20 of water main with COUNTY'S Fifteenth Street and Placentia Avenue

25 struction cent for the parties to do and perform all thins
26 necessary in order to ;relocate the fortioa of water main on
27 PlUteanth Street from approximately 434 feet west of the
23 caliterliiae of Placentia Avenue easterly approxLmately 422 feet,
29 and on Placentia Avenue from 15 feet north of the centerline
30 of Fifteenth Street :southerly approximately 349 feet, all as
31 more particularly delineated on CITY plans for the relocation
32 of 24" water main on Fifteenth Street and Placentia Avenue

1 designated drawing Ilo. W- 5009 -S, dated 11/22/63, revised
2 1/20/64, and to execute and deliver all documents required in
3 con =nection ;.;ith the construction and completion of said
41 project including Certificate of Cost and Certificate of
5 Completion of Project.
6 b. During the period of construction have jurisdiction
7 over the total construction project including relocation of
s the water ;vain.
9 2. CITY SMALL, at all times during the progress of relocation
10 of said portion of water main, have access to the work thereon for
11 the purpose of inspection thereof, and shall supply any raid all
12 inspection necessary to insure adequacy of work perfornad on the
13 water main, and should CITY deem any remedial u°asures to be necessary,
14 CITY shall notify CCL'11'PY thereof.
15 3. The estimated cost of the relocation of said portion of
16 water main is approximately Y4,Jt10, eccluding engineering and overhead.
17 If the lcraest responsible bid received by CCb°lv"rY is such that CITY's
18 share of the construction cost will e_:ceed ;54•,900, CITY'S written
19 consent will be necessary in order to obligate CITY for any cost in
20 excess of $4,900.
21 4. Upon completions of relocation of said ,portion of water
22 main, COUN"EY shall submit full, true and correct copies of documents,
23 certificates, and itemized bills to said CITY and CITY shall reimburse
24 CC;31-1TY within 33 days upon of such costs. Such bills
25 shall be based on the actual quantities of construction and the unit:
26 prices bid for the contract, and shall not contain any charges for
27i engineerinG or inspection nor any charge for overhead.
28 5. CITY'S share of the construction cost shall be determined
29 on the basis of the full and actual amount of work done in relocating
30 said portion of water main.

A regular meeting of the Board of Supervisors of Orange County, California, also
sitting as the Governing Board of the Districts governed by the Board of Supervisors, was
held March 31 , 1964, at 9:30 A.M. The following members being present: William J.
Phillips, Chairman; C. M. Featherly, David L. Baker, Wm. Hirstein, Alton E. Allen and the
Clerk.
IN RE: AGREEMENT LOWERING OF CITY OWNED WATER MAIN
ON FIFTEENTH STREET AND PLACENTIA AVENUE CITY OF
NEWPORT BEACH
On motion of Supervisor Allen, duly seconded and
unanimously carried, the Chairman and the Clerk are authorized
to sign the Agreement dated March 23, 1964 between the County
of Orange and the City of Newport Beach in connection with the
lowering of a city -owned water main on Fifteenth Street and on
Placentia Avenue by the County.

19 economics and public safety to combine the relocation of said portion
20 of water main with COUNTY'S Fifteenth Street and Placentia Avenue
21 improvement project;
22 NOW, THEREFORE, IT IS AGREED by the parties hereto as follows-
23 1. COUNTY SHALL:
24 a. Be and is hereby designated as contracting and con -
25 struction agent for the parties to do and perform all things
26 necessary in order to relocate the portion of water main on
27 fifteenth Street from approximately 434 feet west of tae
28 centerline of Placentia Avenue easterly approximately 422 feet,
29 and on Placentia Avenue from 15 feet north of the centerline
30 of Fifteenth Street southerly approximately 349 feet, all as
31 more particularly delineated on CITY plans for the relocation
32 of 24" water main on Fifteenth Street and Placentia Avenue

3. The estimated cost of the relocation of said portion of
water wain is approximately $4, 900, excluding engineering and overhead.
If the lowest responsible bid received by COUNTY is each that CrTY's
share of the constriction cost will exceed *.4,900, CITY'S written
consent will be necessary in order to obligate CITY for any cost in
excess of $4,900.
4. Upon completion of relocation of said portion of water
main, COUNTY shall submit full, true and correct copies of documents,
certificates, and itemized bills to said CITY and CITY shall reimburse
COUNTY within 30 days upon submission of such costs. Such bills
shall be based on the actual quantities of construction and the unit
prices bid for the contract, and shall not contain any charges for
engineering or inspection nor any charge for overhead.
S. CITY'S share of the construction cost shall be determined
on the basis of the full and actual amount of work done in relocating
said portion of water main.
