Attached is the proposal of Boyle Engineering for engineering
services in connection with the project for the widening of

dated 5, 965, and a letter of revision to the proposal
dated 19, 1965.
The contract for said engineering services provides in paragraph
5 on pages 2 and 3 thereof that the pavment for such services
will be based upon the standard fee schedule contained in the
proposal. Therefore, these documents should be kept on record
as a part of the contract.

Engineering Proposal for
Widening of Jamboree Road
On Thursday, July 15, 1965, we submitted a proposal to the city of
Newport Beach in connection with furnishing professional engineering services for
the widening of Jamboree Road from Pacific Coast Highway to Ford Road.
Subsequent to the submittal of said proposal a telephone conference
was held with Mr. Benjamin B. Nolan, Assistant Public Works Director, regarding
the proposal. Based upon this conference we wish to amend our proposal as follows:
Under SCOPE OF WORK, Lit is herein proposed that, following completion of the
plans for the widening of Jamboree Road from Pacific Coast Highway to Ford Road,
this office prepare the sketches and descriptions of the additional right of way
required for said widening The actual acquisition of the right of way will be
handled by the city of Newport Beach. It is further proposed that, following con-
struction of the improvements, the center ine of the new alignment be monumented
in accordance with the standards of the city of Newport Beach It is proposed that
this service be furnished in accordance with our per diem rates and the maximum fee
in connection therewith will be $1250, increasing the total maximum fee of the
entire project to $18,750.

With respect to the personnel assigned to execute the project, it is
herein proposed that this assignment be modified to provide that Mr. Dwight C.
Schroeder be assigned as project engineer in charge of said project. He will
have complete control of the design of the project and will be the principal
engineer to whom the city will look for execution of the project.
We hope these amendments will meet with your approval and should
there be any further questions relative to our proposal we would be happy to meet
with you and discuss them in more detail.

EVALUATION AND STATEMENT OF THE PROJECT
The city of Newport Beach, Orange County, California, has been growing
and developing at a very rapid rate for an extended period of time and gives every
evidence of continuing such growth in the future.
Jamboree Road, being a major highway in the master plan of the county
of Orange and the city of Newport Beach, is carrying a heavy flow of traffic between
the Coast Highway and Palisades Road. In 1959, the county of Orange in cooperation
with the city of Newport Beach and The Irvine Company completed the construction
of minimum improvements of Jamboree Road between Pacific Coast Highway and the
northerly intersection of Jamboree Road and Bayside Drive. This improvement comprised
the construction of two 12 -foot travel lanes and graded shoulders. Subsequent to the
completion of these improvements, considerable widening has taken place between the
intersection of Ford Road and Jamboree Road northerly to Bayside Drive. At the present
time, additional improvements of Jamboree Road from Bayside Drive northerly to Palisades
Road is under construction.
With the current activity of The Irvine Company in connection with the
improvement of the commercial development in the northwesterly corner of the inter-
section of Pacific Coast Highway and MacArthur Boulevard and with the ever - increasing
traffic flow on Jamboree Road, it is apparent that the balance of Jamboree Road between
Pacific Coast Highway and Ford Road should be improved to a minimum of four traffic
lanes.
At this time the city desires to retain the services of a professional consulting
engineer to prepare the plans and specifications for the initial improvements of Jamboree
Road between Pacific Coast Highway and Ford Road.
SCOPE
8. Preparation of record drawings incorporating therein any construc-
tion changes.
' 9. Final inspection and report.
TIME REQUIRED FOR COMPLETION
' Based on our review of the scope of the project and data available to this
office at this time, it is estimated the plans and specifications can be completed and
' ready for bid within 90 days after receipt of authorization to proceed on said project
from the city of Newport Beach.

SPECIAL SERVICES
In order to accomplish the design and execution of the project, it will
be necessary that certain soils investigations be performed. This will require the
utilization of drilling equipment as well as special testing equipment which could
be furnished through a subcontract with a soils consultant or with the county of Orange.
The results of this soils investigation will be utilized in determining the structural
section of the proposed improvements as well as the control of the grading operation
which would include the fill and cut areas and their resulting cut slopes and fill
banks.

PROFESSIONAL QUALIFICATIONS
As indicated in your letter, a copy of which is included herewith and
made a part of this proposal, you have requested certain information relative to the
personnel who would be assigned to the project and specific background of their
experience in connection with the design of major road improvements.
At present the staff of the Santa Ana office of Boyle Engineering which
would execute this assignment is comprised of some 80 persons of which 14 are
registered engineers. Upon receipt of the assignment, Mr. A. M. Fickes, a principal
engineer in our Santa Ana office, would be assigned to execute the project. Mr. Fickes
has had extensive experience throughout Orange County in the design of major streets
and highways similar to that proposed by the city of Newport Beach. He has been
with our firm for approximately 20 years and during the past several years his principal
assignment has been the design of major land development projects which have included
major and primary highways both onsite and offsite for said developments.

Mr. Fickes has under his direction a supporting staff of assistant
' engineers and draftsmen who, as a group, have executed many road design projects.
A sufficient supporting staff will be assigned to the project in order to complete it
' within the time schedule set forth herein.
Supporting Mr. Fickes will be Mr. Dwight Schroeder, a licensed civil
and structural engineer who also has had extensive experience in the design of major
roadways and drainage facilities. In addition, Mr. Donald Hummel, a licensed
electrical engineer, is available to perform services in connection with the design
of the signalization of the intersection of Jamboree Road and San Joaquin Road.
' The entire staff will be under the personal direction of Mr. J. R. Lester Boyle and
Mr. Edwin H. Finster both of whom maintain their offices in Santa Ana. Mr. Fickes
will have complete control of the design of the project and will be the principal
engineer to whom the city would took for execution of the project.
A few of the major roadways designed by this office include such roads
' as Ford Road between MacArthur Boulevard and Jamboree Road; Rosecrans Avenue
and Bastanchury Road in the Fullerton area; Paseo de Valencia, Alicia Parkway,
' Marco Polo Drive, Valencia Avenue extension and Lo Paz Road in the El Toro area.

At this time, it is estimated that the total fee for our services should not
exceed $17,500. The services required to be performed by others in order to accomplish

the project which would include the specialized subsurface investigation and reports
will be performed only under authorization of the city and under our direction, and
will be reimbursed at actual out -of- pocket cost or contracted for directly by the city.

We propose to furnish upon request the required copies of working drawings
'
and specifications and shall be reimbursed at our actual out -of- pocket cost for blue-
printing and printing expenses. As an alternative to this, we would be pleased to furnish
the city with the original tracings and the plates for the specifications which in turn
could be used for reproduction of the plans and specifications by the city of Newport
'
Beach, at its expense. It is our understanding that the city will handle all of the right

of way acquisition, contract administration and inspection, and that the construction
staking will be made the responsibility of the contractor and will be included in the
detail specifications for said project.

IT IS PROPOSED THAT THE CITY ACQUIRE AN ADDITIONAL 32 FEET OF

TOTAL WIDTH OF 132 FEET. THE NEW ROAD WILL CONSIST OF TWO LANES
IN EACH DIRECTION CENTERED IN THE CENTER OF THE 132 FEET, WITH A
16 -FOOT CURBED MEDIAN. A TYPICAL CROSS SECTION IS ENCLOSED FOR
YOUR REFERENCE. ENGINEERING WILL BE DONE FOR THE ULTIMATE DESIGN.

described engineering services, City agrees to pay Engineer an amount based upon
the standard fee schedule contained in Engineer's proposal dated July 15, 1965,
but in no event shall said amount be greater than $18,750. The amount to be paid
to Engineer shall be payable as follows:
(a) Monthly partial payments, each payment to be the
amount earned as determined by the fee schedule. The sum of the
monthly partial payments shall not exceed ninety per cent (90 0%)
of the above maximum fee.
(b) The balance of the total amount to be paid upon
acceptance of the construction work by the City Council, but In
any event not later than 18 months after submission of the plans
and specifications to the Public Works Director.
In addition, City shall reimburse Engineer for the actual cost of
reproduction of copies of said plans, specifications and related documents requeste
by City.
6. Engineer shall assume the defense of and indemnify and save harmless
the City, and its officers and employees, from all claims, loss, damage, injury
and liability of every kind, nature and description, directly or Indirectly arising
from Engineer's performance of this contract and of the engineering work and
services herein provided.

The scope of work is set forth in the second paragraph of your letter
dated June 29, 1965, and well defines the general scope of work to be accomplished
by the consulting engineer relative to said project. In connection with the scope or
work we propose that the following be performed by this consulting engineers
1. Preliminary investigation including discussions and negotiations.
with all agencies involved in the project.
2. Field surveys necessary for design.
3. Preparation of specifications and general supervision and office
advice concerning test boring, subsurface Investigations and
such design and construction tuts that may be required.
4. Preparation of detailed plans and specifications for the project
including all drainage facilities and signalization of the inter-
section of Jamboree Road and San Joaquin Road.
5. Preparation of quantities and cost estimates for said work.
6. Assistance in letting construction contract.
7. General supervision, consultation, and advice during construction.
8. Preparation of record drawings Incorporating therein any construc-
tion changes.
9. Final Inspection and report.
TIME REQUIRED FOR COMPLETION
Based on our review of the scope of the project and data available to this
office at this time, it is estimated the plans and specifications can be completed and .
ready for bid within 90 days after receipt of authorization to proceed on said project
from the city of Newport Beach. .

SPECIAL SERVICES
In order to accomplish the design and execution of the project, it will
be necessary that certain soils investigations be performed. This will require the
utilization of drilling equipment as well as special testing equipment which could
be furnished through a subcontract with a soils consultant or with the county of Orange.
The results of this wilt Investigation will be utilized In determining the structural
section of the proposed improvements as well as the control of the grading operation
which would include the fill and cut areas and their resulting cut slopes and fill
banks.
PROFESSIONAL QUALIFICATIONS
As indicated in your letter, a copy of which Is included herewith and .
made a part of this proposal, you have requested.certain Information relative to the
personnel who would be assigned to the project and specific background of their
experience in connection with the design of major road Improvements.
At present the staff of the Santa Ana office of Boyle Engineering which
would execute this assignment is comprised of some 80 persons of which 14 are
registered engineers. Upon receipt of the assignment, Mr. A. M. Fickes, a principal
engineer in our Santa Ana office, would be assigned to execute the project. Mr. Fickes
has had extensive experience throughout Orange County in the design of major streets
and highways similar to that proposed by the city of Newport Beach. He has been
with our firm for approximately 20 years and during the past several years his principal
assignment has been the design of major land development projects which have included
major and primary highways both onsite and offsite for said developments.

Mr. Fiakes has under his direction a supporting staff of assistant
engineers and draftsmen who, as a group, have executed many road design projects.
A sufficient supporting staff will be assigned to the project in order to complete it
within the time schedule set forth herein.
Supporting Mr. Fickes will be Mr. Dwight Schroeder, a licensed civil
and structural engineer who also has had extensive experience in the design of major
roadways and drainage facilities. In addition, Mr. Donald Hummel, a licensed
electrical engineer, is available to perform services in connection with the design
of the signalization of the intersection of Jamboree Road and San Joaquin Road.
The entire staff will be under the personal direction of Mr. J. R. Lester Boyle and
Mr. Edwin H. Finster both of whom maintain their offices In Santa Ana. Mr. Fickes
will have complete control of the design of the project and will be the principal
engineer to whom the city would look for execution of the project.
A few of the major roadways designed by this office Include such roads
as Ford Road between MacArthur Boulevard and Jamboree Road; Rolecrans Avenue
and Bastanchury Road in the Fullerton area; Poseo de Valencia, Alicia Parkway,
Marco Polo Drive, Valencia Avenue extension and Lo Paz Road in the El Toro area.
FEE SCHEDULE
With reference to the preparation of plans and specifications we propose
to prepare the plans and specifications including the necessary field surveys for design
purposes in accordance with our current per diem rates which are as followst

At this time, it is estimated that the total fee for our services should not
exceed $17,500. The services required to be performed by others in order to accomplish
the project which would Include the specialized subsurface investigation and reports
will be performed only under authorization of this city and under our direction, and
will be reimbursed at actual out -of- pocket cost or contracted for directly by the city.
We propose to furnish upon request the required copies of working drawings
and specifications and shall be reimbursed at our actual out -of- pocket cost for blue-
printing and printing expenses. As an alternative to this, we would be pleased to furnish
the city with the original tracings and the plates for the specifications which in turn
could be used for reproduction of the plans and specifications by the city of Newport
Beach, at its expense. It is our understanding that the city will handle all of the right
of way acquisition, contract administration and inspection, and that the construction
staking will be made the responsibility of the contractor and will be Included in the
detail specifications for said project.

THE CITY REQUESTS THAT YOUR FIRM SUBMIT A PROPOSAL FOR PERFORMING
DESIGN ENGINEERING SERVICES IN CONNECTION WITH THE WIDENING OF

OF APPROXIMATELY 8,400 FEET.
IT IS PROPOSED THAT THE CITY ACQUIRE AN ADDITIONAL 32 FEET OF
RIGHT OF WAY ON THE EAST SIDE OF THE PRESENT STREET TO MAKE A
TOTAL WIDTH OF 132 FEET. THE NEW ROAD WILL CONSIST OF TWO LANES
IN EACH DIRECTION CENTERED IN THE CENTER OF THE 132 FEET, WITH A
16 -FOOT CURBED MEDIAN. A TYPICAL CROSS SECTION IS ENCLOSED FOR
YOUR REFERENCE. ENGINEERING WILL BE DONE FOR THE ULTIMATE DESIGN.

1 CONTRACT FOR ENGINEERING SERVICES

3 THIS AGREEMENT is made and entered into this = 5 day of
4 October, 1965, by and between the CITY OF NEWPORT BEACH, a municipal
5 corporation, herein referred to as "City ", and BOYLE ENGINEERING, a
6 California corporation and a licensed engineering firm, herein
7 referred to as "Engineer ".
8I WHEREAS, City proposes to widen Jamboree Road between
9 East Coast Highway and Ford Road; and
10 WHEREAS, engineering services are necessary in connection
11 with said project consisting of design, plans and specifications
12 for the entire project; and
13 WHEREAS, Engineer has submitted a proposal to perform
14 said engineering services dated July 15, 1965, and a letter of
15 revision to the proposal dated July 19, 1965;
16 NOW, THEREFORE, the parties agree as follows:
17 1. Engineer shall provide services consisting of the
18 following items:
19 (a) Preliminary investigation including discussions
20 and negotiations with all agencies involved in the project.
21 (b) Field surveys necessary for design, including
22 a topographic survey of the project area.
23 (c) Preparation of specifications and general
24 supervision and office advice concerning test boring, sub -
25 surface investigations and such other design and construction
26 tests that may, from time to time, be required by City.
27 (d) Preparation of detailed plans and specifications
28 for the project, including all drainage facilities and the
29 signalization of the intersection of Jamboree Road and San
30 Joaquin Road. Plans and specifications shall be suitable for
31 use by City in calling for competitive bids.
32 (e) Drawings and descriptions of all right of way
1 .roquired for the project -and centerline montmmentation of the
2 new alignment in accordance with City standards.
3 'f' Preparation of quantities and cost estimates
4I for the project.
5 (g) Assistance in letting construction contract.
6 (h) General supervision, consultation, and advice
7 during construction.
8 (i) Checking of shop drawings and revision of plans
9 and specifications as necessary.to.accommodate conditions
10 discovered during construction.
11 (j) Consultations with the Public Works Director
12 and his staff regarding interpretation of the plans and
13 specifications and other problems which may from time to
14 time arise.
15 (k) Preparation of record drawings incorporating
16 therein any construction changes.
17 (1) Final inspection and report.
18 2. Original drawings, reports, notes, maps, and other
19 documents shall become the property of the City and may be repro -
20 duced as deemed necessary by the.Public Works Director.
21 3. City reserves the right to terminate this contract
22 at any time by giving Engineer three days' prior written notice
23 either by personal service or by placing said notice in the United
24 States mails, postage prepaid, addressed to any of Engineer's
25 business offices. In the event that City shall terminate this
26 contract, it shall reimburse Engineer on the basis of its standard
27 fee schedule contained in its proposal dated July 15, 1965.
28 4. All plans, specifications, and other documents for
29 the project shall be completed to the satisfaction of the Public
30 Works Director of City and delivered to"him within 90 calendar days
31 following the execution of this agreement by the City.
32 5. In consideration of the performance of the above

1 described engineering services, City agrees to pay Engineer an amount based upon
2 the standard fee schedule contained in Engineer's proposal dated July 15, 1965,
3 but in no event shall said amount be greater than $18,750. The amount to be paid
4 to Engineer shall be payable as follows:
5 (a) Monthly partial payments, each payment to be the
8 amount earned as determined by the fee schedule. The sum of the
7 monthly partial payments shall not exceed ninety per cent (90 %)
8 of the above maximum fee.
9 (b) The balance of the total amount to be paid upon
10 acceptance of the construction work by the City Council, but in
11 any event not later than 18 months after submission of the plans
12 and specifications to the Public Works Director.
13 In addition, City shall reimburse Engineer for the actual cost of
14 reproduction of copies of said plans, specifications and related documents requeste
15 by City.
18 6, Engineer shall assume the defense of and indemnify and save harmless
17 the City, and its officers and employees, from all claims, loss, damage, injury
18 and liability of every kind, nature and description, directly or indirectly arising
19 from Engineer's performance of this contract and of the engineering work and
20 services herein provided.
21 IN WITNESS WHEREOF, the parties have executed this contract as of the
22 day and year first above written.
