City Clerk 1 2 3 4 5 6 7 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 X64 (7) 40 - AGREEMENT THIS AGREEMENT, made and entered into this 7 day of July, 1964, between the CITY OF NEWPORT BEACH, hereinafter referred to as "City ", and the NEWPORT HARBOR LAWN BOWLING ASSOCIATION, hereinafter called "Association "; WITNESSETH: WHEREAS, there are now a single bowling green and related) I facilities located at 15th and Balboa Blvd, and situated on City property in the City of Newport Beach, California; and WHEREAS, the Association has been maintaining said green under an agreement with City which expired June 30, 1964; and WHEREAS, it is the desire of the parties hereto to enter into a new agreement under substantially the same terms and condi- tions as said previous agreement; NOW, THEREFORE, in consideration of the premises, it is mutually agreed as follows: 1. The term of this agreement shall begin July 1, 1964, and end June 30, 1965. Either party may terminate the agreement by giving thirty (30) days' written notice of such termination to the other party. 2. During the period covered hereby, the Association agrees to maintain the aforesaid bowling green and related facili- ties, including the fence and equipment used in connection with the green. Association agrees to maintain the green and facilities to the satisfaction of City. 3. For the service of maintaining the green and facili- ties, City agrees to pay Association $75.00 at the end of each month during which Association maintains the green and facilities pursuant to this agreement. 4. The money paid to Association by City shall be used exclusively for the purpose of maintaining the green and facilities as herein provided. All membership green fees, membership dues or green maintenance fees collected by the Association shall be retained by the Association for the purpose of maintaining the green. Associa- tion shall charge no fee for the use of the green without the prior approval of the Parks, Beaches and Recreation Commission. Any fees collected for the use of the green, other than those specifically mentioned above to be retained by the Association, shall be forth- with transmitted to the Director of Finance. Association shall keep accurate books of account to show all receipts and disburse- ments of Association whether or not related to this agreement. 6. All books of Association required to be kept by this agreement shall be open to inspection by City. 7. In accordance with the policy of the Parks, Beaches and Recreation Department, use of the green and facilities shall be open to the public at all times, subject to rules and regulations approved by the Parks, Beaches and Recreation Commission. 8. Subject to its Articles of Incorporation and By -Laws, the Association shall make membership available to all persons. Association agrees that it will undertake to increase interest and participation in lawn bowling as a recreational activity of all citizens in the City of Newport Beach. IN WITNESS WHEREOF City has caused this agreement to be executed by its Mayor and City Clerk and Association has caused it to be executed on its behalf by its President and Secretary. Said agreement provides for the maintenance of the lawn bowling green at 15th Street and Balboa Blvd. for the period of July 1, 1964, through June 30, 1965, under the same terms and conditions as the present agreement with the Association which expires June 30, 1964. The original and two copies of the agreement have been forwarded to the Parks, Beaches and Recreation Director for execution by the Association. To: parks, Beaches and Recreation Director From: City Attorney Subject: Agreement with Newport Harbor Lawn Boding Association Transmitted are the original and two copies of the subject agree- ment providing for the irtai.ntenance of the lawn bowling green at 15th Street and Balboa Blvd. from July 1, 1964, through June 30, 1965. This agreement continues the terms and conditions of the current agreement which expires June 30, 1.964. It is suggested that you obtain execution of the agreement by the Association and return the same to the City Clerk for presentation to the City Council. A resolution is being prepared and forwarded to the City Clerk which will authorize execution of the agreement on behalf of the City.
