CONTRACT FOR ENGINEERING SERVICES
(DESIGN OF -I N_SMISSION MAI N
TO BE CONSTRUCTED IN JAMBOREE ROAD)
THIS AGREEMENT, made and entered into this 1S day of
October, 1965, by and between the CITY OF NEWPORT BEACH, a muni-
cipal corporation, hereinafter referred to as "City ", and JAMBS M.
MONTGOMERY, CONSULTING ENGINEERS, INC., a California corporation,
hereinafter referred to as "Engineer ";
WITNESSETH:
WHEREAS, City intends to let a public works contract for
the construction of an 18 -inch water transmission main which will
be located in Jamboree Road between Eastbluff Drive and Palisades
Road, hereinafter referred to as the project; and
WHEREAS, City desires to contract for pre - construction
engineering services in connection with the project; and
WHEREAS, Engineer has submitted a proposal to City to
furnish said engineering services as hereinafter provided;
NOW, THEREFORE, the parties agree as follows:
1. Scope of Services.
Engineer agrees to provide the following services in con-
nection with the project:
(a) Pipeline surveys in accordance with the re-
quirements of the City Public Works Director.
(b) Preparation of design drawings and specifica-
tions.
(c) Preparation of "Special Conditions" to be
included in the public works contract for the construction of
the project.
All services performed and documents furnished to City
lshall be subject to the approval of the City Public Works Director.

2. Time for Completion.
Engineer agrees to complete the work within 45 days

following the date of execution of this agreement.
3. Fees and Expenses.
In consideration of the work to be performed by Engineer,
City agrees to pay Engineer a fee based upon the following man -hour

The above rates include all payroll costs, overhead,
supervision, and all incidental expenses with the sole exception of
mileage. Mileage necessarily incurred in performance of the work
provided for herein shall be reimbursed to Engineer by City at the
rate of 10¢ per vehicle mile.
The total fee for the work required herein, including
mileage, shall not exceed Five Thousand Dollars ($5,000), unless
expressly consented to in writing by the City Public Works Director.
4. Ownership of Submitted Material.
All maps, surveys, reports and other documents prepared a'
submitted to City by Engineer shall become the property of City.
5. Independent Contractor Relationship.
In carrying out the terms of this agreement, Engineer and
its employees shall at all times be independent contractors and not
employees of the City.
6. Hold Harmless Provision.
Engineer shall assume the defense of and indemnify and
save harmless the City, and its officers and employees, from all
claims, loss, damage, injury and liability of every kind, nature and
description, directly or indirectly arising from the performance of
this contract or work, regardless of responsibility for negligence.

7. Termination Clause.
City may terminate tpis contract at any time on 10 days'
written notice of termination addressed to Engineer at 535 East
Walnut Street, Pasadena, California 91101. If the contract is so
terminated, City shall be obligated to pay to Engineer only the
reasonable value of the services performed by it up to the time of
termination. In the event of such termination, Engineer will
deliver to City copies of all written materials contained in its
files pertaining to the services provided for herein.
IN WITNESS WHEREOF, the parties hereto have executed this
contract as of the day and year first above written.

Attached are the original and three copies of the contract with
James M. Montgomery Consulting Engineers, Inc,, for engineering
services in connection with the design of an 18 -inch water trans-
mission main in Jamboree Road, which contract has been executed
in triplicate by Montgomery.
The attached resolution, if adopted by the City Council, will
authorize the execution of the contract on behalf of the City.
It is requested that this be presented to the City Council for
consideration at the meeting of October 25, 1965.
