BLUROCK AND ASSOCIATES, 7 hereinafter referred to as "Architect "; 8' WHEREAS, the City intends to construct a rest room - 9j: dressing room building in the Corona Del Mar State and City Beach 1011 Park; and llli WHEREAS, in connection with the construction of said 12; building the City requires the services of a licensed architect I 1311 to design the building, make recommendations for the development 14' and landscaping of the area surrounding the building, prepare 15 plans and specifications, and provide architectural supervision 16 for the construction of said building; and 17 WHEREAS, Architect is willing to perform said services 18 in accordance with the provisions of this contract; 19 NOW, THEREFORE, the parties agree: 20 1. Architect shall provide professional architectural 21 services for the construction of said rest room - dressing room 22� building, including interior fixtures and other necessary equip - 23 ment, and in connection therewith shall do the following: 24 (a) Consult with the City administrative staff, 25 Parks, Beaches and Recreation Commission, and City Council 26 as necessary. 27 (b) Provide plans for landscaping, planting and 28 walks surrounding the building site. 29 (c) Prepare preliminary drawings and cost estimates 30 based upon said preliminary drawings by November 1, 1964. 31 (d) After approval of the preliminary drawings 32 and cost estimates by the City Council, prepare working 1 2) I I 4 i 7 8 9 10 11 12 13 14 15 16 17 18 19 20,, 21 221 23 24 25 26 271 28 29 30 31 32 • Cl drawings and specificatia, final cost estimates, and contract documents necessary to call for bids for the construction of the building by December 1, 1964, all of which are subject to approval by the City Council. Archi- tect shall provide fifteen (15) copies of the working drawings, plans and specifications, and contract documents for the fee provided by this contract. If City requires additional copies, City may either provide them itself or Architect shall furnish them at actual cost. (e) Upon request, assist the City administrative staff in evaluating bids on the project and make a recom- mendation as to the award of the contract. (f) Provide architectural supervision over the work of construction, check and approve shop drawings for compliance with design, prepare change orders for approval of City, make inspections and periodic reports on the progress of the work in connection with its approval of bills submitted by the contractor, make a final inspection of the project, assemble written guarantees, instruction books, diagrams and charts required of the contractor, and issue Architect's Certificate of Completion. Architect shall endeavor to protect the City against any deficiencies in the work on the project but does not guarantee performance by the contractor. (g) Submit the preliminary drawings, working draw- ings, specifications, cost estimates and contract documents to the City administrative staff for review at least ten (10) days prior to the time they are to be considered by the City Council. 2. The estimated cost of the building is $22,000. Should the lowest bid obtained within ninety (90) days after the approval of the plans and specifications by the City Council 2. 1 2 31 4i 51 RE 7; 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24' 25 26 27i 28' 29 30 31 321 0 exceed by more than 10% said estimated cost, Architect will if required by the City revise said plans and specifications in such manner as will permit the securing of new bids which do not exceed said estimated cost of construction as hereinbefore stated by more than 10 %. Such revised plans and specifications will be prepared without additional cost to the City. 3. City agrees to pay Architect for the services pro- vided herein a fee equal to 8% of the final contract price, or $1,760.00, whichever is less (the final contract price includes any added cost of change orders or alternates, but does not include Architect's fees, any engineering services paid for or provided by City, any costs of inspection, costs of surveys or tests in con- nection with the construction, or the cost of any walks, landscaping furnishings, equipment or similar items which are not included in the construction contract). 4. The Architect's fee shall be paid as follows: five per cent (25 %) of the fee shall be paid at the time the pre- liminary drawings and cost estimates are approved by the City. This 4 payment shall be based on the preliminary cost estimate as approved by the City Council. The balance of the fee will be paid upon completion of construction and its acceptance by the City. 5. City reserves the right to terminate this contract at any time after the preliminary drawings are submitted to the City Council. In the event of such termination at the time the preliminary drawings are submitted to the City Council, City shall pay Architect the sum of $400 as full compensation for all services performed. If termination occurs after the approval of the pre- liminary drawings and cost estimates by the City, City shall pay an amount which bears the same ratio to the total fee otherwise payable as the services actually rendered bear to the total services necessary for full performance by Architect. If after termination and payment to Architect as herein provided City should decide to proceed with the project, City shall have the right to use all completed work and work in progress of Architect who shall make the same available upon request 6. City shall provide the detailed inspection of con- struction of the building and shall be responsible for the adminis- tration of the construction contract. 7. The final plans, specifications, and other documents as prepared by Architect and approved by the City Council shall be the property of City and reproducible copies thereof shall be delivered to City for its files.
