WITNESSETH:
7 WHEREAS, the Board of Supervisors by Resolution of May 31, 1956
8 adopted the Master Plan of Arterial Highways to serve the entire County
9 including the incorporated cities thereof, and
10 WHEREAS, Articles 2 and 3 of Chapter 9, Division 2 of the Streets
11 and Highways Code authorize a county if it so desires to expend funds
12 apportioned to it out of the California Highway Users Tax Fund for aid
13 to cities and in the improvement, construction, or repair of streets
14 within a city, and
15 WHEREAS, the Orange County Board of Supervisors and the Orange County
16 Division of the League of California Cities have agreed upon a coopera-

tive financial program for the establishment, construction, and mainten-
ance of a County Arterial Highway System known as the Arterial Highway
Financing Program, and
WHEREAS, the Board of Supervisors has, by appropriate action, pro-
vided in the budget of the Special Road Improvement Fund for the Fiscal
Year 1966 -67 funds for the improvement of streets within the incorporated
cities of the County, which streets are a part of the County's Master
Plan of Arterial Highways, and
WHEREAS, the Board of Supervisors on November 5, 1958 has by formal
resolution adopted the formal procedure for the administration of the
Arterial Highway Financing Program, which procedure is outlined in a
document on file with the County Clerk, formally known as the County of
Orange Arterial Highway Financing Program Procedure Manual, and
WHEREAS, it is mutually agreed between the parties that

la street included in the Orange County Master Plan of Arterial Highways,
is a street of general County interest and should be improved in accord-
lance with the policies of the Arterial Highway Financing Program. Said
(work of such improvement shall be referred to hereinafter as the Project
NOW, THEREFORE, IT IS AGREED by the parties hereto as follows:
1. The procedures outlined in the Arterial Highway Financing Program
Procedure Manual herein referred to shall be made a part of this
agreement.
2. The Contracting Authority for the Project is hereby designated
as the City.
3. The Project Engineer for the Project is hereby designated as
the City.
4. The Construction Engineer for the Project is hereby designated
as the City.
5. All soils engineering and material and construction testing neces-
sary for the Project shall be performed by the County. This shall
include preliminary soils investigations, structure foundation
investigations, recommendations for structural sections and
compaction requirements, and quality control of materials and
construction.
6. The work shall be subject at all times to inspection by the
authorized representatives of both parties.
7. Funds to be used for the Project:
(a) The estimated cost of the Project covered by this agreement is:

(c) Final adjustments of Project costs will be made on the basis of
the County SO per cent, the City SO per cent on eligible
items in the Contract.
(d) Any funds spent prior to 1Weh 1, 1966 shall not be con-
sidered in the final accounting of this Project.
8. After completion of construction, the party having responsibility
for maintenance of the Project shall maintain the roadway structure:
and facilities in the safe and usable condition to which they have
been improved or constructed under this Project.
9. County -wide extension of Arterial System:
To promote uniformity of County Arterial Highway System with City
Master Plan of Major Streets, both parties agree to continue the
promulgation of the A..H.F.P. as outlined in the aforementioned
Procedure Manual.
IN WITNESS WHEREOF, City has caused this agreement to be executed
by its Mayor and attested by its Clerk, and County has caused this agree-
ment to be executed by the Chairman of its Board of Supervisors and
attested by its Clerk, on the dates written opposite their signatures,
all thereunto duly authorized by Minute Order of the City Council and
the Board of Supervisors, respectively.

ENTRY AGREEMENT
This Entry Agreement was made as of this day of
1966, by and between THE IRVINE COMPANY, here -
inaf r called 'Owner," and the CITY OF NEWPORT BEACH, hereinafter
called "City ".
RECITALS
Owner is the owner of certain real property in the City
of Newport Beach, State of California, County of Orange, located
adjacent to Jamboree Road, lying between Pacific Coast Highway
and Ford /Eastbluff Road, hereinafter called the "premises ". City
desires to enter upon the premises to grade slope banks, plant
suitable ground cover, construct culverts and maintain said
culverts upon the following terms and conditions.
W I T N E S S E T H•
1. Owner hereby grants the right of entry to the City
to enter upon the premises adjacent to the right of way as shown
on City of Newport Beach Drawing R- 5065 -S, sheet 15 of 18, attached
hereto as Exhibit "A" and by this reference incorporated herein.
2. Said entry permit is limited to entry for the
purpose of construction and maintenance adjacent to Jamboree Road
in accordance with the plans and specifications for Select System
Project #53, City of Newport Beach Drawing R- 5065 -5, sheets 1 -18,
dated May 17, 1966. Said construction and maintenance will include:
(a) Construction of slope banks.
(b) Construction of culverts and down drains upon and /or
under said slope banks.
(c) Planting of said slope banks.
(d) Disposal of suitable excess soil, to be compacted
and placed in locations approved by Irvine in writing.
(e) Maintenance of said culverts.
3. City agrees to plant and cultivate on the slope
banks without cost to the Owner, until growth is established,
suitable ground cover as mutually approved by the parties hereto
1 and included in the said specifications.
2 4. The term of :thin entry permit for Items 2(a) through
3 2(d) shall be until construction is complete and /or said growth is
4 established, whichever is later, but in no event later than June
5 30, 1967.
6 5. This entry perm t as applied to Item 2(e) shall
7 remain valid until such time as said culverts and down drains are
8 removed or this agreement is mutually modified by the parties
9 hereto.
10 6. Owner shall not be liable for any loss, damage or
11 injury of any kind or character to any person or property caused
12 by or arising from any act or omission of City or any of its
13 agents or employees and City, as a material part of the consider -
14 ation for this agreement, hereby agrees to indemnify and hold
15 Owner free and harmless from all liability for any such loss,
16 damage or injury.
17 7. City shall not suffer or permit to be enforced
18 against the premises covered by this entry agreement, or any part
19 thereof, any mechanics', materialmen's, contractors' or sub -
20 contractors' liens arising from or any claim for damage growing
21 out of the work authorized by this agreement; and City shall
22 pay or cause to be paid all of said liens, claims or demands before
23 any action is brought to enforce the same against said land; and
24 City agrees to indemnify and hold Owner and said land free and
25 harmless from all liability for any and all such liens, claims and
26 demands, together with reasonable attorneys' fees and all costs
27 and expenses in connection therewith. Notwithstanding anything to
28 the contrary hereinabove contained, if City shall in good faith
29 contest the validity of any such lien, claim or demand, then City
30 shall, at its expense, defend itself and Owner against the same
31 and shall pay and satisfy any adverse judgment that may be
32 rendered thereon before the enforcement thereof against Owner or

the premises, upon the condition that if Owner shall require, City
shall furnish to Owner a surety bond satisfactory to Owner in an
amount equal to such contested lien, claim or demand indemnifying
Owner against liability for the same, and holding the premises free
from the effect of such lien or claim or if Owner shall request,
City shall procure and record the bond provided for in Section
1193 -2 of the California Code of Civil Procedure, or any comparable
statute hereafter enacted providing for a bond freeing the premises
from the effect of such lien or claim or action thereon. Owner
reserves the right at any time and from time to time to post and
maintain on the premises such notices as may be necessary to pro-
tect Owner against liability for all such liens or claims.
IN WITNESS WHEREOF, the parties hereto have executed this
entry agreement as of the day and year first above written.

real property adjacent to Jamboree Road, lying between Pacific
Coast Highway and Ford /Eastbluf€ Road, upon which premises the
City desires to enter for the purpose of grading slope banks,
planting suitable ground cover, constructing culverts and main-
taining said culverts; and
WHEREAS, there has been presented to the City Council
an Entry Agreement under which The Irvine Company grants to the
City the right to enter upon said premises for the purposes
specified; and
WHEREAS, the City Council has considered the terms and
conditions of the agreement and found them to be fair and
NOW, THEREFORE, BE IT RESOLVED that said Entry Agreement
is approved and the Mayor and City Clerk are authorised and dir-
ected to execute the same on behalf of the City of Newport Beach.

4. The term of this entry permit for Items 2(a) through
2(d) shall be until construction is complete and/or said growth is
established, whichever is later, but in no event later than June
30, 1467,
5. This entry permit as applied to Item 2(e) shall
remain valid until such time as said culverts and down drains are
removed or this agreement is mutually modified by the parties
hereto.
6. owner shall not be liable for any loss, damage or
injury of any kind or character to any person or property caused
by or arising from any act or omission of City or any of its
agents or employees and City, as a material part of the consider -
ation for this agreement, hereby agrees to indemnify and hold
Owner free and harmless from all liability for any such loss,
damage or injury.
7. City shall not suffer or permit to be enforced
against the promises covered by this entry agreement, or any )cart
thereof, any mechanics'. ewtarialaen's, contractors' or sub"
contractors' liens arising from or any claim for dams& growing
out of the work authorised by this agreement; and City shall
pay or cause to be paid all of said liens, claims or demands belere
any action is brought to enforce the some against said lead; and
City agrees to indemnify and hold Owner and said land free and
Mess from all liability for any and all such liens, claims and
demands, together with reasonable attorneys' fees and all costs
and expenses in connection therewith. Notwithstanding anythias_to

WHEREAS, the City of Newport Dumb desires to improve
Jamboree Road from Pacific Coast Highway to Ford Roads and
WHEREAS, Jamboree Road is an important artery in the
Comty of prangs and of general County interest; and
WIMUREAB. Article 3 and Article 39 Chapter 9, Division 2
of the Streets and Highways Code authorises a county, if it so
desires, to expend funds apportioned to it out of the California
Highway Users Tax Fund for aid to any city in the improvement, con-
struction or repair of a street within a city; and
WHEREAS, the Board of Supervisors intends to, by appro-
priate action, provide in the County budget of the Special Road
Improvement Fund for the Fiscal Year 1966.67 a sum of money for the
improvement of streets within the incorporated cities of the County
in accordance with the Orange County Arterial Highway Financing
Program;
NOW, THEKEFORE, BE IT RESOLVED that the City Council of
the City of Newport Beach hereby requests the Hoard of Supervisors
of the County of Orange to allocate to said City froia County Funds
the swunt of $191,000, said amount to be matched by funds from said
City, to be used to aid said City in the improvement of Jamboree
Road from Pacific Coast highway to Ford Road, and for the acquisi-
tion of necessary rights of way; said improvements and acquisition
of rights of way to be in accordance with the attached project
statement;
BE IT iHM<TKM RESOLVED that the Board of Supervisors of
the County of Orange is hereby requested to find that said work
acquisition of rights of way on Jamboree Road, in the manner pro-
vided, is in the general County interest.

DESCRIPTION:
THE PROJECT CONSISTS OF A REVISION OF THE VERTICAL AND HORIZONTAL ALIGNMENT
OF JAMBOREE ROAD BETWEEN PACIFIC COAST HIGHWAY AND FORD ROAD AND THE WIDEN-
ING OF THE ROAD TO FOUR LANES. THE PROPOSED ALIGNMENT WILL ELIMINATE SHORT
RADIUS CURVES WHERE POSSIBLE AND WILL INCREASE THE SIGHT DISTANCE AT PACIFIC
COAST HIGHWAY AND ON VERTICAL CURVES WHEN ECONOMICALLY FEASIBLE.
THE ROAD WILL BE WIDENED TO FOUR 12-FOOT LANES WITH A 16 -FOOT MEDIAN WITH
PROVISIONS FOR TWO ADDITIONAL LANES AT A LATER DATE. GRADING TO THE ULITMATE
WIDTH WILL BE ACCOMPLISHED AS PART OF THE PROJECT.
A TRAFFIC SIGNAL WILL BE INSTALLED AT SAN JOAQUIN HILLS ROAD. RELOCATION
OF SIGNAL STANDARDS AT FORD ROAD WILL BE REQUIRED.
FUNDING:
THE PROJECTS -IF APPROVEDZ WILL BE FINANCED 50/v FROM COUNTY AHFP FUNDS AND

DISCUSSION:
THE SUBJECT PROJECT WAS SUBMITTED TO THE COUNTY FOR AHFP FINANCING
DURING F.Y. 65 -66. THE ESTIMATED COST WAS $382,000.00, OF WHICH $191,000.00
WAS TO BE FUNDED BY THE COUNTY. DURING F.Y. 65 -66 SUFFICIENT AHFP FUNDS WERE
NOT AVAILABLE TO COVER THIS PROJECT AND ONLY $100,000.00 WAS PROVIDED. .THE
PROJECT IS BEING RESUBMITTED FOR F.Y. 66 -67. THE COUNTY HAS ADVISED THAT THIS
PROJECT WILL RECEIVE TOP PRIORITY FOR FUNDING DUE TO THE PRIOR COMMITMENT. A
SEPARATE PROJECT HAS ALSO BEEN SUBMITTED FOR THE IMPROVEMENT OF JAMBOREE ROAD
FROM FORD ROAD TO PALISADES ROAD.
THE CITY PORTION OF THE F.Y. 65 -66 FUNDING WAS ORIGINALLY BUDGETED
FOR SECTION 186.1 GAS TAX FUNDS. IT HAS BECOME APPARENT THAT DUE TO THE MECHANICS
OF EXPENDING GAS TAX pF UNDSy IT WOULD BE MORE EFFICIENT FROM THE CITY'S POINT OF
VIEW TO USE SECTION 186.1 FUNDS FOR SMALLER PROJECTS. THE SECTION 2107 FUNDS
WHICH REQUIRE STATE APPROVAL PRIOR TO EXPENDITURE WOULD BE USED FOR THIS LARGE
SCALE PROJECT. IN THIS WAY, PRIOR APPROVAL WILL ONLY BE REQUIRED ONCE RATHER
THAN SEVERAL TIMES.

DISCUSSION:
ON DECEMBER As 1964, THE COUNCIL REQUESTED ORANGE COUNTY TO INCLUDE
THE WIDENING OF JAMBOREE ROAD FROM PACIFIC COAST HIGHWAY TO FORD ROAD IN THE
1965 -1966 ARTERIAL HIGHWAY FINANCING PROGRAM. THE PROJECT HAS BEEN APPROVED BY
THE COUNTY; THE AGREEMENT IS FOR THE PURPOSE OF PROVIDING PROJECT ADMINISTRATION.
A PROPOSAL HAS BEEN RECEIVED FROM BOYLE ENGINEERING TO PREPARE THE
PLANS AND SPECIFICATIONS FOR THE PROJECT. THE DESIGN FEE WOULD NOT EXCEED
$18,750. THIS AMOUNT IS ABOUT 51% OF THE ESTIMATED CONSTRUCTION COST OF $332,OOO
AND IS WITHIN THE FEE SCHEDULE RECOMMENDED FOR PROJECTS OF THIS SIZE AND TYPE
BY THE AMERICAN SOCIETY OF CIVIL ENGINEERS. WE HAVE REVIEWED THE BOYLE PROPOSAL
AND FEEL THAT THE TECHNICAL ABILITIES AND RESOURCES OF THE FIRM ARE APPROPRIATE
FOR THIS PROJECT. THE PUBLIC WORKS DEPARTMENT HAS PLACED PARTICULAR EMPHASIS
ON THE SELECTION OF A PROJECT ENGINEER FOR THE WORK. WE FEEL THAT THE ENGINEER
SELECTED, MR. DWIGHT SCHROEDER, IS ESPECIALLY WELL QUALIFIED AND CAPABLE.
