TH :aem 1/ 9/66 (8) AGREEMENT FOR ARCHITECTURAL SERVICES (Additions to Mariners Library)' 1 2 THIS AGREEMENT, made and entered into this z -liV, day of 1966, by and between the CITY OF NEWPORT 4 BEACH, hereinafter referred to as "City ", and WILLIAM E. BLUROCK 5 & ASSOCIATES, hereinafter referred to as "Architect "; 6I WHEREAS, the City intends to construct certain additions, 7 hereinafter referred to as the "library additions ", to the existing 8 library building in Mariners Park, consisting of a multi - purpose 9 room capable of being used for an auditorium, related storage facil- 10 'ties, a kitchenette and restroom facilities; and 11 WHEREAS, in connection with the design and construction of 12 said library additions, the City will require the services of a 13 Licensed architect to design said library additions and to provide 14 architectural supervision for the construction work; and 15 WHEREAS, Architect is well qualified to perform such 16 3ervices and is willing to do so in accordance withthe terms and 17 provisions of this agreement; 18i NOW, THEREFORE, the parties agree as follows: )fI 191 1. Architect agrees to provide the following professional 20 architectural services for the design and construction of said 21 Library additions, including all necessary interior fixtures and 22 equipment. The Architect shall: 23 (a) Confer with the City administrative staff, City 241 Council and City commissions when requested to do so. 25 ii (b) Prepare preliminary studies, working drawings, 26i� specifications, large scale and full size detail drawings 27 for architectural, structural, plumbing, heating, electrical 28 and other mechanical work and assist in the drafting of forms 29 of proposals and contracts. 30 (c) Provide architectural supervision over the con - 31 struction work, check and approve shop drawings for compliance I 32I) with design, prepare change orders for approval of the Public Works Director, make inspections and periodic reports on the 1! progress of the work, prepare a color schedule of all mater- 2 ials for City's review and approval, make a final inspection 3 of the project, assemble written guarantees, instruction 4I books, diagrams and charts required of the contractor, and 5 issue Architect's Certificate of Completion. 6 (d) Preliminary drawings and cost estimates shall 7 be prepared and made available to the City administration for 8 presentation to the City Council on or before April 1, 1966. 9 Following approval of the preliminary drawings and cost 10 estimates, Architect shall prepare working drawings and speci- 11 fications, final cost estimates and contract documents needed 12 to call for bids for the construction of the library additions. 13 Architect shall supply fifteen (15) copies of the working 14 drawings, plans, specifications and contract documents for 15 the fee specified by this agreement. 16 2. The estimated cost of the library additions is $38,000 17 Shouldthe lowest bid obtained within ninety (90) days after the 18j approval of the plans and specifications by the City Council exceed 19 ! said estimated cost by more than 10 %, Architect will, if requested 20 to do so by the City, revise said plans and specifications in such 21 manner as will permit the securing of new bids which do not exceed 22 said estimated cost by more than 10 %. The revised plans and speci- 25 fications, if required by the City, shall be prepared without any 24 additional fee being paid to Architect by City. 25i 3. City agrees to pay Architect for services provided i 26� herein a fee equal to 87 of the final contract price or $3040, 27 whichever is less. The final contract price shall include the 28 added cost of any change orders or alternates, but shall not 29i include Architect's fees, any engineering services paid for by 30 the City, cost of inspection, cost of surveys or tests in 31 connection with site preparation or construction, or the cost of 32i any exterior landscaping, interior furnishings or similar items which are not a part of the work done or materials furnished by (+ the contractor for the construction work. li 2. i f 11 4. The fee to be paid to the Architect shall be paid 21 on the following basis: Twenty -five per cent (25 %) of the fee i 31 shall be paid at the time the preliminary drawings are approved 4Ii by the City Council and shall be based upon the preliminary cost 5I estimates approved by the City Council. Upon completion of the 6I working drawings, plans and specifications, and contract documents, 7 and their approval by the City Council, 70% of the fee, based upon 8 the final cost estimate approved by the City Council, shall be 9 payable. Upon completion of the construction work and its accept - 10 ante by the City, the balance of the fee as herein provided, less 11 any amounts previously paid, shall be payable. 12 5. City has the option to terminate this contract at 13 any time after the preliminary drawings are submitted to the 14 City Council. In the event of termination prior to approval of 15 the preliminary drawings by the City Council, City shall pay 16 Architect 25% of the fee based upon the cost estimates as approved 17i or $780, whichever is less, as full compensation for all services 18 performed. If termination occurs thereafter, City shall pay an 191 amount which bears the same ratio to the total fee otherwise pay - 20 able as the services actually rendered bear to the total services i 21 necessary for full performance by Architect. If such termination 22i occurs after City has approved the preliminary drawings and 23, approved the preparation of working drawings, consideration shall 24 1 be given to completed work and work in progress in determining 251 the services actually rendered. If, after termination and pay - 26.1 ment to Architect as herein provided, City should decide to pro - 27 coed with the project, City shall have the right to use all 281 completed work and work in progress of Architect, who shall make 291 the same available upon request. 1 30 6. The final plans,;specifications and other documents prepared by Architect and approved by the City Council shall be the property of the City and reproducible copies thereof shall be delivered to the City for its files. Blurock & Associates for architectural services in connection with the construction of additions to the exist- ing library building in Mariners Park. The attached resolution, if adopted by the City Council, will authorize execution of said agreement on behalf of the City. The agreement has been transmitted to Mr. Blurock for execution and return to your office.
