3. AUTHORIZE THE CITY CLERK TO RELEASE THE BONDS 35 DAYS AFTER
THE NOTICE OF COMPLETION WAS BEEN FILED.
DISCUSSION:
THE CONTRACT FOR DEMOLITION OF THE ABANDONED SEWAGE TREATMENT PLANT HAS
BEEN COMPLETED TO THE SATISFACTION OF THE PUBLIC WORKS DEPARTMENT.

THERETO SHOWN ON THE PLANS AND SPECIFICATIONS THEREFOR; TO FURNISH AT HIS OWN PROPER
COST AND EXPENSE ALL TOOLS, EQUIPMENT, LABOR, AND MATERIALS NECESSARY THEREFOR, (EX-
CEPT SUCH MATERIALS) IF ANY, AS IN THE SAID SPECIFICATIONS ARE STIPULATED TO BE FUR-
NISHED BY THE CITY), AND TO DO EVERYTHING REQUIRED BY THIS AGREEMENT AND THE SAID
PLANS AND SPECIFICATIONS.
Z. FOR FURNISHING ALL SAID MATERIALS AND LABOR, TOOLS AND EQUIPMENT, AND DOING
ALL THE WORK CONTEMPLATED AND EMBRACED IN THIS AGREEMENT, ALSO FOR ALL LOSS AND DAMAGE
ARISING OUT OF THE NATURE OF THE WORK AFORESAID, OR FROM THE ACTION OF THE ELEMENTS,
OR FROM ANY UNFORESEEN DIFFICULTIES WHICH MAY ARISE OR BE ENCOUNTERED IN THE PROSECU-
TION OF THE WORK UNTIL ITS ACCEPTANCE BY THE CITY, AND FOR ALL RISKS OF EVERY DE-
SCRIPTION CONNECTED WITH THE WORK; ALSO, FOR ALL EXPENSES INCURRED BY OR IN CONSE-
QUENCE OF THE SUSPENSION OR DISCONTINUANCE OF WORK, EXCEPT SUCH AS IN SAID SPECIFI-
CATIONS ARE EXPRESSLY STIPULATED TO BE BORNE BY THE CITY; AND FOR WELL AND FAITHFULLY
COMPLETING THE WORK AND THE WHOLE THEREOF, IN THE MANNER SHOWN AND DESCRIBED IN THE
SAID PLANS AND SPECIFICATIONS, THE CITY WILL PAY AND THE CONTRACTOR SHALL RECEIVE IN
FULL COMPENSATION THEREFORE THE LUMP SUM PRICE, OR IF THE BID IS ON THE UNIT PRICE
BASIS, THE TOTAL PRICE FOR THE SEVERAL ITEMS FURNISHED PURSUANT TO THE SPECIFICATIONS,
NAMED IN THE BIDDING SHEET OF THE PROPOSAL, AS THE CASE MAY BE.
3. THE CITY HEREBY PROMISES AND AGREES WITH THE SAID CONTRACTOR TO EMPLOY, AND
DOES HEREBY EMPLOY THE SAID CONTRACTOR TO PROVIDE THE MATERIALS AND TO DO THE WORK
ACCORDING TO THE TERMS AND CONDITIONS HEREIN CONTAINED AND REFERRED TO FOR THE PRICE
AFORESAID, AND HEREBY CONTRACTS TO PAY THE SAME AT THE TIME, IN THE MANNER, AND UPON
THE CONDITIONS SET FORTH IN THE SPECIFICATIONS; AND THE SAID PARTIES FOR THEMSELVES,
THEIR HEIRS, EXECUTORS, ADMINISTRATORS, SUCCESSORS AND ASSIGNS, DO HEREBY AGREE TO
THE FULL PERFORMANCE OF THE COVENANTS HEREIN CONTAINED.
4. THE NOTICE TO BIDDERS, INSTRUCTIONS TO BIDDERS, CONTRACTOR'S PROPOSAL, AND
THE PLANS AND SPECIFICATIONS, AND ALL AMENDMENTS THEREOF, WHEN APPROVED BY THE PAR-
TIES HERETO, OR WHEN REQUIRED BY THE CITY IN ACCORDANCE WITH THE PROVISIONS OF THE
PLANS AND SPECIFICATIONS, ARE HEREBY INCORPORATED IN AND MADE PART OF THIS AGREE-

LESS OF RESPONSIBILITY FOR NEGLIGENCE AND FROM ANY AND "ALL CLAIMS, LOSS, DAMAGE,
INJURY, AND LIABILITY, HOWSOEVER THE SAME MAY BE CAUSED, RESULTING DIRECTLY OR IN-
DIRECTLY FROM THE NATURE OF THE WORK COVERED BY THE CONTRACT, REGARDLESS OF RESPON-

I. SCOPE OF WORK
THE CONTRACTOR SHALL FURNISH ALL LABORS TOOLS AND OTHER EQUIPMENTS AND ALL MATERIALS
OF EVERY DESCRIPTION AS REQUIRED OR NECESSARY TO DEMOLISH, REMOVES AND DISPOSE OF
ALL PORTIONS OF THE ABANDONED SEWAGE TREATMENT PLANT ABOVE ELEVATION 107.0 FEET,
AND TO BACKFILL, CLEAN UPS AND LEAVE IN AN ACCEPTABLE CONDITION.ALL PARTS OF THE
SITE AS SHOWN ON THE PLANS, CITY OF NEWPORT BEACH DRAWING NO. S- 5023 -S, AND IN
ACCORDANCE WITH THE STANDARD SPECIFICATIONS AND STANDARD DRAWINGS OF THE CITY
OF NEWPORT BEACH AND THESE SPECIAL PROVISIONS.
Il. TIME OF COMPLETION
THE CONTRACTOR SHALL COMPLETE THE WORK WITHIN 60 CALENDAR DAYS FROM THE DATE OF
EXECUTION OF THE CONTRACT BY THE CITY.
III. PROTECTION OF EXISTING FACILITIES WHICH ARE TO REMAIN
THE CONTRACTORS ATTENTION IS CALLED TO THE PRESENCE OF EXISTING TRUNK SEWERS AND
MANHOLES ON THE EASTERLY AND NORTHERLY SIDES OF THE SEWAGE TREATMENT PLANT. THESE
FACILITIES MUST NOT BE DAMAGED OR DISTURBED IN ANY WAY.
EXISTING UTILITY POLES AND ANCHORS MUST BE PROTECTED FROM DAMAGE.
IV. DEMOLITION AND REMOVAL
ALL MATERIALS OF CONSTRUCTION, PIPES, AND EQUIPMENT', TREESS AND VEGETATIONS ABOVE
ELEVATION 107.0 FEET WITHIN THE AREA SHOWN WITHIN THE LIMITS OF REMOVAL SHOWN ON
THE DRAWING NO. 5- 5023 -S SHALL BE REMOVED. ALL MATERIAL SO REMOVED, EXCEPT AS
NOTED IN SECTION V OF THESE SPECIAL PROVISIONS, SHALL BECOME THE PROPERTY OF THE
CONTRACTOR AND SHALL BE DISPOSED OF OFF THE SITE.
HOLES OF AT LEAST 4 SQUARE FEET EACH SHALL BE BROKEN OUT OF THE BOTTOM OF THE
LOWEST.PART OF EACH IMHOFF TANK, AND IN THE FLOOR OF THE PUMP ROOM.
V. SALVAGE
CHAIN LINK FENCES GATES, POSTS, AND OTHER APPURTENANCES TO THE FENCE SHALL BE
SALVAGED AND DELIVERED TO THE CITY CORPORATION YARD AT 592 SUPERIOR AVENUE,
NEWPORT BEACH.
Vi. BACKFILLING
CLEAN EARTH MATERIALS FROM THE SITE SHALL BE USED TO BACKFILL THE IMHOFF TANKS$
PUMP ROOMS AND OTHER EXCAVATIONS. THE ENTIRE AREA SHOWN WITHIN THE LIMITS OF
EXCAVATION SHALL BE GRADED TO DRAIN FROM THE RIDGE" LINE: SHOWN ON THE DRAWING TO
THE LIMITS OF EXCAVATION. IT IS INTENDED THAT THE EXCAVATION SHOWN EQUAL THE
AMOUNT OF BACKFILL REQUIRED. EXCAVATION SHALL BE ADJUSTED AS NEEDED FOR BAL-
ANCING PURPOSES. ADDITIONAL MATERIAL SHALL BE HEAPED TO AN ELEVATION APPROXI-
MATELY 2 FEET HIGHER THAN THE SURROUNDING GRADE OVER THE PUMP ROOM AND THE IMHOFF
TANKS TO.COMPENSATE FOR FUTURE SETTLEMENT.

VIII. DATUM
THE ELEVATIONS REFERRED TO ON THE PLAN AND IN THESE SPECIAL CONDITIONS ARE BASED
ON THE DATUM USED FOR THE CONSTRUCTION OF THE SEWAGE TREATMENT PLANT.
IX. CONS ?RUCTION PLANS FOR ORIGINAL SEWAGE TREATMENT PLANT
PRINTS OF SHEETS 34, 35, 36, AND 38 OF THE CITY OF NEWPORT BEACH PLAN NO. 4Ot
ARE FURNISHED FOR THE USE OF THE CONTRACTOR.
THESE DRAWINGS ARE FOR THE SOLE PURPOSE OF INDICATING DETAILS OF CONSTRUCTION
OF THE SEWAGE TREATMENT PLANT, BUT NO WARRANTY IS MADE AS TO THEIR ACCURACY.
THE CONTRACTOR SHALL VISIT THE SITE PRIOR TO OPENING BIDS IN ORDER TO DETERMINE
EXISTING CONDITIONS TO HIS SATISFACTION* UPON REQUEST, THE PUBLIC WORKS DEPART-
MENT WILL ARRANGE VISITS TO THE SITE FOR INTERESTED BIDDERS.

1. APPROVE THE PLANS AND SPECIFICATIONS.
2. AUTHORIZE THE CITY CLERK TO ADVERTISE FOR BIDS TO BE
OPENED AT 10:00 A.M. ON OCTOBER 31 1966.
DISCUSSION:
THIS PROJECT WILL PROVIDE FOR DEMOLITION OF THE CITY'S ABANDONED
SEWAGE TREATMENT PLANT LOCATED ADJACENT TO THE SANTA ANA RIVER CHANNEL ABOUT
ONE- QUARTER MILE NORTHERLY OF COAST HIGHWAY. THE PLANT IS CONSIDERED TO BE AN
ATTRACTIVE NUISANCE AND A SAFETY HAZARD.
THE SUPERSTRUCTURES OF THE PUMP STATION BUILDING AND OF THE TWO
IMHOFF TANKS WILL BE.DEMOLISHED AND REMOVED FROM THE SITE. REMOVAL OF THE SLUDGE
DRYING BED AND OF THE SUBSURFACE PORTIONS OF THE PUMP STATION BUILDING AND THE
IMHOFF TANKS IS NO'F INCLUDED IN THIS CONTRACT INASMUCH AS THE PURPOSE OF THE
PROJECT IS ONLY TO ELIMINATE THE SAFETY HAZARD AND NOT TO COMPLETELY CLEAR THE
SITE. THE LOWER PORTIONS OF THE STRUCTURES WILL BE FILLED WITH MATERIAL OB-
TAINED ON THE SITE.
THE ESTIMATED COST OF THE PROJECT AND THE AMOUNT APPROPRIATED IN
ACCOUNT N0. 02- 5597-158 IS 101000. THE ESTIMATED DATE OF COMPLETION 15
DECEMBER 201 1966.

THE PUBLIC WORKS DEPARTMENT, CITY HALL, NEWPORT BEACH, CALIFORNIA.
A NON- REFUNDABLE CHARGE OF $2.00 WILL BE REQUIRED FOR EACH SET OF STANDARD SPECIFI-
CATIONS. A REFUNDABLE DEPOSIT OF $5.00 WILL BE REQUIRED FOR EACH SET OF PLANS, SPECIAL
PROVISIONS, AND CONTRACT DOCUMENTS. UPON RETURN OF THE SET OF PLANS, SPECIAL PROVISIONS,
