THIS AGREENtEi'x, made and entered into this day of
3 July, 1963, between the CITY OF NEWPORT BEACH, hereinafter referred
4II to as "City ", and the NEWPORT HARBOR LAWN BOWLING ASSOCIATION,
51j hereinafter called "Association ";
6ii WITNESSETH•
7� WHEREAS, there are now a single bowling green and related
8I facilities located at 15th and Balboa Blvd. and situated on City
9 property in the City of Newport Beach, California; and
10 WHEREAS, the Association has been maintaining said green
11 under an agreement with City which expired June 30, 1963; and
12 WHEREAS, it is the desire of the parties hereto to enter
13 into a new agreement under substantially the same terms and condi-
14 tions as said previous agreement;
15 NOW, THEREFORE, in consideration of the premises, it is
16 mutually agreed as follows:
17 1. The term of this agreement shall begin July 1, 1963,
18 and end June 30, 1964. Either party may terminate the agreement by
19 giving thirty (30) days' written notice of such termination to the
20 other party.
21 2. During the period covered hereby, the Association
22 agrees to maintain the aforesaid bowling green and related facili-
23 ties, including the fence and equipment used in connection with the
24 green. Association agrees to maintain the green and facilities to
25 the satisfaction of City.
26 3. For the service of maintaining the green and facili-
27 ties, City agrees to pay Association $75.00 at the end of each
28 month during which Association maintains the green and facilities
29 pursuant to this agreement.
30 4. The money paid to Association by City shall be used
31 exclusively for the purpose of maintaining the green and facilities
32 as herein provided. Association shall keep accurate books of

account indicating how the money is spent.
5. All membership green fees, membership dues or green
maintenance fees collected by the Association shall be retained by
the Association for the purpose of maintaining the green. Associa-
tion shall charge no fee for the use of the green without the prior
approval of the Parks, Beaches and Recreation Commission. Any fees
collected for the use of the green, other than those specifically
mentioned above to be retained by the Association, shall be forth-
with transmitted to the Director of Finance. Association shall
keep accurate books of account to show all receipts and disburse-
ments of Association whether or not related to this agreement.
6. All books of Association required to be kept by
this agreement shall be open to inspection by City.
7. In accordance with the policy of the Parks, Beaches
and Recreation Department, use of the green and facilities shall be
open to the public at all times, subject to rules and regulations
approved by the Parks, Beaches and Recreation Commission.
8. Subject to its Articles of Incorporation and By -Laws,
the Association shall make membership available to all persons.
Association agrees that it will undertake to increase interest and
participation in lawn bowling as a recreational activity of all
citizens in the City of Newport Beach.
IN WITNESS WHEREOF City has caused this agreement to be
executed by its Mayor and City Clerk and Association has caused it
to be executed on its behalf by its President and Secretary.

Attached is an executed copy of the agreement between
the City of Newport Beach and Newport Harbor Lawn
Bowling Association for transmittal to the Newport
Harbor Lawn Bowling Association. Said agreement
was authorised by the adoption of Resolution No. 6810
on July S, two copies of which are attached.
I am also attaching an unexecuted copy of the agreement
for your files.
