AGREEMENT #1431
The City of Newport Beach, a body politic and
municipal corporation of the State of California, hereinafter
1. referred to as "CITY ", and the State of California, Department of
Public Works, Division of Highways, hereinafter referred to as
j' "STATE ", do enter into the following agreements

!� WHEREAS, State and City contemplate installation of
traffic control signal system and highway lighting at the inter-
section of Ford Road with State Highway Route 07- Ora -73 2.0
(MacArthur Boulevard), within the City of Newport Beach, and
desire to specify the proportionate share of the costs that are
i
to be borne by City and State and to arrange herein for
maintenance;
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
SECTION I
i
For and in consideration of the covenants and conditionsi
to be kept and performed by City as set forth herein, State
agrees:
(a) To furnish the traffic control signal system and

highway lighting hereinbefore mentioned, through construction by
contracts with construction contractors licensed by the State of
California, said contract to be carried out in accordance with
is
provisions of the State Contract Act, Chapter 3, Part 5,
is
Division 3, Title 2 of the Government Code, and to be completed

in conformity with plans and specifications of the State of
I California, Department of Public Works, Division of Highways.
(b) To bear the entire expense of preparation of
plans and specifications, and State's share of expense of the

construction engineering costs, including assessments for
indirect charges to be made at current rates, and construction

costs required to complete the traffic control signal system and

highway lighting referred to herein, such share to be a sum

6 bearing the same proportion to the total cost of installation of
7 the traffic control signal system and highway lighting as the
i
8 II number of legs of highways under jurisdiction of State at the
9 intersection involved, bears to the total number of legs of
ii
10 i highways at such intersection.

11 (c) State will maintain and operate the entire traffic.
12 control signal system and highway lighting as constructed.
13 SECTION II
14 For and in consideration of the covenants and conditions
15 to be kept and performed by State as set forth in this Agreement,
16 City agrees;
17 (a) To reimburse State promptly upon rendition of
18 statement therefor, City's share of expense of the construction
19 engineering costs, including assessments for indirect charges to
20 be made at current rates, and construction costs required to
21 complete the traffic control signal system and highway lighting
22 referred to herein, such share to be a sum bearing the same pro -
23 portion to the total cost of installation of the traffic control
24 signal system and highway lighting as the number of legs of
25 highways under jurisdiction of City at the intersection involved,
26 bears to the total number of legs of highways at such intersection.
27 It is estimated that City's share is $7,000. The
28 actual amount of City's share will be determined after award and
29 completion of the construction contract.

(b) To reimburse State for City's proportionate share

of the cost of general maintenance and operation of said traffic

5 SECTION 0_ N III
6 IT IS MUTUALLY UNDERSTOOD AND AGREED:
7 (a) That neither State nor any officer or employee
8 thereof shall be responsible for any damage or liability occurring;
9 by reason of anything done or omitted to be done by City under or
10 in connection with any work, authority or jurisdiction delegated
11

to City under this Agreement. It is also understood and agreed

that, pursuant to Government Code Section 895.4, City shall fully
13

indemnify and hold State harmless from any liability imposed for
14

injury (as defined by Government Code Section 810.8) occurring by
15
reason of anything done or omitted to be done by City under or in
16
connection with any work, authority or jurisdiction delegated to
17
it

Attached are the original and one copy of the above Agreement (State No. 1431)
which have been fully executed by the Mayor and myself. Also attached are
two copies of Resolution 6292 authorizing said A mement in accordance
with the letter dated January 10, 1966 to Ben Nolan from Mr. A. W. Hoy,
Deputy District Engineer. It is our understandim, that one fully
executed copy will be returned to us for our files.

DISCUSSION:
CITY PARTICIPATION IN THE COST OF CONSTRUCTING A TRAFFIC SIGNAL AT THE
INTERSECTION OF FORD ROAD AND MACARTHUR BOULEVARD :WAS APPROVED BY THE COUNCIL ON
SEPTEMBER, 27, 1965, SUBJECT TO RECEIPT OF CERTAIN RIGHTS OF WAY. THE EXECUTED
DEEDS FOR THE RIGHT OF WAY HAVE BEEN RECEIVED AND ARE 13EING PRESENTED TO THE
COUNCIL FOR ACCEPTANCE.
BASED ON THE RELATIVE NUMBER OF LEGS OF THE INTERSECTION UNDER CITY
CONTROL, THE CITY'S SHARE OF THE COST IS ESTIMATED TO BE $7,000.00 (ONE —THIRD OF
THE TOTAL). SECTION 186.1 GAS TAX FUNDS WILL BE USED FOR'FINANCING.
CONSTRUCTION IS EXPECTED TO TAKE PLACE IN MAY AND JUNE OF THIS YEAR.

the City and the State providing for the installation
of a traffic control signal system and highway lighting
at the intersection of Ford Road and MacArthur Boulevard,
all of which have been approved as to form.
2. A resolution which, if adopted by the City Council, will
authorize the execution of the agreement on behalf of the
City.
3. A copy of transmittal letter dated January 10, 1966 to
Benjamin B. Nolan, City Engineer, from G. L. Russel.,
Asst. District Engineer of the Division of Highways:;.
setting out the requirements of the State for execution
and transmittal of the agreement.
The Public Works Director has requested that this be presented
to the Council at their meeting on February 14, 1966.

SIGNAL, SUBJECT TO ACQUISITION OF THE RIGHTS OF WAY MENTIONED
BELOW WITH FINANCING TO BE PROVIDED WITH SECTION 186.1 GAS
TAX FUNDS.

A LETTER HAS BEEN RECEIVED FROM THE STATE DIVISION OF HIGHWAYS REQUESTING
THE CITY TO SHARE IN THE COST OF CONSTRUCTION OF THE ABOVE TRAFFIC SIGNAL. THE CITY
SHARE WOULD BE ONE -THIRD OF THE COST, BASED ON THE RELATIVE NUMBER OF LEGS OF THE
INTERSECTION; THE ESTIMATED COST TO THE CITY IS 7,000.00.
AERONUTRONIC TRAFFIC AND DEVELOPMENT OF THE CORONA DEL MAR HIGH SCHOOL,
THE EASTBLUFF CHURCHES, AND THE EASTBLUFF RESIDENTIAL AREA HAVE INCREASED THE NEED
FOR THIS SIGNAL. THE WARRANTS ARE MET, AND THE STATE HAS ALMOST COMPLETED PREPA-
RATION OF THE PLANS AND SPECIFICATIONS.
THE CITY IS CURRENTLY NEGOTIATING WITH AERONUTRONIC FOR ACQUISITION OF
A CORNER CUT-OFF NEEDED FOR THE SIGNAL AT THE NORTHWEST CORNER OF THE INTERSECTION,
AND ALSO FOR A PARCEL OF APPROXIMATELY 8,500 SQUARE FEET AT THE NORTHEAST CORNER
OF FORD,ROAD AND JAMBOREE ROAD NEEDED FOR A CORNER CUT -OFF AND FOR THE ULTIMATE
WIDENING OF JAMBOREE ROAD. IN ADDITION, A CORNER CUT -OFF NEEDED FOR THE SIGNAL IS
BEING ACQUIRED FROM THE IRVINE COMPANY AT THE SOUTHWEST CORNER OF FORD ROAD AND
MACARTHUR BOULEVARD.
A COOPERATIVE FINANCING AGREEMENT FOR CONSTRUCTION OF THE SIGNAL WILL
BE PREPARED BY THE STATE. EXECUTION OF.THE AGREEMENT BY THE CITY SHOULD BE SUBJECT
TO COMPLETION OF ACQUISITION OF THE RIGHTS OF WAY MENTIONED ABOVE.
