STOCKTON, V.M.D., a licensed veterinarian, herein - after referred to-as "Veterinarian"; WITNESSETH: WHEREAS, the City of Newport Beach under the Municipal Code thereof is obligated to impound and keep fowl and animals found running at large; and WHEREAS, the Code requires the licensing and vaccina- tion of dogs kept within the City; and WHEREAS, the City does not have facilities suitable for impounding and keeping fowl, dogs, cats or other animals;; and WHEREAS, Veterinarian has facilities for rece iving and A caring for fowl.ond animals that may ba.p�cked upon the City streets; NOW, THEREFORE, the parties agree: 1. Veterinarian agrees to receive and care fQr1any dog, T cat, bird, f9wi,o;r animal, other than a wild animal or horse, cow, or other animal too.large to be cared for in his facilities.' that is delivered to him by City. ..2. Veterinarian will keep such animal or bird for a period of not less than three (3) days unlessthe same is -redeemed by the owner thereof. 3. After said three-day period, Veterinarian will dis- pose of such bird or animal either by-selling it in accordance with the terms of Section 1208.5 of the Code of Civil Fr.ceedure or by destroying it in accordance with Section 4108 of the Newport Beach Municipal Code. 4. if said animal or bird is redeemed by theowner or sold or delivered to any other person,.Veterinarian will collect Aj i 1' 2 3 4 5 6 7 8 9, 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 from said owner or other person to whom it is sold or delivered the impounding fee and_any boarding charges that may have accrued since the impounding. Veterinarian shall charge only the impound- ing fee and boarding charges established by or pursuant to the Municipal Code for fowl or animals delivered to him by the City for impounding. 5. In case such bird or animal is not reclaimed by the owner thereof, City shall pay Veterinarian.the boarding charges which have been established by the City Council by reeolation for the period of time the animal is retained by Veterinarian, but not to exceed a three -day period for any such bird or animal„ except that when any,d©g or other animal is delivered to Veterinarian for the purpose of quarantine, City shall pay the boarding charges for such animal established as aforesaid for a period of timenot to exceed fifteen -(15) days. 6. City shall pay Veterinarian a fee of Three -Dollars ($3.00) for any bird or animal that has been impounded by. City 1. which is destroyed by Veterinarian pursuant to this contract and.- .._...; the Municipal Code of City. Veterinarian agrees to dispose of the carcass of any .. bird or animal destroyed by him pursuant to this contract and the Municipal Code of City. In consideration thereof City - .agrees to pay Veterinarian a fee of One"Dollar and Fifty -Cents ($1.0) for each Snimal carcass disposed of pursuant to this agreement. 7. Veterinarian shall keep records to show the'.date each animal or bird is delivered to him by City, the tine"it is kept, the disposition of it, and the amount of fees or charges collected from the owner or person to whom it is sold or delivered-. These records shall be open and available for- inspection by City. Veterinarian shall transmit to the City on:or before the tenth (10th) day of each month all impounding and license fees collected in the preceding month. City shall p ha same within fifteen (15) days after, receipt thereof. 9. The term of this contract shall begin on the date of execution and shall continue until June 30, 197U.; provided, however, that it may be teiminated by either party by giving sixty (60) days' prior notice in writing to the other party. Any such notice of termination directed to the City shall be addressed to the City Clerk, 3300 Newport Boulevara,,Bewport Beach, California.. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF AN ANIMAL CONTROL AGREEMENT WITH ALBERT E. STOCKTON,, V.M.D. WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain animal control agreement with Albert E. Stockton, V.M.D., for the receiving and caring for fowl and animals impounded by the City under its Mmicipal Code and other services in connection therewith; and WHEREAS, the City Council has considered the tezvo and conditions of said agreement and found them to be reasonable and equitable; Vii, THEREFORE, BE IT RESOLVED that said animal control agreement be approved and the Mayor and City Clerk ore hereby authorized and directed to execute the same on behalf of the City of Newport Beach. ATTEST; My Clerk CITY OF NEWPORT BEACH CITY ATTORNEY DEPARTMENT May 6, 1966 To: The Honorable Mayor and Members of the City Council From: City Attorney Subject: Animal control agreement Since 1960 the City has been a party to an agreement with Albert E. Stockton, V.M.D., to provide custodial care for impounded animals. Dr. Stockton has recently advised the Chief of Police that the existing fee schedule for this service is inadequate and has re- quested that the agreement be revised to provide for the following increases: The fee for destroying any impounded bird or animal would be increased from $2.00 to $3.00. The fee for disposal of the carcass of any bird or animal destroyed by him would be changed from a flat fee of $15 per month to a fee of $1.50 for the disposal of each animal carcass. The boarding fee for any dog or cat im- pounded by the City is presently set at $1.00 per day by resolution. It is proposed to increase this boarding charge to $1.50 per day. The animal control agreement with Dr. Stockton has been revised to incorporate the increased fees described.above. If approved, the agreement will continue until June 30, 1970. Both parties have the right to terminate the agreement at any time on sixty days` notice. The resolution establishing boarding charges for impounded animals has also been revised to increase the per diem fee from $1.00 to $1.50. Stockton, V.M.D. 3338 East Coast Highway Corona del Mar, California Hear Dr. Stockton: Transmitted are the original and one copy of an animal control agreement with the City of Newport Beach which will continue your services for the City in connection with receiving and caring for impounded fowl and animals. On May 9, 1966, the City Council approved the agree- ment and authorized its execution on behalf of the City. In addition, they adopted a resolu- tion which increased the boarding charge for impounded dogs and cats to $1.50 per day. This agreement provides for a fee of $3.00 for destroying any impounded bird or animal and a $1.50 fee for the disposal of each animal carcass. In all other respects, it contains the same provisions as the agreement dated February 8, 1965. It is requested that you execute the original agreement and return it to us.
