SUBJECT: COOPERATIVE PROJECT WITH ORANGE COUNTY TO WIDEN CAMPUS DRIVE FROM
PALISADES ROAD TO MAC ARTHUR BOULEVARD
RECOMMENDATION:
APPROVE CITY PARTICIPATION IN THE PROJECT, WITH FUNDING TO BE PROVIDED
IN FY 67 -68 FROM SECTION 186..1 GAS TAX FUNDS.
DISCUSSION:
CAMPUS DRIVE FROM PALISADES TO MACARTHUR IS PRESENTLY PAVED TO PROVIDE TWO
TRAVEL LANES PLUS PARKING NORTHBOUND (32 FEET) AND ONE TRAVEL LANE WITH NO PARKING
SOUTHBOUND (10 FEET). ORANGE COUNTY IS PROPOSING TO WIDEN THE STREET TO PROVIDE
FOUR FULL TRAVEL LANES. FROM QUAIL STREET NORTHERLY, CURB AND GUTTER ON THE WESTERLY
SIDE OF THE STREET WILL BE CONSTRUCTED BY THE AIRPORT PRIOR TO START OF THIS PROJECT.
IN THIS CURBED AREA PAVEMENT WILL BE EXTENDED OUT TO THE GUTTER. THIS WILL RESULT IN
A TOTAL IMPROVED WIDTH OF 64 FEET. SOUTHERLY OF QUAIL DRIVE A GRADED SHOULDER WILL
BE PROVIDED IN COUNTY TERRITORY.
WITHIN THE CITY OF NEWPORT BEACH A TWO INCH CAP OF ASPHALTIC CONCRETE WILL
BE PLACED OVER THE TWO EXISTING TRAVEL LANES. IN ADDITION, APPROXIMATELY 5000 SQUARE
FEET OF PAVING ON THE CITY SIDE WILL BE RECONSTRUCTED IN THE VICINITY OF DOVE STREET
TO ELIMINATE A SUMP CONDITION.
THE TOTAL ESTIMATED COST OF THE PROJECT IS $53,000. S�ITp IS ESTIMATED THAT
THE CITY'S SHARE OF THE WORK WOULD BE $130000. FISCAL YEAR 67 -68 SECTION 186.1 GAS
TAX FUNDS COULD BE USED TO FINANCE THE CITY'S SHARE.
A COOPERATIVE AGREEMENT WITH ORANGE COUNTY IS BEING PREPARED AND WILL BE
SUBMITTED FOR COUNCIL ACTION IN THE NEAR FUTURE. THE AGREEMENT WILL STIPULATE THAT
NO PAYMENT WILL BE REQUIRED FROM THE CITY UNTIL FY 67 =68.

WITNESSETH:
WHEREAS, County is proposing to construct roadway improvftents on
Campus Drive between MacArthur Boulevard and Palisades
Road, hereinafter referred to as the "Project ", and
WHEREAS$ portions of the proposed improvement are in the City of
Newport Beach, and
WHEREAS, the provisions of Title 1, Division 7, Chapter 5, Article
1, of the California Government Code entitled "Joint
Powers Agreements" authorise two or more public agencies
to jointly exercise auj power comma to the contracting
parties, and
WHEREAS, County and City consider it in the best interests of
economics and public safety to combine the improvemmt it
their respective jurisdictions into one project, and
WHEREAS, County has offered to design, contract and inspect said
City portions of the Project.
NOW, THEARFOR11, IT IS AGREED by the parties hereto as follows:

B. During the period of construction have jurisdiction over

the construction area including that portion of the Pro-

ject within City area.

II. CITY SHALL:

A. Prior to the award of the contract give its approval in
11
writing to the plans, specifications and cost estimates
12
as they pertain to construction and maintenance features
13
for City portions of the Project.

g. At all times during the progress of construction of said
15
Project have access to the work thereon for the purpose
16
i of inspection thereof, and should City dean any remedial
11
measures to be necessary, City shall notify County thereo
18
III. The total estimated cost for the City portion is presently
19
$13,000, which sum includes an estimate of the engineering
20
I and overhead for the City portion.

i IV. City's share of the construction cost shall be determined on
22
the basis of the amount of work done on said portion of road-
23
lying within its boundaries, as these boundaries exist
24
at the time of advertising the Project.
25
V. Upon completion of the Project, County agrees. to submit full,
26
true and correct copies of documents, certificates and itemis
27
bills to City, and City shall reimburse County within thirty
28
(30) days upon submission of statement of such costs or by
29
! ,July 1, 1967, whichever is later, for the full cost of the

I City construction. Such bills shall be based on the actual

quantities of construction and the contract bid prices, and

shall include a charge, not exceeding fifteen percent (15%)

of the Citei share of the total Project cost, for overhead
on tba.tagineering and inspection performed by County.
VI. IT IS MUTUALU .DOWTOOD AND AGREV:
A. That neither nflr any officer or employee thereof
- 41ball be responsible.for any damage or liability occurrin
by reason of anything done or omitted to be done by City
under or in connection with any work, authority or
jurisdiction delegated to City under this agreement. It
is also understood and agreed that, pursuant to Govasnmen
Cods Section 895.4, City shall fully indemnify and Bold
County harmless from any liability imposed for injury
(as defined by Government Code Section 810.8) occurring
by reason of anything done or omitted to be done by City
under or in connection with any work, authority or
jurisdiction delegated to City under this agreement.
B. That neither City nor any officer or employee thereof is
responsible for any damage or liability occurring by
reason of anything done or omitted to be done by County
under or in connection with any work, authority or
jurisdiction not delegated to City under this agreement.
It is also understood and agreed that, pursuant to
Government Code Section 895.4, County shall fully
indemnify and hold City harmless from any liability impos

Subject: Agreement with the County of Orange for roadway
improvements on Campus Drive between MacArthur
Boulevard and Palisades Road
Attached are the original and four copies of the subject agree-
ment, all of which have been approved as to form by me and by
the County Counsel, together with a resolution which, if
adopted by the City Council, will authorize its execution on
behalf of the City.
The Public Works Director requested that this be referred to
the Council for consideration at their meeting of December 12,
1966.
