Accept the work. 2. Authorize the City Clerk to file a Notice of Completion. 3. Authorize the City Clerk to release the bonds 35 days after the Notice of Completion has been filed. DISCUSSION: The contract for the widening of the Pacific Coast Highway adjacent to the Balboa Bay Club Apartments has been completed to the satisfaction of the Public Works Department. The bid price was: $19,706.48 Amount of unit price items constructed: 20,520.50 Amount of change orders: - Total contract cost 20,520.50 Amount budgeted: 22,000.00 Under the terms of an agreement dated November 18, 1966, the Balboa Bay Club will pay $5,259.18 of the contract. The Bay Club was responsible for the cost of the curb, gutter, and sidewalk. The contract amount was more than the bid price due to the State Division of Highways requirement for a wider sidewalk and larger storm drain pipe The contractor is R. W. McClellan and Sons of Costa Mesa, California. The contract date of completion was October 12, 1968. Huseby Garcia Subst R.Cockrell- Const. ..i , De ' V 0 GENERAL PROVISIONS 1. Definition. This permit is issued under Chapter 3 of Division 1 of the Street and Highways Code. The term encroach- ment is used in this permit as defined in the said Chapter 3 of said code. Except as otherwise provided for public agencies and franchise holders, this permit is revocable on five days notice. 2. Acceptance of Provisions. It is understood and agreed by the Permittee that the doing of any work under this permit shall constitute an acceptance of the provisions. 3. No Precedent Established. This permit is granted with the understanding that this action is not to be considered as establishing any precedent on the question of the expediency of permitting any certain kind of encroachment to be erected within right of way of State highways. 4. \stoic, Prior to Starting Work. Before starting work on which an inspector is required, or whenever stated on the face of this permit, the Permittee shall notify the District Engineer or other designated employee of the district in which the work is to be done. Such notice shall be given at least three days in advance of the date work is to begin. 5. Keep Prnrrit on the Work. This permit shall be kept at the site of the work and must be shown to any representative of the Grantor or any law enforcement officer on demand. 6. Permits from Other Agencies. The parry or parties to whom this permit is issued shall, whenever the same is required by law, secure the written order or consent to any work hereunder from Elie Public Utilities Commission of the State of California, or any other public board having jurisdiction, and this permit shall be suspended in operation unless and until such order or consent is obtained. 7. Protection of Traffic. Adequate provision shall be made for the protection of the traveling public. Barricades shall be placed with red lights at night, also flagmen employed, all as may be required by the particulai work in progress. 8. Minimum Interference With Traffic. All work shall be planned and carried out so that there will be the least possible inconvenience to the traveling public except for the specific work permitted. 9. Storage of Material. No material shall be stored within eight (8) feet from the edge of pavement or traveled way or within the shoulder line where the shoulders are wider than eight feet. 10. C lean Up Right of Way. Upon completion of the work, all brush, timber, scraps and material shall be entirely removed and the right of way left in as presentable condition as before work started. 11. Standards of Construction. All work shall conform to recognized standards of construction. 12. Supervision of Grantor. On work which requires the presence of an employee of the Grantor as inspector, the salary, travel- ing expense and other incidental expense of such inspection during the work shall be paid by the Permittee upon presentation of a bill therefor. 15. Liability for Dmnagrs. The Permittee is responsible for all liability for psrmnal injury or property damage which nut arise out of work herein permitted, or which may arise out of failure on the Permittec's part to perform his obligations under this permit in respect to maintenance. In the event any claim of such liability is made against the State of California, or any department, officer, or employee thereof, Permittee shall defend, indemnify and hold them and each of them harmless from such claim. This permit shall not be effective for any purpose unless and until the above named Permittee files with the Grantor, a surety bond in the form and amount required by said Grantor, unless specifically exempted on the face hereof. The requirement that a bond be filed does not apply in the event the Permittee is a govermnental board which derives its revenue by taxation. 16. Making Repots. If the Grantor shall so elect, repairs to paying which has but. disturbed shall be made by employ... of the Grantor and the expenses thereof shall be borne by the Permittee, who shall purchase and deliver on the road the materials necessary for said work as directed bs the Grantor. All payments to laborers, inspectors, etc., employed by said Grantor for or on account of the work herein contemplated, shall be made by said Permittee forthwith on receipt of written orders; pay rolls or vouchers approved by Grantor. Or the Grantor may elect to require a deposit before starting repairs, in an amount sufficient to corer the estimated cost discord. The Grantor will give reasonable notice of its election to make such repairs. If the Grantor does not so elect, the Permittee shall make such repairs promptly. In every case the Pennitree shall be responsible for restoring anv portion of the highway which has been excavated or otherwise disturbed to its former condition as nearly as may be possible except where the Grantor elects to make repairs to paving as above Provided in this paragraph and except where provision to the contrary is made in the typewritten portion of the permit. 17. Care of Drainage. If the work herein contemplated shall interfere with the established drainage, ample provision shall be made by the Permittee to provide for it as may be directed by the Grantor. 19. Submit Location Plan. Upon completion of underground or surface work of consequence. the Permittee shall furnish plan to the Grantor's District Office showing location and details. 19. afaintnrance. PIPES, CONDUITS, GAS PUMPS, ETC. 20. Crossing Roadway. Service and other small diameter pipes shall be jacked or otherwise forced underneath pavement without disturbing same. Pavement or roadway shall not be cut unless specifically permitted on the face hereof. Service pipes will not be permitted inside of metal culvert pipes used as drainage structures. 21. Limit Excavation. No excavation is to be made closer than eight (8) feet from the edge of the pavement except as may be specified. 22. Tunneling. No tunneling will be permitted except on major work as may be specifically act forth on the face h"rof. 23. Depth of Pipes. There shall be a minimum of two (2) feet of cover over all pip" or conduits. 24. Backfilling. All backfilling is to be moistened as necessary and thoroughly hand camped, there being not less than one camper to each shoveler. Whenever required by the grantor, a trench crossing the roadway shall be backfilled with gravel or crushed rock. 25. Preserve Surfacing Material. Whenever a gravel or crushed rock surface is trenched, such material shall be placed at one side and when backfilling'is started the rock material shall be replaced to its original position. 26. Maintain Surface. The Permittee shall maintain the surface over structures placed hereunder as long as necessary. 27. Pipe[ Along Roadway. Pipes and utilities paralleling the pavement shall be located at the distance from traveled way and ac such depth as specifically directed on the face hereof. Cutting of tree roots-will not be permitted. City of Newport Beach 768 -E- 769306 'Page., 07 -ORA -001- 18.72/19.27 August 5, 1968 4) The Permittee's work shall be coordinated with the pending State Highway resurfacing project, so as not to interfere with the State Highway Contractor's operations. 5) Backfill material shall attain a sand equivalent value of 301 (Calif. Test Method 217F) and shall be compacted to a mini- mum relative compaction of 95% (Calif. Test Method 216F) within the areas as defined in the attached "Substructures" sheet. 6) By acceptance of this permit, the Permittee agrees to pay all laboratory costs in connection with the necessary tests as may be required by the Division of Highways' Engineer to deter- mine the sand equivalent value of the backfill material and the trench backfill compaction. It is further understood that the fre- quency of such tests shall not exceed one test per 1500 feet of trench at elevations of not less than every 2 feet of backfill depth. Prior to starting the trench backfill, the Permittee shall make the necessary arrangements with the Division of Highways or a private materials testing laboratory to conduct these tests. 7) All existing teees wit remove This permit shall be kept at shown to any representative officer on demand. is of this project av as a condition o the site of the work and must be of the grantor or any law enforcement Should the Division of Highways' Representative find work in pro- gress prior to his notification, he shall stop said work for a period not less than the remainder of that working day. Special attention is directed to General Provisions 2, 3, 5 and 6 printed on this form. The attached Substructure, loadside Improvement, Curb, Driveway Sheets are part of this permit. MAINTENANCE SPECIAL TERMS AND CONDITIONS (SUBSTRUCTURES) TO BE ATTACHED TO AND 6mADE A PART OF ENCROACHMENT PERMIT NO. 768 -E- 769306 I A. - Inspection Requirements 1 - It is imperative that the Permittee notify the State Inspector at least 48 hours prior to starting any work under thiq pqrmit. Huseby phone 714 - 542 -4739 between 8:0 a.m. an a.m . or if no answer phone between A.M. an . 2 - All inspection costs incurred incidental to this work shall be borne by the Permittee, unless otherwise specified on the face of the permit. 3 = All work shall be performed within the hours designated by the Division of Highways. B - Specifications Unless otherwise detailed and authorized on the face of this permit all work shall be done in accordance with the Division of Highways' Standard Specifications dated July, 1964, to the satisfaction of the Division of Highways representative and the following special provisions: 1 - SAFETY AND TRAFFIC CONTROL: A minimum ofSeePermit lanes shall be provided for traffic in each direction. In ITdiiTo—no minimum clearances of two feet adjacent to any surface obstruction and a five -foot clearance between the excavation and the traveled way, shall be maintained. vrovision shall be made for barricades, lights, and flagmen to adequately protect the traveling public during, construction operations. When necessary for public safety, flagmen shall be on duty 24 (twenty - four) hours a day at no expense to the State. When the permit authorizes installation by the open -cut method, not more than one lane of the highway pavement shall be open -cut at any one time After the pipe is placed in the open section, the trench is to be back - filled, in accordance with Specifications, permanent repairs made to the surfacing and that portion opened to traffic befo.re'the pavement is cut for the next section. 2 - CONSTRUCTION REQUIREMENTS: Unless otherwise authorized pipes and conduits shall be installed in a manner to provide at least a minimum clearance of 42 inches between the top of pipe and surface. Except in cases where the ,perimeter of pavement removal will be less than 30 feet, P.C.C. pavement shall be scored to a depth of 11 inches by means of a concrete saw to provide a neat and straight pavement break along both sides of trench also, provide an unfractured pavement Joint and rigid bonding of pavement replacement patch. A.C. pavement shall be scored as the opinion of the State Inspector straight along both sides of trench pavement joint for bonding existing 7 -MP -607 AUG 66 Rev per P.C.C. pavement except where in the pavement has baen cut neat and to provide an unfractured and level pavement and replacement patch. ( OVER Y"... Repairs to P.C.C. pavement shall be made of Portland Cement concrete containing a minimum of 7 sacks of cement per cubic yard. Replacement of P.C.C.. pavement shall equal existing pavement thickness. The concrete shall be satisfactorily cured and protected from disturbance for not less than 48 hours. High early cement may be required at the discretion of the Division of Highways' representative. Repairs to A.C. pavements shall be made with asphaltic concrete meeting State specifications, with every effort made to match the existing pavement as to color and surface texture. Replacements of A.C. pavement shall equal existing pavement thickness but not less than 3 ". Rock base will be required. Structure backfill within the roadbed area shall be compacted in horizontal layers not exceeding 8 inches in thickness, using approved hand, pneumatic or mechanical type tampers, to obtain a "relative compaction" of 95 percent using California Test Method 216F. Structure backfill outside of slope lines and not beneath any roadbed shall be compacted to a relative compaction of 90 percent. Backfill material shall have a "Sand Equivalent" value of not less than 30, as determined by the California Test Method 217FJ if the excavation falls within the existing or proposed roadbed. In such areas consolidation by ponding and Betting will be permitted when, as determined by the engineer, the backfill material is of such character that it will be self draining when compacted and that foundation materials will not soften or be otherwise damaged by the applied water and no damage from hydrostatic pressure will result. Ponding and jetting of the upper 4 feet below finished grade is is not permitted. hen ponding and getting is permitted, material for use as structure backfill shall be placed and compacted in layers not exceeding 4 feet in thickness. Ponding and jetting methods shall be supplemented by the use of vibratory or other compaction equipment when necessary to obtain the re- quired compaction. Repairs to asphalt shoulders shall be made with SC -800 Asphalt Plant Mix Surfacing . (See second paragraph, third and fourth line) Concrete sidewalks or curbs shall be cut to the nearest score marks and replaced equal in dimensions to that removed, with score marks matching existing score marks. When installation is to be made by boring or Backing under the traveled way, excavations on either side of the road shall be sufficiently distant from the edge of pavement to insure pavement stability and minimum obstruction to traffic as determined by the Division of Highways' representative. If considered necessary by the Division of Highways' representative, the permittee shall, at his expense, pressure grout from within the casing and /or from the top of pavement, the area between the pavement and the casing, in order to fill any voids caused by the work as covered under this permit. Service connections must be installed at an angle of 90 degrees from the centerline of the State Highway which the main line traverses. MAINTENANCE.- PERMITS is 0 SPECIAL PROVISIONS (Roa a e mprovements) TO BE ATTACHED TO AND MADE A PART OF PERMIT N0. 768 -E- 769306 I. INSPECTION REQUIREMENTS It is imperative that the permittee notify the following State Inspector at least 48 hours prior to starting any work under this permit. All work shall be performed during the working hours regularly assigned to Division of Highways Employees. II. CONSTRUCTION REQUIREMENTS Unless otherwise detailed and authorized on the face of this permit, all work shall be done in accordance with the Division of Highways Standard Specifications dated July 1964, and the following special provisions: (Only items pertaining to the applicable construction work will apply.) A. Sidewalk shall be constructed with Class "A" Portland Cement Con- crete four (4) inches in depth except at commercial driveways where six (6) inch depths respectively, will be required. Back edge of sidewalk shall be placed on the right -of -way line. The finished grade of sidewalk shall have a cross fall of 1/4 inch per foot. Concrete shall be scored in accordance with the Standard Specifications or so that scoring will match adjoining existing concrete. B. Concrete curbs and gutters shall be constructed grades or, in conformance with existing curb fo grade. Grade outside the approval of the Prior to the construction of new curbs, the permittee shall relocate surface obstructions (such as utility poles, trees, etc.) to.locations back of the proposed curb, also continuation of curb line within the following limits: Fifty (50) feet back from beginning of curb construction and one hundred and fifty (150) feet beyond the end of curb construction for safe traffic movement. Removal or relocation of surface obstructions shall be done without expense to the State. C. Sections of existing concrete curbs and sidewalks to be removed shall be cut on the nearest score mark"eyond the limits of re- moval. This concrete shall be removed to full depth and disposed of outside the Division of Highways right of way. Unless a neat cut is made without damage to remaining concrete, additional con- crete shall be removed to the next score line, using a concrete saw if considered necessary by the State Inspector. (OVER) 7- MP -610 April 68 REV D. (1) Concrete driveways shall be constructed in accordance with the attached Regu a ons for Standard Driveways. (2) Concrete driveway shall be located to provide not less than 2 fee or M22-h-Ug-BY curb between permittee's property line and driveway. In those cases where the lot line does not intersect the highway right -of -way line at 90', the extension of the pro- perty line within the Division of Highways' right of way for purposes of determining driveway locations, shall be on a line at right angles to the curb or edge of traveled way and passing through permittee's lot corner. E. Temporary �driveways when authorized shall be constructed with Asphalt surrac ni to a depth of not less than three (3) inches. The edge of driveway shall be not less than five (5) feet from permittee's side property line when curbs are not constructed. Driveways shall be constructed at right angles to and shall join existing surfacing. Radius of flared sections placed between edges of pavement and driveway shall not exceed ten (10) feet, unless a larger radius is authorized on face of permit. Finished grade of surfacing placed between traveled way and curb shall conform to existing shoulder grade. This construction shall not interfere with the existing drainage in any way. The permittee understands and agrees that asphalt- concrete surface driveways are temporary; at such time as concrete sidewalks are constructed, asphalt- concrete surface driveways shall be replaced with standard driveways of Portland Cement Concrete. F. Roof drains, when authorized, must be restricted in use for the exclusive purpose of draining rain water from the roof of permittee's building and /or paved parking lot. Roof drains if used for any other purpose, such as draining waste water or domestic supply water onto the highway, will be summarily plugged at curb face outlet by State forces. Drains shall be installed at right angles to the curb line. Removal and replacement of concrete curb and sidewalk sections for the installation of roof drains shall be done in accordance with provisions of Paragraph "C" above. G. Roadside landscaping, when authorized, shall conform with require - men s g ven on a ace of the permit and /or the State s Landscaping Regulations. Phone 620 -3660 Basic Encroachment Regulations - -- DRIVEWAYS Policy: These instructions apply to the location and design of residential and commercial driveways to serve property fronting on State highways in cities and in areas outside of cities where.urban type development is encountered, but not in oases where highway access is controlled by deed conditions. �ecifications: For design and construction details, see State brooTure en e , "Regulations for Standard Driveways -Jan. 1960 ". The maximum length of a Residential Driveway is 12 feet for a single driveway, and 20 feet for a double driveway. The maximum length of a Commercial Driveway is 35 feet. Where only one driveway serves a given property, an increase in the maximum width will be considered if the prima facie speed limit is 45 m.p.h:', and the width of State R/W constricts driveway approach. When more than one - -driveway approach serves a given property frontage, the total length of driveways'shall not exceed 70% of the frontage where such frontage is 100 feet or lose, and shall not exceed 60% when the frontage is greater than'100 feet. Location of Drivewa (1) - e sec on o a driveway shall not cross the side property line unless the application for permit includes the approval.and si ture of the adjacent property owner. (2T- When approval of adjacent property owner has not been obtained, as mentioned above, the driveway shall be located to provide not less than 2 --feet of full height curb between the top of "X' section and aide property line._, This will provide room for the installation of utility poles, light standards, fire hydrants, eto., in the. vicinity of the side property.11ne where they will afford the least nuisance to abutting property owners. In the absence of curb, the edge of driveway shall be located not less than 5 feet from side property line to provide for future curb construction and the minimum 21 Pull height curb requirement mentioned above. 13? - Consideration will be given in extenuating cases to start the X' section of a driveway at the side property line. To illustrate: (a) - An existing building may be located up to the side property line in which ease the proposed•driveway would not conflict with .future adjacent property driveway. O�b - A joint driveway design could be considered, in which case the XI section could start at the side property line provided that the width of driveway is. limited to --one -half of the maximum allowable width pending future construction of the other half on adjacent roperty. p(4) - Driveways may encroach one - eighth (1/8) into the are of the curb return when the curb return radius 1s 35 feet or greater ". When drainage is away from the curb, the cross slope shall equal the pavement cross slope. On wide gutters, the cross slope shall not be steeper than 7 percent, since steeper cross slopes may cause a, pas- senger car to drag its under carriage in a driveway. POLES, WIRES, CABLES AND OVERHEAD STRUCTURES 28. Location Pole Lines, etc. Pole lines shall be located one foot from the property fine orders; otherwise specified on the face hereof. orders; 29. No guy wires are to be attached to trees except on specific authority and in stet event shall they be so attached as to girdle the tree or interfere with its growth, Guy wires shall be kept at a minimum elevation of six feet above the ground whenever so directed. 33. Clearing Around Poles. The Permittee shall remove and keep dear all vegetation from within a radius of at least five feet of the polo. 34. Painting or Visibility Strips. All poles are to be painted for a distance of six feet above the ground using white lead and oil or aluminum paint or in lieu thereof, when polo have creosoted beta, wood, metal or other approved type of visibility strips may be placed. The entire length of such timbers shall be removed from the ground and the bolo backfilled and thoroughly tamped. PLANTING TREES 36. Lu,etiou and Sprcirs. The location and kind of trees to be planted shall be specified on the face of this permit. 37. Planting and Maintruance Cost. The Permittee most bear the cost of planting the trees. The arrangement as to maintenance of the trees shall be specifically set forth on the face of the permit. In particular cases arrangements may be made for the Grantor to do this work upon deposit of a certain sum for each tree which is to be planted. The Grantor reserves the right to assume the maintenance or to decline to do so as conditions justify. 38. Grarp Planting. The cost of group plantings and similar special work which may be agreed upon with the Grantor shalt be borne by the Permittee. Land for such plantings shall be secured in fee by the Permittee and turned over to the State. Plantings for parking and picnic grounds will not be considered in this connection. REMOVAL OR TRIMMING. OF ROADSIDE TREES 39. Removed of Trees. When permit is granted for removal of a tree r an independent operation or as a part of other work, the entire stump shall be taken out for a depth of at least two feet blow the ground surface. 40. Clearing the Site, All timber and debris shall be removed from the right of way. The hole left by the stump shall be backfilled and thoroughly tamped and the site left in a presentable condition. 41. Trimming of Trees. In general, only light trimming of brandies two inches or less in diameter will be permitted and only when specifically so stated on the face hereof. The shapeliness of the tree must be preserved. 42. lmpertiorr. If the permit requires inspection by the Grantor during progress of the work the cost of inspection shall be borne by the Permittee. No charge will be made for occasional routine inspection. Road Approaches, Connecting Pavements and Minor Work 43. Grades and Specifications. Grades and types of construction shall be as detailed by plane or stated on the face of this permit. 44. Borrow and Waste. Only such borrow and waste will be permitted and within the limits as see forth on the face of this permit. 45. Minor Work. Grading down of small banks, small ditches, plating of awnings, and other similar minor work shall be governed by the general provisions and r detailed on the face hereof. Signs 46. Clearance of Signs. The minimum clearance from the sidewalk shall be twelve feet. Railroad Crossings 47. Safety and Convenience. A budget amendment requesting an additional appropriation of $4,500, to Account 22- 3397 -050 is being presented for Council consideration. Negotiations with the California State Division of Highways are not pro- gressing as rapidly as originally anticipated, and receipt of the Encroachment Permit may delay the start of construction until the latter part of July, 1968. Construction should be completed within two months thereafter. Continued discussions with the Southern California Edison Company recently concluded that their overhead facilities in this area are located so as to make it physically impossible to install the proposed street light standards at this time. The number of services, State law clearance requirements, and the size of the facilities relative to the width of the parkway are largely responsible for this con- clusion. However, the conduit will be installed and other provisions made at this time to facilitate installation of the standards following removal of the Edison Company's overhead facilities in the future. It had originally been planned to carry storm runoff on the surface, however, during detailed design, it was deter- mined that the flat grades and highway superelevation in the area made an underground drain necessary. DISCUSSION: The current budget contains a capital improvement fund appropriation of $15,000.00 for improvements to Coast Highway adjacent to the Balboa Bay Club. The work includes street widening, and construction of curb, sidewalk, and drainage improvements, A portion of the cost is to be borne by the Bay Club in accordance with an agreement between between the Club and the City- The cost estimate and the budget message contemplated that the plans would be Prepared by the City. As a result of additional unscheduled work in the office, including the beach erosion problem, the Public Works Department has been unable to meet the desired schedules for some capital improvement projects, among them, the Coast Highway improvements. _ It is desired to start construction of the work not later than March, 1968 in order to minimize interference with summer traffic, to precede a proposed State project for resurfacing of the highway, and to meet the commitment established in the agreement with the Bay Club. If this timing is to be met it will be necessary to have the plans prepared by a private engineer. Because of the extremely flat nature of the terrain along the highway and the drainage problems which exist, it would be desirable to establish grades and determine the drainage requirements for the entire presently unimproved frontage from the Sea Scout Base to the Upper Bay, even though initial construction of improvements would include only the Bay Club frontage.. It is felt that the best and most economical overall design would result from this approach. The firm of Raub, Bein, Frost and Associates has offered to perform the necessary topographic surveys and prepare the plans for the entire frontage for a fee not to exceed $4,900.00. The firm has satisfactorily performed other consulting services for the City, including design of the Irvine Avenue realignment in the Upper Bay area which was recently completed. Because of the limited amount of general fund money available, it is pro- posed to finance the design work with gas tax funds.. CONDUCT OF WORK The Contractor shall maintain the job site in a neat and orderly condition at all times. Any excess spoil shall be immediately removed from the job site. . III. UNFORESEEN DIFFICULTIES Should the Contractor encounter, or the City discover, during the progress of the work subsurface and /or unknown conditions at the site materially differing from those shown on the drawings or indicated in the Specifications, the attention of the City shall be immediately called to such conditions before they are disturbed. The City shall thereupon promptly investigate the conditions, and if he finds that they do so materially differ, the additional work shall, with the written approval of the City, be qualified as "Extra Work." VIII. SCHEDULE OF WORK A complete schedule showing the order and dates the Contractor proposes to carry out the work shall be submitted to the City for approval. No work shall commence until a schedule of work has been approved in writing by the City. IX. UTILITIES RIGHTS -OF -WAY The Contractor shall not be entitled to any extra compensation on account of any postponement, interferences, or delay caused by any pipelines, transmission lines, fences or structures being on the line of the work except as provided in Section 8 -05 and 8 -07 of the Standard Specifications. TRAFFIC CONTROL (a) The Contractor shall submit a Plan of the proposed method of Traffic Control to the Engineer for written approval prior to start of the work. (c) Two travel lanes in each direction shall remain open to traffic at all times along Pacific Coast Highway. (d) Full compensation for conforming with these requirements will be considered as included in the prices paid for the various Contract items of work and no additional compensation will be allowed therefor. XI. PROTECTION OF EXISTING UTILITIES The location of existing utilities shall be verified in the field at time of construction. The Contractor shall request each utility company to locate their underground lines prior to commencing work. The City does not guarantee the presence or absence of utilities in any location. It will be the Contractor's responsibility to locate and uncover the existing utility lines sufficiently in advance of the work to determine their location and to work around the utilities at his own expense. XII. EXISTING HIGHWAY FACILITIES The work performed in connection with various existing highway facilities shall conform to the provisions in Section 15 of the State Standard Specifications and these Special Pxbvisions. All debris resulting from the Contractor's operation shall be removed as it develops and before the end of each work day. XIII. EXCAVATION (a) General. Excavation shall include without classification, the rem— oval of all materials of whatever nature encountered, except asphalt paving, including all obstructions of any nature that would interfere with the proper execution and completion of the work. CONSTRUCTION STAKING All field staking for the control of construction shall be the respon- sibility of the Contractor and shall be performed under the supervision of a Civil Engineer or Land Surveyor licensed to practice in the State of California. Payment fdi all staking shall be included in the unit prices bid for the various items of work and no separate compensation will be made therefore. XV. PAVING The Contractor may, at his option, Blade -lay the base course lift XVI. SALVAGE All material to be salvaged shall be carefully removed and transported, at no additional cost to the City, as part of the unit prices set forth in the Contract, to the City of Newport Beach (4'lr*_' r� Yard at 592 Superior Avenue for storage. XVII. ADJUST EXISTING SEWER MANHOLES TO GRADE The work shall be subject to inspection by the County Sanitation Districts. Contractor shall notify the Districts at (714)540 -2190 at least twenty- four(24) hours prior to beginning any work on the manholes. XVIII. EXISTING DRIVEWAYS The Contractor shall be responsible for maintaining ingress and egress to all private driveways adjoining this work and shall provide a final smooth join between the old and new driveway pavements. XIX. STREET LIGHTING This contract requires the installation of 1Q inch conduit, pull boxes, and sidewalk block outs, to provide for the future installation of street lights. The conduit shall run from a stub end at station 106 +54 to a pull box at station 116 +60. The ends of each section of conduit shall be plugged. The filled -in sidewalk block outs shall be considered as included with the construction of the sidewalk and no additional payment will be made there- fore. DISCUSSION: The current budget contains a capital improvement fund appropriation of $15,000.00 for improvements to Coast Highway adjacent to the Balboa Bay Club, The work includes street widening, and construction of curb, sidewalk, and drainage improvements. A portion of the cost is to be borne by the Bay Club in accordance with an agreement between between the Club and the City. The cost estimate and the budget message contemplated that the plans would be orepared by the City. As a result of additional unscheduled work in the office, including the beach erosion problem, the Public Works Department has been unable to meet the desired schedules for some capital improvement projects, among them, the Coast Highway improvements. It is desired to start construction of the work not later than March, 1968 in order to minimize interference,with summer traffic, to precede a proposed State project for resurfacing of the highway, and to meet the commitment established in the agreement with the Bay Club. If this timing is to be met it will be necessary to have the plans prepared by a private engineer, Because of the extremely flat nature of the terrain along the highway and the drainage problems which exist, it would be desirable to establish grades and determine the drainage require -meats for the entire presently unimproved frontage from the Sea Scout Base to the Upper Bay, even though initial construction of improvements would include only the Bay Club frontage, It is felt that the best and most economical overall design would result from this approach. The firm of Raub, Bein, Frost and Associates has offered to perform the necessary topographic surveys and prepare the plans for the entire frontage for a fee not to exceed $4,900,00- The firm has satisfactorily performed other consulting services for the City, including design of the Irvine Avenue realignment in the Upper Bay area which was recently completed. As you had observed, the walk extends to the end of the existing Bay Club wall. The reasons for this are as follows: 1. The State encroachment permit allows the sidewalk to be constructed only in the wall area. A copy of the permit is attached for reference. 2. In the area southeasterly of the wall there is a substantial grade differential between the elevation of the sidewalk and the elevation of the Bay Club property. When the wall is built it will function partially as a retaining wall, and will simplify construction of the sidewalk to the proper grade. 3. Because of the proximity of the sidewalk to the wall and the grade differential mentioned above, it would be difficult to construct the sidewalk at this time and the wall at a later date without damaging the sidewalk. 6 Benjamin B. We have been advised that their policies require that the following conditions be attached to the Encroachment Permit: a. The sidewalk must be placed 2 inches from the property line. It must be a minimum of 5 feet wide. b. All the existing trees must be removed. c. No landscaping will be allowed within the parkway except that a low ground cover may be planted and maintained between the back of the curb and the sidewalk. Tree wells similar to those in Corona del Mar may be allowed. The permit has been requested in accordance with these conditions. When the project was originally conceived it had been planned to place the sidewalk adjacent to the curb, leaving a 2; foot wide planting strip between the sidewalk and the wall. I was also unable to contact Mr. A. A. Smith who is in charge of Design "D ", the section that is responsible for the thin blanket program on the Coast Highway. I was hottever, successful in contacting Mr. Bork, Sr. Civil Engineer (Ma 0- 5326). He stated that the thin blanket program is a maintenance operation and any alterations to the scope of work would have to be approved by Sacramento. This differs from a minor capital improvement project in which the scope of work can be controlled by the Division in Los Angeles. After explaining our concern over the final appearance of the street he said that they could arrange to Fog Seal the parking strip area so that the entire roadway would have a uniform color at the completion of the project. This type of treatment could bc:::uccessful depending on the quality of workmanship. Mr. Bork agreed to give the City an opportunity to review some of the work of this type being done by the thin blanket contractor in other areas of Orange County. We will be given an opportunity to see the work that is being done before the Coast Highway portion of the project 1s started. After reviewing the quality of this work and its final appearance, the City would be in a better position to make a determination On what we would.accept on the Coast Highway. I have indicated to Mr. Bork that you would like to accompany us on this inspection trip. On Monday, August 5, 1968, I talked to Mr. Ayanian and the thin blanket program. Street light installation is proposed for this area in the near future. Provisions for installation of these lights and appurtenances shall then be incorporated with the final im- provement drawings.
