Re: Lifeguard Headquarters Building

Nov. 23, 1964
Our preliminary design of the Lifeguard Headquarters designates
the use of concrete pilings to support the major portion of the
building. The Uniform Building Code prescribes standards for the
design of these pilings which are fairly conservative. These
standards are used in the absence of any special soil testing on
a specific site.
The code also acknowledges bearing values resulting from soil
testing and reporting by a recognized testing firm.
It is our opinion that bearing values resulting from a specific
soil test will not only insure adequate design, but will also re-
sult in a more definitive solution that will save more in bidding
and construction than the cost of the test.
dVe are enclosing a proposal from the firm of Moore and Taber in
the amount of $375.00. Ne ask that the council authorize the
employment of this firm to make the tests and recommendations
outlined in their proposal.

Subject: Foundation Investigation
Newport Beach Life Guard Headquarters Building
Dear Sir:
In accordance with your request, we would like to present the
following proposal to conduct a foundation investigation for the
subject building, which will be located on the beach adjacent to
the Newport Beach Pier.
The foundation investigation under this proposal includes ex-
ploration, soil testing, engineering analysis and report preparation.
The exploratory phase will consist of one rotary boring at
the building location and would be drilled to a depth sufficient
to analyze the foundation materials for pile support. Undisturbed
samples would be obtained from the boring and tested in the labora-
tory for shear strength, density and other pertinent soil properties.
An engineering analysis of the field and laboratory data would be made
and presented in a written report giving specific recommendations for
suitable foundation types, pile length and allowable load.
The investigation outlined above could be performed for a total
cost which is estimated to be approximately $375.00. We hope we can
be of service in this work.

4II THIS AGREEMENT, made and entered into this 12th day of
51; November , 1964, by and between the CITY OF NEWPORT BEACH,
61 hereinafter referred to as "City ", and DORIUS AND BELL, a partner-
7 ship, hereinafter referred,I;o as "Architect`;.
8 :. WHEREAS, the City intends to construct a lifeguard head -
9i quarters building on the ocean baach easterly of and adjacent to
101 the Newport Pier; and
11 +i WHEREAS, in connection with the construction of said
121 building the City requires the services of a licensed architect to
13 design the building, make recommendations for the development and
14 landscaping of the area surrounding the building, prepare plans and
15 specifications, and provide architectural supervision for the con.
16 struction of said building; and
17 WHEREAS, Architect is willing to perform said services in
18 accordance with the provisions of this contract ;.
19 NOW, THEREFORE, the parties agree:

1. Architect shall provide professional architectural
21
services for the design and construction of said lifeguard head -
22
quarters building, including interior fixtures and cabinets, and
23
in connection therewith shall do the following:

(a) Consult with the City administrative staff
25
and City Council as necessary.

(b) Provide a general site development plan,
27
including walks, driveways, landscaping and planting
28
areas surrounding the building site.
29
(c) The services to be provided by the Architect
30
shall not include the design of public utility services
31
outside the walls of the building.

based upon said preliminary drawings, which Architect will
attempt to submit to City by November 12, 1964...
(e) After approval of the preliminary drawings and
cost estimates by the City Council, prepare working drawings
and specifications, final cost estimates, and contract docu-
ments necessary to call for bids for the construction of the
building, which Architect will attempt to submit to City by
December 15, 1964, all of which are subject to approval of
the City Council. Architect shall provide fifteen (15)
copies of the working drawings, plans and specifications and
contract documents for the fee provided by this contract.
If City requires additional copies, City may either provide
them itself or Architect shall furnish them at actual cost.
(f) The notice inviting bids and bid proposal form
shall be drawn in such a manner that the following phases of
the work shall be shown as separate additional bid items which
may be deleted from the contract at the time the contract is
awarded;
(1) Communications center cabinets.
(2) Other cabinets.
(3) Site development, e.g., walks, drive-
ways, landscaping and planting areas.
(g) Upon request, assist the City administrative
staff in evaluating bids on the project and make a recommenda-
tion as to the award of the contract.
(h) Provide architectural supervision over the
work of construction, check and approve shop drawings for
compliance with design, prepare change orders for approval of
City, make inspections and periodic reports on the progress
of the work in connection with its approval of bills submitted
by the contractor, make a final inspection of the project,
assemble written guarantees, instruction books, diagrams and

5 2. The estimated construction cost of the building is
6! $46,500, exclusive of bid items (1), (2) and (3) listed hereinabove
7 at paragraph I (f), The amount stated does not include the cost of

9 design and installation of public utility services outside the walls
10 of the building, all of which costs will be assumed by the City,
11 Should the lowest bid for the building, not including the separate
12 bid items listed in paragraph I (f) herein, obtained within ninety
13 (90) days after the approval of the working plans and specifications
141 by the City Council exceed said estimated cost by more than 5%,
15 Architect will, if requested to do so by City, revise said working
16 plans and specifications in such manner as will permit the securing.

21 3. City agrees to pay Architect for their services a
22 flat fee of $3,255.00.

24 (a) 20% of the fee shall be payable at the time
25 the preliminary drawings and cost estimates are approved by
26 the City Council.
27 (b) An additional 35% of the fee shall be payable
28 at the time the working drawings, specifications, final cost
29 estimates and contract documents are approved by the City
30 Council.
31 (c) An additional 25% of the fee shall be payable
32 when the contract for the construction work is awarded by

I the City Council.
2I (d) The balance of the fee (20 %) shall be payable
when the construction work is accepted by the City Council.
4,I 5. City reserves the right to terminate this contract
5If at any time after the preliminary drawings and cost estimates are
6 submitted to the City Council. In the event of such termination
7, at the time the preliminary drawings and cost estimates are sub-

mitted to the City Council, City shall pay Architect the sum of
9' $651.00 as full compensation for all services performed. If
10 termination occurs after the approval of the preliminary drawings
11 and cost estimates by the City, City shall pay Architect an amount
12 which bears the same ratio to the total fee otherwise payable as
13 the services actually rendered bear to the total services necessary
14 for full performance by Architect. If such termination occurs after
15 City has approved the preliminary drawings and approved the prepara-
16 tion of working drawings, consideration shall be given to completed
1'7 work and work in progress in determining the services actually
18 rendered, If after termination and payment.to Architect as herein
19 provided City should decide to proceed with the project, City shall
20 have the right to use all completed work and work in progress of
21 Architect who shall make the same available upon request.
22 6. City shall provide the detailed inspection of con
25 struction of the building and shall be responsible for the admin-
24 istration of the construction contract.
25 7. The final plans, specifications, and other documents
26 as prepared by Architect and approved by the City Council shall be
27 the property of City and reproducible copies thereof shall be
28 delivered to City for its files.
29 IN WITNESS WHEREOF, the parties have executed this agree -

16 hereby authorized and directed to execute the sase on behalf of
17 the City of Newport Beach.

Subject: Architectural agreement for lifeguard headquarters
building

Transmitted are the original and two copies of the subject agree-
ment with Dorius and Bell, all of which have been executed by the
architect.
The attached resolution, if adopted by the City Council, will
authorize execution of the contract on behalf of the City, after
which an executed copy thereof should be forwarded to Dorius and
Bell at 2712 East Pacific Coast Highway, Corona del Mar.
