THIS AGREEMENT entered into this _ day of

ORANGE,COUNTY FLOOD CONTROL DISTRICT
hereinafter referred to as "District?`,
CITY OF NEWPORT BEACH, hereinafter
referred to as "City ".
R E C I T A L S
A. City has heretofore acquired rights of way recorded
in Book 6135, Page 155, Official Records of Orange County, for
the realignment of that portion of Jamboree Road that crosses
San Diego Creek Channel.
B. District has acquired rights of way recorded in
Book 6462, Page 165, of said Official Records, upstream of said
Jamboree Road right of way for the improvement of San Diego
Creek Channel, which channel is project F5 of the Engineer's
Report dated March 1955.
C. City, in the improvement of Jamboree Road, plans
on an 80' bridge at the present crossing of San Diego Creek
Channel; said 80' bridge would provide hydraulic capacity equal
to the existing bridge.
D. District's proposed improvement for San Diego Creek
Channel would require a bridge approximately 360' in length at
its crossing of Jamboree Road. For the purpose. of this agree-
ment, bridge length shall be measured parallel to the center
line of the roadway, and shall extend from outside to outside
of the end abutments.
It is deemed mutually advantageous for District and City
to enter into an agreement to share the costs of construction

of a bridge of the ultimate length necessary to span the pro-
posed channel as a part of City's plans for the improvement
of Jamboree Road.
NOW, THEREFORE, it is agreed as follows:
1. City shall undertake all work necessary for the
preparation of plans and specifications for the improvement
of Jamboree Road. Said plans shall include a bridge approxi-
mately 360' in length at the crossing of San Diego Creek Channel.
The width of the bridge shall provide for 2 standard traffic
lanes and a sidewalk for pedestrians. Provision for future
widening of the bridge shall be made in the design.
2. Upon approval of said plans and specifications by
District, and other agencies as may be required by law, or
agreement, City shall promptly advertise the same for bids,
receive and open bids and award a contract for the construction
to the lowest responsible bidder, if any.
3. The construction contemplated by this agreement
shall be under the direction and control of City, except that
District may also furnish an inspector for the bridge at San
Diego Creek Channel. In case of disagreement between District's
and City's inspectors, such disagreement shall be referred to
City's Director of Public Works for resolution.
4. The bridge costs shall include the cost of construction
of the substructure and superstructure, wingwalls and abutments
and incidental appurtenances thereto. Said bridge costs do not
include the cost of any asphalt surfacing, channel work, or
embankment construction and approach features. Within 45 days
of demand, District shall pay to City 280/360 of the acceptable
low bidder's construction costs for said bridge construction
as herein contemplated; said demand, however, shall not be made
prior to award of contract.

1 5. After completion of the work and filing of Notice
2 of.Completion, City shall determine the actual betterment cost
3 of said bridge construction, which betterment cost shall be
4 280/360 of the actual payment made to the Contractor, as outlined
5 in paragraph 4 above. If the final cost payable by District
6 is less than the amount previously paid, City shall refund to
7 District promptly the difference. If the final cost payable
8 by District is greater than the amount previously paid, District
9 shall, upon demand, promptly pay the difference to City.
10 6. In the event that the final design of the bridge
11 provides for a length other than 360', the City share shall be
12 modified to the proportion of 80' divided by the actual length
13 and the District share shall be the remainder of the bridge
14 cost as defined above.
15 7. District also agrees to pay to City a sum equal to
16 10% of District's share of the construction cost as compensation
17 for the costs of engineering, administration, and inspection.
18 The method of payment shall be the same as provided above for
19 construction costs.
20 8. From and after completion of said construction,
21 maintenance of the bridge shall be the responsibility of City.
22 9. It is estimated that District's total cost under this
23 agreement including engineering, administration, and inspection
24 will be $125,000. If the lowest responsible bid received by
25 City is such that District's cost would exceed the above amount
26 by more than ten percent (10 %), District's written concurrence,
27 will be required prior to award of contract in order to obligate
28 District for any cost in excess of $137,500.

to sign the Joint Powers Agreement No. BA63F5 -107 dated November
1, 1963, between the Orange County Flood Control District and
the City of Newport Beach for the lengthening of the Jamboree
Road bridge over the San Diego Creek Channel to its ultimately
required length.

Subject: Agreement with Orange County Flood Control
District on Jamboree Road Bridge
Transmitted is a copy of a proposed agreement with the
Orange County Flood Control District under which the
City and District will share the cost of constructing
a bridge on Jamboree Road across the San Diego Creek
Channel. Also transmitted is a resolution which, if
adopted by the City Council, will authorize the exe-
cution of the contract upon its being approved by the
Board of Supervisors.
It is requested this matter be submitted to the City
Council for consideration at the meeting on October 28,
1963.
