The estimate is based on a tentative vertical alignment which could change somewhat in finail design. However, the estimated construction cost of $37,600 shot%ld be sufficient for budget purposes. Included in the estimate is an allowance of $4500 for replacing the existing 12" and 10" cast iron water. Uain with a new 12" A.C. line. Based on our tentative p bfile, the existing main will have up to 17 feet ol.;cloyer. This.depth would make it difficult to gain access for deeded maintenanoel and, in the @vent of a failure, a large pe"ion of the roadway embankment might be damaged. City engages Engineer to furnish the services here 19 inafter mentioned, at and for the compensation herein stipulated, 20 and Engineer accepts said engagement upon the terms hereinafter set 21 forth. 22I 2. Engineer shall: 23 (a) Undertake a preliminary investigation of the 24 overall project, including discussions and negotiations with 25 all agencies involved in the project. 26 (b) Make supplementary field investigations as 27 required. 28 (c) Prepare construction bid propc.sals and detailed 29 plans and specifications for the improvements outlined above, 30 suitable for use by City in calling for competitive bids. 31 (d) Prepare quantity estimates and related cost 32 estimates for the improvements outlined above. (f) Provide continuous liaison with the Public Works Director and his staff. 3. City shall provide field surveys consisting of top- ographic notes and cross sections. 4. Original drawings, reports, notes, maps and other documents shall become the property of the City and may be reproduced as deemed necessary by the Public Works Director. 5. City reserves the right to terminate this agreement at any time by giving Engineer three (3) days prior written notice in the United States mails, postage prepaid, and addressed to Engineer's business office. In the event that City terminates this agreement, it shall reimburse Engineer on the basis of his standard fee schedule contained in his proposal dated February 8, 1967. 6. All plans, specifications and other documents for the project shall.be completed to the satisfaction of the Public Works Director and delivered to him within ninety (90) calendar days following execution of this agreement. 7. In consideration of the performance of the above described engineering services, City agrees to pay Engineer an amount based upon the standard fee schedule contained in Eng- ineer's proposal dated February 8, 1967, but in no event shall said amount be greater than $3500.00. The amount to be paid Engineer shall be payable as follows: (a) Monthly partial payments, each payment to be the amount earned as determined by the fee schedule. The sum of the monthly partial payments shall not exceed ninety percent (90 %) of the above maximum fee. In addition, City shall reimburse Engineer for the actual cost of reproduction of copies of said plans, specifications and related documents, and filing fees, checking fees and other related costs authorized by the Public Works Director and advanced by Engineer. 8. Engineer shall indemnify and save harmless the City, and its officers and employees, from all damage and liability arising from any errors, omissions, or negligence in Engineer's performance of this agreement or from the engineering work and services herein provided. THIS WOULD HAVE THE ADVANTAGE OF MAKING 5TH AVENUE CONTINUOUS AND ALSO CLASSIFYING IT AS A CONTINUOUS STREET IN ADVANCE OF ANY FINAL FREEWAY DESIGNS BY THE STATE. I WOULD LIKE TO HAVE THIS PROJECT INCLUDED IN NEXT YEARS CAPITAL IMPROVEMENT PROGRAM IF IT PROVES TO BE FEASIBLE.
