LEROY C. HARDY, herein- 6 after called "Consultant "; 7 WITNESSETH• I 8 WHEREAS, Section 1005 of the Newport Beach City :Charter 9 requires that the City, Council appoint a committee every :dour 10 years to study and report to the City Council on the advisability ZZ of redistricting the City's councilmanic districts; and 12 WHEREAS, the City Council has appointed such a committee 13 composed of three Councilmen to study the matter of redistricting 14 and to report its findings to the Council during the year 1967; 15 and 16 WHEREAS, said Councilmanic Redistricting Committee is 17 in.need of technical assistance in performing its assignment; and 18 WHEREAS, Consultant is well qualified to act as tech - 79 nical consultant to said Councilmanic Redistricting Committee and 20 has submitted.a proposal to the City Council to furnish the 21 services hereinafter described; 22 NOW, THEREFORE, the parties agree as follows: 23 I. Scope of work 24 (a) Consultant agrees to prepare a comprehensive 25 councilmanic redistricting analysis and report which takes 26 into consideration present and projected future populations 27 within the present and anticipated future boundaries of the City. 28 Such analysis and report shall include a set of ideal councilmanic 29 districts. 30 (b) Consultant agrees to meet with and discuss his 31 analysis and report upon request with the Councilmanic 32 Redistricting Committee and individual members of the City ^t i 1 3 4i 5 6' 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 321 I Council. (c) Consultant agrees to .make such recommendations concerning redistricting as may be requested by the Council- manic Redistricting Committee. 2. Time for performance Consultant shall deliver his initial analysis and report to the Chairman of the Councilmanic Redistricting Committee on or before March 1, 1967. 3. Fees In consideration of the services hereinabove described, City agrees to pay Consultant at the rate of ten dollars ($10.00) per hour upon the receipt of itemized statements; provided, how-' ever, that the total amount to be paid shall not exceed $250.00, unless the City Council shall authorize an additional amount. 4. Independent contractor relationship In carrying out the terms of this agreement Consultant, his agents and employees shall at all times be indepeadentcon• tractors and not employees of the City. 5. Termination clause City may terminate this contract at any time on 10 days' written notice of termination addressed to Consultant at California State College, Long Beach, California 90804. If the contract is so terminated, City shall be obligated to pay to Consultant only the reasonable value of the services performed by him up to the time of termination. In the event of such termination, Consultant will deliver to City copies of all written materials contained.in his files pertaining to the services provided for herein. C11y NEl1FORT BEq %/ S, .GILIF, A 1., I' • CITY OF NEWPORT BEACH January 23, 1967 TO: HONORABLE MAYOR AND CITY COUNCIL FROM: Redistricting Committee SUBJECT: REPORT OF ACTIVITIES AND RECOMMENDATIONS / — } 3 - % Since appointment of the Council Committee on Redistricting, discussions and study have indicated the following: L 1. There is disparity of ample magnitude in both population and 1 voter registration between some of the existing Councilmanic Districts to indicate that redistricting should be undertaken at this time. 2. The use of an outside consultant would be desirable in the light of a realistic need for an educated and objective ap- proach to the problems of redistricting. 3. That redistricting initially be approached by the consultant with the general criteria set forth in the City Charter modi- fied only by a guideline that a fair and equitable districting should not be based on population (census) alone, but should be based on both population and voter registration. 4. Should the Council Committee ascertain there will be difficulty in presenting plans submitted by the consultant directly to the Council, a Citizens Committee, approved by the Council, be formed to undertake further study of the districting making such use of the consultant as they deem desirable. S. That of the two consultants, i2r,-Lerov C. Hardy, Chairman of the Political Science Department at California tate College, Long Beach, presents three distinct advantages to the City. 1) Availability to start immediately 2) Cost to City ($10.00 per hour on an estimated 25 hours) 3) Direct experience in redistricting It is respectfylly requested that the City Council approve the above ap- proach to the matter of redistricting and that the Council authorize expenditure of up to $250.00 to retain the services of Dr. Hardy.
