The eligible portions of this Select System project are approved for matchinz fund credit as set forth in the Collier -Unruh Act subject to the following provisions: -� 1) Additional materials sar.­,ples should be taken before or during construction to substantiate proposed structural section for the roadway. 2) Matchin; fund credit will be allowed for City funds expended on right of way and on eligible construction items. In considera- tion of work eligible for matching credit, it should be noted that the 23th Street connection between Balboa and Newport Boulevards is not on the City's interim Select System. Further, the proposed widening of 28th Street does not appear to have been made necessary because of grade change or similar control on the Select System Street. Therefore, the cost of roadwork beyond the limits on curb returns on Balboa Boulevard is not considered eligible for matching credit. Contract Items Nos. 2, 23 (portion), 24, 25 and 26 involved in sanitary sewer construction and Items 27 through 34 involved in crater line construction are not eligible for gas tax expenditure or matching fund credit. Hudson Partner C CITY OF NEWPORT BEACH CITY ATTORNEY DEPARTME NT March 19, 1964 To: The Honorable Mayor and City Council From: City Attorney Subject: Pacific Electric and Southern Pacific acquisition We had a meeting with Mr. Leo Brown of the railroad companies on Wednesday, March 18, 1964, concerning the City's acquisition and immediate possession of the property. As a result thereof, a letter authorizing the City to take imme- diate possession was prepared by the companies and transmitted to the City. A copy is attached. Authorization for possession is subject to the City's executing the original copy of the letter and returning it to the companies. The following motion would be proper to authorize the signing of the letter on behalf of the City: "The Mayor and City Clerk are authorized and directed to execute the original of the letter from Southern Pacific Company and Pacific Electric Railway Company in which the City is authorized to take possession of the property which is.in the process of being purchased by the City of Newport Beach and under which the City would agree to hold the companies harmless from liability arising by virtue of the City's taking possession of the property." A draft of the deed on the portion of the station property within the 100 -foot strip of the Southern Pacific property and a draft of a deed of all of the remainder of the property along Balboa Boulevard constituting 19 parcels have been prepared and submit- ted to the City. Each of the deeds contains a reservation and exception of the mineral rights to the grantor. This exception and reservation was discussed with Mr. Brown on Wednesday and he indicated that all of the property they sell is sold subject to this exception and it was their intention throughout the negoti- ations to except and reserve mineral rights on all of the property now being sold to Newport Beach. The conveyances on the prior purchases by Newport Beach along Newport Boulevard contained similar exceptions and reservations. The City Council should decide if it is acceptable for the exception and reservation to be included in the conveyances. If so, the documents will be approved subject to this exception and reservation. However, the documents differ in language and a proposed paragraph has been To: The Honorable Mayor and City Council -2- March 19, 1964 prepared for the conveyances under which the exception would apply only below a depth of 500 feet and would not permit surface entry or the impairment of the lateral or subjacent support of the land or improvements and would not permit penetration within 500 feet of the surface, and further that the exception and reservation is subject to state and local laws.
