HomeMy WebLinkAboutC-1065 - Channelization and Signal Modifications for Bayside Drive & Pacific Coast Highwayu 2 07207 - 157201 3 4 AGREEMENT NO. 2092 5 6 The City of Newport Beach, a body politic and a 7 municipal corporation of the State of California, hereinafter e referred to as "CITY% and the State of California, Department 9 of Public Works, Division of Highways, hereinafter referred 10 to as "STATE% do enter into the following agreement: 11 WHEREAS, State and City contemplate modification 12 of traffic control signal system and highway lighting and 13 construction of curbed median channelization on State Highway 14 Route 1 (Pacific Coast Highway) at the intersection of Bayside 15 Drive with State Highway Route 07 -Ora -1 18.1 (Pacific Coast 16 Highway), all within the City of Newport Beach, and desire to 17 specify the proportionate share of the costs that are to be 18 borne b City and State and to arrange nge herein for maintenance; 19 NOW, THEREFORE, IT IS AGREED AS FOLLOWS: 20 SECTION I 21 For and in consideration of the covenants and condit 22 to be kept and performed by State as set forth herein, City 23 agrees: 24 (a) To modify the traffic control signal system and 25 highway lighting and construct the channelization hereinbefore 26 mentioned, through construction by City forces, or by contracts 27 with construction contractors licensed by the State of California; 28 said contracts to be carried out in accordance with the laws 29 governing City with reference to the character of the work to 30 be done thereunder, and to be completed in conformity with plans 31 k 1 _ 2 and specifications of City or State, and to the satisfaction of i 3 and subject to the approval of State. i 4 (b) To bear the entire expense of preparation of plans 5 and specifications, except where prepared by State, and City's li 6 share of expense of the construction engineering costs, and 7 construction costs required to modify the traffic control I 8 signal system and highway lighting referred to herein, such 9 share to be a sum bearing the same proportion to the total cosh 10 of modification of the traffic control signal system and highway 11 lighting as the number of legs of highways under jurisdiction of 12 City at the intersection involved, bears to the total number of 13 legs of highways at such intersection. 14 (e) To reimburse State for City's proportionate share 15 of the cost of general maintenance and operation of said traffic 16 control signal system and highway lighting in the manner pro- 17 vided in that Agreement for Maintenance of State Highways in 18 the City which is in effect at the time said costs arise. 19 SECTION II 20 For and in consideration of the covenants and 21 conditions to be kept and performed by City as set forth in this 22 Agreement, State agrees: 23 (a) To reimburse City promptly upon rendition of 24 statement therefor, the wA41 *e expense`of the construction 25 engineering costs, including assessments for indirect charges to 26 be made at current rates, and construction costs required to 27 complete the channeliza.tion referred to herein; and State's 28 share of expense of the construction engineering costs and 29 construction costs required to modify the traffic control 30 signal system and highway lighting referred to herein, such 31 share to be a sum bearing the same proportion to the total -2- i I 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 M 19 20 21 22 23 24 25 26 27 28 29 30 31 i cost of modification of traffic control signal system and highway lighting as the number of legs of highways under juris- diction of State at the intersection involved, bears to the total number of legs of highways at such intersection. It is estimated that State's share is $12,000: Signals and Lighting $100000 Channelization $ 29000 The actual amount of State's share will be determined after the traffic control signal and highway lighting modification and channelization construction are completed, but in no event shall State's share exceed $12,000 unless otherwise provided in a subsequent agreement between City and State. (b) State will maintain and operate the entire traffic control signal system and highway lighting as constructed. SECTION III IT IS MUTUALLY UNDERSTOOD AND AGREED: (a) That neither State nor any officer or employee thereof shall be responsible for any damage or liability occurr- ing by reason of anything done or omitted to be done by City under or in connection with any work, authority or jurisdiction delegated to City under this Agreement. It is also understood and agreed that, pursuant to Government Code Section 895.4, City shall fully indemnify and hold State harmless from any liability imposed for injury (as defined by Government Code Section 810.8) occurring by reason of anything done or omitted to be done by City under or in connection with any work, authority or jurisdiction delegated to City under this Agreement. ADOPT A RESOLUTION AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE A COOPERATIVE AGREEMENT WITH THE STATE FOR CHANNELIZATION AND SIGNAL MODIFICATICNS. 2. ADOPT A RESOLUTION AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE A COOPERATIVE AGREEMENT WITH THE IRVINE COMPANY FOR THE CONSTRUCTION OF IMPROVEMENTS ON BAYSIDE DRIVE. 3. ADOPT A RESOLUTION ACCEPTING EASEMENTS FOR STREET AND HIGHWAY PURPOSES FROM BAYSIDE DRIVE TO ALOHA DRIVE. DISCUSSION. THE PROJECT WILL PROVIDE FOR WIDENING BAYSIDE DRIVE APPROXIMATELY 24 FEET TO ALLOW FOR A LEFT TURN LANE AND FOUR TRAVEL LANES SOUTHERLY OF PACIFIC COAST HIGHWAY. U T WILL ALSO INCLUDE MCDIFICIATIONS TO THE EXISTING TRAFFIC SIGNAL At PACIFIC COAST HIGHWAY TO ACCOMMODATE THE STREET WIDENING AND TO FACILITATE THE INCREASING FLOW OF TRAFFIC THROUGH THE INTERSECTION. THE SIGNAL MODIFICATIONS INCORPORATE 3.PHASE OFERATION IN ORDER TO PROVIDE GREEN ARROWS FOR LEFT TURNS FROM THE COAST HIGHWAY. •TFE SUBJECT IMPROVEMENT IS INCLUDED IN THIS YEAR S BUDGET. FUNDS IN THE AMOUNT OF $179000 HAVE BEEN APPROPRIATED IN ACCOUNT N0. 19- 3373-039• THE CITY WILL FINANCE THE CONSTRUCTION OF THE ROADWAY AND ONE -HALF OF THE COST ''F THE SIGNAL MODEFICATION.
