Division of Highways' right of way on the Pacific Coast Highway,
Ora - 60(1) -NptB, between Grant Street and Lugonia Street in accordance
with the attached plan No. R- 5023 -S Sheets 1 through 11 of 11 Sheets
and subject to the special terms and conditions of this permit.
1. During construction, a minimum of one 10 -foot lane in each direc-
tion shall be provided for public traffic on Pacific Coast Highway.
Lane reduction will not be permitted during hours of darkness or
during the summer months.

3. All striping shall be under the direction of Mr. L.R. Smith who
shall be notified 72 hours prior to the start of work by phoning
RAymond 3 -1273. State forces will place new striping at the

4. All signal work shall be performed in accordance with the
attached revised Signal Modification Plan, Sheet 3 of 11 Sheets
dated February 1964. This work shall be under the direct supervision
of Mr. A.L. Hewes, who shall be notified 72 hours prior to the start
of work by phoning RAymond 3 -1373• (cont'd. on page 2)

GENERAL PROVISIONS
1. Definition. This permit is issued under Chapter 3 of Division I of the Streets and highways Coda The term encroach-
ment is used in this permit as defined in the said Chapter 3 of said code. Except u otherwise provided for public agencies and franchise
holders, this permit is revocable on five days notice.
2. Acceptance of Provisions. It is understood and agreed by the Permitter that the doing of any work under this permit
shall constitute an acceptance of the provisions.
J. No Precedent Established. This permit is granted with the understanding that this action is nor to be considered at
establishing any precedent on the question of the expediency of permitting any certain kind of encroachment to be erected within right
of way of State highways.
4. Notice Prior to Starting Work. Before starting work on which an inspector is required, or whenever stated on the
face of this permit, the Permittee shall notify the District Engineer or other designated employee of the district in which the work
is to be done. Such notice shall be given at least three days in advance of the date work is to begin.
5. Keep Permit on the Work. This permit shall be kept at the site of the work and must be shown to any representative of
the Grantor or any law enforcement officer on demand.
6. Permits from Other Agencies. The party or parties to whom this permit is issued shall, whenever the same is required
by law, secure the written order or consent w any work hereunder from the Public Utilities Commission of the State of California, or any
other public board having jurisdiction, and this permit shall be suspended in operation unless and until such order or consent is obtained.
7. Protection of Tragic. Adequate provision shall be made for the protection of the traveling public. Barricades shall
be placed with red lights at night, also flagmen employed, all as may be required by the particular work in progress.
S. Minimum Interference With Traffic. All work shall be planned and carried out s s that there will be the least possible
inconvenience to the traveling public except for the specific work permitted.
9. Storage of Material. No material shall be stored within eight (9) feet from the edge of pavement or traveled way or
within the shoulder line where the shoulders are wider than eight feet.
10. Clean Up Rigbt of Way. Upon completion of the work, all brush, timber, scraps and material shall be entirely
removed and the right of way left in as presentable condition as before work started.
11. Standards of Construction. All work shall conform to recognized standards of construction.
12. Supervision of Grantor. All the work shall be done subject to the mpervision of, and m the satisfaction of, the grantor.
13. Future Moving of Installation. It is understood by the Permittee that whenever construction, reconstruction or
maintenance work on the highway may require, the installation provided for herein shall, upon request of the Grantor, be immediately
moved by, and at the sole expense of, the Permittee.
14. Expense of Inspection. On work which requires the presence of an employee of the Grantor as inspector, the salary, travel-
ing expense and other incidental expense of such inspection during the work shall be paid by the Permittee upon presentation of a bill
therefor.
Is. Liability for Damages. The Permittee is responsible for all liability for personal injury or property damage which
may arise out of work herein permitted, or which may arise out of failure on the Permittee's part to perform his obligations under this
permit in respect to maintenance. In the event any claim of such liability is made against the State of California, or any department,
officer, or employee thereof, Permittee shall defend, indemnify and hold them and each of them harmless from such claim. This permit shall
not be effective for any purpose unless and until the above named Permittee files with the Grantor, a surety bond in the form and amount
required by said Grantor, unless specifically exempted on the face hereof. The requirement that a bond be filed does not apply in the event
the Permittee is a governmental board which derives its revenue by taxation.
16. Making Repairs. If the Grantor shall so elect, repairs to paving which has been disturbed shall be made by employees
of the Grantor and the expenses thereof shall be borne by the Permittee, who shall purchase and deliver on the road the materials
necessary for said work as directed by the Grantor. All payments to laborers, inspectors, eta., employed by said Grantor for or on account
of the work herein contemplated, shall be made by said Permittee forthwith on receipt of written orders, pay rolls or vouchers approved
by Grantor. Or the Grantor may elect to require a deposit before Starting repairs, in an amount sufficient to cover the estimated cost thereof.
The Grantor will give reasonable notice of its election to make such repairs. If the Grantor does not so elect, the Permittee shall
make such repairs promptly. In every case the Permittee shall be responsible for restoring any portion of the highway which has been
cxovated or otherwise disturbed to its former condition as nearly as may be possible except where the Grantor elects to make repairs to
paving as above provided in this paragraph and except where provision to the contrary is made in the typewritten portion of the permit.
17. Care of Drainage. If the work herein contemplated shalt interfere with the established drainage, ample provision shall
be made by the Permittee to provide for it as may be directed by the Grantor.
18. Submit Location Plan. Upon completion of underground or surface work of consequence, the. Permittee shall furnish
plan to the Grantor's District Office showing location and details.
19. Maintenanec. The Permittee agrees by the acceptance of this permit to exercise reasonable care to maintain properly
any encroachment placed by it in the highway and to exercise reasonable care in inspecting for and immediately repairing and making
good any injury to any portion of the highway which occurs as a result of the maintenance of the encroachment in the highway or as a
result of the work done under this permit, including any and all injury to the highway which would not have occurred had such work
not been done or such encroachment not placed therein.
PIPES, CONDUITS, GAS PUMPS, ETC.
20. Crossing Roadway. Service and other small diameter pipes shall be jacked or otherwise forced underneath pavement
without disturbing same. Pavement or roadway shall not be cut unless specifically permitted on the face hereof. Service pipes will
not be permitted inside of metal culvert pipes used as drainage structures.
21. Limit Excavation. No excavation is to be made closer than eight (9) feet from the edge of the pavement except as may
be specified.
22. Tunneling. No tunneling will be permitted except on major work as may be specifically tat forth on the face hereof.
23. Deptb of Pipes. There shall be a minimum of two (2) feet of cover over all pipes or conduits.
24. Backfslling. All backfilling is to be moistened as necessary and thoroughly hand tamped, there being not less than
one camper to each shoveler. Whenever required by the grantor, a trench crossing the roadway shall be baekfilled with gravel or
crushed rock.
25. Preserve Surfacing Material. Whenever a gravel or crushed rock surface is trenched, such material shall be placed
at one aide and when backfilling is started the rock material shall be replaced to its original position.
26. Maintain Surface. The Permittee shall maintain the surface over structures placed hereunder as long as necessary.
27. Pipes Along Roadway. Pipes and utilities paralleling the pavement shall be located at the distance from traveled way
and at such depth as specifically directed on the face hereof. Cutting of tree roots will not be permitted.
POLES, WIRES, CABLES AND OVERHEAD STRUCTURES
28. Location Pole Liner, Or. Pole lines shall be located one foot from the property line union otherwise specified on the
face hereof.
29. Public Utilities Commfuion Orders. All oleasenw and type of construction shall be in accordance with the applicable
orders of the Public Utilities Commission of the State of California.
30. Permission from Property Owners. Whenever necessary to secure permission from abutting property owner$, such
authority must be secured by the Permittese prior to starting snarls.
31. Clearance of Trees. Poles most be of such height at to permit clearance over a tree 40 feet in height, where quick
growing trees are in place. At locations where slow growing trees are in plscq normal construction standard easy be followed at the
option of the pole line company, with provision to ultimately clear a 40 -foot tree.
33. Guy Wires. No guy wirer are w be attached to trees except on specific authority and in no event shall they be so
attached as to girdle the tree or interfere with its growth. Guy wires shall be kept at a minimum elevation of six fees above the ground
whenever so directed.
33. Clearing Around Polo. The Permitter shall remove and keep clear all vegetation from within a radius of at lent five
feet of the polo.
34. Painting or Visibility Strips. All poles are to be painted for a distance of six fees above the ground using whin lead
and oil or aluminum paint or in lieu thereof, when Polo have creosoted butte, wood, metal or other approved type of visibility strips may be
Placed. Wood strips are to be Douglas fir 1" x 3 ' -5' long placed on 6" centers about the base of pole and painted with white Ind and
oil or aluminum paint. If metal stripe are used such strips may be placed either vertically or borizontally. Paint is to be renewed as often
as may be required to maintain a satisfactory covering. If not painted when installed or renewed as the grantor may consider necessary,
the right is reserved to have this painting done and the Permitter hereby agrees to beat the cost thereof under the terms of this permit.

35. Remotes Old Poles, Guys and Stubs. The entire length of such timbers shall be removed from the ground and the holes
backfilled and thoroughly tamped.
PLANTING TREES
36. Location anal Species. The location and kind of trees to be planted shall be specified on the face of this permit.
37. Planting acrd Maintruanrr Cost. The Permitter must bear the cost of planting the trees. The arrangement as to
maintenance of the trees shall be specifically set forth on the face of the permit. In particular cases arrangements may be made for the
Grantor to do this work upon deposit of a certain sum for each tree which is to be panted. The Grantor reserves the right to assume the
maintenance or to decline to do so as conditions justify.
38. Group Planting. The cost of group plantings and similar special work which may be agreed upon with the Grantor
shall be borne by the Permittee. Land for such plantings shall be secured in fee by the Permitter and turned over to the State. Plantings
for parking and picnic grounds will not be considered in this connection.
REMOVAL OR TRIMMING OF ROADSIDE TREES
39. Removal of Trees. When permit is granted for removal of a tree u an independent operation or as a part of other
work, the entire stump shall be taken out for a depth of at least two fact blow the ground surface.
40. Clearing the Site. All timber and debris shall be removed from the right of way. The hole left by the stump shall be
backfilled and thoroughly tamped and the tire left in a presentable condition.
41. Trimming of Trees. In general, only light trimming of branches two inches or less in diameter will be permitted and
only when specifically so stated on the face hereof. The shapeliness of the tree must be preserved.
42. Inspection. If the permit requires inspection by the Grantor during progress of the work the cost of inspection shall be
borne by the Permittee. No charge will be made for occasional routine inspection.
Road Approaches, Connecting Pavements and Minor Work
43. Grades and Sped$svtiow. Grades and types of construction shall be as detailed by Plans or stated on the face
of this permit.
44. Borrow and Water. Only such borrow and waste will be permitted and within the limits an ao forth on the face of
this permit.
45. Minor Work. Grading down of small banks, small ditches, placing of awnings, and other similar minor work shall
be governed by the general provisions and as detailed on the face hereof.
Signs
46. Clearance of Signs. The minimum clearance from the sidewalk shall be twelve feet.
Railroad Crossings
47. Safety aid Convenience. The future safety and convenience of the traveling public shall be given every consideration
in the location and type of construction.
48. Meet Highway Grade. The grade and superelevation of the track must conform to the grade of the highway at
point of crossing.
49. Width of Paving. The crossing shall be planked or paved an may be specified on the face of this permit for the full
roadway and shoulder width.

SPECIAL PROVISIONS
(Roadside Improvements)

I. INSPECTION REQUIREMENTS
It is imperative that the permittee notify the following State Inspector
at least 48 hours prior to starting any work under this permit. State

All inspection costs incurred incidental to this work shall be borne by
the permittee.
II. CONSTRUCTION REQUIREMENTS
Unless otherwise detailed and authorized on the face of this permit, all
work shall be done in accordance with the Division of Highways Standard
Specifications dated January 1960, and the following special provisions:
(Only items pertaining to the applicable construction work will apply.)
A. Sidewalk shall be constructed with Class "A" Portland Cement Con -
cre a ree (3) inches in depth except at residential and com-
mercial driveways where four (4) inch and six 6) inch depths
respectively, will be required. (For three (3) inch depths, a
standard 2" x 4" header board will be required.)
Back edge of sidewalk shall be placed on the right -of -way line.
The finished grade of sidewalk shall have a cross fall of 1/4 inch
per foot. Concrete shall be scored on thirty (30) inch centers
provided that in joining existing concrete the score marks will
match.
B. Concrete curbs and gutters shall be constructed to authorized plan
grades or, n con ormance with existing curb for alignment and
grade. (State Standard type curb and gutter is required.) Grade
and alignment of portions of curb- returns lying outside the
Division of Highways right of way�Fave the approval of the
city or county involved.
Prior to the construction of new curbs, the permittee shall make
the necessary arrangements for the relocation of surface ob-
structions (such as utility poles, trees, etc.) to locations back
of the proposed curb, also continuation of curb line within the
following limits: Fifty (50) feet back from beginning of curb
construction and one hundred and fifty (150) feet beyond the end
of curb construction for safe traffic movement. Removal or re-
location of surface obstructions shall be done without expense to
the State.
C. Sections of existing concrete curbs and sidewalks to be removed
shall be cut on the nearest score marks beyond the limits of re-
moval. This concrete shall be removed to full depth and disposed
of outside the Division of Highways right of way. Unless a neat
cut is made without damage to remaining concrete, additional con-
crete shall be removed to the next score line, using a concrete
saw if considered necessary by the State Inspector.

D. (1) Concrete driveways shall be constructed in accordance with
the aETa—cFe-U Regulations for Standard Driveways.
(2) Concrete driveway shall be located to provide not less than
2 feet of u - e g curb between permittee's property line and
driveway. In those cases where the lot line does not intersect
the highway right -of -way line at 900, the extension of the pro-
perty line within the Division of Highways' right of way for
purposes of determining driveway locations, shall be on a line at
right angles to the curb or edge of traveled.way and passing
through permittee's lot corner.
E. Temporary driveways when authorized shall be constructed with
An a sur ac ng to a depth of not less than three (3) inches.
The edge of driveway shall be not less than five (5) feet from
permittee's side property line when curbs are not constructed.
Driveways shall be constructed at right angles to and shall join
existing surfacing. Radius of flared sections placed between
edges of pavement and driveway shall not exceed ten (10) feet,
unless a larger radius is authorized on face of permit.
Finished grade of surfacing placed between traveled way and curb
shall conform to existing shoulder grade.
This construction shall not interfere with the existing drainage
in any way.
The permittee understands and agrees that asphalt- concrete surface
driveways are temporary; at such time as concrete sidewalks are
constructed, asphalt- concrete surface driveways shall be replaced
with standard driveways of Portland Cement Concrete.
F. Roof drains, when authorized, must be restricted in use for the
exclusive purpose of draining rain water from the roof of
permittee's building and /or paved parking lot. Roof drains if
used for any other purpose, such as draining waste water or
domestic supply water onto the highway, will be summarily plugged
at curb face outlet by State forces.
Removal and replacement of concrete curb and sidewalk sections for
the installation of roof drains shall be done in accordance with
provisions of Paragraph "C" above.
G. Roadside landscaping, when authorized, shall conform with require-
ments g ven on e ace of the permit and /or the Landscaping
Regulations Brochure, if attached to this permit.

5. Special attention is directed to paragraphs 2,3,5, and 6
of the "General Provisions" printed on this form.
6. Should the Division of Highways' representative find work
in progress prior to his notification, he shall stop said work
for a period not less than the remainder of that working day.

SEALED PROPOSALS Will be received at the Office of the City Clerk, City gall,
Newport Beach, California, until 11:00 A.M. on the 18TH day of MARCH, 1964
at which time they will be publicly opened and read, for performing work as
follows:

SIGNALS AND WIDENING
No bid will be received unless it is made on a proposal form furnished by
the Public Works Department. Each bid must be accompanied by cash, certified
check of bidder's bond made payable to the City of Newport Beach, for an
amount equal to at least 10 percent of the amount bid, such guaranty to be
forfeited should the bidder to whom the contract is awarded fail to enter into
the contract.
In accordance with the provisions of Section 1770 of the Labor Code, the City
Council of the City of Newport Beach has ascertained the general prevailing
rate of per diem wages in the locality in which the work is to be performed
for each craft or type of workman or mechanic needed to execute the contract
• and is set forth in Resolution No. 5729 . A copy of said Resolution is
available in the office of the City Clerk in the City of Newport Beach.
All bids are to be compared on the basis of the Engineer's estimate of the
quantities of work to be done.
No bid will be accepted from a .Contractor who has not been licensed in accordance
with the provisions of Chapter 9, Division 111 of Business and Professions'
Code.
Plans and specifications, forms of proposals, bonds, and contract may be obtained
at the Public Works Department, City Hall, Newport Beach, California.
A non - refundable charge of $2.00 will be required for each set of Standard
Specifications. A refundable deposit of $5.00 will be required for each set
Of pl§ns, special provisions, and contract documents. NO REFUNDS WILL BE MADE LATER
THAN 00 DAYS AFTER AWARD OF BID.
The City of Newport Beach reserves the right to reject any or all bids and to
waive any informality in such bids.

ARISING OUT OF THE NATURE OF THE WORK AFORESAID, OR FROM THE ACTION OF THE ELEMENTS,
OR FROM ANY UNFORESEEN DIFFICULTIES. WHICH MAY ARISE OR BE ENCOUNTERED IN THE PROSECU-
TION OF THE WORK UNTIL ITS ACCEPTANCE BY THE CITY, AND FOR ALL RISKS OF EVERY

STANDARD SPECIFICATIONS
Sections 1 through 9 only of the Standard Specifications, City of
Newport Beach Public Works Department shall apply to this project.
All items not specifically covered therein, on the plane or by
these special provisions shall be governed by the applicable sections
of the Standard Specifications of the State of California, Division
of Highways, January 1960 Editions, hereafter referred to as the
State Standard Specifications.
SCOPE OF WORK
This contract involves pavement widening for channelization and the
installation of a traffic signal system on the Pacific Coast
Highway in the Vicinity of Orange Street in Newport Beach, California.
A
Special attention is directed to the fact that this is a cooperative
contract between the City of Newport Beach and the State of California,
Division of Highways.
WORKING TIME
The project shall be completed within 45 calendar days.

MAINTENANCE OF TRAFFIC
Attention is directed to Sections 7 -1.08 and 7 -1.09 of the State
Standard Specifications and these special provisions.
Public traffic shall be permitted to pass through the work with
as little inconvenience and delay as possible.
Connections between new and existing roadbeds shall not be constructed
until work can be completed without delay or interruption.
A minimum of two 10 -foot traffic lanes in each direction shall be
provided for the use of public traffic on the Coast Highway. Each
of the remaining legs of the intersecting streets shall have a minimum
of two 10 -foot lanes provided for the use of public traffic.
•
The existing overhead street light at Orange Street intersection
shall remain in operation until the new lighting system is placed
in service.

EXISTING UTILITIES
The City does not guarantee the completeness or accuracy of the
various information pertaining to overhead and underground utilities
shown on the plans. It shall be the responsibility of the Contractor
to contact th-e owners and /or operators Of.. all .utilities ; to determine
the location, size, type, direction and clearances of any and all
utilities in the work area.
• CLEARING AND GRUBBING
Clearing and' Grubbing shall conform to the provisions of Section 16
of the State Standard Specifications and these special provisions.
Full compensation for all costs involved in the clearing and grubbing
work required for this project shall be considered as included in the
unit contract prices paid for the various other contract items and no
other compensation will be allowed.

ROADWAY EXCAVATION
Roadway Excavation shall conform to the provisions of Section 19
of the State Standard Specifications and these special provisions.
All A. C. pavement excavated from the roadway, prisms shall be disposed
of outside the project right -of -way at the Contractors own expense.
At the contractors option, other excavated materials may be placed in
a single uncompacted six (6) inch layer on the undeveloped southerly
portions of the right -of -way.
Excavation work shall be so coordinated with the placing and
compacting of the aggregate base that not more than two (2) working
flays will elapse between start of excavation and completion of
aggregate base to the typical section limits shown on the plans. In
• no event shall the unfilled excavation areas be left open over Saturday..
Sundays or legal holidays.

WATERING
Developing water supply and applying water shall conform to the
provisions in Section 17 of the State Standard Specifications and

of the State Standard Specifications, shall be considered as
included in the prices paid for the various contract items of work
involving the use of water, and no separate payment will be made
• therefor.

AGGREGATE BASE

Aggregate base shall be Class 2 and shall conform 'to the provisions
in Section 26 of the State Standard Specifications and these special
provisions.
The grading for the 3/4 inch maximum aggregate shall be used.
At the time aggregate base is spread it shall have a moisture content
sufficient to obtain the required compaction. Such moisture shall be
uniformly distributed throughout the material.
The requirements of the first and second paragraphs in Section 26 -1.04
of the State Standard Specifications are superseded by the following:
• Aggregate bases shall be delivered to the roadbed as uniform
mixtures and each layer shall be spread in one operation.
Segregation shall be avoided and the base shall be free from
pockets of coarse or fine material.
The requirements of the fourth paragraph in Section 26 - 1.04 of the
State Standard Specifications are superseded by the following:
Aggregate bases, placed on road approaches and connections,
street intersection areas, median strip areas, shoulder areas
10 feet or less in width, and at locations which are inaccessible
to the spreading equipment, may be spread in one or more layers
by any means to obtain the specified results.
The requirements in the second paragraph in Section 26 - 1.04B of the
State Standard Specifications are superseded by the followingi

graders will not be permitted, except that motor graders may
be used to correct unavoidable segregation at edges and to
trim the surface of the aggregate base in order to finish the
base within the tolerances specified.

The requirements of Section 26 - 1.06 of the Standard Specifications
are superseded by the following:
Quantities of aggregate base will be measured by the ton or
cubic yard in accordance with the provisions in Section 9 - 1.01
of the Standard Specifications except that when aggregate base
-is paid for on a weight basis, the weight of material to be
paid for will be determined by deducting from the weight of material
delivered to the work, the weight of water in the material, at
the time of weighing, in excess of one percentage point more
than the optimum moisture content as determined by Test Method
No. Calif. 216. The weight of water deducted as provided herein
will not be paid for.
The requirements of the second paragraph of Section 26 - 1.07 of the
State Standard Specifications are superseded by the following:
The above prices and payments shall be full compensation for
furnishing all labor, materials (including water in the material
at the time of weighing), tools, equipment and incidentals,

base, complete in place, as shown on the plans, and as specified
in these specifications and the special provisions, and as directed by

ASPHALTIC CONCRETE PAVING
Type BI asphalt concrete shall conform to the provisions for type B
asphalt concrete in Section 39 of the State Standard Specifications
and these special provisions.
In lieu of the provisions in Section 39 - 2.04A, "Coarse and Fine
Aggregates," of the State Standard Specifications, the following shall
apply:
The aggregate shall be clean, hard, tough, durable, and sound
and shall be of uniform quality and free from decomposed
materials, vegetable matter and other deleterious substances.
Coarse aggregate shall consist of material retained on the No. 4
sieve of which at least 75 percent by weight shall be crushed
• particles.
Fine aggregate shall consist of material passing the No. 4 sieve.
The fine aggregate shall be composed of not less than 20 percent
by weight of material obtained by crushing and not more than
80 percent shall be natural sand. At least 20 percent by weight .*
of the material passing the No. 4 sieve and retained on the No.
8 sieve shall consist of crushed particles. In no case will
blending of the crushed and natural fine material in the same
storage be permitted.
The amount of crushing will be determined by Test Method No.
Calif. 205. A crushed particle is defined as one having at least
one mechanically fractured face.
The amount of natural material added shall be so limited that the
mixture of fine aggregate shall contain not less than the specified'
percentage of crushed particles.
When the combined aggregate is tested as provided in Section 39 - 2.04C,
"Tests ", of the State Standard Specifications, the stabilometer value shall
be 36 Min.
The penetration range of paving asphalt will be determti.ned by the Engineer.
The requirements of the ninth
paragraph in Section 39
- 3.04A of the

State Standard Specifications
will not apply,
• The required minimum rolling equipment specified in Section 39 - 5.03
of the State Standard Specifications may be reduced to one 2-axle
tandem roller, weighing at least 8 tons, for each paver under the following
conditions; provided it is demonstrated to the satisfaction of the
Engineer that one roller can perform the work.
(A) When asphalt concrete is placed at a rate of 50 tons,
. or less, per hour at any location. .. .
(B) When asphalt concrete is placed at a rate of 100 tons,
or less, per hour, and (1) is placed on miscellaneous
areas in accordance with the provisions in Section
39 - 7.01 of the State Standard Specifications, or (2)
when the width to be placed is less than 8 feet, or (3)
when the total thickness to be placed is less than 0.1 -foot.
When rolling equipment is reduced as provided herein, the rolling requirements
as provided in Section 39 - 6.03 of the State Standard Specifications may
be reduced to 3 complete coverages with said tandem roller.
The areas which are inaccessible to a roller shall be thoroughly compacted
to the lines, grades and cross section by means of pneumatic tampers,
or by other methods that will produce the same degree of compaction as
pneumatic tampers.
Samples for the Sand Equivalent Test, Test Method No. Calif. 217, shall
• be taken from the belt feeding the drier. The test shall be run on the
sample as taken from the belt without oven drying.
A prime coat of liquid asphalt SC -250 and asphaltic emulsion paint binder
shall be applied in conformance with the provisions in Section 39 - 4.02
of the State Standard Specifications. Asphaltic emulsion for paint binder
shall be mixing type, with paving asphalt, grade 60 - 70 as the bituminous
base.
The Contractor may use asphaltic emulsion, as above specified, to which
water has been added in the amount of 50 percent of the volume of the
original emulsion, for prime coat, in lieu of asphalt, SC -250.
Full compensation for asphaltic emulsion paint binder, and for liquid
asphalt, SC -250 or asphaltic emulsion prime coat, shall be considered
as included in the contract price paid per ton for asphalt concrete
(Type B1), and no separate payment will be made therefor.

ASPHALT CONCRETE DIKES
Asphalt Concrete Dikes shall be constructed in conformance with
the applicable sections of the State Standard Specifications and
these special provisions. Attention is directed to the fact that
the new dikes on the northerly curb returns are to be constructed
upon the existing pavement edge.
Quantities of dikes constructed of asphalt concrete will be paid
for at the unit contract price per ton for Asphalt Concrete and also
at the unit contract price per linear foot for Placing Asphalt
Concrete Dikes.

CONSTRUCTION SURVEYS
The Contractor shall be responsible for conducting all construction
surveying or "stake out" work required for this project.
The survey line and stationing indicated on the plans, locating
physical monuments set, shall be the basis of control for all
construction work undertaken under this contract.
The lump sum contract price for Construction Surveys shall be full
compensation for all staking, blue topping and other "stake out ".
No other compensation will be allowed.
STATE - FURNISHED MATERIALS
Attention is directed to Section 6 - 1.02 of the State Standard Specifications
and these special provisions.
Unless otherwise provided in this section, the Contractor shall submit
a written request to the Engineer for the delivery of State - furnished
material at least 15 days in advance of the date of its intended use.
The request shall state the quantity and type of each material.
All State - furnished material that is not used on the work shall remain
the property of the State and shall be delivered to the Engineer.
(A) Paint.- -Where paint and pretreatment washes for application in
the field are specified in these special provisions to be
furnished by the State, they will be furnished free of charge
at the site of the work.
The quantity of each type of paint required shall be determined
by the Contractor subject to verification by the Engineer.
(B) Traffic Signal Lamps.- -Lamps for traffic signal units will be
furnished free of charge to the Contractor at the site of
• the work.

SIGNALS SYSTEM AND LIGHTING
Furnishing and installing the traffic signal system and highway lighting
and payment therefor shall conform to the provisions.in Section 86 of the
State Standard Specifications.
Equipment list and drawings of electrical equipment and materials shall conform
to the provisions in Section 86 -1.03 of the State Standard Specifications.
Maintaining existing electrical systems shall conform to the provisions in
Section 86 -1.06 of the State Standard Specifications.
Foundations shall conform to the provisions in Section 86 -2.03 of the State
Standard Specifications and these special provisions.
In lieu of placing grout under base plate of each post, standard or pedestal
• located off of structures, the top 2 inches of the concrete foundation shall
be placed after the post, standard or pedestal is in proper position. The
exposed portions of the foundation shall be formed to present a neat
appearance.
Portland cement concrete shall be produced from commercially available
aggregates and cement. No sampling or testing, except visual inspection by
the Engineer, will be performed in connection with such concrete.
The concrete for post, standard and pedestal foundations shall contain not
less than 6 sacks of cement per cubic yard.
The concrete for detector foundations shall contain not less than 7 sacks
of cement per cubic yard or 6 sacks of cement per cubic yard using Type III
cement, conforming to ASTM Designation: C 150, or 6 sacks of cement per
cubic yard with the addition of calcium chloride conforming to the provisions
in Section 90- 1.08A, "Calcium Chloride ",.,of the State Standard Specifications:
The footings shown on the plans shall be extended if conditions require
additional depth and such additional work, if ordered by the Engineer, will
be paid for as extra work as provided in Section 4 -1.03D of the State
Standard Specifications.

CONDUIT
The provisions of this Section "Conduit" of these special provisions shall
supersede all the provisions in Section 86 -2.05, "Conduit ", of the State
Standard Specifications.
All conductors shall be run in conduit, except for overhead and temporary
installations and where conductors are run inside poles. Conduit to be
installed underground shall be rigid metal type manufactured of mild steel,
wrought iron or a silicon- bronze alloy containing at least 1.25 percent
silicon and shall conform to UL Publication UL -6 for Rigid Metallic Conduit.
Conduit to be installed on the surface of poles or in structures and
foundations shall be rigid metal type as specified above for underground
installations or rigid metal type manufactured of an aluminum -base alloy
containing no more than 0.40- percent copper and shall conform to
UL Publication UL -6 for Rigid Metallic Conduit.
• All conduit installed on the surface of poles or structures or other
exposed locations shall be unpainted zinc coated metal or aluminum.
Where signal conductors are run in lighting standards containing high
voltage series street lighting conductors, either the signal conductors or
the lighting conductors shall be encased in flexible or rigid metal conduit,
to a point where the 2 types of conductors are no longer in the same raceway.
Where telephone circuits are installed adjacent to higher voltage circuits,
the telephone conductors shall be encased in flexible metal conduit.
Installation of conduit shall conform to the provisions of the Code.
The size of conduit used shall be as shown'on the plans or as specified in
the special provisions.
Where pull boxes are installed adjacent to the base of a standard or a sign
structure post, conduit installed between pull boxes and base shall not be
less than 2 inches in diameter, unless otherwise shown on the plans.
It shall be the option of the Contractor, at his expense, to use conduit of
larger size than shown on the plans, if desired, and where used, it shall ...
be for the entire length of the run from outlet to outlet. No reducing
couplings will be permitted.
•

• The ends of all conduits, whether shop or field cut, shall be reamed to
remove burrs and rough edges. Cuts shall be made square and true so that
the ends will butt or come together for the full circumference thereof.
Slip joints or running threads will not be permitted for coupling conduit.
When a standard coupling cannot be used for coupling metal type conduit,
an approved threaded union coupling shall be used. The threads on all
ferrous metal conduit shall be painted with rust preventive paint before
couplings are made up. All couplings for metal type conduit shall be
screwed up until the ends of the conduits are brought together, providing
a good electrical connection throughout the entire length of the conduit
run. Where the coating on ferrous metal conduit has been damaged in
handling or installing, such damaged places shall be painted with rust
preventive paint.
Exposed ungalvanized threads on ferrous metal type conduit resulting from
field cuts shall be painted with rust preventive paint.
All metal type conduit ends shall be threaded and shall be capped with
standard pipe caps until wiring is started. When caps are removed, the
threaded ends shall be provided with approved conduit bushings.
Conduit stubs from electrolier bases shall extend at least 6 inches from
face of foundation and at least 18 inches below top of foundation. Conduit
stubs on structures shell be as shown on the plans.
The location of ends of all conduits in structures, or terminating at curbs,
shall be marked by a "Y" at least 3 inches high cut into the face of curb,
gutter or wall, directly above the conduit.
Conduit bends, except factory bends, shall have a radius of not less than
6 times the inside diameter of the conduit. Where factory bends are not
used, conduit shall be bent, without crimping or flattening, using the
longest radius practicable.
Conduit shall be laid to a depth of not less than 30 inches below highway
pavement grade in road areas and finished grade in all other areas.
Rigid metal conduit shall be palced under existing pavement by jacking or
drilling methods. Pavement shall not be disturbed without the approval of
the Engineer. In the event obstructions are encountered, upon approval of
the Engineer, small test holes may be cut in the pavement to locate
obstructions. Jacking or drilling pits shall be kept 2 feet clear of the
edge of any type of pavement wherever possible. Excessive use of water,
such that pavement might be undermined, or subgrade softened, will not be
permitted.

• Conduit terminating in standards or pedestals shall extend approximately
2 inches vertically above the foundation and shall be sloped towards the
handhole opening. Conduit entering concrete pull boxes shall terminate
2 inches inside the box wall and not less than 2 inches above the bottom,
and shall be sloped toward top of box to facilitate pulling of conductors.
Conduit entering through the bottom of a pull box shall be located near
the end walls to leave the major portion of the box clear. At all outlets,
conduits shall enter from the direction of the run.
Conduit for future use in structures, leading to points below grade of
pull box, shall be threaded and capped.
A No. 12 AWG galvanized pull wire shall be installed in all conduits which
are to receive future conductors. At least 2 feet of pull wire shall be
doubled back into the conduit at each termination.
Conduit runs shown on the plans are for bidding purposes only and may be
changed, with the approval of the Engineer, to avoid underground
obstructions.

PULL BOXES
Pull boxes shall conform to the provisions in Section 86 -2.06 of the
State Standard Specifications and these special provisions.
All No. 5 pull boxes shall be provided with recesses in the cover flange as
shown on the plans. Hangers shall be furnished when ballasts or transformers
are to be installed in the pull boxes.
Full compensation for pull box markers shall be considered as included in the
lump sum price paid for signals and lighting, and no separate payment will
be made therefor.

CONDUCTORS AND WIRING
Conductors and wiring shall conform to the provisions in Sections 86 -2.09
of the State Standard Specifications and these special provisions.
Insulation shall be TW Grade, polyvinyl chloride compound, conforming to
the specifications of ASTM Designation: D 734 for conductors No. 14 AWG and
larger and TF Grade for conductors No. 16 AWG and smaller.
All conductors in controller cabinets subject to flexing during opening of
the cabinet door or removal of equipment shall be stranded. Conductors
No. 14 AWG through No. 10 AWG inclusive shall be 19- strand and conductors
No. 16 AWG shall be 26- strand.
Conductors in traffic - actuated controller cabinets between service terminals
and the "AC +" terminals on external light relays (including connections to
• the police panel switches), the signal light neutral, and all conductors in
the highway lighting circuit within the controller cabinet shall be No. 10
AWG, or larger. All other conductors in the signal light circuits shall be
No. 14 AWG.
•
Permanent identification bands shall be made of 6 mil, oil resistant vinyl,.
pressure - sensitive material.
Soldering of pressure connectors may be omitted provided the connectors are
applied with a ratchet type crimping tool which will not release the
connector until the crimping operation is completed. The sleeve shall be
compressed on each end. The finished connection shall comply with the
requirements of Military Specification: MIL -T -7928.
Splices shall be insulated in conformance with "Method B" as shown on the
plans.
Tape for insulating splices (low and high voltage) shall be UL approved,
shall be resistant to ozone, corona and water and shall consist of the
following:
a. Self - fusing, flame - resistant, synthetic rubber.
b. Pressure- sensitive, adhesive, polyvinyl chloride.
• Where polyvinyl.chloride tape is used for a final layer, an electrical
insulating coating shall be used which shall be fast drying, resistant to
oil, acids, alkalies and corrosive atmospheric conditions and compatible
with the tape.
In lieu of the 600 -volt or the 5,000 -volt splice and splice insulation shown
on the plans, the Contractor may elect to use either:
a. A cast insulation of self- curing epoxy resin which is compatible
with wire insulation to form a moisture resistant joint. The resin shall
be resistant to weather and aromatic and straight chain solvents and, in
addition, shall not sustain combustion. The resin shall be poured into
molds of dimensions suitable for the splice; or
b. A pin and receptacle, locking type connector, with waterproof
housing, capable of being disconnected without damage.
The pin shall be of medium hard copper material with the portion to be crimped
onto the conductor fully annealed.
The receptacle shall be of copper material fully annealed.
The pin and the receptacle shall be of such size that they shall have at
least 90 percent conductivity when crimped onto the conductor ends. Both
• the pin and the receptacle shall have centrally located recessed locking
areas which shall match complementary areas of the housing.
The receptacle shall establish contact pressure with the pin through the use
of a copper beryllium sleeve spring and the receptacle and pin shall lock
together so that the connection will be maintained when a minimum force of
20 pounds tension pull is applied to the attached conductors.
Separate housings shall be provided for the pin and the receptacle, each
housing made of water resisting, synthetic rubber suitable for direct
burial in the ground or installation in the direct sunlight.
Each housing shall have an interior arrangement, complementary to the pin
and the receptacle, suitable to receive and securely retain the pin and the
receptacle, also a section to form a water -seal around the conductor and
also a section to provide a dater -seal between the housings at the point of
disconnection.
A small slot or vent shall be provided along the housings to permit the
exclusion of air. Sufficient silicon type insulating compound to fill all
the voids in the assembly shall be placed in the housings before
installing the pin and the receptacle.
The pin and receptacle connector shall be installed in accordance with the
manufacturer's instructions.

GALVANIZING
Galvanizing shall conform to the provisions in Section 86 -2.15 of the
State Standard Specifications and these special provisions.
Where galvanized surfaces have been damaged they shall be repaired in
conformance with State Standard Specification Section 66 -1.02G except
that the first paragraph of said Section 66 -1.02G is hereby revised as .
follows:
In lieu of the requirements of AASHO Designation: M 36, damaged
spelter coating shall be repaired by thoroughly wire brushing
the damaged area and removing all loose and cracked spelter
coating, after which the cleaned area shall be painted with 2
coats of paint conforming to the requirements of Federal
Specification MI1,-P- 21035. The paint shall be furnished by the
Contractor at his expense.
ELECTRICAL FIELD TESTS
Field tests shall conform to the provisions in Section 86 -2.14 of the State
Standard Specifications and these special provisions.
Tests shall not start on a Friday, or on the day preceding a holiday.
ELECTRICAL SERVICE
Service shall conform to the provisions in Section 86 -2.11 of the State
Standard Specifications and these special provisions.
The enclosure for service equipment may be constructed of material galvanized
prior to fabrication in lieu of galvanizing after fabrication as required
in said Section 86 -2.11. Other types of protective coating shall be approved
by the Engineer prior to installation.
Full compensation for labor and materials required for making the connection
between an existing service point, or a point established on the plan
where the service point will be, and the nearest pull box shall be
considered as included in the lump simm contract price for Signals and
• Lighting. '

Painting shall conform to the provisions in Section 86 -2.16 of the State

if equal in quality to the specified finish.
Paint for application in the field will be furnished by the State as
provided under "State- furnished Materials" of these special provisions.
New galvanized metal surfaces to be painted in the field shall be cleaned
as specified above before applying the vinyl wash primer specified in said
Section 86 -2.16.
The requirement for 2 finishing 'coats, of aluminum paint, specified in said
• Section 86 -2.16, shall also apply to exterior surfaces and ungalvanized steel
edges of raintight enclosures (switches, service control equipment,
transformers, eto.).

CONTROLLER, CABINET AND AUXILIARY EQUIPMENT
The controller, cabinet and auxiliary equipment for the traffic- actuated
signal system shall conform to the provisions in Section 86 -3 of the State
Standard Specifications and these special provisions.
The adjusted vehicle clearance interval for the traffic- actuated controller
shall remain constant regardless of the reason for phase termination.
Attention is directed to Section 86 -3.07C (1) of the State Standard
Specifications. Flashing mechanism with plug-in-base and plug-in-mounting
shall be independent of the controller and shall remain in operation upon
shutdown of the controller or removal of the controller from the cabinet.
Contact arms for external light relays shall be capable of carrying a
• current of 10 amperes per contact at 120 volts, 60 cycles, AC.
Relays for special control devices and external light relays for pedestrian
signals shall have double -pole, double -throw contacts and shall conform to
the requirements in Section 86 -3.07C (2) of the Standard Specifications.
The pedestrian interval timer assembly shall provide the following sequence
of operations:
a. Steady green "WALK" interval.
b. Flashing red "DON'T WALK" clearance interval.
C. Steady red "DON'T WALK" interval.
Indication b. shall occur during the clearance interval and shall be
accomplished by a separate flasher. The flasher for the pedestrian interval>
timer assembly shall conform to the provisions in said Section 86 -3.07C (1).

• Momentary contact switches shall be installed in the controller cabinet to
place calls on each phase. All switches shall be mounted on a single
readily accessible bracket and identified with labels.
Each momentary contact switch shall be phenolic enclosed switching; unit,
single -pole, double- throw, with screw type terminals, rated 15 amperes at
125 volts, AC and shall have the following characteristics:
Switch shall be the precision snap - active type.
Switch shall have an operating force of 9 to 13 ounces and minimum
release force of 4 ounces.
Pretravel shall be 164 -inch maximum.
Overtravel shall be 732 -inch minimum.
Differential travel shall be 0.0004 to 0.002 -inch.
Connectors on all equipment cables shall be provided with cable strain clamps.
Conductors and cables in the controller cabinet shall be as specified under
"Conductors and Wiring" of these special provisions.
• Receptacles for relays, timers, and flashers shall be of the type now in
general use by the Division of Highways.
The controller cabinet shall be equipped with an electric fan with ball or
roller bearings and a capacity of at least 100 cubic feet per minute.
The fan shall be mounted in a raintight housing attached to the top of the
controller cabinet.
The fan shall be thermostatically controlled and shall turn on at a
temperature inside the controller cabinet of 120 degrees and off at
100 degrees F.
The fan and cabinet ventilation holes shall be so located, with respect to
each other, so as.to direct the bulk of the air flow over the controller
case or through ventilating holes in the controller case, where such holes
exist.

PEDESTRIAN SIGNALS
Gas tube type pedestrian signals shall conform to the provisions in Section
86 -4.07 of the State Standard Specifications and these special provisions.
Pedestrian signals shall be Type A.
Messages shall be "WALK" and "DON'T WALK" in lieu of the "Walk" and "Wait"
provided in said Section 86 -4.07.
The word in the upper compartment when illuminated shall read "DON'T" in
red letters and the work "WALK" in the lower compartment shall appear green
or red as selected. In the lower compartment, clear red tubing without
blockout paint shall be placed in front of the green tubing to achieve the
dual color.
The surface behind the "WALK" tubing in the Type A signal shall be finished
• with flat black enamel in lieu,of the flat white enamel specified in said
Section 86 -4.07.
Acrylic plastic front for Type A signals shall be weather, craze and heat
resistant.
The housing for pedestrian signals shall be dustproof, weatherproof and
corrosion resistant and shall provide for easy access to, and replacement of,
all components.
Gaskets shall conform to the provisions in ASTM Designation: D 1056, Grade
SBE 42L.
The red words "DON'T" and "WALK" shall operate from a single transformer.
Each transformer shall have a power factor of not less than 90 percent.

The maximum luminaire brightness reading for luminaires with 400 -watt lamps
specified in said Section 86 -5.02 may be tested using a 1 -1/2 degree
circular field under the following test conditions:
Using a 1 -1/2 degree photoelectric brightness meter on the 90 degree
and 270 degree lateral angle line, the maximum luminaire brightness shall
not exceed 100- foot - lambers when meter is located at a horizontal distance
of 120 feet and a vertical distance of 7.5 feet between the luminaire and
• the meter, or at an angle of 3 degrees 35 minutes from the horizontal to
the line between the luminaire and the meter.
All mercury vapor luminaires shall be provided with glare shields.

The City or Newport Beach, a body politic and a

I municipal corporation of the State of California, hereinafter
referred to as "CITY ", and the State of California, Department
of Public Works, Division of Highways, hereinafter referred to
as "STATE ", do enter into the fallowing agreement:
WHEREAS, State and City contemplate installation of
traffic control signal system and highway lighting and con-
struction of roadwork at the intersection of Orange Street with
State Highway Route VII - Ora- 60 -NptB (Pacific Coast Highway),
all within the City of Newport Beach, and desire to specify the
proportionate share of the costs that are to be borne by City
and State and to arrange herein for maintenance;
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
SECTION I
Por and in consideration of the covenants and con-
ditions to be kept and performed by State as set forth herein,
City agrees:
(a) To furnish the traffic control signal system and
highway lighting and construct the roadwork hereinbefore
mentioned, through construction by City forces, or by contracts
with construction contractors licensed by the State of
California, said contracts to be carried out in accordance with
the laws governing City with reference to the character of the
work to be done thereunder, and to be completed in conformity
with plans and specifications of City or State, and to the
satisfaction of and subject to the approval of State.

(b) To bear the entire expense of preparation of
3 plans and specifications, except where
prepared by State, and
4 City's share of expense of the construction engineering costs,
5 and construction costs required to complete the traffic control
6 signal system and g y highway lighting referred to herein, such

share to be a sum bearing the same proportion to the total cost
8
of installation of the traffic control signal system and highway
9
lighting as the number of legs of highways under jurisdiction of
10
City at the intersection involved, bears to the total number of
11
legs of highways at such intersection.

(c) To reimburse State for City's proportionate
13
share of the cost of general maintenance and operation of said
14
lb traffic control signal system and highway lighting in the manner
16 provided in that Agreement for Maintenance of State highways in
17 the City which is in effect at the time said costs arise.
18 SECTION II
19 For and in consideration of the covenants and con -
20 ditions to be kept and performed by City as set forth in this
21 Agreement, State agrees:
22 (a) To reimburse City promptly upon rendition of
23 statement therefor, the entire expense of the construction
24 engineering costs and construction costs required to complete
26 the roadwork on Pacific Coast Highway, and State's share of
26 expense of the construction engineering costs and construction
27 costs required to complete the traffic control signal system and
28 highway lighting referred to herein, such share to be a sum
29 bearing the same proportion to the total cost of installation of
30 traffic control signal system and highway lighting as the number
31 of legs of highways under jurisdiction of State at the inter-
section involved, bears to the total number of legs of highways
at such intersection.

2 It is estimated that State's share is $18,000:
3 Roadwork on Pacific Coast Highway $10,000, Signals and Lighting
4 $8,000. The actual amount of State's share will be determined
5 after the traffic control signal and lighting installation and
6
roadway construction are completed, but in no event shall
7 State's share exceed $18,000 unless otherwise provided in a
8
subsequent agreement between City and State.

(b) State will maintain and operate the entire

traffic control signal system and highway lighting as constructed.

Attached is our preliminary construction cost estimate for subject project,
dated December 11, 1963-
Please note that this estimate does not include the costs of work which
will be accomplished by state forces such as painting traffic stripes,
furnishing signs, etc.
Quantities for roadway improvements were based on the following assumptions.
(1.) No resurfacing required over the existing 40 foot wide
"travelled way ".
(2.) The existing 8 foot paved shoulders on the Coast Highway will
be completely removed from beginning to end of project.
(3.) Existing street pavement outside the northerly highway shoulder
will not be removed or resurfaced, but all street pavement
outside the southerly shoulder will be replaced.
(4.) Any costs of flagmen, barricades, etc. are incidental to other
itmes of work.

volume with froe access of unlimited water. Unless otherwise nofnd the cover is assumed,to' weigh 130 pounds per
cubic foot. If it is desired to determine the pressure (p.s.i.( exerted in the test, than multiply the thickness of cover
by the factor .076.
Indicated Minimum Thickness of Cover is the final expression for evaluating the material as 'a subgrade
or base. From the retafion befween thickness indicated by sfabiiometer and thickness indicated by Expansion
Pressure, a saturated moisture density condition may be predicted for which the thickness of cover material re-
quired to prevent plastic' flow of the' underlying soil, will also provide sufficient weight to maintain the soil at
this state of density and thus limit the amount of moisture which can be absorbed.
This thickness is then reported as the indicated minimum thickness of cover and applies only to the condi-
tions of traffic and of pavement 'strength as shown on the test report.

MUNICIPAL CORPORATION, HEREINAFTER REFERRED TO AS "CITYTI AND PORTER, O'BRIEN
& ARMSTRONG, A PARTNERSHIP AND A LICENSED ENGINEERING FIRM, HEREINAFTER
REFERRED TO AS "ENGINEER";
WHEREAS, THE DEPARTMENT OF PUBLIC WORKS OF THE STATE OF CALIFORNIA
HAS APPROVED THE CONSTRUCTION OF A TRAFFIC SIGNAL SYSTEM AT THE INTERSECTION
OF PACIFIC COAST HIGHWAY AND ORANGE STREET IN NEWPORT BEACH; AND
WHEREAS, CITY WILL PARTICIPATE IN THE DESIGN AND CONSTRUCTION OF
SAID TRAFFIC SIGNAL SYSTEM; AND
WHEREAS, IN ORDER TO FACILITATE THE CONSTRUCTION OF SAID SYSTEM
IT IS NECESSARY FOR CITY TO PREPARE THE PLANS AND SPECIFICATIONS THEREFOR AND
TO HAVE THE WORK DONE UNDER A PUBLIC WORKS CONTRACT; AND
WHEREAS, ENGINEER HAS MADE A PROPOSAL TO PERFORM THE ENGINEERING
SERVICES IN CONNECTION WITH THE DESIGN AND THE PREPARATION OF PLANS AND SPECI-
FICATIONS FOR THIS PROJECT; AND
WHEREAS, CITY HAS FOUND SAID PROPOSAL TO BE ACCEPTABLE;
NOW, THEREFORE, THE PARTIES AGREE.
1. ENGINEER SHALL PERFORM THE FOLLOWING SERVICES WITH RESPECT TO
SAID PROJECT:
(A) MAKING A TOPOGRAPHIC SURVEY OF THE AREA OF THE INTERSECTION
AS NECESSARY TO CONSTRUCT A TRAFFIC SIGNAL SYSTEM AND INTERSECTION IMPR'OVE-
MENTS.
(B) DESIGN THE INSTALLATION OF SAID TRAFFIC SIGNAL SYSTEM AND
INTERSECTION IMPROVEMENTS AT THIS LOCATION.
(C) PREPARE PLANS AND SPECIFICATIONS NECESSARY TO CALL FOR
BIDS ON A PUBLIC WORKS PROJECT TO COMPLETE SAID CONSTRUCTION.
(D) PREPARE A COST ESTIMATE BASED UPON THE PLANS AND SPECIFICA-
TIONS PROVIDED BY ENGINEER.
(E) CONSULT WITH CITY AS NECESSARY ON THE EVALUATION OF THE

3. IN CONNECTION WITH THE PERFORMANCE OF THIS CONTRACT BY ENGINEER,
CITY SHALL FURNISH ENGINEER THE FOLLOWING:
(A) DRAWINGS OF THE PRESENT INTERSECTION INCLUDING AREAS ON
ALL SIDES OF THE INTERSECTION OF SUFFICIENT SIZE TO INCLUDE THE PROPOSED
IMPROVEMENT.
(B) STANDARD TRAFFIC SIGNAL DRAWINGS OF THE STATE DIVISION
OF HIGHWAYS.
(C) CRITERIA ACCEPTABLE TO THE DEPARTMENT OF PUBLIC WORKS OF
THE STATE OF CALIFORNIA FOR THE TYPE OF CONTROLLER, DETECTORS, SIGNALS;
AND LUMINAIRES AND ANY TRAFFIC CONTROL STUDIES APPLICABLE TO SAID INTER-
SECTION.
(D) A DESIGN SECTION FOR THE PROPOSED ROADWAY WIDENING.
(E) STANDARD TITLE AND PLAN SHEETS USED BY CITY.
4. ENGINEER SHALL COMPLETE THE WORK REQUIRED BY THIS CONTRACT WITHIN
60 DAYS FROM THE DATE HEREOF. SUCH WORK SHALL BE DONE TO THE SATISFACTION OF
THE PUBLIC WORKS DIRECTOR OF CITY.
5. IN CONSIDERATION OF THE WORK BY ENGINEERO CITY AGREES TO PAY
ENGINEER THE LUMP SUM PRICE OF $3,900.00, PAYABLE AS FOLLOWS:
(A) SEVENTY -FIVE PERCENT (75 %) SHALL BE PAID WITHIN 20 DAYS
AFTER DELIVERY OF THE PLANS, SPECIFICATIONS AND SURVEY TO THE PUBLIC WORKS
DIRECTOR OF CITY AND HIS APPROVAL THEREOF.

Gentlemen:
At your request we submit our proposal to do the subject work. It is our
understanding that the following information will be furnished our office:
1. "As Built" drawings of the present intersection, extending either
side of the intersection a sufficient distance to include the new design
area.
2. Standard Traffic Signal drawings of the State Division of Highways.
3. Criteria for the type of controller, detectors, signals, luminaires,
etc. desired along with any preliminary traffic control studies.
4. Design section for the proposed roadway widening.
5. Standard City of Newport title and plan sheets.
We propose to conduct the necessary surveys, and design to prepare contract
plans, construction drawings and cost estimate to construct the subject work

side of the intersection a sufficient distance to include the new design
area.
2. Standard Traffic Signal drawings of the State Division of Highways.
3. Criteria for the type of controller, detectors, signals, luminaires,
etc. desired along with any preliminary traffic control studies.
4. Design section for the proposed roadway widening.
5. Standard City of Newport title and plan sheets.
We propose to conduct the necessary surveys, and design to prepare contract
plans, construction drawings and cost estimate to construct the subject work
for the lump sum price of 3,900.00.

Further reference is made to the investigation
of traffic conditions at the intersection of Pacific Coast
Highway with Orange Street. As a result of our study, it
is proposed to install traffic signals and safety lighting,
provide painted channelization, improve the shoulder areas
on Pacific Coast Highway and develop the road connections
on both legs of Orange Street. A copy of the traffic report
is attached.
In order to accommodate the proposed ehannelization,
it will be necessary to prohibit parking on both sides of
Pacific Coast Highway on the approaches to Orange Street:
The City is requested to pass an ordinance to that effect
at the time of the installation.
The cost of the signal and lighting installation
will be shared by the City of Newport Beach and State on a
50 -50 basis. A preliminary estimate indicates that the
City's share, exclusive of engineering and contingencies,
will be approximately $13,000: Signals and lighting $101000

It is understood that the City will prepare the
plans and specifications and administer the contract for the
work. Please advise at your earliest convenience if this is
the City's intent. Upon receipt of your estimate of cost and
application for an Encroachment Permit a cooperative agreement
will be prepared and forwarded to the City for execution.

QXN11RAL: Route 6Q is on the California Freeway and
Expressway System and 1s also on the present
State Highway System. VW District VIi
1964 -71 Pineal Year Planning Program, approved
June 28, 1963, includes a project for the
replaeoent of existing Route 60 on Pacific
Coast Sighway by the Route 60 Freeway, with
construction indicated for after the 1970 -71
fiscal year:,
Pacific Coast Highway is a south- north, 4 -lane
undivided highway running west to east through
this area. The intersection with Orange Street
is located in a residential area now under
development in the northwest portion of the
City of Newport Beeoh; Orange Street is an
unstriped City street, 32 feet wide on the
north leg, 25 feet wide on the south leg,
and serves as the only access from the beach

from all City streets except Gramme Street on

vehicular OW pedestrian traffic at the

Traffic is presently controlled by Rn (Stop)
signs facing traffic on Orange Street. The
nearest existing traffie signals on Route 60
are located at Supariow Avenue - Balboa ilvaisvard,
0.8 arils to the east and at Srookhurst Streets

is sated for 45 miles per hour through this

As you know, the City is quite �suce to receive a%Q�Go -Nye;
Division of Highways approval for the installation of a
traffic signal at the intersection of Pacific Coast Highway ����
and Orange Street. You indicated several months ago, in
the meeting we had in your office, that if access to the
intersection from the northerly side of the Highway could
be improved and conflicting left -turn moves easterly of
Orange Street reduced chances for approval would be improved.
The paving of Orange Street from the Highway to Newport
Shores Drive and Newport Shores Drive from Orange Street
easterly will be completed within the next month or two.
O This will provide access to the intersection for all of
the new development. The City Council, at their January 14,
1963, meeting agreed to authorize the installation of signs
when the signal is installed. Left -turns onto Coast High-
way from all streets and alleys easterly of Orange Street
except 60th Street and Prospect Street will be prohibited.
I believe if you would again review the situation in
light of these changed conditions you would now find that
the necessary warrants are more than satisfied. The instal-
lation of a traffic signal at.thia location would greatly
reduce the present hazards to motorists and pedestrians in
the area without unduly delaying traffic on Pacific Coast
Highway.

As you know, the.City is quite anxious to receive
Division of Highways a #proval for the installation of a
traffic signal at the intersection of Pacific Coast Highway
and-orange Street. You indicated several`months aqo, in
the matting we had in your office, that if access to the
intersection from the northerly side of the Highway could
be improved and conflicting left -turn stoves easterly of
Orange street reduced chances -'for approval would be improved.
The paving of orange Street from the highway to Newport
Shores Drive and Newport Shores Drive from orange Street
easterly will be completed within the next month or two.
This will provide access to the intersection for all of
the new development. The City Council, at their January 14,
1963, meeting agreed to authorise the installation of signs
when the signal is installed. Left -turns onto Coast High-
way from all streets and alleys easterly of orange Street
except 60th street and prospect Street will be prohibited.
2 believe if you would again review the situation in
light of these changed conditions you would now find that
the necessary warrants are more than satisfied. The instal-
lation of a traffic signal at this location would greatly
reduce the present hazards to motorists and pedestrians in
the area without unduly delaying traffic on Pacific Coast.

STREETS AND ALLEYS BETWEEN 60TH STREET AND ORANGE STREET EXCEPT
69TH STREET, PROSPECT STREET, AND ORANGE STREET AFTER A TRAFFIC
SIGNAL IS INSTALLED AT THE INTERSECTION OF COAST HIGHWAY AND
ORANGE STREET.
THE CITY HAS FOR SOME TIME BEEN ATTEMPTING TO CONVINCE THE STATE DIVI-
SION OF HIGHWAYS OF THE NEED FOR A TRAFFIC SIGNAL AT THE INTERSECTION OF COAST
HIGHWAY AND ORANGE STREET. THE STATE HAS INDICATED THE'WARRANTS ARE CLOSE TO
BEING SATISFIED, BUT THEY ARE CONCERNED ABOUT THE LACK OF'ACCESS TO THE INTER-
SECTION FROM THE NEWPORT SHORES AREA AND THE CONFLICTING LEFT -TURNS ONTO THE HIGH-
WAY EASTERLY OF ORANGE STREET.
THE DEVELOPER OF NEWPORT SHORES HAS INDICATED THAT NEWPORT SHORES
DRIVE AND ORANGE STREET WILL BE PAVED SHORTLY, WHICH WILL PROVIDE ACCESS TO THE
INTERSECTION. A LETTER WAS SENT TO THE COMMUNITY ASSOCIATION AND DISTRIBUTED TO
ALL PROPERTY OWNERS BETWEEN THE-HIGHWAY AND NEWPORT SHORES DRIVE RELATIVE TO THE
POSSIBILITY OF PROHIBITING ALL LEFT -TURNS ONTO THE HIGHWAY EXCEPT AT 60TH STREET,
PROSPECT STREET, AND ORANGE STREET. THE ASSOCIATION HAS INDICATED THEY HAVE NO
OBJECTION TO THE PROPOSAL. THE ONLY OBJECTION RECEIVED HAS BEEN FROM MR. AND
MRS. WILLIAM KACHIG, OWNERS OF THE NEWPORT SHORES MOTEL LOCATED AT 6600 WEST
COAST HIGHWAY.
ALTHOUGH THE DIVISION OF HIGHWAYS HAS MADE, NO COMMITMENT, IT IS
FELT THE CHANCES FOR APPROVAL WOULD BE CONSIDERABLY ENHANCED IF THE STATE WERE

The Board feels, as you mentioned, that this would
be the less complicated method of control, there-

1. The commercial properties with highway frontage will in NO WAY BENEFIT
from this proposal.

Highway BOTli RIGHT AND LEFT HAND TURNS DEMANDED for survival
of such businesses situated on the Coast Highway with Highway
FRONTAGE. These commercial properties PAY TAXES to the City
of Newport Beach FOR THE PRIVILEGE of being situated on the
Pacific Coast Highway, U. S. 101 Alternate and the business
created by being so situated.
We protest the proposal.

of the traffic signal as planned will forestall any necessity for such
drastic action. The circumstance for such action has as yet, not been

ALTHOUGH THE DIVISION OF HIGHWAYS SEEMS TO UNDERSTAND THE PROBLEM IN THE
AREAS THEY POINTED OUT THAT THE RESULTS OF ALL THEIR PAST STUDIES DO NOT
MEET THE MINIMUM WARRANTS REQUIRED TO JUSTIFY A TRAFFIC SIGNAL INSTAL-

THERE IS SOME QUESTION WHETHER THE PHYSICAL BARRICADING OF THE STREETS
WOULD BE LEGALLY POSSIBLE. OF THE OTHER TWO ALTERNATIVES, THREE COULD BE

HIGHWAYS IN WHICH WE SUGGEST THAT THEY REVIEW SIGNAL WARRANTS AT 61ST
STREET AND AT ORANGE STREET AFTER FULL DEVELOPMENT OF NEWPORT SNORES.
WE HAVE EXAMINED THEIR WARRANTS WHICH WERE MADE JUNE LASTS AND
DO CONCUR IN THEIR FiNDiNO3. THESE WARRANTS DID NOT JUSTIFY INSTALLA-
TION OF SIGNALS DUE TO GREATLY INSUFFICIENT PEDESTRIAN MOVEMENT AND
VERY MINOR VEHICULAR MOVEMENT ENTERING COAST HIGHWAY FROM THE SIDE
STREET.
YOUR INTEREST IN THE IMPROVEMENT OF TRAFFIC SAFETY UPON OUR

Reference is made to your letter of May 22, 1961
Dilative to traffic conditions on Pacific Coast highway in
the vicinity of the Newport Shores residential tract.
As a result of your request, we have made an additional
investigation In this area. This study included a review of the
accident history, traffic counts covering both morning and
evening peak geriods, and a field investigation of physical
conditions. Gur previous investigation covered conditims at
the intersection with orange Street, as this is the only location
through this area with access to both aides of Pacific Coast
Highway. Our new investigation also included the intersection
of Pacific Coast Highway with 61st Street In accordance with
your request.
A review of the accident history for the one and one-
half year period from January 1, 1960 to date revealed two
reported aoaidenta at the intersection with Orange Street and
no accidents at the intersection with 61st Street. The first
accident at Orange Street was of the rear -end type caused by one
vehicle slowing down to turn into the intersection. The second
was a side swipe of two vehicles traveling in the same direction.
Neither of these accidents are considered susceptible of cor-
rection by the installation of traffic signals.
Traffic signals are valuable for designating vehicular
and pedestrian right of way but are not safety devices. Before
signals are installed, certain nationally accepted warrants
should be met which are based on traffic volumes and other
factors which have been determined from analysis of data from a
large number of signal installations, co:-pled with the judgment
of engineers with long experience in this field. In our recent
Investigations none of these warrants were satisfied at the
locations investigated.
