COMMUNICATIONS - REFERRALS:
1. A letter dated February 17, 1967 from Newport
Shores Community Association thanking Council for
its appropriation to clean their channel, and asking
that title to this channel be settled and that Council
plan a recreation area for children of West Newport,
was referred to staff.
Councilman Forgit made a motion to file Communications
Nos. 2 and 3, which motion was withdrawn.
2. The City Clerk's referral to the insurance carrier of
the claim of Davis D. Chambers for damage to his
automobile allegedly caused when it was struck by
a City trash truck at 211 Via Ravenna, Newport Beach
on January 20, 1967, was confirmed.
3. A letter dated February 22, 1967 from James L.
Rubel, Jr. stating that he has enjoyed serving as a
member of the Board of Adjustments and would like
his name to be placed on list of citizens interested in
serving the City, was referred to the Committee for
Appointment of Commissioners.
BUSINESS:
1.1 The following Minute Resolution authorizing changes
in the Lido Shopping Association permit for a flag-
pole on Via Lido, was adopted:
The flagpole may be used to fly the American,
State and City flags, nautically oriented flags
and pennants of a non - advertising nature, and,
at Christmas time, to support a Christmas
tree. Any private organization flags or
pennants will be related to Newport Beach
organizations only.
2. Resolution No. 6524, amending Section 6 of
Resolution No. 6378, as amended by Resolutions
Nos. 6474 and 6496, which established regulations
for the operation of parking meters, was adopted.

THIS AGREEMENT is made and entered into this _LaZ�- day

NEWPORT BEACH, a municipal corporation, herein referred to as

"City ", and the LIDO SHOPS ASSOCIATION, herein referred to as

"Association ",.

WHEREAS, Association has requested permission from
9
City to erect a flagpole on that certain raised traffic island
10
located at the intersection of Via Lido and Newport Boulevard
11
within the City of Newport Beach; and
12
WHEREAS, City has granted such permission subject to
13
certain conditions;

NOW, THEREFORE, the parties hereto do hereby agree as
15
follows:

1. Association may erect a flagpole 50 feet in
17
height on that certain raised traffic island located at the

intersection of Via Lido and Newport Boulevard, and as shown on
19
Exhibit "A" attached hereto and by this reference made a part
20
hereof.

2. The flagpole may be used to fly the American flag
22
and, at Christmas time, to .support a Christmas tree. No other
23
' use may be permitted.

3. In the event that the right -of -way within which the
25
island is located is deemed to be under the jurisdiction of the
26
California State Highway Department, Association will remove said
27
flagpole, at its own expense, upon written request from said Statel
28
Highway Department.

4. The installation of the flagpole shall be to the
30
satisfaction of the Director of Public Works.

5. If, for any reason, it becomes the desire of City
32
to terminate this agreement, City may so terminate the agreement

by one (1) weeks written notice to Association. Association
shall, with dispatch, remove the flagpole at its own expense.
If the flagpole is not removed within two (2) weeks from the
date of mailing of the notice of termination, City may remove
the flagpole and charge the cost thereof to Association.
6. Association shall hold harmless the State, the City,
their officers and employees from any and all cost or liability
directly or indirectly arising from the installation, existence,
operation or removal of the flagpole.
7. Association shall carry public liability insurance
with the City named as coinsured in the amount of $100,000 for
any one person, $300,000 for any one accident, and property
damage insurance in the amount of $50,000, and shall furnish a
certificate of such insurance prior to the erection of the
flagpole.

Beautification Committee
Gentlemen:
Enclosed is an executed copy of agreement between The City
of Newport Beach and the Lido Shops Association is connection
with the erection of a flagpole at the intersection of Via Lido
and Newport Boulevard. Oa November 14, 1966 the City Council
adopted a Minute Resolution authorizing said agreement.
Also enclosed is lease agreement between the City of Newport
Beach and the Lido Shops Association authorized by the City
Council on November 28, 1966 in which the City agrees to
&rant the Association the use of thirty parking spaces from
November 30 to December 31, 1966.

Attached are the original and three copies of subject agreement,
the provisions of which were generally approved by the City Council
at their meeting of October 24th.

The Lido Shops Association wish to submit this
proposal for Council approval:
The erection of a nautical flagpole
at the junction of Via Lido and
Newport Boulevard, The exact
location and specifications of the
pole are attached.
The purpose of this flagpole is for identification
of the Lido Area and is also the first phase of our
plan for Lido beautification.
The flagpole will also be used to support a Christmas
tree at Christmas. For this reason we hope that
your approval will be expedited,
