1 CONTRACT FOR ENGINEERING

SERVICES
3� THIS AGREEMENT is made and entered into this lo day of
4I A 1963, by and between the CITY OF NEWPORT BEACH, a
5I municipal corporation, hereinafter referred to as "City ", and
6 PORTER, O'BRIEN & ARMSTRONG, a partnership and a licensed engineer -
71 ing firm, hereinafter referred to as "Engineers ";
s WHEREAS, City intends to realign Jamboree Road between
9 Back Bay Drive (formerly known as Bayside Drive) and Palisades
10 Road, and to construct a bridge over the San Diego Creek drainage
11 channel, hereinafter referred to as "Project "; and
12 WHEREAS, engineering services are necessary in connection
13 with said project consisting of plans and specifications for said
14 project; and
15 WHEREAS, Engineers have furnished City with plans and
16 specifications for the "project" pursuant to a contract between
17 said parties entered into on January 4, 1963; and
18 WHEREAS, City has decided to make substantial changes in
19 the "project" which will necessitate additional engineering serv-
20 ices, including a revision of the plans and specifications previous]
21 submitted by Engineers; and
22 WHEREAS, Engineers have submitted a proposal to perform
23 such additional engineering services and to revise said plans and
24 specifications;
25 NOW, THEREFORE, the parties agree as follows:
26 I. Scope of Work. Engineers agree to perform the fol-
27 lowing services:
28 (a) To furnish revised plans, specifications and
29 cost estimates for the project, including, but not necessarily
30 limited to, the following specific items:
31 (1) To design and to furnish plans and speci-
32 fications for a bridge across the San Diego Creek channel.

1� The bridge shall be designed with a length of approximatel
2 360 feet and a width of 33 feet with sidewalk and with
3f provision for future widening.
4 (2) To prepare an economic analysis of alternat
511 bridge designs in order to aid in determining the most
6lI economical structure consistent with design requirements.
7I (3) To conduct additional subsurface investiga-
8 tion needed as the result of the increased length of the
9 bridge.
10 (4) Revision of grading, drainage and other
11 details necessitated by the changes in the bridge design.
12 (b) The revised plans and specifications shall
13 include special provisions, all of which shall be suitable for
14 use by City to call for competitive bids.
15 (c) All drawings shall be prepared in ink on stand
16 Mylar sheets which will be furnished by City.
17 II. Checking of shop drawings and revision of plans and
lg specifications as necessary to accommodate conditions discovered
19 during construction shall be included within the contract price
2011 hereinafter stated.
21 III. Engineersshall be available for consultations with
22 the Public Works Director and his staff regarding interpretation
23 of the plans and other problems which may from time to time arise
24 at no additional cost to City.
25 IV. Original drawings, reports, notes, maps, and other
261documents shall become the property of the City and may be repro -
27 duced as deemed necessary by the Public Works Director.
28 V. Engineering work, except bridge design, shall be per -
29 formed in the Newport Beach offices of Engineers.
30 VI. City reserves the right to terminate this contract
31 at any time by giving Engineers three (3) days' prior written notice
32 either by personal service or by placing said notice in the United

States mails, postage prepaid, addressed to any of Engineers' busi-
ness offices. In the event that City shall terminate this contract
it shall reimburse Engineers on the basis of its actual payroll
costs incurred to the date of termination plus 110 %.
VII. All plans, specifications, and other documents for
the project shall be completed to the satisfaction of the Public
Works Director of City and delivered to him within 90 calendar
days following the execution of this agreement by the City.
VIII. In consideration of the performance of the above-
described engineering services, City agrees to pay Engineers the
actual costs of said services computed on the basis of the follow-
ing fee schedule, but in no event shall the City be obligated to
pay more than the total sum of $14,400.00.

Payment shall be made on the following basis after sub-
mission to the Public Works Director of an itemized statement:
(a) Seventy -five per cent (75 %) to be paid
within 20 days after submission of the completed plans,
specifications, and additional subsurface investigation
to the Public Works Director.
(b) Twenty per cent (20 %) to be paid within 30
days after approval of the plans and specifications by
the City Council, but in any event not later than 90 days
after delivery of the plans and specifications.

lI! (c) The final five per cent (5 %) to be paid
21 upon acceptance of the construction work by the City
31 Council, but in any event not later than 18 months after

4i submission of the plans and specifications to the Public
51 Works Director.

6 In addition, City shall reimburse Engineersfor the actual
7 cost of reproduction of copies of said plans, specifications and
8 related documents requested by city.
9 IN WITNESS WHEREOF, the parties have executed this con -
10 tract as of the day and year first above written.

Transmitted is a copy of the proposed contract with Porter,
O'Brien & Armstrong for engineering services in connection with
the revision of the plans and specifications for the Jamboree
Road realignment project, together with a resolution which, if
adopted by the City Council, will approve the same and authorize
its execution on behalf of the City.
The contract has been forwarded to the Public Works Director to
obtain its execution by the engineers, after which it should be
presented to the Council for consideration along with the subject
resolution.
