AGREEMENT:
11 Generale
city engages Engineer to furnish the services hereinafter
specified for the compensation herein stipulated,`and Engineer
agrees to perform said services upon said terms.
2. Duties of Engineer.
The Engineer shall :.
(a) Make necessary preliminary investigations, including.
discussions with all affected public agencies gild public. ;utility

27' (b) Conduct field, surveys and topographical studies
28 necessary for design.
29 (c) Prepare detailed plans and specifications for the
30 project suitable for the calling for competitive bids for the work,
31 including structural design of the span of the flood control channel
32 and design of structures as required.

8 4. Completion of Services,
9 Engineer agrees to complete all of the services specified
10 herein within eight weeks after execution of this contract.;
11 5. Payment by City.
12 City agrees to pay Engineer for.allpservices called for
13 under the provisions of this contract an amount ,based upon the fee
14 schedule attached hereto as Exhibit "A" and_made � gprt hereof, but
15 in no event shall the total amount exceed $8,000. in addition, City
16 shall reimburse, giueer for the actual cost,of'reproduction of
17 copies of said. plans, specifications and related documents requested

6. Termination.
This agreement may be terminated at any time by the City
upon five days' written notice to Engineer, either by personal
service or by placing said notice in the United States mail, postage
prepaid, addressed to any of Engineer's business offices. In.the
event of termination due.to the fault of Engineer., City shall be
relieved of any obligation to compensate Engineer, if this agree -'
meat is.terminated` for any reason other than the fault of Engineer,
City agrees to compensate Engineer for the actual services per-
formed up to the effective date of the notice of termination.
7. Amendment.
This agreement may be amended or modified only by written
agreements signed by both parties and failure on the part of either .
party to enforce any- provision of this agreement shall not be

SUBJECT: UPPER BAY WATER TRANSMISSION MAIN - IN TUSTIN AVENUE FROM NORTHERLY
OF UNIVERSITY DRIVE TO PALISADES ROAD. _ 6
RECOMMENDATION:
ADOPT A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
A CONTRACT WITH JAMES M. MONTGOMERY, CONSULTING ENGINEERS, FOR THE
PREPARATION OF PLANS AND SPECIFICATIONS FOR THE CONSTRUCTION OF THE
SUBJECT WATER MAIN.
DISCUSSION:
$90,000 HAS BEEN INCLUDED IN THIS YEARS CAPITAL PROJECTS' BUDGET FOR
THE DESIGN AND CONSTRUCTION OF A WATER TRANSMISSION MAIN, APPROXIMATELY 4,000 FEET
IN LENGTH, IN TUSTIN AVENUE FROM NORTHERLY OF UNIVERSITY DRIVE TO PALISADES ROAD.
THE BUDGET PROVIDES FOR PREPARATION OF THE PLANS BY A PRIVATE ENGINEER.
A PROPOSAL HAS BEEN RECEIVED FROM JAMES M. MONTGOMERY, INC., TO PERFORM
THE WORK FOR A FEE NOT TO EXCEED $8,000. THE ACTUAL FEE WILL BE BASED UPON THE
TIME REQUIRED FOR THE WORK AND AN ESTABLISHED SCHEDULE OF RATES. THE MONTGOMERY
FIRM HAS DONE CONSIDERABLE WORK OF A SIMILAR NATURE FOR THE CITY, AND 15 ESPECIALLY
WELL QUALIFIED TO PERFORM ENGINEERING SERVICES OF THIS TYPE.
THIS PROJECT WILL JOIN THE EXISTING 12" MAIN IN TUSTIN AVENUE TO A
SECONDARY CONNECTION TO THE M.W.D. LINE IN PALISADES ROAD AT CAMPUS DRIVE. THE
PROJECT WILL ALSO PLACE THE INDUSTRIAL AREA ADJACENT TO THE AIRPORT ONTO A DIRECT
FEED FROM BIG CANYON RESERVOIR,
WITH THE COMPLETION OF THIS,PROJECT,THE UPPER BAY LOOP WILL BE COMPLETED
EXCEPT FOR THE LINK IN PALISADES ROAD BETWEEN CAMPUS DRIVE AND JAMBOREE ROAD. THE
REMAINING LINK IN PALISADES ROAD WILL BE INCLUDED IN THE PROPOSED LIST OF CAPITAL
PROJECTS FOR THE NEXT FISCAL YEAR.,
