SUBJECT: JAMBOREE ROAD BRIDGE CONSTRUCTION AT SAN DIEGO CREEK (C -841, C -876)
RECOMMENDATION:
Adopt a resolution authorizing the Mayor and the City Clerk to
execute a supplementary agreement with the Orange County Flood Control
District redefining the financial obligations for the subject construction
DISCUSSION:
Agreement No. C -876 (County No. BA63 -FS -107) between the City and the Orange
County Flood Control District, executed November 5, 1963, provided for the Flood Control
District to pay for approximately three- quarters of the cost of the first Jamboree Road
Bridge over San Diego Creek. The City and the Arterial Highway Financing Program were
to share equally the remaining cost.
During the construction of the bridge, problems arose which necessitated the
execution of several change orders, which in effect reduced the overall cost of the
bridge, making the provisions of the original agreement inequitable.
The subject agreement redefines the Flood Control Districts financial obli-
gations, correctly representing the original intent of the first agreement. Under
the terms of the supplemental agreement the District's share of the bridge cost is
established at $162,500 with the City's share then being $23,300.

carried by Board members present, the letter dated May 13, 1969, from
the Road Commissioner and County Surveyor, stating that the Contract for
relocation of all facilities of the Colonia Mutual Water Company, situat
within the proposed road right -of -way to 32' W/o Centerline of Gilbert
Street approximately 2501 S/o Pacific Place, with M. L. Garten, Contract
has been satisfactorily completed on April 16, 1969,-is received and
ordered filed and the work accepted.
The Chairman and the Clerk are authorized to sign the Notice
of Completion.

Construction of the Jamboree Road Bridge
at the San Diego Creek Channel
W I T N E S S E T H:
WHEREAS, Agreement BA63F5 -107 defined DISTRICT's share of
bridge cost as the 259.6/339.6 fraction of the actual payments made to
the Contractor for the cost of construction of the substructure and
superstructure, wingwalls and abutments and incidental appurtenances
thereto, plus 10% of the above DISTRICT share as compensation to CITY
for costs of engineering, administration, and inspection. Total cost
to the DISTRICT was estimated at $125,000 and could not exceed
$137,500 without written concurrence; and
WHEREAS, on the basis of bids received by CITY, DISTRICT's
share, including engineering, was computed to be $163,700. Expenditure
in this approximate amount was subsequently authorized by Order of
DISTRICT's Board of Supervisors, dated November 3, 1964; and
WHEREAS, CITY has computed DISTRICT's share of bridge costs
from the contract item final quantities at bid prices, and including
Contract Item No. 28, Construction Surveys - an item sugceptible of
being an engineering cost. DISTRICT share on this basis would be
$151,752.46 plus 107. for a total of $166,927.71; and
WHEREAS, actual payment to the contractor for bridge construc-
tion was less than the sum obtained by multiplying final quantities by

respective bid prices by reason of:
(1) Change Order No. 7 which imposed the following conditions
upon the contractor:
(a) a $5700 price reduction to compensate CITY for
possible future bridge widening costs;
(b) a $25,529.13 price reduction.to compensate CITY for
loss of A.H.F.P. participating funds.
(2) Change Order No. 7a which reduced total price reductions
of Change Order No. 7 by the sum of $762.00.
(3) A liquidated damage assessment of $11,750.00 withheld and
approximately $4470.00 of which may be pro - ratable to
bridge construction.
AND WHEREAS, as a result of the foregoing a dispute exists
between the parties hereto .as to the final cost shares of CITY and
DISTRICT.
NOW, THEREFORE, the parties hereto agree that to resolve said
dispute, DISTRICT's share of bridge construction cost °i's "'£ixed at the

LIQUIDATED DAMAGES
The contractor was assessed liquidated damages in the amount of $11,750
for 235 days at the contract rate of $50.00 per day.
The City had awarded a contract for construction of a water main across
the bridge, the timing being based on normal progress of the bridge
construction. The delay in completion of the bridge resulted in a delay
and extra expense to the water main contractor. The City was forced to
pay $3,315.29 to cover this extra expense.
The contractor has filed a claim with the City to recover the liquidated
damages. It is anticipated that this matter will ultimately be settled
in a court action.

Contractor's Performance <.

The general contractor, Coxco, Inc., completed their portions of
the project in a slightly above average manner. The nearly one
year delay in the completion of the project was caused by the
bridge deck sub - contractor.
The sub - contractors on the project were:
1. Harlen Underground Contractor (underground), 'barely acceptable.,':
2. Macco (piling), barely acceptable.

3. Rockwin (pre- stressed deck), barely acceptable. "
4. Alhambra Foundry (guard rails, bridge rail), excel lent.
Quality of Work
The pre- stressed bridge deck slabs were unacceptable as originally
delivered to the job site due to the voids having floated during
casting. A four -inch thick reinforced concrete topping was placed
over the slabs, making the bridge construction acceptable to the
State Division of Highways, Orange County Flood Control District, and
the City of Newport Beach, The work remained unacceptable to the
Orange County Road Department and their financial participation was .
withdrawn from the bridge.
The remainder of the project was completed in an acceptable manner.

In response to your letter of November 4, 1968 concerning the subject agreement,
the following information is offered in support of our September 3, 1968 billing.
.. There were no Change Orders either reducing or increasing the quantities of the
bid items relating to the bridge. Therefore, the Flood Control District's share of
the bridge construction costs was based on the full amounts bid for Items 11, Ila, 12
and a proportion of the amount bid on Item 28. Provision six of the subject agreement
states that ....... the City's share shall be modified to the proportion of 80 feet
divided by the actual length ".
The method which the City used to finance its 80 feet section of bridge was not
a part of this agreement. The City had made arrangements for the County Road
Department through the AHFP program to finance one -half of the City's share of the
bridge. When the County withdrew its financial participation in the bridge as a
result of the contractor's workmanship, the City, as a condition for accepting the
repair of the defective bridge deck, required the contractor to pay the County's
share of the 80 feet bridge section.
The exchange of funds described above was accomplished through Change Order No. 7,
(copy enclosed) and had the effect of reducing the overall contract price.
Condition one of Change Order No. 7 compensated the City for the estimated
increase in cost of future bridge widening due to the thicker section which resulted
from the remedial work. If the Flood Control District participates in the future
widening of the bridge to three lanes, this compensation will be divided between the
District and other agencies participating in the construction project.
Change Order Flo. 7a (copies enclosed) revises the dollar value of Change Order No
No. 7 to reflect the cost of the two inch A. C. wearing course which was no longer needed
as a result of the remedial work perfomed on the bridge by the contractor. Provision
four of the subject agreement states that bridge costs shall not include Vie cost
of asphalt surfacing. Therefore, this Change Order doesn't affect the Flood Control
District's share of bridge costs.

Change Order No. 7 does reduce the overall contract price of the bridge.
However, it is the City's position that this reduction relates to the financing
of theCCity's share of the bridge and the future widening of the bridge. Neither
of these items would affect the cost of constructing the Flood Control District's
share of the bridge,
If you feel that under the wording of the present agreement, the District
cannot accept the City's billing as originally submitted, perhaps a modification
to the agreement can be negotiated to allow for the unusual circumstances of
this contract.

Enclosed are copies of the Change Orders for the subject project for
your review. It is regretted that these were not submitted to you at an
earlier date.
Background information relating to the changes follows:
C.O. 1: At Sta. 80+ 80t there was an existing ditch crossing the
right -of -way. The plans called for this ditch to be
diverted along the westerly side of the fill and to drain
into the stream channel. It was not possible to build
the ditch in this way because:
(1) The fill was immediately adjacent to the salt vat
header; and (2) the flow line :rould have been below
the levee. It was decided to lay the 15 inch C.M.P.
under the fill in the same alignment as the original
ditch.
C.O. 2: Self explanatory.
C.O. 3: The plans called for construction of time temporary by -pass
with oiled sand. The contractor was responsible for main-
tenance (no cost) after initial construction. The con-
tractor elected to pave the by -pass with two inches of
A.C. pavement in an attempt to minimize maintenance. The
cost of the oiled sand was computed and paid to the con-
tractor under C.O. 3. The quantity of A.C. paving used
was not included in the pay quantities.

Subject: Realignment of Jamboree Road
C.O. 4: This change was made at the request of the O.C.R.D.
Materials Laboratory.
C.O. 5: The septic tank system serving the farmhouse was in
the area acquired for the new right -of -way. As a
condition of obtaining this right -of -way from The
Irvine Company, the septic tank and leach lines had to
be rebuilt behind the new property line. C.O. 5
covered additional work required to connect to the
new system.
C.O. 6: Self explanatory.
C.O. 7 & 7 -A: Self explanatory.
C.O. 8: The plans had called for a down drain at this location.
It would have drained into the proposed ditch along the
westerly side of the fill mentioned under C.O. 1. By
this time it was known that the "second bridge" project
(now under construction) would include an underground
drain in the median. It was decided to install the
inlet and connector pipe temporarily, draining into the
existing ditch on the easterly We of the fill. This
connector pipe has recently been connected to the new
median drain.
C.O. 9: This change provided for a better right turn move than
that which had been shown on the plans.
C.0.10: This material was in addition to that shown in C.O.
C.0.11: Subsequent to preparing the plans, Palisades Road had
been widened under a County contract. This change
permitted a better right turn movement from Jamboree to
the widened Palisades.
Upon your review of these changes, the final report for AIIFP 138 will
be revised per your memo dated June 6, 1968 and resubmitted.

Some time ago we requested information of the total amoufl -V
paid to the various vendors on the subject project. You supplied
the information - copy attached - and it was used in compiling the
final report. In reviewing this final report, the City Engineer
noticed that the amount paid to Porter, O'Brien, and Armstrong seemed
low. In checking our files. I have found copies of invoices totaling
nearly $30,000 - nearly $15.000 more than you had previously indicated.
Since the County pays 50% of the bills, this difference means a
$7,500 payment to the City.
The earliest pjwment I can find is $10800 in November, 1962.
Others that are not indicated on your summary sheet are $10,800 in
September 19649 and $2,880 in April, 1965.
Please review your records and let me know the total paid
to Porter, O'Brien and Armstrong (also Porter & O'Brien, Ken O'Brien
& Associates, etc). We would like to complete our final report and
clear the project financially before the and of the fiscal year. If
I can be of any help, please tail.

DISCUSSION:
Attached for information is a copy of the Public Works Department memo on
Jamboree Road Contract C -847, dated December 27, 1967.
At the Council meeting on December 27, 1967, this matter was referred back
to the Public Works Director and City Attorney for consultation and review of facts
as presented by the contractor. At the Council meeting it was pointed out by the
contractor's attorney that a reduction should be made due to the contractor having
waited, at the City's request, to permit installation of a water main on the bridge.
A check of the records showed that a 21 day delay did occur and the amount of
liquidated damages recommended in the memo, dated December 27, 1967, has been re-
duced by $1,050. (21 x $50 = $1,050).
The contractor's attorney also pointed out, correctly, that a large amount
of time was consumed in checking and reviewing the proposed remedial measures sub-
mitted, There were four public agencies involved in the financing of this project:
(1) State (Gas Tax) (2) County Road Department (3) County Flood Control District,
and (4) City. A certain amount of time was necessary to transmit the proposals to
and receive replys from these many agencies. The State, for example, reviews all
bridge plans in Sacramento, These agencies all incurred expenses in reviewing and
checking the plans. In retrospect, the project could have been completed sooner
had all the agencies merely rejected the deck slabs, as did the County Road Department.
However, it was felt that the contractor should be given every chance to make good
his defective work. The time spent reviewing the remedial plans, no matter how
long or short, was at the contractor's request and for the contractor's convenience.
A reduction in liquidated damage is not recommended for time spent reviewing re-

In projects of this type, the City acts as contracting agency, representing
the other agencies involved. The quality of the work and the disbursement of funds
is the City's responsibility. The liquidated damages collected by the City are
therefore shared with the other agencies on the basis of each agency's share of the
construction contract cost.
The contractor's failure to perform his work properly on time has involved
the City in a controversy with another contractor, Cabildo Corporation: Cabildo holds
a contract to install the water main on the easterly side of the bridge, and presently
is attempting to recover damages from the City as the delay in completing the bridge
prevented Cabildo from completing their work..
It should be made clear that the assessment of "liquidated damages" is not
a penalty or fine imposed for wrongdoing. It is instead a commonly used method of
agreeing upon a dollar amount to compensate the owner and/or public for costs and
inconvenience incurred as a result of the failure of a contractor to properly per-
form his obligations.
Upon Council action on the damages and receipt of a final billing from the
Orange County Road Department, a complete financial accounting will be submitted.

DISCUSSION:
The contract for the realignment of Jamboree Road has been completed to the
satisfaction of the Public Works Department. Due to the possibility of the assessment
of liquidated damages, a financial accounting for the project has not been submitted
at this time. Upon Council action on the damages and receipt of a final billing from
the Orange County Road Department, a complete accounting will be submitted.
During construction of the bridge, it was discovered that the deck slabs had
been improperly fabricated. It was agreed by the City, State, and County Flood Control
District that the contractor could repair the defective deck by placing a cast -in -place
concrete slab over the precast panels. A delay in completion of the project of over 8
months resulted. Attached is a brief history of the delays and computation of the re-
commended amount of liquidated damages.
The contractor on the project was Coxco, Inc., of Stanton, California. The
bridge deck sub- contractor was Rockwin Prestressed Concrete Corporation of Santa fe
Springs, California.

COMPUTATION OF REVISED COMPLETION DATE AND LIQUIDATED DAMAGES

,i,e contract called for completion of the project in 250 working days. Any .
delays in the placement of fill due to high pore pressure were to be added
to the time of completion. The fill. was to be placed at the rate of one -half
foot per vreek. Most of the fill was placed at the rate of one foot in one
week, then a week off to allow for stabilization, resulting in an average
of 1/2 foot per week. The engineer might delay the paving up to 6 months
after the completion of the fill to allow the rate of settletent to decrease.
II. CHRONOLOGY:
A certain amount of clearing started on December 2,•1964, however the
actual start was delayed until January 11, 1965 due to errors in the plans
relative to alignment.

It was decided to take advantage of the above mentioned 6 month period to
construct the 18 inch water main parallel to the roadway while the fill was
settling. The water main contractor completed his work in the paved areas
by September 1, 1966. The work on the bridge had been stopped in March, 1966.
Coxco was notified on April 28, July 13, and July 19, 1966 that the rate of
settlement had slowed to a nearly acceptable. rate, that the repairs should
be made to the bridge deck as soon as possible, and that paving of the
roadway could begin by about September 1, 1966. Through the summer of 1966
there v:as much correspondence from.Rockwin and Coxco suggesting remedial
methods and from the City indicating that the methods did not appear to be
acceptable. In July, 1966, it was agreed by all parties that a consultant

be fired to prepare plans and specifications for the remedial work. These were
s;'mitted, reviewed, returned, revised, etc. through the fall of 1966. Due to
the nu,ber of public agencies involved in the project, review and approval took
up to 3 weeks in some cases. Also during this period, the County Road Depart-_
ment indicated they would withdraw their funds unless the deck was removed and
replaced rather than repaired. The City attempted to convince the County that
their stand should be reversed, however the County remained adamant.
On December 30, 1966, the remedial work plans were approved by the City and the
change order issued. On January 9, 1967 the repairs were begun. There were
some further "delays and correspondence due to portions of the work being per-
formed in a less than acceptable manner. Upon completion of the deck, work a:as
started on the barrier railing. The City's letter of May 24, 1967, indicates the
dissatisfaction with the progress of that phase of the work. Upon actual completion
of the bridge, the remaining grading, paving and drainage operations required
approximately 30 days.
iii. Assuming that the grading and paving work had started on Septembeer 1, 1966, the
project could have been completed by October 1, 1966. The date on which the work
was substantially completed and the roadway opened to traffic was June 14, 1967,
256 days later. Section 8 -06 of the Standard Specifications fixes the amount
oI liquidated damages at $50.00 per day.

This letter is written as counsel for the contractors concerned in
the above improvement, and as a supplement to the position and
contentions regarding the assessment of "liquidated damages" as
presented at your meeting of December 27, 1967,
As was demonstrated by the graphic portrayal at such meeting,
virtually all of the delay in the completion of the remedial work
performed was a direct consequence of the fact that a number of
governmental bodies were involved. More than 211 days alone
were consumed by such agencies in review, consideration and
approval of the work in question. Another 20 days delay is solely
attributable to a third party contractor not involved herein,
The "Change Order" authorizing the remedial work executed
December 30, 1966 directs a reduction in price of $5, 700, 00 to
compensate the City for alleged additional cost when the bridge
is widened at a future date. Additionally, the price was reduced
by the Change Order in the further amount of $25, 529,13, to com-
pensate the City from withdrawal from participation in financing
of the bridge by the Arterial Financing Program of Orange County,
At the time of the Change Order, the contractors agreed to the
foregoing reductions and agreed to bear, and did bear, all of the
costs of the remedial work together with inspection thereof and
certification of completion, at an additional cost of approximately

$32, 000. 00. The Change Order makes no reference whatever to
assessment of "liquidated damages" in addition to the reductions and
expense set forth, and, of necessity, the Change Order implies
the granting of a reasonable time to the contractors to perform the
remedial work without any further and arbitrary penalty assessment.

DISCUSSION:
Attached for information is a copy of the Public Works Department memo on
Jamboree Road Contract C -847, dated December 27, 1967.
At the Council meeting on December 27, 1967, this matter was referred back
to the Public Works Director and City Attorney for consultation and review of facts
as presented by the contractor. At the Council meeting it was pointed out by the
contractor's attorney that a reduction should be made due to the contractor having
waited, at the City's request, to permit installation of a water main on the bridge.
A check of the records showed that a 21 day delay did occur and the amount of
liquidated damages recommended in the memo, dated December 27, 1967, has been re-
duced by $1,050. (21 x $50 = $1,050).
The contractor's attorney also pointed out, correctly, that a large amount
of time was consumed in checking and reviewing the proposed remedial measures sub -
mitted. There were four public agencies involved in the financing of this project:
(1) State (Gas Tax) (2) County Road Department (3) County Flood Control District,
and (4) City. A certain amount of time was necessary to transmit the proposals to
and receive replys from these many agencies. The State, for example, reviews all
bridge plans in Sacramento. These agencies all incurred expenses in reviewing and
checking the plans. In retrospect, the project could have been completed sooner
had all the agencies merely rejected the deck slabs, as did the County Road Department.
However, it was felt that the contractor should be given every chance to make good
his defective work. The time spent reviewing the remedial plans, no matter how
long or short, was at the contractor's request and for the contractor's convenience.
A reduction in liquidated damage is not recommended for time spent reviewing re-
medial plans.

The contractor's failure to perform his work properly on time has involved
the City in a controversy with another contractor, Cabildo Corporation. Cabildo holds
a contract to install the water main on the easterly side of the bridge, and presently
is attempting to recover damages from the City as the delay in completing the bridge
prevented Cabildo from completing their work.
It should be made clear that the assessment of "liquidated damages" is not
a penalty or fine imposed for wrongdoing. It is instead a commonly used method of
agreeing upon a dollar amount to compensate the owner and /or public for costs and
inconvenience incurred as a result of the failure of a contractor to properly per-
form his obligations.
Upon Council action on the damages and receipt of a final billing from the
Orange County Road Department, a complete financial accounting will be submitted.

DISCUSSION:
The contract for the realignment of Jamboree Road has been completed to the
satisfaction of the Public Works Department. Due to the possibility of the assessment
of liquidated damages, a financial accounting for the project has not been submitted
at this time. Upon Council action on the damages and receipt of a final billing from
the Orange County Road Department, a complete accounting will be submitted.
During construction of the bridge, it was discovered that the deck slabs had
been improperly fabricated, It was agreed by the City, State, and County Flood Control
District that the contractor could repair the defective deck by placing a cast -in -place
concrete slab over the precast panels. A delay in completion of the project of over 8
months resulted. Attached is a brief history of the delays and computation of the re-
commended amount of liquidated damages.
The contractor on the project was Coxco, Inc., of Stanton, California. The
bridge deck sub - contractor was Rockwin Prestressed Concrete Corporation of Santa fe
Springs, California.

actual start was delayed until January 11, 1965 due to errors in the plans

construct the 18 inch water main parallel to the roadway while the fill was
settling. The water main contractor completed his work in the paved areas
by September i, 1966. The work on the bridge had been stopped in March, 1966.
Coxco was notified on April 28, July 13, and July 19, 1966 that the rate of
settlement had slowed to a nearly acceptable, rate, that the repairs should
be lade to the bridge deck as soon as possible, and that paving of the
roadway could begin by about September 1, 1966. Through the summer of 1966
there iras much correspondence from Rockwin and Coxco suggesting remedial
methods and from the City indicating that the methods did not appear to be
acceptable. In July, 1966, it was agreed by all parties that a consultant

.usni`ed, reversed, returned, revised, etc. through the fall of 1966. Due to

up to 3 weeks in some cases. Also during this period, the County Road Depart -
ment indicated they would withdraw their funds unless the deck was removed and
replaced rather than repaired. The City attempted to convince the County that
their stand should be reversed, however the County remained adamant.
On December 30, 1966, the remedial work plans were a pp roved by the City and
the
change order issued. On January 9, 1967 the repairs were begun. There were
some further
delays and correspondence due
to

the

Upon
completion
of

started on the barrier railing. The City's letter of May 24, 1967, indicates the
dissatisfaction with the progress of that phase of the work. Upon actual completion
of the bridge; the remaining grading, paving and drainage operations required

project could have been completed by October 1, 1966. The date on which the work
was substar, ially completed and the roadway opened to traffic was June 14, 1967,
256 days later. Section 8 -06 of the Standard Specifications fixes the amount
of liquidated damages at $50.00 per day.

This letter is written as counsel for the contractors concerned in
the above improvement, and as a supplement to the position and
contentions regarding the assessment of "liquidated damages" as
presented at your meeting of December 27, 1967.
As was demonstrated by the graphic portrayal at such meeting,
virtually all of the delay in the completion of the remedial work

approval of the work in question. Another 20 days delay is solely
attributable to a third party contractor not involved herein.
The "Change Order" authorizing the remedial work executed
December 30, 1966 directs a reduction in price of $5, 700.00 to
compensate the City for alleged additional cost when the bridge
is widened at a future date. Additionally, the price was reduced
by the Change Order in the further amount of $25, 529.13, to com-
pensate the City from withdrawal from participation in financing
of the bridge by the Arterial Financing Program of Orange County,

Assuming that the Council assesses liquidated damages on the
subject project, a decision must be made as to who will be the benefic-
iary /beneficiaries of the money. There appear to be three possibilities:
1. The City assessed the damages, spent most of the time re-
viewing and administering the remedial work and its citi-
zens were primarily affected by the delay. Therefore, City
gets 100 %.
2. The damages are a result of delays on the bridge, not the
roadway. Therefore, split the money on the basis of
participation in the cost of the bridge which would include
City and O.C.F.C.D. only.
3. As the project is financed partially by A.H.F.P., it must
serve people from all over the County. Therefore, a delay
in completion affected all, so the damages could be split
on the basis of A.H.F.P. and City participation in the
total project. O.C.F.C.D. was left out as there was no in-
convenience to them.
Of these, #1 would probably be the most difficult to defend.
We charged our time to the project whether it was time spent on the basic
contract or on the remedial work, so we will be reimbursed by the other
participants. It has been discussed that our relations with the Road
Department have been harmed due to the bridge decision, in which case #3
might be best.
Any comments or suggestions would be appreciated.

Gentlemen:
Pat, the final quantities for the work as we figure
them, agree with our telephone conversation of a few days ago.
We believe in addition to what you have already paid us, as of June
15, 1967, that we have the following due us:
Item 2 - Roadway Excavation - a small amount of work was done
after the last quantity increase - approximately 200 CY.
Item 21 - Downdrain anchor assembly - we had one delivered to
the site - wasn't it installed?
Item 22 - Metal beam guard railing - 260 Lin. Ft.
Item 25 - Remove traffic stripes - this item showed a quantity
on the last estimate, but no money.
Item 12 - San Diego Creek Bridge - 10016 of course.
Then we have another change order due us. A copy
of your field daily report is attached along with our invoice in the
amount of $344. 62.

Some clearing started on December,,-2, I964, however, job was delayed until
January 11, 1965 due to error in plansecs. called for fill to be placed at'
the rate cif , foot per week.: Most fill was placed at the rate of 1 foot in a
week, then a week off to allow for stabilization. As this is -the same as 2 foot
per week, no time allowance is deserved.

The specs allow the Engineer to delay paving up to 6 months to allow for
the settlement rate to decrease. It was decided to use this time also to permit
installation of the 18 -inch water main by Cabildo. Cabildo's work was completed
(in paved areas) by 9/1/66. On April 28, July 13, 04 July 19, 1966, Cox was
notified that the fill settlement rate had slowed and that paving could start as
soon as the bridge deck was completed.
Upon actual completion of the deck, the remaining grading, paving and drainage
operations took 30 days. Assuming that this work had started on 9/1/66, the project
would have been completed on 10/1/66. The actual completion date was June 14, 1967.
It is therefore recommended that liquidated damages be assessed for 256 days at the
contract specified rate of $50.00 per day. Total $12,800.

Upon cowletion of the Jambora Ro AM4dp. it was
anticipated thats due to settlement of the ungerlying
ground, patching would be necessary at the s'ly
abutment about every two months. It has been far
months since the bridge was spend and the settlement
has now reached the point dare a certain amount of
patching is necessary.
It is suggested that a "feather patch• be extended
from the abutment to a point approximately five fat
ally. The material should be hot. ,/B inch fine mix.
and thoroughly rolled with a steel wheel roller.
The weft should be coordinated with the paint crew
so that the double yellow stripe can be replaced on
the new patch.

During a recent telephone conversation, we discussed
the fact that the metal beam guard rail posts on the
Jamboree Road Bridge were not properly bolted to the anchor
plates. In a subsequent discussion with Mr. Sofranko of
Alhambra Foundry, it was brought out that while the contract
plans for the project called for the center of the rail to
be 18 inches from the deck surface, the plan for the re-
medial work on the bridge deck shaved the rail to be 15 inches
from the deck.
As you will remember, Rockwin engaged the services of
Mr. lever to prepare the p)an for the remedial work on the
bridge deck. When this plan was submitted for the City's
approval, it was checked for structural adequacy, Ia.
placing of the dowels, reinforcing steel, guard rail anchor
extensions, concrete thickness,, etc. Unfortunately, it did
not occur to the City that this plan would contain an error
in the height of the guard rail. The 18 -inch height is the
standard in Orange County, while the State STandard is 21
inches. It is felt that the 15 -inch height shorn on the
remedial work plan is too low to provide adequate safety.

It is regretted that this error was not observed in the
checking of the Plans.
It appears that in most cases an additional plate
could be bolted or welded on at the joint providing the
anchorage of the 8 high strength bolts as required.
It is recommended that you and/or Alhambra Foundry
submit a suggested means of providing the proper anchorage
for the City s approval.

Dear Harvey:
In looking at the new bridge over the Back Bay on Jamboree
Road, it would appear to me that an ideal condition would
be to have the new bridge handle the south bound traffic
and leave the old wooden bridge in to handle the north
bound traffic, so that we get a four lane road in that area.
Undoubtedly, there could be millions and millions of engin-
eering facts as to why the old wooden bridge cannot be used,
but certainly for the next 5 or 6 years it could be used
without remodelling or tearing it down and certainly would
be a better safety program than to abandon it completely.
Please give this some thought.

May 24, 1967 and note your general dissatisfaction with the
present progress of construction of the barrier railing. At
a meeting with you at the site on May 25, 1967 our Mr. Kerfoot
reports that you were advised of our plan to complete this work
considerably prior to your estimated date of June 28 to 30, 1967.
Every effort will be made to accomplish that goal.
Your reference to liquidated damages is re-
ceived with some surprise. Long delays have been experienced
during the progress of the work. However, in our opinion these
delays have been beyond the control of the contractor and multi-
farious in nature. In consideration of the causes for the various
delays we respectfully request your approval for contract time
continuing to June 30, 1967.

APPROVE CHANGE ORDER NUMBER 7 FOR THE SUBJECT PROJECT.
DISCUSSION:
SECTION 4-03 OF THE CITY STANDARD SPECIFICATIONS REQUIRES COUNCIL
APPROVAL OF ALL CHANGE ORDERS IN EXCESS OF $500.
THE ORIGINAL PLANS FOR THE REALIGNMENT OF JAMBOREE ROAD FROM EASTBLUFF.
DRIVE TO PALISADES ROAD CALLED FOR THE CONSTRUCTION OF TWO DOWN DRAINS IN THE
AREA SOUTHERLY OF THE BRIDGE. AS A RESULT OF THE DESIGN OF THE SECOND BRIDGE
AND ROADWAY, IT HAS BEEN DETERMINED THAT THE DRAINAGE IN THIS AREA 3MOULD,9E
HANDLED BY AN UNDERGROUND SYSTEM, INCLUDING AN INLET BOX AND APPROXIMATELY 50
FEET OF PIPE BENEATH THE ROADWAY PRESENTLY UNDER CONSTRUCTION. IT IS FELT THAT
THIS PORTION OF THE WORK SHOULD BE DONE AT THIS TIME RATHER THAN AS A PART OF
THE SECOND ROADWAY. BY DELAYING THE WORK, THE COST WOULD BE NEARLY DOUBLED AND /
TRAFFIC WOULD BE GREATLY'INCONVENIENC£D•
THE ESTIMATED COST OF THE INLET AND-PIPE IS APPROXIMATELY '$I,000.
THIS WILL BE PARTIALLY OFFSET, IN THE AMOUNT OF APPROXIMATELY $500 BY THE

This letter will clarify the following queries which have arisen during
construction of the above :
(1). Projection of dowels into slab must be a minimum of six (6)
inches, adding both vertical and horizontal portions. The
four (4) inch minimum horizontal dimension shown on the
drawing may be reduced to not less than two (2) inches
provided that the total minimum projection as stated above
is satisfied.
(2). Where existing reinforcing in the pile capsprevents the
placing of dowels at the ends of units, such dowels may be
O n� eAt4 omitted, provided that at least nine (9) of the eighteen (18)
dowels as shown on the plans are installed at the end of
each span.
(3) . Where dowel holes enter voids and it is impracticable to
place dowels, the holes shall be plugged to prevent concrete
from entering the voids, and new holes shall be drilled and
replacement dowelsplaced and grouted in the immediate
vicinity of the unused holes.

but not less than one inch clear, measured from the nearest
surface of the concrete to the outside of the bar. " Refer to
State of California Standard Specifications, Section 52 - 1.07
(5) . Coupling nuts shall be centered on new and existing bolt
threads, and existing projection as constructed shall govern
over the two (2) inch dimension shown on the drawing.

Some time ago our subcontractor, Macco Corp-
oration, sent a claim to us for additional remuneration for the
required removal of plastic sleeves from piling, Their con-
tention is that this operation and effort is not required by the
contract specifications, and therefore becomes extra work and
compensible accordingly.
Our study of the specifications reveals so such
specific requirements with regard to the piling. Macco's added
costs for this work, involving air tool operation, pickup truck
and foreman to81s $531, 90.
Please let me be informed of the basis for the
required plastic sleeve removal, and your position with regard
to payment to the contractor for his work.

suitable for the purpose intended on this project, if used strictly
in accordance with the manufacturer's instructions. One printed

Cement mortar cylinders, some containing a
competitive grouting material, and the others
containing FERROLITH G, were prepared for
testing in accordance with A.S.T.M. Specifi-
cation C157 -40T.
The cylinders were allowed to set for 24 hours,
at the end of which time they were measured.
They were remeasured after 14 and 28 days
with the following results:

Conclusion:
At early ages (one and three days) FERRO -
LITH G "D.S." and REDI -MIXED will give

strength is more important in any metallic
grouting compound to allow early use after
installation.

APPLICATION AND PREPARATION

A clean virgin surface is a prime requisite for
satisfactory results. Concrete foundations must
be chipped with chisel or bush hammered to re-
move all grease, oil, laitance, glaze and foreign
deposits; but do not roughen so deeply as to
interfere with proper placing of the grout. Re-
move all dust and loose particles with a high
pressure water jet. Foundation less than 28 days
old should be kept wet for at least 12 hours, and
older foundations for a minimum of 24 hours
before placing grout. All excess water must be
removed before grouting.
All grease, oil, paint, loose rust and foreign ma-
terial must be removed from the bottom of
machine bases and sole plates. Position the equip-
ment, align and level it solidly on the shims. All
forms built around machine bases should be of
minimum 1 -1/2" lumber and securely braced.
Top of forms should be at least 6 inches above
the bottom of the machine base to assure sufficient
"head" pressure on the grout for proper place-
ment. Forms must be made tight in order to
prevent leakage.

The amount of water to be used for each 100
pounds of FERROLITH G "D.S." Grout REDI-
MIXED depends upon requirements for a stiff or
flowable grout, and the mix selected is determined
by working conditions. The water factor also in-
fluences early and ultimate strengths.
Mixing:
All mixing should be done as close as possible
to the work area. Do not mix more than can be
used in about 40 minutes. If mixed mechanically,
turn over for not less than 3 minutes. If mixed by
hand, turn over until thoroughly wetted out and
uniform. In either case, add the correct amount
of water slowly for efficient mixing and for de-
sired consistency and strength.
Application:
The grout should be placed from one side only,
and the entire batch used as quickly as possible
to avoid overworking. Nearby equipment should
be shut down to avoid vibration interfering with
the set and bond of the fresh grout. The grout
must be compacted thoroughly and be free of
voids and air pockets. Chains, with 1/2" to 1"
links, placed between the concrete foundation and
the machine bedplate prior to grouting will aid
greatly in working the grout into place without
voids.

The forms may be removed after the grout has
set 12 to 24 hours at a temperature not below
70 degrees F. At lower temperatures, form re-
moval should be delayed accordingly. FERRO -
LITH G "D.S." Grout does not require special
handling of unrestrained areas. Finishing of ex-
posed surfaces with cement -sand grout even when
exposed to excessive side thrust is not necessary.
When not in use, all bags of FERROLITH G
"D.S." Grout should be kept tightly sealed and
stored in a dry area.

Resumption of work on the bridge commenced two
weeks past and is progressing at a satisfactory rate in our
opinion.
The required dowel hole drilling has been com-
pleted as of yesterday. Sandblasting work began last Monday
and should be completed by the middle of next week. Dowel
placing will commence with the delivery of material and follow
right behind the sandblasting work. It is planned to commence
the placing of the deck concrete on February 1st. Then, allow-
ing for the required curing time it is estimated that the balance
of the work on the approaches and the bridge can be completed
by March 8, 1967.

SPECIFICATIONS FOR REMEDIAL WORK,
SAN DIEGO CREEK BRIDGE.
1. Standard Specifications.
Except as modified herein, all work shall conform to Standard.
Specifications dated July 1964 of the State of California
Department of Public Works, Division of Highways, hereinafter
referred to as State Standard Specifications.
In the event of any conflict between these Specifications for
Remedial Work and the specifications issued as part of the
contract documents for Jamboree Road Realignment, these
Specifications for Remedial Work shall govern.
2. Payment.
Portions of the State Standard Specifications regarding payment
do not apply to these Specifications for Remedial Work. All
remedial work including additional earthwork shall be performed
by the Contractor at no cost to the City of Newport Beach.
3. Sandblasting.
The rough top surface of the precast prestressed concrete deck
units shall be sandblasted to provide a positive key between
the units and the new concrete slab which is to be poured over
them. .
Sandblasting shall be of sufficient severity to clean and expose
the coarse aggregate over the entire area of the tops of the units,
by the removal of all cement matrix and laitance.
Undercutting, loosening, abrasion and removal of the coarse
aggregate shall be avoided, All coarse aggregate shall remain
firmly embedded after sandblasting.
Sandblasting shall be dry process, using silica -type sand.
Sand shall be used once only and shall be blown clear of the
surface after exposure of the coarse aggregate. At least 300
cubic feet per minute of air at 100 pounds per square inch
pressure shall be used for each nozzle.

4. Drilling.
Holes for dowels shall be drilled at the locations shown on the
drawings unless interference with reinforcing steel occurs. In
such case the drill shall be withdrawn as soon as the reinforcing
is encountered, and a new hole shall be started adjacent so as
to clear the obstruction.
All holes shall be vertical and of diameter and depth as shown
on the drawings. All chips and dust shall be removed from the
holes on completion, and holes shall be washed out with water
and .shall be re- cleaned with compressed air immediately before
placing dowels and grout.
S. Reinforcement.
Materials and workmanship shall conform to State Standard Spec-
ifications, Section 52. Dowels shall be reinforcing bars and
shall be embedded in drilled holes and in keyways to the depth
shown on the drawings. Projection of dowels shall be the correct
length to permit them to act as chairs for the support of the slab

6. Grout.
Materials and workmanship shall conform to State Standard Spec-
ifications, Section 51. Grout for keyways and dowel holes shall
contain a non -shrink additive. Non - shrink additive shall be
Embeco,.;manufactured by Master Builders, Inc. , and used in
accordance with manufacturer's instructions.
Grout shall be proportioned by weight and shall consist of one
part of Embeco non - shrink additive to two parts of non- air - entrain-
ing portland cement, to three parts of moist concrete sand. Water
content shall be the minimum required for workability, a higher
content being permissable for embedment of dowels in drilled holes
than for continuous keyways between units. All grout shall be
mixed at site, and for at least two minutes in a mechanically-
operated mixer. Keyways shall be free of grease or bond release
agents and shall be saturated with water so as to be moist prior
to placement of the grout.

7. Concrete Deck.
The deck shall be a reinforced portland cement concrete slab
with a finished surface forming continuous smooth curves and
tangents as indicated on the profile drawing. Finish of deck
shall conform to State Standard Specifications, Section 40. .
Minimum thickness of the deck slab shall be four inches, vary-
ing to a maximum thickness in excess of seven inches, as
required to conform to the profile and to compensate for irreg-
ularities in elevations of prestressed concrete units.
Materials and workmanship shall conform to State Standard Spec-
ifications, Sections 51 and 90, modified as follows :
Portland Cement Concrete shall be Class A, with the mix proport-
ioned to contain 6.0 sacks of cement per cubic yard, a maximum
proportion of 44% by weight of fine aggregate, and a minimum pro-
portion of 45% by weight of #3 aggregate (1" maximum) . Admixture
shall be 3LA Pozzolith at a quantity of 0.2 pounds per sack of
cement.
The sandblasted surface of existing concrete shall be thoroughly
washed down and shall be damp but not wet immediately before
the new concrete slab is poured.
Transverse joints shall be formed of premolded expansion joint
filler and shall be located over each pier and abutment at the
ends of existing prestressed units..All joints shall be sealed
with Rubber Calk 3105 or Presstite No. 55 sealant, applied hot.
8. Barrier Railing, Guard Rail and Handrail.
Barrier Railing, Guard Rail and Handrail shall be installed at
uniform heights above the finished deck slab, conforming to
corresponding continuous smooth curves and tangents as indic-
ated on the profile drawing.
Dowels for the barrier railing shall be spliced as shown on the
drawing. Guard rail posts shall be raised three or six inches as
required, using splice plates in the latter case. Four high - tensile
bolts conforming to ASTM A 325 shall be used in each embedded
plate or splice, in lieu of six unfinished bolts.

Adjustment of guard rail to required profile shall be obtained
by use of slotted holes in flanges of posts. Height of handrails
shall be adjusted by the use of coupling nuts and extension studs.
9. Pile Cap Dowels.
The number of holes to be drilled in pile caps and abutments,
and the number of dowels to be placed in said drilled holes to
secure prestressed units shall be reduced to one at each end
of each unit.
