permit the use of grout pads on
the post.
Please advise the next course of action otherwise, we are
prepared to make the installation as outlined above and de-
tailed on the plans.

Gentlemen:
We are in receipt of recent letters from your office dated March 1, 1966:
March 30 1966 and March 4, 1966, requesting certain information. The following
points are made in answer to your requests:
1. Enclosed please find six (6) copies of our Grout Mix Data sheet indicating
1/8 lb. of Alcoa Powder per cu. yd, of concrete which would represent less
than .02% of the weight of cement as recommended by the Civil Engineering hand-
book by Urguhart, and confirmed by Mr. John McKoan, Technical Representative
of Alcoa Aluminum.
2. Please also find herewith six (6) copies of a sketch indicating a method
for inserting dowels in our prestressed deck slab.
3. Expansion papers between bents shall be extended by this company to the
proper height.
4. Bolts shall be inserted by Rockwin into inserts in the side of the girders
prior to the installation of the water main.
5. The gaps at the ends of the prestressed girders shall be remedied as follows:
a. Form along bottom of girders with foamed polyurethane so as grout
material will not spill out over abutment and around bearing pads.
b. Push expansion paper over against end of one girder.
c. Pump grout into the remaining opening at the same time shear keys
are grouted.

On March 3, 1966, Mr. Robert Franklin of this office, visited the site of
the Jamboree Road Bridge and inspected prestressed concrete deck members
which were in place on the subject bridge.
Mr. Franklin also made a preliminary review of contract drawings, shop
drawings, and structural calculations as relating to these deck members
and made calculations of his own, copies of which are enclosed.
The field investigation disclosed random cracks on the top surface of maw
of the deck members. These cracks were concentrated at or near the ends
of the members. Calculations indicate that under the weight of the mem-
bers only there exists approximately 300 psi tension in the top surface of
these members at their ends. The cracks are attributed to differential
vertical shrinkage between concrete poured between and around sonotube
voids and concrete poured directly over sonotubes. Surface cracking is
aggravated to some extent by the presence of relatively large amounts of
mild steel top reinforcement. It is probable that the tendency to develop
shrinkage cracks as described exists throughout the full length of the
member. Calculated tensile stresses in the ends of the stresses, however,
will keep cracks in these areas open and may, indeed, cause some new
cracks to develop or may cause existing cracks to widen slightly. Shrink-
age cracks in the center of the members are closed and are kept closed due
to the prestressing and the fact that compressive stress exists at the top
surface.
It is not felt that these cracks are of structural significance. They will
not impair the strength or rigidity of the prestress deck members to any
appreciable degree. It is recommended that these cracks be thoroughly
sealed to prevent the intrusion of atmospheric moisture and to eliminate
any possibility of corrosion of reinforcement.

Gentlemen:
SUBJECT: Jamboree Road Realignment
As requested, we have reviewed the pile cap design as effected by the pile
deviations. The following are our conclusions and recommendations:

1. Widening of the pile caps to include the deviated piles is not critical
insofar as the pile caps are concerned. It is therefore recommended that the
entire pile caps be widened to maintain a minimum edge distance of 6 inches.
Minimum steel cover should be maintained and the interior steel rearranged
to provide equal spacing. Stirrups should be lengthened as required.
2. The deviation, however, becomes critical due to eccentric loading on the
piles themselves, and cause undesirable bi- lateral bending and unequal
loading on individual piles. Investigations indicate even though these deviations
will reduce the safety factor on the structure, they will not increase the stresses
beyond acceptable limits. It is concluded, therefore, that the piles are
acceptable as driven.
3. The wing -wall pile in its present location will not adversely effect the
structure. It is concluded that this pile may remain in place.
